Web Accessibility

• Web accessibility means that people with disabilities can use the web.

– All users must be able to perceive, understand, navigate, interact with, and contribute to the web.

– Web sites must provide equal access and equal opportunity to people with disabilities.

Threatened Lawsuits

• Financial institutions are the most recent targets

• Threats begin with a demand letter claiming to have identified access barriers on a web site.

– Seeks a settlement agreement which includes an award of attorney’s fees and costs to plaintiffs and a web accessibility compliance plan.

Reduce Litigation Risk

• Be Proactive

– Take action to address web accessibility issues now.

– Don’t wait until you receive a demand letter.

• Implement an ADA website accessibility policy

– Affirms your commitment to compliance

– Provides for training of appropriate personnel

– Provides for management oversight

– Provides for ongoing accessibility monitoring/auditing

Compliance

• The ADA does not directly address website accessibility and does not include any technical standard for determining compliance.

• However, the Dept. of Justice has held that ADA’s requirements are not limited to physical places so would also apply to websites.

– This has held up in some courts.

– It’s unlinkely that the DOJ will issue a technical standard for web accessibility before 2018.

– But “practical” standards for web accessibility do exist.

Meeting the Web Content Accessibility Guidelines 2.0 Level AA standards should be your objective.

The Guidelines

Perceivable• Provide text alternatives for non-text

content. (Image ALT tags)

• Provide captions and other alternatives for multimedia. (Video transcripts – YouTube/Vimeo)

• Create content that can be presented in different ways, including by assistive technologies, without losing meaning. (HTML tags to identify reading sequence)

• Make it easier for users to see and hear content. (Use of color, contrast ratios, text links must make sense when read out of context)

Operable• Make all functionality available from

a keyboard. (HTML tags, correct tab order)

• Give users enough time to read and use content. (Minimize timing of content, give users control)

• Do not use content that causes seizures. (No scrolling text, ability to pause or control speed of rotating banner ads)

• Help users navigate and find content. (Site map accessible from every page)

WCAG 2.0 Additional Guidelines

Understandable• Make text readable and

understandable. (Minimize jargon and acronyms, adjustable text size)

• Make content appear and operate in predictable ways. (Consistent navigation)

• Help users avoid and correct mistakes. (Form field labels, user-friendly error messages, confirmation of form submission)

Robust• Maximize compatibility with current

and future user tools. (Proper coding, standard HTML)

• You need a tool to scan your web site.

• But it’s not quite that easy. – MANY of the WCAG 2.0 guidelines need to be verified manually.

– For example: A computer can’t determine if a text description adequately describes an image.

Fixing Accessibility Issues

• Your web developer will likely need to do some research.

– It takes longer to understand many of the requirements than to fix them.

– Most of the items are small and relatively easy to fix. BUT, there are A LOT OF THEM.

– There are some larger issues that can take significant time to correct.

– You may need to change how you include videos and multimedia content.

Should You Fix Your Site?

• This is not as easy to answer as you may think.

• From our experience, typical financial institution web sites take 30-50 hours to fix.

• Money talks.

– Is your site due for a redesign (old or outdated)?

– Is your current site responsive (mobile friendly)?

– Are you able to manage and update your site as easily as you need?

Maintaining Web Site Accessibility

• Web accessibility is not a one and done kind of project.

– Today’s Content Management Systems (CMS) make it easy for you to update, add, and edit content on the fly.

– Web sites are updated by people not aware of accessibility requirements.

• Your site should be audited on a regular basis either by an experienced web development agency or a knowledgeable internal site owner.

– This is where the subscription based tools make sense.

• WCAG standards will change as well.

– Staying on top of WCAG guidelines and auditing your website against the success criteria not only will make the experience better for all your users, but may also save you money due to potential litigation.
