N a t i o n

American Patent System took a U-Turn with

the implementation of the Leahy-Smith

America Invents Act (AIA) and made USA a

“first-to-file” nation. This type of filing system

isn't novel; it is actually more in line with the

rest of the world's patent laws. By simply

accelerating the timeline for filing patent

applications, it gave an advantage to quick

decision and strategy makers in US and

didn’t change much for larger companies

that had their R&D departments, financial

resources and the means in place to get the

process going. However, it mounted up the

pressure on the startups and also resulted

in problems of forfeiting of foreign patent

rights as it required public disclosure prior to

filing a patent application.

Nevertheless, numbers of provisional

applications at USPTO increased which

implies that inventors now were using a very

cost-effective way to obtain an early priority

date for a patent application. It didn’t change

much for larger companies that had their

R&D departments, financial resources and

the means in place to get the patenting

process going.

In 2013, UK businesses realized that

patents are not just a great tool for

protecting innovation from imitation but they

are also the most effective tool to earn

supra-normal profits following the launch of

“UK PATENT BOX SCHEME”. It reduced

the tax liabilities of the qualifying companies

on income generated through patents and

specifically rewarded those companies who

engaged in R&D (or innovation) from

conception to commercialization of patents

(scheme excluded products with copyright

or trademark protection). Thus, companies

could enjoy a reduced rate of corporation

tax of 10% for profits from the exploitation of

patented inventions and certain other

innovations.

In 2013, the world witnessed the emergence and might of an increasing

number of new companies that were keen on buying patents. Thus,

Nokia & Microsoft entered a multi-billion dollar deal and Microsoft in

return for a 10-year ‘Non-exclusive Licensing Rights’ to Nokia’s patents

& its mobile phone unit paid a whopping $7.17 billion.

United States initiated the first ever reform

in its patent system to fight the might of

patent trolls and face the emergence of

aggressive IPR exploitation in the country in

the form of US Innovation Act.

On Thursday, December 5, 2013, the United

States House of Representatives passed

the Innovation Act by a vote of 325-91.

Surprisingly, the Innovation Act (HR 3309)

had only been introduced on October 23,

2013, and was marked-up on November 20,

2013.

The Innovation Act makes numerous

amendments to Title 35, the section of U.S.

Code embodying U.S. patent law. These

changes include introducing a discovery

delay and other discovery changes, fee

shifting, customer suit staying and party-of-

interest transparency, heightening pleading

requirements and expanding post-grant

review. If nothing else, NPEs and their

targets should know the following about

these changes and the Innovation Act.

Since Oct 15, 2013 Indian Patent Office began functioning as the

International Search Authority (ISA) and International Preliminary

Examining Authority (IPEA) under Patent Cooperation Treaty (PCT).

This significantly reduced the Indian patent filing cost to ~50%. Besides

that Govt. of India revised the Indian Patent Rules to align its practices

with the practices of World Intellectual Property Organization (WIPO).

L a u n c h e d

Cooperative Patent Classification system officially launched by USPTO

& EPO in 2013 marked the harmonization, increased uniformity and

consistency in the patent system and processes at the international

level. This global classification system for patent documents was

available for use of USPTO, 45 additional patent offices and more than

20,000 patent examiners. It already includes 250,000 classification

symbols and is on its way to becoming an “international standard” in the

patent world.

A smart-watch that connects to user's smartphone or tablet to provide

alerts, take photos, make calls, and access certain apps.

SONY SMART WIG

These have built-in sensors and a wearable computing device and HMDs with information displays for both eyes unlike for one as is the case with Google Glass.

Rockstar vs Google

"Rockstar”, a legal entity created by Microsoft, Apple, RIM, Ericsson, and Sony, bought the vast Nortel patent

portfolio of more than 6,000 patents covering 4G wireless innovations and a range of technologies back in 2011

for $4.5 billion. Later in 2013, “ROCKSTAR” used those patents to sue Google and seven companies that make

Android smartphones:

Google's failure to get patents in the Nortel auction was seen as one of the driving

factors in its $12.5 billion purchase of Motorola in 2011. Later, Google also began to

amass patents and now stands as 3rd largest winner of software patents after IBM

and Microsoft.

- “ROCKSTAR used its 6,000 patents covering 4G wireless

innovations and a range of technologies to sue Google & 7

other companies that make Android smartphones.”

After 15 months of appeals and an eight-day

retrial, a dispute between Apple Inc.

and Samsung Electronics Ltd. over smartphone

patents has come nearly full circle. Federal jury

in San Jose, Calif., ordered Samsung to pay

Apple $290 million in damages for infringing on

five Apple patents with 13 Samsung devices.

Adding the $640 million from the original award

that wasn't in dispute in the retrial, Samsung

owes Apple $930 million. The $930 million total

amounts to about 12% of Apple's most recent

quarterly profits and about 14% of Samsung's

latest income.
