Periodically, temporary applications are filed with the Board. Details of these applications can be made available at anytime to any interested parties by calling (416) 326-6732.

The following are applications for extra-provincial and public vehicle operating licenses filed under the Motor Vehicle Transport Act, 1987, and the Public Vehicles Act. All information pertaining to the applicant i.e. business plan, supporting evidence, etc. is on file at the Board and is available upon request.

Any interested person who has an economic interest in the outcome of these applications may serve and file an objection within 29 days of this publication. The objector shall:

1. complete a Notice of Objection Form,

2. serve the applicant with the objection,

3. file a copy of the objection and provide proof of service of the objection on the applicant with the Board,

4. pay the appropriate fee.

Serving and filing an objection may be effected by hand delivery, mail, courier or facsimile. Serving means the date received by a party and filing means the date received by the Board.

structures but does not include a drill rig that, (a) is used for geotechnical sampling, (b) is used for drilling water, oil or gas wells, (c) is a rock drill or a diamond drill, (d) is a digger derrick, (e) is used for digging holes for posts, sonotubes, poles or light standards, (f) is a pile driver without an auger, (g) is a horizontal boring machine, or (h) is a tunnel boring machine; (4) The Table to subsection 1 (2) of the Regulation is revoked and the following substituted:

9. Section 47 of the Regulation is revoked and the following substituted: 47. (1) This section does not apply to an internal combustion engine operated in a tunnel. (2) No internal combustion engine shall be operated in an excavation or in a building or other enclosed structure unless there is an adequate supply of air for combustion and, (a) the exhaust gases and fumes from the engine are adequately discharged directly outside the excavation, building or

other enclosed structure to a point sufficiently remote to prevent the return of the gases and fumes; or (b) there is adequate natural or mechanical ventilation to ensure that exhaust gases and fumes from the engine will not

accumulate in the excavation, building or other enclosed structure. (3) An excavation or a building or other enclosed structure in which an internal combustion engine is being operated shall be tested for airborne concentrations of carbon monoxide to ensure that the concentrations do not exceed the applicable limits as determined in accordance with section 4 of Regulation 833 of the Revised Regulations of Ontario, 1990 (Control of Exposure to Biological or Chemical Agents), made under the Act. (4) The testing under subsection (3) shall be carried out by a competent worker in accordance with a written testing strategy, which shall be developed by the employer in consultation with the joint health and safety committee or a health and safety representative, if any. (5) An internal combustion engine under this section shall be maintained and used in accordance with section 93. 10. Clause 53 (2) (b) of the Regulation is revoked and the following substituted: (b) shall have an Underwriters’ Laboratories of Canada rating of at least 4A40BC. 11.(1)Subsection67(7)oftheRegulationisamendedbystrikingout“Subjecttosubsection(8)”atthebeginning. (2) Subsections 67 (8) and 67 (9) of the Regulation are revoked.

(3) Subsection 67 (10) of the Regulation is amended by striking out “On and after January 1, 2003,” at the beginning. (4) Subsection 67 (12) of the Regulation is revoked and the following substituted: (12) If a project is on a freeway and involves a mobile operation, an adequate number of crash trucks shall be adequately positioned between vehicular traffic and workers in order to adequately protect workers at the project. 12. Subsection 69.1 (3) of the Regulation is amended by striking out “On and after January 1, 2001,” at the beginning. 13. Sections 78 to 83 of the Regulation are revoked and the following substituted:

78. In sections 78 to 84,“extension trestle ladder” means a self-supporting portable ladder that is adjustable in length, consisting of a trestle ladder

base, a vertically adjustable extension section and an adequate means of locking the ladder base and extension section together;

“platform ladder” means a self-supporting portable ladder that is not adjustable in length, where the highest standing level is a platform;

“single ladder” means a non-self-supporting portable ladder that is not adjustable in length and having only one section;“step-ladder” means a self-supporting portable ladder that is not adjustable in length, having flat steps and a hinged back, and

whose back section is either a single ladder or other supporting device, but does not include a step stool or platform ladder;“step stool” means a self-supporting, portable, fixed or foldable ladder, not adjustable in length, and having, (a) a height of 800 millimetres or less, excluding side rails, if any, above the top cap, (b) flat steps, but no pail shelf, and (c) a ladder top cap that can be stood or stepped on;“top step” means the first step below the top cap of a step-ladder or, if there is no top cap, the first step below the top of the

rails;“trestle ladder” means a self-supporting portable ladder, non-adjustable in length, having two sections and hinged at the top

so as to be able to form equal angles with the base. 79. A ladder shall be designed, constructed and maintained so as not to endanger a worker and shall be capable of withstanding all loads to which it may be subjected. 80. (1) A portable ladder at a project shall be manufactured and shall meet the design, performance, test and marking requirements of a Grade 1, Grade 1A or Grade 1AA ladder in the CSA Standard Z11-12, Portable Ladders. (2) Despite subsection (1), a portable single ladder that is custom-built for use at a project may be used at the project if the ladder has, (a) rungs spaced at 300 millimetres on centres; (b) side rails at least 300 millimetres apart; and (c) a maximum length, measured along its side rail, of not more than nine metres. (3) If a portable single ladder under subsection (2) is made of wood, the ladder shall also, (a) be made of wood that is straight-grained and free of loose knots, sharp edges, splinters and shakes; and (b) not be painted or coated with an opaque material that obscures the wood grain or interferes with inspections of the

ladder. (4) If the rungs of a ladder under subsection (3) are of the cleat type, the ladder shall also, (a) have side rails that are not less than 400 millimetres but not more than 610 millimetres apart; (b) have side rails that measure not less than, (i) 38 millimetres by 89 millimetres if the ladder is 5.8 metres long or less, or (ii) 38 millimetres by 140 millimetres if the ladder is more than 5.8 metres long; (c) have rungs that measure not less than, (i) 19 millimetres by 64 millimetres if the side rails are 400 millimetres apart, or

(ii) 19 millimetres by 89 millimetres if the side rails are more than 400 millimetres apart; and (d) have rungs braced by filler blocks that are at least 19 millimetres thick and located between the rungs. (5) If a ladder under subsection (3) is a double-width wooden ladder, the ladder shall also, (a) have three evenly-spaced rails that measure at least 38 millimetres by 140 millimetres; (b) have rungs that, (i) measure at least 38 millimetres by 89 millimetres, (ii) extend the full width of the ladder, and (iii) are braced by filler blocks that are at least 19 millimetres thick; and (c) be at least 1.5 metres wide but not more than 2 metres wide. 81. (1) A portable ladder, (a) shall be free from defective or loose rungs; (b) shall be placed on a firm and level footing or support surface; and (c) shall not be used in an elevator shaft or a similar hoisting area when the shaft or area is being used for hoisting. (2) A non-self-supporting portable ladder shall be situated so that its base is not less than one-quarter, and not more than one-third, of the length of the ladder from a point directly below the top of the ladder and at the same level as the base of the ladder, if the ladder is not securely fastened to prevent its movement. (3) A portable ladder or ladder section shall not be tied or fastened to another ladder or ladder section to increase its length unless the manufacturer’s instructions allow for this. (4) A manufactured portable ladder shall be used in accordance with the manufacturer’s instructions. 82. (1) This section applies if a portable ladder is used as a means of access and egress between, (a) levels of a building or structure; (b) the ground or grade level to a building or structure; or (c) different work surface levels. (2) The ladder, (a) shall extend at the upper level at least 900 millimetres above the landing surface; (b) shall, subject to subsection (3), have a clear space of at least 150 millimetres behind every rung; (c) shall be located so that an adequate landing surface that is clear of obstructions is available at the top and bottom of

the ladder for access and egress; and (d) shall be secured at the top and bottom to prevent movement of the ladder. (3) Clause (2) (b) does not apply to a ladder lying on an excavation wall that is sloped, as required by section 234. 83. (1) When a step-ladder is being used, its legs shall be fully spread open and its spreaders shall be locked. (2) No worker shall stand or step on, (a) the top cap, top step or pail shelf of a step-ladder; (b) the top cap or top step of a combination ladder when it is used as a step-ladder; (c) the top step of the extension section of an extension trestle ladder; or (d) the top step of a trestle ladder. 14.(1)Clause84(1)(d)oftheRegulationisamendedbystrikingout“threemetres”andsubstituting“fivemetres”. (2) Subsection 84 (1) of the Regulation is amended by striking out “and” at the end of clause (e) and adding the following clauses: (g) shall have an adequate landing surface that is clear of obstructions at the top and bottom of the ladder for access and

egress; (h) shall be free from defective or loose rungs; and (i) shall not be used in an elevator shaft or a similar hoisting area when the shaft or area is being used for hoisting.

(3) Subsection 84 (2) of the Regulation is revoked and the following substituted: (2) Clauses (1) (b), (c) and (d) do not apply to any access ladder on a tower, water tank, chimney or similar structure that has a safety device that will provide protection should a worker using the ladder fall. 15. (1) Subsection 96 (1) of the Regulation is amended by adding “or powered machine, tool or equipment” after “vehicle”. (2) Subsection 96 (2) of the Regulation is amended by adding “or powered machine, tool or equipment” after “vehicle”. 16. Subsection 106 (1.3) of the Regulation is amended by striking out “On and after January 1, 2001,” at the beginning. 17. (1) An elevating work platform, (a) shall not be loaded in excess of its rated working load; (b) shall be used and moved only in accordance with the manufacturer’s written instructions; (c) shall not be loaded and used in such a manner as to affect its stability or endanger a worker; and (d) shall not be moved unless all workers on it are protected from ejection by being attached to an adequate fixed support

on the elevating work platform by a method of fall protection. (2) Clause (1) (d) does not apply to a mast climbing work platform or a mast climbing transport platform if the platform has guardrails protecting all open sides of the platform where a worker is exposed to a hazard of falling 2.4 metres or more. (3) An elevating work platform that is a boom type or a vehicle-mounted aerial device shall not be used unless all workers on it are protected from falling by being attached to an adequate fixed support on the elevating work platform by a method of fall protection. 19. The Regulation is amended by adding the following sections:

rotary FounDation Drill rigS

156.1 (1) Before the start of any drilling operation on a project with a rotary foundation drill rig, (a) an inspection of the work area shall be conducted to identify, (i) potential hazards, including utilities, services, obstructions, structures and soil conditions that may endanger a

worker engaged in, or in the vicinity of, the drilling operation, and (ii) buildings and structures adjacent to, or in the vicinity of, the drilling operation that may be affected by it; (b) any hazards identified under subclause (a) (i) shall be removed if practicable; (c) if it is not practicable to remove the hazards identified under subclause (a) (i), (i) if practicable, they shall be disconnected or inactivated so as not to endanger workers engaged in, or in the

vicinity of, the drilling operation, and (ii) they shall be located and marked by signs; and (d) a written report shall be prepared that indicates, (i) all of the hazards identified under subclause (a) (i),

(ii) which hazards have not been removed, and (iii) which hazards have been disconnected or inactivated. (2) The constructor shall keep a copy of the report mentioned under clause (1) (d) at the project until the drilling operation is completed, and make the report available, upon request, to an inspector and an employer responsible for the drilling operation. 156.2 (1) Before a drilling operation begins, the employer responsible for it shall, (a) develop written measures and procedures in accordance with subsection (2) to protect the health and safety of workers

engaged in, or in the vicinity of, the drilling operation; and (b) have a copy of these written measures and procedures provided to, and reviewed with, the workers engaged in the

drilling operation. (2) The written measures and procedures required under subsection (1) shall include, at a minimum, details of, (a) the measures and procedures to be implemented to protect workers from all unremoved hazards; (b) the procedures to be implemented for the assembly, erection, disassembly, alteration and operation of the drilling

equipment; (c) the safe work areas that have been designated for, (i) the drilling operation, (ii) the staging, disassembly and alteration of the drilling equipment, and (iii) the storage of any excavated soil and material; (d) the procedures to be implemented for removing excavated soil and material; (e) the restricted access zone that has been designated around the drilling operation to restrict or prevent access by persons

or equipment; (f) the fall protection measures, in addition to those required under sections 26.1 to 26.9, to be implemented to prevent

workers from falling into a drill hole or being engulfed by collapsing soil around a drill hole, while or after the hole is drilled; and

(g) the communications system to be used among the drill rig operator, the drill rig front-end worker and other workers in the restricted access zone, or a system of prearranged visual signals to be used among them if those signals are clearly visible and understood by them.

(3) Workers shall follow the written measures and procedures. 156.3 Sections 156.4 and 156.5 apply when a drilling operation at a project uses a rotary foundation drill rig that can exert a ground pressure of 200 kiloPascals or more under its tires, crawlers or outrigger pads in any configuration, including during its operational activities. 156.4 (1) Before a drilling operation described in section 156.3 begins, a professional engineer shall, (a) design a supporting surface for the drill rig in accordance with good engineering practice to adequately support the

drill rig during all drilling and drill rig set-up activities; (b) designate and design a path of travel for the drill rig to use on the project to ensure the path of travel safely supports

the drill rig; and (c) prepare a written report described in subsection (2). (2) The written report required under clause (1) (c) shall include, at a minimum, details of, (a) the project and its location; (b) the designs and specifications for the supporting surface and path of travel; (c) any operating restrictions imposed by the drill rig manufacturer’s instructions, including the maximum safe ground

slope for the drilling operation; (d) the existing soil conditions, all associated hazards to workers’ health and safety and the precautions to be taken to

protect workers from the hazards associated with the soil conditions; (e) the minimum load-bearing capacity of the supporting surface required for each activity to be undertaken by the drill

rig; (f) the surface preparation required for the supporting surface and path of travel to safely support the drill rig during its

operation and travel;

(g) the parts of the drill rig and the attachments of the drill rig that are permitted on the supporting surface; (h) the precautions to be taken to ensure that the drilling operation and movement of the drill rig on the path of travel, (i) do not damage or affect the stability of any building, structure, property or public way adjacent to, or in the

vicinity of, the drilling operation, and (ii) do not endanger a person using any building, structure, property or public way adjacent to, or in the vicinity of,

the drilling operation; (i) the frequency of inspections of the supporting surface and the path of travel of the drill rig, and the type of inspection

required, to ensure they remain stable, do not deteriorate and continue to function as designed by the professional engineer, and any specific weather or other conditions that could affect the supporting surface or path of travel that would require additional inspections to be conducted; and

(j) the qualifications of the person who conducts the inspections of the supporting surface and path of travel and whether the person needs to be a professional engineer, a person under the direction of a professional engineer, a competent worker or another person with specified qualifications.

(3) The supporting surface and path of travel for the drill rig shall be prepared or constructed in accordance with the professional engineer’s written report. (4) No deviation from the written report is permitted unless the deviation is approved, in advance and in a written report, by a professional engineer. (5) The supporting surface and path of travel for the drill rig shall be inspected by a professional engineer after they are prepared or constructed and before the drill rig is assembled and erected on the supporting surface or uses the path of travel to confirm that they were prepared or constructed in accordance with the professional engineer’s report. (6) The professional engineer shall prepare a written report of the results of the inspection under subsection (5). (7) While a rotary foundation drill rig is in service at a drilling operation described in section 156.3, the employer responsible for the drilling operation shall ensure that, (a) the supporting surface and path of travel are regularly inspected in accordance with, and by the person identified by,

the report described in subsection (2); and (b) a written report of the inspections and results are kept at the project and made available to an inspector upon request. (8) The constructor and employer responsible for the drilling operation shall keep at the project a copy of all reports described in this section and make them available to an inspector upon request until the drilling operation is completed. 156.5 (1) Before a drilling operation described in section 156.3 begins, the employer responsible for it shall, (a) develop a drilling procedure for the drill rig in accordance with subsection (2) and have it approved by a professional

engineer; and (b) have a copy of the drilling procedure provided to, and reviewed with, the workers engaged in the drilling operation. (2) The drilling procedure shall be in writing and shall include, at a minimum, details of, (a) the sequence of activities of the drilling operation to be followed including, if applicable, the delivery of concrete,

rebar, steel piles and other materials related to the drilling operation; (b) the procedures to be implemented for removing excavated soil and material from an auger or drilling tool and away

from the supporting surface of the drill rig; (c) the location to be used for storing excavated soil and material so that it does not endanger workers; (d) the working area and designated path of travel to be used for any machinery or equipment used in the vicinity of

the drilling operation so that the machinery or equipment does not affect the stability and integrity of the supporting surface of the drill rig;

(e) the measures and procedures to be implemented during the drilling operation to ensure that unremoved hazards do not endanger workers; and

(f) the areas that have been designated at, or in the vicinity of, the drilling operation where, (i) only persons authorized by the employer are allowed to enter, and (ii) no persons or equipment are allowed to enter. (3) While a rotary foundation drill rig is in service at a drilling operation described in section 156.3, the employer responsible for the drilling operation shall ensure that, (a) the drilling procedure described in subsection (2) is implemented; and

(b) the drilling procedure is followed by the workers engaged in, and in the vicinity of, the drilling operation. 156.6 (1) An employer shall ensure that a worker who operates a rotary foundation drill rig, (a) is qualified in accordance with section 156.7; (b) has completed a training program that meets the requirements of section 156.9, or is participating in a training program

that meets such requirements and is being instructed on the operation of the drill rig; (c) has demonstrated to the employer that the worker has adequate knowledge and proficiency in operating the drill rig to

be used at the project; and (d) is authorized by the employer to operate the drill rig at the project. (2) The employer shall maintain a record of the training program described in section 156.9 provided to the worker that includes, (a) the worker’s name and the training dates; and (b) the name and signature of the training provider. (3) The employer shall make the training record available to an inspector upon request. 156.7 (1) No worker shall operate a rotary foundation drill rig except in accordance with this section. (2) The worker shall, (a) have completed a training program that meets the requirements of section 156.9 and have written proof of training

available at the project to an inspector upon request; or (b) be participating in a training program that meets the requirements of section 156.9 and is being instructed on the

operation of the drill rig. (3) If a worker is operating a drill rig with an effective torque equal to or greater than 50 kilonewton metres, the worker shall have a certificate of qualification or written proof of training as required by section 156.8 available at the project to an inspector upon request. 156.8 (1) No worker shall operate a rotary foundation drill rig with an effective torque greater than 270 kilonewton metres unless the worker, (a) holds a certificate of qualification issued under the Ontario College of Trades and Apprenticeship Act, 2009, that is not

suspended, in the trade of hoisting engineer – mobile crane operator 1; or (b) is an apprentice who is working pursuant to a training agreement registered under the Ontario College of Trades and

Apprenticeship Act, 2009, that is not suspended, in the trade of hoisting engineer – mobile crane operator 1. (2) No worker shall operate a rotary foundation drill rig with an effective torque greater than 190 kilonewton metres but less than or equal to 270 kilonewton metres unless the worker, (a) holds a certificate of qualification issued under the Ontario College of Trades and Apprenticeship Act, 2009, that is not

suspended, in the trade of hoisting engineer – mobile crane operator 1, or hoisting engineer – mobile crane operator 2; or

(b) is an apprentice who is working pursuant to a training agreement registered under the Ontario College of Trades and Apprenticeship Act, 2009, that is not suspended, in the trade of hoisting engineer – mobile crane operator 1, or hoisting engineer – mobile crane operator 2.

(3) No worker shall operate a rotary foundation drill rig with an effective torque equal to or greater than 50 kilonewton metres but less than or equal to 190 kilonewton metres unless the worker, (a) holds a certificate of qualification issued under the Ontario College of Trades and Apprenticeship Act, 2009, that is not

suspended, in the trade of hoisting engineer – mobile crane operator 1, or hoisting engineer – mobile crane operator 2; (b) is an apprentice who is working pursuant to a training agreement registered under the Ontario College of Trades and

Apprenticeship Act, 2009, that is not suspended, in the trade of hoisting engineer – mobile crane operator 1, or hoisting engineer – mobile crane operator 2; or

(c) has written proof that the worker has completed a training program on the operation of a 0-8 ton mobile crane that included instruction on,

(i) the relevant requirements of this Regulation, (ii) how to use the manufacturer’s operating manuals, (iii) minimum distances when approaching an overhead electrical conductor, (iv) communications and signals,

(v) types of mobile cranes and their components, including wire and synthetic rope, hydraulics, rigging and rigging hardware,

(vi) pre-operational inspections and checks, and (vii) safe work practices related to mobile cranes, including crane set-up, load charts, assembly and disassembly of

manual boom extensions, basic crane operation and maintenance. 156.9 A training program for the operation of a rotary foundation drill rig shall include instruction on, (a) the relevant requirements of this Regulation and the drill rig manufacturer’s operating manual; (b) safe work practices; (c) communications and signals; (d) pre-operational inspections and checks; (e) site assessment; (f) drill rig set-up, securing and operation; and (g) equipment maintenance. 20. Section 176 of the Regulation is amended by adding the following subsections: (2) No alloy steel chain shall be annealed or welded. (3) A chain used for hoisting shall, (a) be labelled to indicate its load rating capacity; (b) be repaired and reconditioned in accordance with the specifications of its manufacturer; (c) after being repaired or reconditioned, be proof tested in accordance with the specifications of its manufacturer; and (d) be visually inspected by a competent worker as frequently as recommended by its manufacturer and, in any case, at

least once a week when the chain is in service. 21. Section 177 of the Regulation is revoked. 22. Subsection 181 (1) of the Regulation is amended by striking out “the Electrical and Utilities Safety Association of Ontario Incorporated and revised January, 2009” at the end and substituting “the Infrastructure Health and Safety Association and revised 2014”. 23. The Table to subsection 188 (2) of the Regulation is revoked and the following substituted:

ONTARIO ENERGY BOARD ACT, 1998



Amending O. Reg. 53/05(PAYMENTS UNDER SECTION 78.1 OF THE ACT)

1.Subsection0.1(1)ofOntarioRegulation53/05isamendedbyaddingthefollowingdefinitions:“Darlington Refurbishment Project” means the work undertaken by Ontario Power Generation Inc. in respect of the

refurbishment, in whole or in part, of some or all of the generating units of the Darlington Nuclear Generating Station;“deferral period” means the period beginning on January 1, 2017, and ending when the Darlington Refurbishment Project

ends;“nuclear facilities” means the nuclear generation facilities prescribed in paragraphs 3, 4 and 5 of section 2; 2. The Regulation is amended by adding the following section:Darlington refurbishment rate smoothing deferral account

5.5 (1) Ontario Power Generation Inc. shall establish a deferral account in connection with section 78.1 of the Act that records, on and after the commencement of the deferral period, the difference between, (a) the revenue requirement amount approved by the Board that, but for subparagraph 12 i of subsection 6 (2) of this

Regulation, would have been used in connection with determining the payments to be made under section 78.1 of the Act each year during the deferral period in respect of the nuclear facilities; and

(b) the portion of the revenue requirement amount referred to in clause (a) that is used in connection with determining the payments made under section 78.1 of the Act, after determining, under subparagraph 12 i of subsection 6 (2) of this Regulation, the amount of the revenue requirement to be deferred for that year in respect of the nuclear facilities.

(2) Ontario Power Generation Inc. shall record interest on the balance of the account at a long-term debt rate reflecting Ontario Power Generation Inc.’s cost of long-term borrowing that is determined or approved by the Board from time to time, compounded annually. 3. (1) Paragraph 4 of subsection 6 (2) of the Regulation is amended by striking out the portion before subparagraph i and substituting the following: 4. The Board shall ensure that Ontario Power Generation Inc. recovers capital and non-capital costs and firm financial

commitments incurred in respect of the Darlington Refurbishment Project or incurred to increase the output of, refurbish or add operating capacity to a generation facility referred to in section 2, including, but not limited to, assessment costs and pre-engineering costs and commitments,

. . . . . (2) Subsection 6 (2) of the Regulation is amended by adding the following paragraph: 12. For the purposes of section 78.1 of the Act, in setting payment amounts for the nuclear facilities during the deferral

period, i. the Board shall determine the portion of the Board-approved revenue requirement for the nuclear facilities for

each year that is to be recorded in the deferral account established under subsection 5.5 (1), with a view to making more stable the year-over-year changes in the payment amount that is used in the determination of the undeferred payments made under section 78.1 of the Act with respect to the nuclear facilities,

ii. the Board shall determine the approved revenue requirements referred to in subsection 5.5 (1) and the amount of the approved revenue requirements to be deferred under subparagraph i on a five-year basis for the first 10 years of the deferral period and, thereafter, on such periodic basis as the Board determines,

iii. for greater certainty, the Board’s determination of Ontario Power Generation Inc.’s approved revenue requirement for the nuclear facilities shall not be restricted by the yearly changes in payment amounts in subparagraph i,

iv. the Board shall ensure that Ontario Power Generation Inc. recovers the balance recorded in the deferral account established under subsection 5.5 (1), and the Board shall authorize recovery of the balance on a straight line basis over a period not to exceed 10 years commencing at the end of the deferral period, and

v. the Board shall accept the need for the Darlington Refurbishment Project in light of the Plan of the Ministry of Energy known as the 2013 Long-Term Energy Plan and the related policy of the Minister endorsing the need for nuclear refurbishment.

Amending O. Reg. 119/11(PRODUCE, HONEY AND MAPLE PRODUCTS)

1. Section 6 of Ontario Regulation 119/11 is amended by adding the following subsections: (2) Every person who operates premises at which maple products that are intended to be sold are produced or packed shall ensure that all equipment, utensils, containers or other food contact surfaces that are used during the production or packing of maple products and will come into contact with the maple products during their production or packing, are made of food grade material that is non-toxic and that will not cause or contribute to the contamination of the maple products. (3) Every person who collects, stores or transports maple sap for use in maple products that are intended to be sold shall ensure that all equipment, utensils, containers or other food contact surfaces that are used during the collection, storage or transportation of the maple sap are made of food grade material that is non-toxic and that will not cause or contribute to the contamination of the maple sap. 2. (1) Clause 12 (1) (b) of the Regulation is revoked and the following substituted: (b) classify the maple syrup as one of the four colour classes set out in Column 2 of Table 5, based on the percentage of

light transmission set out opposite the colour class in Column 4 of the Table that the person determines exists in the maple syrup, subject to subsection (3).

(2) Subsection 12 (3) of the Regulation is revoked and the following substituted: (3) For the purposes of this Regulation, a colour class of maple syrup may be identified either by using the colour name that appears in Column 2 of Table 5 alone (without a taste descriptor) or by using the colour name in Column 2 of Table 5, together with the taste descriptor that is set out opposite to it in Column 3 of Table 5. (4) Despite anything in this section or in Tables 4 and 5, until December 31, 2017, a person who grades maple syrup or classifies maple syrup for colour may continue to, (a) grade maple syrup in accordance with the grades set out in Table 4, as it read before January 1, 2016; and (b) classify maple syrup in accordance with the colour classes set out in Table 5, as it read before January 1, 2016. (3) Subsection 12 (4) of the Regulation, as made by subsection (2), is revoked. 3. Subsection 18 (5) of the Regulation is revoked. 4. (1) Subsection 22 (1) of the Regulation is amended by striking out the portion before paragraph 1 and substituting the following: (1) The following information shall be set out on one or more labels that are applied to a container of maple product: (2) Paragraph 3 of subsection 22 (1) of the Regulation is amended by striking out “and” at the end of subparagraph i, by adding “and” at the end of subparagraph ii and by adding the following subparagraph: iii. a code identifying the production lot of the maple syrup. (3) Subsections 22 (1.1) and (2) of the Regulation are revoked and the following substituted: (1.1) Despite paragraph 4 of subsection (1), the labels on a container of maple product, other than maple syrup, with a maximum capacity of 150 grams or less, are not required to set out the net weight of the product. (2) Despite subsection (1), labels on a container of maple syrup with a maximum capacity of 125 ml or less are not required to set out the information in paragraph 3 of subsection (1). (2.1) Despite subparagraph 3 ii of subsection (1) and Tables 4 and 5, until December 31, 2017, labels on a container of maple syrup may continue to, (a) set out the grade of the syrup using the grades set out in Table 4, as it read before January 1, 2016; and (b) set out the colour class of the syrup using the colour classes set out in Table 5, as it read before January 1, 2016.

(3) Quiconque recueille, entrepose ou transporte de la sève d’érable aux fins d’utilisation dans des produits de l’érable destinés à être vendus doit veiller à ce que les surfaces en contact avec des aliments, et notamment le matériel, les ustensiles et les contenants, utilisées durant la collecte, l’entreposage ou le transport de la sève d’érable soient fabriquées d’un matériau de qualité alimentaire non toxique qui n’entraînera pas la contamination de la sève d’érable ou n’y contribuera pas. 2.(1)L’alinéa12(1)b)duRèglementestabrogéetremplacéparcequisuit: b) le classe dans l’une des quatre classes de couleur énoncées à la colonne 2 du tableau 5, en fonction du pourcentage de

CONTINUOUS PROFESSIONAL LEARNING

Continuous professional learning program

1. (1) Every member of the College shall fulfil the requirements of the continuous professional learning program, which are the following: 1. Successful completion of any educational course, including any jurisprudence course, required by the College. 2. Completion of self-assessments. 3. Development of professional learning plans. 4. Engagement in and completion of the activities set out in professional learning plans. 5. Ongoing completion of records of professional learning that document the member’s engagement in and completion

of the activities set out in professional learning plans. 6. Compliance with any other requirements relating to continuous professional learning specified by the College. (2) The self-assessments, professional learning plans and records of professional learning referred to in paragraphs 2, 3 and 5 of subsection (1), and any other record or documentation that may be required under paragraph 6 of subsection (1), shall be developed and completed in any form and manner specified by the College, and shall include any information or address any elements specified by the College.Timelines for completion

2. (1) The College may set out rules respecting the timelines for the fulfilment of the requirements of the continuous professional learning program, rules respecting the order in which the requirements must be fulfilled and rules respecting how often a requirement must be fulfilled, and every member of the College shall comply with such rules. (2) A member of the College may submit a request to the Registrar to defer the fulfilment of a requirement of the continuous professional learning program if there are extenuating circumstances such as maternity or parental leave, illness, disability, bereavement or personal hardship. (3) The Registrar may grant a deferral requested under subsection (2) if the Registrar determines that the extenuating circumstances would materially interfere with the member’s ability to comply with the requirement. (4) If the Registrar grants a deferral, he or she shall specify modified timelines for fulfilling the requirement.Records

3. (1) Every member of the College shall keep the following records: 1. Any record that demonstrates successful completion of any educational course required by the College. 2. A copy of each self-assessment. 3. A copy of each professional learning plan. 4. Any documentation demonstrating the member’s engagement in and completion of the activities set out in the

professional learning plan. 5. A copy of each record of professional learning. 6. Any record or documentation demonstrating compliance with any other requirements relating to continuous

professional learning specified by the College. (2) Records that are required to be kept under subsection (1) shall be kept in the form and manner and for the period of time specified by the College.

Proof of compliance

4. (1) Each year, at the time that a member of the College pays his or her annual membership fee, the member shall submit to the Registrar a declaration of compliance with the requirements of the continuous professional learning program in the form and manner specified by the College. (2) At any time, the Registrar may request information and documents from a member to demonstrate the member’s compliance with the requirements of the continuous professional learning program. (3) If a request is made under subsection (2), the member shall provide the information and documents within 30 days after the day the request is made.Suspensionofcertificate

5. (1) The Registrar may suspend the certificate of registration of a member of the College in accordance with this section if, in the Registrar’s opinion, the member failed to comply with, (a) any requirement of the continuous professional learning program; (b) any requirement set out in this Regulation; or (c) any other requirement specified by the College that relates to continuous professional learning. (2) The Registrar shall serve upon the member a written notice of an intention to suspend the member’s certificate that, (a) specifies the default; and (b) states that the member may provide written submissions to the Registrar no later than 60 days after service of the

notice. (3) After considering any written submissions provided by the member under clause (2) (b), the Registrar shall decide whether or not to suspend the member’s certificate. (4) Except as provided for under subsections (2) and (3), the Registrar is not required to hold a hearing or provide the member an opportunity to be heard or to make oral or written submissions before making a decision. (5) The Registrar shall notify the member in writing of his or her decision under subsection (3). (6) The Registrar is not required to give reasons for his or her decision. (7) A person whose certificate of registration was suspended under subsection (3) may have the suspension removed if the Registrar is satisfied that the person, (a) has complied with the requirements mentioned in clauses (1) (a), (b) and (c); and (b) has paid any outstanding fees and penalties, including any reinstatement fee. (8) The Registrar may revoke the certificate of registration of a person whose certificate was suspended under subsection (3) if the suspension is not removed for more than three years.Notice of program requirements

6. The College shall post the requirements of the continuous professional learning program, and any changes to the requirements, on its website.

PERFECTIONNEMENT PROFESSIONNEL CONTINU

Programme de perfectionnement professionnel continu

1. (1) Les membres de l’Ordre doivent satisfaire aux exigences du programme de perfectionnement professionnel continu, qui sont les suivantes : 1. Achèvement avec succès de tous les cours de formation, notamment les cours sur la jurisprudence, qu’exige l’Ordre. 2. Réalisation d’autoévaluations. 3. Élaboration de plans de perfectionnement professionnel. 4. Participation aux activités énoncées dans les plans de perfectionnement professionnel et achèvement de ces activités. 5. Tenue sur une base continue de dossiers de perfectionnement professionnel qui consignent la participation du membre

aux activités énoncées dans les plans de perfectionnement professionnel et l’achèvement de ces activités. 6. Respect des autres exigences relatives au perfectionnement professionnel continu que précise l’Ordre. (2) Les autoévaluations, les plans de perfectionnement professionnel et les dossiers de perfectionnement professionnel visés aux dispositions 2, 3 et 5 du paragraphe (1), ainsi que tout autre dossier ou pièce justificative qui peut être exigé en application de la disposition 6 du paragraphe (1), sont élaborés et réalisés sous la forme et de la manière que précise l’Ordre, et comprennent tout renseignement ou abordent tout élément que précise l’Ordre.Délais

2. (1) L’Ordre peut énoncer des règles relativement aux délais pour satisfaire aux exigences du programme de perfectionnement professionnel continu, à l’ordre dans lequel il faut satisfaire aux exigences et à la fréquence à laquelle il faut y satisfaire. Tous les membres de l’Ordre doivent se conformer à ces règles. (2) Un membre de l’Ordre peut présenter une demande au registrateur visant à reporter la satisfaction d’une exigence du programme de perfectionnement professionnel continu en cas de circonstances atténuantes telles que congé de maternité ou parental, maladie, invalidité, deuil ou difficultés personnelles. (3) Le registrateur peut accorder un report demandé en vertu du paragraphe (2) s’il juge que les circonstances atténuantes nuiraient de façon importante à la capacité du membre de satisfaire à l’exigence. (4) S’il accorde un report, le registrateur précise les délais modifiés pour satisfaire à l’exigence.Dossiers

3. (1) Chaque membre de l’Ordre tient les dossiers suivants : 1. Un dossier indiquant qu’il a achevé avec succès les cours de formation qu’exige l’Ordre. 2. Une copie de chaque autoévaluation. 3. Une copie de chaque plan de perfectionnement professionnel. 4. Toute pièce justificative indiquant qu’il a participé aux activités énoncées dans le plan de perfectionnement professionnel

et qu’il les a achevées. 5. Une copie de chaque dossier de perfectionnement professionnel. 6. Tout dossier ou pièce justificative indiquant la satisfaction des autres exigences relatives au perfectionnement

professionnel continu que précise l’Ordre. (2) Les dossiers qui doivent être tenus en application du paragraphe (1) le sont sous la forme, de la manière et pour la période que précise l’Ordre.

Preuve de respect des exigences

4. (1) Chaque année, au moment où il paie sa cotisation annuelle, le membre de l’Ordre présente au registrateur une déclaration de conformité aux exigences du programme de perfectionnement professionnel continu sous la forme et de la manière que précise l’Ordre. (2) À tout moment, le registrateur peut demander à un membre des renseignements et des documents prouvant son respect des exigences du programme de perfectionnement professionnel continu. (3) Si une demande est présentée en vertu du paragraphe (2), le membre fournit les renseignements et les documents dans les 30 jours qui suivent la date de la demande.Suspensionducertificat

5. (1) Le registrateur peut suspendre le certificat d’inscription d’un membre de l’Ordre conformément au présent article si, à son avis, le membre n’a pas satisfait à l’une ou l’autre des exigences suivantes : a) toute exigence du programme de perfectionnement professionnel continu; b) toute exigence énoncée au présent règlement; c) toute autre exigence précisée par l’Ordre qui se rapporte au perfectionnement professionnel continu. (2) Le registrateur signifie au membre un avis écrit de son intention de suspendre son certificat qui : a) précise le manquement; b) indique que le membre peut fournir des observations écrites au registrateur au plus tard 60 jours après la signification

de l’avis. (3) Après étude des observations écrites fournies par le membre en vertu de l’alinéa (2) b), le registrateur décide s’il y a lieu ou non de suspendre le certificat du membre. (4) Sous réserve des paragraphes (2) et (3), le registrateur n’est pas obligé de tenir d’audience ni de donner au membre l’occasion d’être entendu ou de présenter des observations orales ou écrites avant de prendre une décision. (5) Le registrateur avise le membre par écrit de la décision qu’il a prise aux termes du paragraphe (3). (6) Le registrateur n’est pas tenu de donner les motifs de sa décision. Amending O. Reg. 610/06(FINANCIAL ACTIVITIES)

1. Section 11 of Ontario Regulation 610/06 is revoked. 2. Part IV of the Regulation is revoked and the following substituted:

PART IV INVESTING OF MONEY

Definitions

42. In this Part,“investment” means an investment with respect to which this Part applies under section 43;“Investment Board” means the City board described in subsection 46 (2).Application

43. This Part applies only with respect to the investment, in securities, of money that the City does not require immediately.Investment standards

44. (1) In investing money, the City must exercise the care, skill, diligence and judgment that a prudent investor would exercise in making such an investment. (2) The City must consider the following criteria in planning investments, in addition to any other criteria that are relevant to the circumstances: 1. General economic conditions. 2. The possible effect of inflation or deflation. 3. The role that each investment or course of action plays within the City’s portfolio of investments. 4. The expected total return from income and the appreciation of capital. 5. Needs for liquidity, regularity of income and preservation or appreciation of capital. (3) The City must diversify its investments to an extent that is appropriate to general economic and investment market conditions. (4) The duty under subsection (1) includes a duty to obtain the advice that a prudent investor would obtain under comparable circumstances.Limitation, school board securities

45. The City shall not invest money in a security issued or guaranteed by a school board or similar entity in Canada unless the money raised by issuing the security is to be used for school purposes.Investments only through Investment Board

46. (1) The City may invest money only by having the Investment Board described in subsection (2) do so on its behalf. (2) The Investment Board referred to in subsection (1) is a City board to which the City has given the control and management of investments by delegating to the board the City’s powers to make such investments and the City’s duties under section 44. (3) The following persons may not be appointed as members of the Investment Board: 1. An officer or employee of the City. 2. A member of the Council.

(4) Subsection (3) does not apply to the treasurer.Investment policy

47. (1) The council shall adopt and maintain an investment policy. (2) The investment policy shall include requirements with respect to the following: 1. The City’s objectives for return on investment and risk tolerance. 2. The City’s need for liquidity including, for greater certainty, the City’s anticipated needs for funds for planned projects

and the City’s needs to have funds available for unanticipated contingencies. (3) The investment policy may include other requirements with respect to investment matters that council considers to be in the interests of the City. (4) At least annually, the council shall review the investment policy and update it, as necessary, as a result of the review.Investment plan

48. (1) The Investment Board shall adopt and maintain an investment plan. (2) The investment plan shall deal with how the Investment Board will invest the City’s money and set out the Board’s projections of the proportions of the City’s portfolio of investments to be invested at the end of the year in each type of security selected by the Investment Board and may include other requirements. (3) At least annually, following the council’s review of the investment policy under subsection 47 (4), the Investment Board shall review the investment plan and update it, as necessary, as a result of the review.Investment report

49. (1) The Investment Board shall prepare and provide to the council, each year or more frequently as specified by the council, an investment report. (2) The investment report shall contain, (a) a statement about the performance of the City’s portfolio of investments during the period covered by the report; (b) a statement by the treasurer as to whether or not, in his or her opinion, all investments are consistent with the investment

policy under section 47 and the investment plan under section 48; and (c) such other information that the council may require or that, in the opinion of the treasurer, should be included.Inconsistencies, treasurer’s duty

50. If an investment is, in the treasurer’s opinion, not consistent with the investment policy under section 47 and the investment plan under section 48, the treasurer shall report the inconsistency to the council within 30 days after becoming aware of it.Agents of the Investment Board

51. (1) Subject to subsections (2) and (3), the Investment Board may authorize an agent to exercise any of the Investment Board’s functions to the same extent that a prudent investor, acting in accordance with ordinary investment practice, would authorize an agent to exercise any investment function. (2) The Investment Board may not authorize an agent under subsection (1) unless a written agreement between the Investment Board and the agent is in effect and the agreement includes, (a) a requirement that the agent comply with the requirements included in the investment policy under section 47 and with

the investment plan under section 48; and (b) a requirement that the agent report to the Investment Board at regular stated intervals. (3) The Investment Board shall exercise prudence in selecting an agent, in establishing the terms of the agent’s authority and in monitoring the agent’s performance to ensure compliance with those terms. (4) For the purpose of subsection (3), prudence in monitoring an agent’s performance includes, (a) reviewing the agent’s reports; (b) regularly reviewing the agreement between the Investment Board and the agent and how it is being put into effect,

including assessing whether the requirement described in clause (2) (a) is being complied with; (c) considering whether directions should be provided to the agent or whether the agent’s appointment should be revoked;

and (d) providing directions to the agent or revoking the appointment if the Investment Board considers it appropriate to do

so.

(5) This section does not prevent the investment, by the Investment Board, in mutual funds, pooled funds or segregated funds under variable insurance contracts and the manager of such a fund is not an agent for the purpose of this section.Transition

52. (1) The following apply with respect to the former Part IV: 1. Reports shall be made under subsection 49 (1) of the former Part IV as though section 49 of the former Part IV

continues to apply, until reports have been made covering the periods up to and including the period ending on December 31, 2017.

2. Section 50 of the former Part IV continues to apply with respect to investments made on or before December 31, 2017. 3. Reports shall be made under subsection 54 (1) of the former Part IV as though section 54 of the former Part IV

continues to apply, until reports have been made covering the periods up to and including the period ending on December 31, 2017.

(2) In subsection (1),“former Part IV” means Part IV of this Regulation as it read on December 31, 2017. 3. The Regulation is amended by adding the following section:

55.1 (1) For greater certainty, the following may be done under the new Part IV at any time before that new Part is made: 1. The Investment Board described in subsection 46 (2) of the new Part IV may be established and the members appointed. 2. The council may adopt an investment policy under section 47 of the new Part IV. 3. The Investment Board may adopt an investment plan under section 48 of the new Part IV. 4. The Investment Board may authorize an agent under section 51 of the new Part IV. (2) In subsection (1),“new Part IV” means Part IV of this Regulation as made by section 2 of O. Reg. 360/15.Commencement

Un nouvel abonné peut commander des copies d’éditions précédentes de la Gazette au coût d’une copie individuelle si l’inventaire le permet.

The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. For the Christmas/New Year holiday schedule please contact the Gazette at (416) 326-5310 or by email at [email protected]

Advertising rates and submission formats:

1) Please submit all notices in a Word.doc format to: [email protected]

2) For a first insertion electronically submitted the basic rate is $75 up to ¼ page.

3) For subsequent insertions of the same notice ordered at the same time the rate is $40 each.

4) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at: www.ontario.ca/gazette or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + H.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.
