    ntruct: Whereas:

    (1) Potenialul de utilizare a cogenerrii ca msur deeconomisire a energiei este, n prezent, insuficientfolosit n cadrul Comunitii. Promovarea uneicogenerri cu randament ridicat, pe baza cererii deenergie termic util este o prioritate comunitar, avndn vedere beneficiile poteniale ale cogenerrii din punctde vedere al economisirii energiei primare, al evitriipierderilor n reele i al reducerii emisiilor, n special degaze cu efect de ser. De asemenea, folosirea eficienta energiei produse prin cogenerare poate contribuipozitiv la securitatea aprovizionrii cu energie i lapoziia concurenial a Uniunii Europene i a statelormembre. De aceea, este necesar s se ia msuri pentrua garanta c potenialul este exploatat mai bine n

    (1) The potential for use of cogeneration as a measureto save energy is underused in the Community atpresent. Promotion of high-efficiency cogenerationbased on a useful heat demand is a Community prioritygiven the potential benefits of cogeneration with regardto saving primary energy, avoiding network losses andreducing emissions, in particular of greenhouse gases.In addition, efficient use of energy by cogeneration canalso contribute positively to the security of energysupply and to the competitive situation of the EuropeanUnion and its Member States. It is therefore necessaryto take measures to ensure that the potential is betterexploited within the framework of the internal energymarket.

    (2) Directive 2003/54/EC of the European Parliamentand of the Council of 26 June 2003(5) establishescommon rules for the generation, transmission,distribution and supply of electricity within the internalmarket in electricity. In this context, the development ocogeneration contributes to enhancing competition, alswith regard to new market actors.

    external energy supplies currently accounting for 50 %of requirements and projected to rise to 70 % by 2030if current trends persists. Import dependency and risingimport ratios heighten the risk of interruption to ordifficulties in supply. However, security of supply shouldnot be conceived as merely a question of reducingimport dependency and boosting domestic production.Security of supply calls for a wide range of policy

    initiatives aimed at, inter alia, diversification of sourcesand technologies and improved international relations.he Green Paper emphasised furthermore that security

    of energy supply is essential for a future sustainabledevelopment. The Green Paper concludes that theadoption of new measures to reduce energy demand isessential both in terms of reducing the importdependence and in order to limit greenhouse gasemissions. In its Resolution of 15 November 2001 onthe Green Paper(6), the European Parliament called forincentives to encourage a shift towards efficient energyproduction plants, including combined heat and power.

    (4) The Commission's Communication "A SustainableEurope for a better world - A European Union Strategyfor Sustainable Development" presented at theGothenburg European Council on 15 and 16 June 2001identified climate change as one of the principal barrierto sustainable development and emphasised the needfor increased use of clean energy and clear action toreduce energy demand.

    (5) The increased use of cogeneration geared towardsmaking primary energy savings could constitute animportant part of the package of measures needed tocomply with the Kyoto Protocol to the United NationsFramework Convention on Climate Change, and of anypolicy package to meet further commitments. TheCommission in its Communication on theimplementation of the first phase of the EuropeanClimate Change Programme identified promotion ofcogeneration as one of the measures needed to reducethe greenhouse gas emissions from the energy sectorand announced its intention to present a proposal for a

    Directive on the promotion of cogeneration in 2002.

    (8) The Council in its Conclusions of 30 May 2000 andof 5 December 2000 endorsed the Commission's ActionPlan on energy efficiency and identified promotion ofcogeneration as one of the short-term priority areas.The European Parliament in its Resolution of 14 March2001 on the Action Plan on energy efficiency(10) calledon the Commission to submit proposals establishingcommon rules for the promotion of cogeneration, wherthis makes environmental sense.

    (9) Directiva 96/61/CE a Consiliului din 24 septembrie1996 privind prevenirea i controlul integrat al polurii[11], Directiva 2001/80/CE a Parlamentului European ia Consiliului privind limitarea emisiilor n aer aleanumitor poluani provenii de la marile instalaii deardere [12] i Directiva 2000/76/CE a ParlamentuluiEuropean i a Consiliului din 4 decembrie 2000 privindincinerarea deeurilor [13] au evideniat necesitatea dea evalua potenialul de cogenerare n instalaii noi.

    (9) Council Directive 96/61/EC of 24 September 1996concerning integrated pollution prevention and control(11), Directive 2001/80/EC of the European Parliamentand of the Council of 23 October 2001 on the limitationof emissions of certain pollutants into the air from largecombustion plants(12) and Directive 2000/76/EC of theEuropean Parliament and of the Council of 4 December2000 on the incineration of waste(13) highlight theneed to evaluate the potential for cogeneration in newinstallations.

    (10) Directiva 1002/91/CE a Parlamentului European ia Consiliului din 16 decembrie 2002 privind performanaenergetic a cldirilor [14] impune statelor membre sasigure ca pentru cldirile noi cu o suprafa total utilde peste 1000 m2, s se analizeaz i s se ia nconsiderare, nainte de nceperea construciei,fezabilitatea tehnic, de mediu i economic a

    (10) Directive 2002/91/EC of the European Parliamentand of the Council of 16 December 2002 on the energyperformance of buildings(14) requires the MemberStates to ensure that for new buildings with a totaluseful floor area of over 1000 m2, the technical,environmental and economic feasibility of alternativesystems, such as cogeneration of heat and power, is

    considered and taken into account before constructionstarts.

    (11) n prezenta directiv, cogenerarea cu randamentridicat este definit de economiile de energie obinuteprin producerea combinat fa de producerea separatde energie electric i termic. Economiile de energiemai mari de 10 % justific folosirea expresiei"cogenerare cu randament ridicat".     (11) High efficiency cogeneration is in this Directivedefined by the energy savings obtained by combinedproduction instead of separate production of heat andelectricity. Energy savings of more than 10 % qualify fothe term "high-efficiency cogeneration". To maximisethe energy savings and to avoid energy savings beinglost, the greatest attention must be paid to thefunctioning conditions of cogeneration units.

    (13) It is important for transparency to adopt aharmonised basic definition of cogeneration. Wherecogeneration installations are equipped to generateseparate electricity or heat production, such productionshould not be specified as cogeneration for issuing aguarantee of origin and for statistical purposes.

    (14) To ensure that support for cogeneration in thecontext of this Directive is based on the useful heatdemand and primary energy savings, it is necessary toset up criteria to determine and assess the energyefficiency of the cogeneration production identifiedunder the basic definition.

    (15) Obiectivul general al prezentei directive trebuie sfie stabilirea unei metode armonizate de calculare a

    energiei electrice produse prin cogenerare i aorientrilor necesare pentru punerea n aplicare aacesteia, lund n considerare metodologii precum celecare sunt puse la punct n prezent de ctre organismeleeuropene de standardizare. Aceast metod trebuie spoat fi adaptat pentru a ine seama de progresultehnic. Aplicarea calculelor din anexele II i III launitile de microcogenerare se poate baza, nconformitate cu principiul proporionalitii, pe valorilerezultate dintr-un proces de testare de tip, certificat deun organism competent i independent.

    (15) The general objective of this Directive should be toestablish a harmonised method for calculation of

    electricity from cogeneration and necessary guidelinesfor its implementation, taking into accountmethodologies such as those currently underdevelopment by European standardisationorganisations. This method should be adjustable to takeaccount of technical progress. Application of thecalculations in Annexes II and III to micro-cogenerationunits could, in accordance with the principle ofproportionality, be based on values resulting from atype testing process certified by a competent,independent body.

    (16) The definitions of cogeneration and of high-efficiency cogeneration used in this Directive do not

    prejudge the use of different definitions in nationallegislation, for purposes other than those set out in thisDirective. It is appropriate to borrow in addition therelevant definitions contained in Directive 2003/54/ECand in Directive 2001/77/EC of the European Parliamenand of the Council of 27 September 2001 on thepromotion of electricity produced from renewableenergy sources in the internal electricity market(15).

    (19) For the purpose of this Directive, the definition of"cogeneration units" may also include equipment inwhich only electrical energy or only thermal energy canbe generated, such as auxiliary firing and after burningunits. The output from such equipment should not beconsidered as cogeneration for issuing a guarantee oforigin and for statistical purposes.

    (23) To ensure increased market penetration ofcogeneration in the medium term, it is appropriate torequire all Member States to adopt and publish a reportanalysing the national potential for high-efficiencycogeneration and to include a separate analysis ofbarriers to cogeneration in the report, and of measurestaken to ensure the reliability of the guarantee system.

    (24) Public support should be consistent with theprovisions of the Community guidelines on State aid forenvironmental protection(16), including as regards thenon-cumulation of aid. These guidelines currently allowcertain types of public support if it can be shown thatthe support measures are beneficial in terms ofprotection of the environment because the conversionefficiency is particularly high, because the measures willallow energy consumption to be reduced or because thproduction process will be less damaging to theenvironment. Such support will in some cases benecessary to further exploit the potential forcogeneration, in particular to take account of the needto internalise external costs.

    (25) Programele de sprijin public pentru promovareacogenerrii trebuie s se concentreze n principal pe

    (25) Public support schemes for promoting cogeneratioshould focus mainly on support for cogeneration based

    on economically justifiable demand for heat andcooling.

    (26) Statele membre pun n aplicare diferite mecanismede sprijin pentru cogenerare la nivel naional, careinclud ajutoare pentru investiii, scutiri sau reduceri deimpozite, certificate verzi i programe de sprijin direct alpreurilor. Un mijloc important de atingere a scopuluiprezentei directive este garantarea funcionriicorespunztoare a acestor mecanisme, pn la punerean funciune a unui cadru comunitar armonizat, pentru amenine ncrederea investitorilor. Comisia intenioneazs monitorizeze situaia i s prezinte rapoarte cu privire

    la experiena ctigat n aplicarea programelornaionale de sprijin.

    (26) Member States operate different mechanisms ofsupport for cogeneration at the national level, includinginvestment aid, tax exemptions or reductions, greencertificates and direct price support schemes. Oneimportant means to achieve the aim of this Directive isto guarantee the proper functioning of thesemechanisms, until a harmonised Community frameworkis put into operation, in order to maintain investorconfidence. The Commission intends to monitor thesituation and report on experiences gained with the

    application of national support schemes.

    (27) For the transmission and distribution of electricityfrom high-efficiency cogeneration, the provisions ofArticle 7(1), (2) and (5) of Directive 2001/77/EC as wellas relevant provisions of Directive 2003/54/EC shouldapply. Until the cogeneration producer is an eligiblecustomer under national legislation within the meaningof Article 21(1) of Directive 2003/54/EC, tariffs relatedto the purchase of additional electricity sometimesneeded by cogeneration producers should be set

    (30) n sensul prezentei directive, de creare a unuicadru pentru promovarea cogenerrii, este important sse pun accentul pe necesitatea unui mediu economic iadministrativ stabil pentru investiiile n noi instalaii decogenerare. Statele membre trebuie ncurajate ssusin aceast necesitate prin proiectarea unorprograme de sprijin cu o durat de minimum patru anii prin evitarea schimbrilor frecvente ale proceduriloradministrative etc. De asemenea, statele membretrebuie s fie ncurajate s garanteze c programele desprijin public respect principiul retragerii treptate dinfunciune.

    (30) Within the purpose of this Directive to create aframework for promoting cogeneration it is important temphasise the need for a stabile economical andadministrative environment for investments in newcogeneration installations. Member States should beencouraged to address this need by designing supportschemes with a duration period of at least four yearsand by avoiding frequent changes in administrativeprocedures etc. Member States should furthermore beencouraged to ensure that public support schemesrespect the phase-out principle.

    (31) The overall efficiency and sustainability of

    cogeneration is dependent on many factors, such astechnology used, fuel types, load curves, the size of theunit, and also on the properties of the heat. Forpractical reasons and based on the fact, that the use ofthe heat output for different purposes requires differenttemperature levels of the heat, and that these andother differences influence efficiencies of thecogeneration, cogeneration could be divided into classesuch as: "industrial cogeneration", "heatingcogeneration" and "agricultural cogeneration".

    (32) In accordance with the principles of subsidiarityand proportionality as set out in Article 5 of the Treaty,

    general principles providing a framework for thepromotion of cogeneration in the internal energy markeshould be set at Community level, but the detailedimplementation should be left to Member States, thusallowing each Member State to choose the regime,which corresponds best to its particular situation. ThisDirective confines itself to the minimum required inorder to achieve those objectives and does not gobeyond what is necessary for that purpose.

    Obiectul prezentei directive este de a crete

    randamentul energetic i de a mbunti securitatea deaprovizionare, prin crearea unui cadru pentrupromovarea i dezvoltarea cogenerrii cu randamentridicat a energiei electrice i termice, pe baza cererii deenergie termic util i a economiilor de energieprimar pe piaa intern de energie, innd seama demprejurrile naionale specifice, n special cele privindcondiiile economice i climatice.

    Purpose

    Articolul 2 The purpose of this Directive is to increase energyefficiency and improve security of supply by creating aframework for promotion and development of highefficiency cogeneration of heat and power based onuseful heat demand and primary energy savings in the

    internal energy market, taking into account the specificnational circumstances especially concerning climaticand economic conditions.

    Prezenta directiv se aplic cogenerrii, astfel cum estedefinit la articolul 3, precum i tehnologiilor decogenerare enumerate n anexa I.

    Article 2

    Articolul 3 Scope

    Definiii This Directive shall apply to cogeneration as defined inArticle 3 and cogeneration technologies listed in AnnexI.

    Definitions

    For the purpose of this Directive, the followingdefinitions shall apply:

    (d) "energie electric produs prin cogenerare"nseamn energia electric produs ntr-un proces legatde producerea de energie termic util i calculat nconformitate cu metodologia prezentat n anexa II;

    (a) "cogeneration" shall mean the simultaneousgeneration in one process of thermal energy andelectrical and/or mechanical energy;

    (e) "energie electric de rezerv" nseamn energiaelectric furnizat prin reeaua de energie electric oride cte ori procesul de cogenerare este ntrerupt,inclusiv n perioadele de revizie sau n stare de avarie;

    (b) "useful heat" shall mean heat produced in acogeneration process to satisfy an economicallyjustifiable demand for heat or cooling;

    (c) "economically justifiable demand" shall mean thedemand that does not exceed the needs for heat orcooling and which would otherwise be satisfied at

    (e) "back-up electricity" shall mean the electricitysupplied through the electricity grid whenever thecogeneration process is disrupted, includingmaintenance periods, or out of order;

    (f) "top-up electricity" shall mean the electricity suppliethrough the electricity grid in cases where the electricitdemand is greater than the electrical output of thecogeneration process;

    (g) "overall efficiency" shall mean the annual sum ofelectricity and mechanical energy production and usefulheat output divided by the fuel input used for heatproduced in a cogeneration process and gross electricitand mechanical energy production;

    (k) "raportul dintre energia electric i energia termic"nseamn raportul dintre energia electric produs princogenerare i energia termic util la funcionareexclusiv n regim de cogenerare, utiliznd dateleoperaionale ale unei uniti specifice;

    (h) "efficiency" shall mean efficiency calculated on thebasis of "net calorific values" of fuels (also referred toas "lower calorific values");

    (l) "unitate de cogenerare" nseamn acea unitate carepoate funciona n regim de cogenerare;

    (i) "high efficiency cogeneration" shall meancogeneration meeting the criteria of Annex III;

    (m) "unitate de microcogenerare" nseamn o unitatede cogenerare cu o capacitate maxim sub 50 kWe;

    (j) "efficiency reference value for separate production"shall mean efficiency of the alternative separateproductions of heat and electricity that the cogeneratioprocess is intended to substitute;

    (n) "cogenerare la scar redus" nseamn uniti de

    cogenerare cu capacitate instalat mai mic de 1 MWe;

    (k) "power to heat ratio" shall mean the ratio between

    electricity from cogeneration and useful heat whenoperating in full cogeneration mode using operationaldata of the specific unit;

    (l) "cogeneration unit" shall mean a unit that canoperate in cogeneration mode;

    (m) "micro-cogeneration unit" shall mean acogeneration unit with a maximum capacity below 50kWe;

    Article 4

    Articolul 5 Efficiency criteria of cogeneration

    1. For the purpose of determining the efficiency ofcogeneration in accordance with Annex III, theCommission shall, in accordance with the procedurereferred to in Article 14(2), not later than 21 February2006, establish harmonised efficiency reference valuesfor separate production of electricity and heat. Theseharmonised efficiency reference values shall consist ofmatrix of values differentiated by relevant factors,including year of construction and types of fuel, andmust be based on a well-documented analysis taking,inter alia, into account data from operational use underrealistic conditions, cross-border exchange of electricity,fuel mix and climate conditions as well as appliedcogeneration technologies in accordance with theprinciples in Annex III.

    (1) Pe baza valorilor de referin armonizate alerandamentului, prevzute la articolul 4 alineatul (1),statele membre, nu mai trziu de ase luni de laadoptarea acestor valori, se asigur c originea energieielectrice produse prin cogenerare cu randament ridicatpoate fi garantat n conformitate cu criterii obiective,transparente i nediscriminatorii stabilite de fiecare statmembru. Acestea iau msuri pentru ca aceast garaniede origine a energiei electrice s permit productorilors demonstreze c energia electric pe care o vnd esteprodus prin cogenerare cu randament ridicat i s fieemis n a acest scop, ca rspuns la o solicitare dinpartea productorului.

    2. The Commission shall, in accordance with theprocedure referred to in Article 14(2), review theharmonised efficiency reference values for separateproduction of electricity and heat referred to inparagraph 1, for the first time on 21 February 2011,and every four years thereafter, to take account oftechnological developments and changes in thedistribution of energy sources.

    (2) Statele membre pot desemna unul sau mai multeorganisme competente, independente de activitile deproducie i distribuie, pentru a superviza emitereagaraniei de origine menionate la alineatul (1).

    3. Member States implementing this Directive beforethe establishment by the Commission of harmonisedefficiency reference values for separate production ofelectricity and heat referred to in paragraph 1, should,

    until the date referred to in paragraph 1, adopt theirnational efficiency reference values for separateproduction of heat and electricity to be used for thecalculation of primary energy savings from cogeneratioin accordance with the methodology set out in AnnexIII.

    Article 5

    (5) O garanie de origine: Guarantee of origin of electricity from high-efficiencycogeneration

    1. On the basis of the harmonised efficiency referencevalues referred to in Article 4(1), Member States shall,not later than six months after adoption of these valuesensure that the origin of electricity produced from high-efficiency cogeneration can be guaranteed according toobjective, transparent and non-discriminatory criterialaid down by each Member State. They shall ensure thathis guarantee of origin of the electricity enableproducers to demonstrate that the electricity they sell isproduced from high efficiency cogeneration and isissued to this effect in response to a request from theproducer.

    3. Member States or the competent bodies shall put inplace appropriate mechanisms to ensure that theguarantee of origin are both accurate and reliable andthey shall outline in the report referred to in Article 10(1) the measures taken to ensure the reliability of theguarantee system.

    4. Schemes for the guarantee of origin do not bythemselves imply a right to benefit from nationalsupport mechanisms.

    National potentials for high-efficiency cogeneration

    Articolul 7 1. Member States shall establish an analysis of thenational potential for the application of high-efficiencycogeneration, including high-efficiency micro-cogeneration.

    issues, barriers in relation to administrative procedures,and barriers relating to the lack of internalisation of theexternal costs in energy prices.

    3. Member States shall for the first time not later than21 February 2007 and thereafter every four years,following a request by the Commission at least sixmonths before the due date, evaluate progress towardsincreasing the share of high-efficiency cogeneration.

    1. Member States shall ensure that support forcogeneration - existing and future units - is based onthe useful heat demand and primary energy savings, in

    the light of opportunities available for reducing energydemand through other economically feasible orenvironmental advantageous measures like otherenergy efficiency measures.

    2. Without prejudice to Articles 87 and 88 of the Treaty,the Commission shall evaluate the application ofsupport mechanisms used in Member States accordingto which a producer of cogeneration receives, on thebasis of regulations issued by public authorities, director indirect support, which could have the effect ofrestricting trade.

    mechanisms contribute to the pursuit of the objectivesset out in Articles 6 and 174(1) of the Treaty.Proceduri administrative 3. The Commission shall in the report referred to in

    1. For the purpose of ensuring the transmission anddistribution of electricity produced from high-efficiencycogeneration the provisions of Article 7(1), (2) and (5)of Directive 2001/77/EC as well as the relevantprovisions of Directive 2003/54/EC shall apply.

    1. Member States or the competent bodies appointed bthe Member States shall evaluate the existing legislativeand regulatory framework with regard to authorisation

    procedures or the other procedures laid down in Article6 of Directive 2003/54/EC, which are applicable to high-efficiency cogeneration units.

    1. Member States shall, not later than 21 February2006, publish a report with the results of the analysisand evaluations carried out in accordance with Articles(3), 6(1), 9(1) and 9(2).

    2. Member States shall not later than 21 February 2007and thereafter every four years, following a request bythe Commission at least six months before the duedate, publish a report with the result of the evaluationreferred to in Article 6(3).

When evaluating the progress referred to inparagraph 1(a), the Commission shall consider to whatextent the national potentials for high-efficiencycogeneration, referred to in Article 6, have been or areforeseen to be realised taking into account MemberState measures, conditions, including climateconditions, and impacts of the internal energy marketand implications of other Community initiatives such as

    Directive 2003/87/EC of the European Parliament and othe Council of 13 October 2003 establishing a schemefor greenhouse gas emission allowance trading withinthe Community and amending Council Directive96/61/EC(19).

    3. When evaluating the scope for further harmonisationof calculation methods as referred to in Article 4(1), theCommission shall consider the impact of the coexistencof calculations as referred to in Article 12, Annex II andAnnex III, on the internal energy market also takinginto account the experiences gained from nationalsupport mechanisms.

    Articolul 14 If appropriate, the Commission shall submit furtherproposals to the European Parliament and Councilaiming at further harmonisation of the calculationmethods.

    Alternative calculations

    1. Until the end of 2010 and subject to prior approvalby the Commission, Member States may use othermethods than the one provided for in Annex II(b) tosubtract possible electricity production not produced ina cogeneration process from the reported figures.

    However, for the purposes referred to in Article 5(1)and in Article 10(3), the quantity of electricity fromcogeneration shall be determined in accordance withAnnex II.

Member States may calculate primary energy savingsfrom a production of heat and electricity andmechanical energy according to Annex III(c), withoutusing Annex II to exclude the non-cogenerated heatand electricity parts of the same process. Such aproduction can be regarded as high-efficiencycogeneration provided it fulfils the efficiency criteria inAnnex III(a) and, for cogeneration units with anelectrical capacity larger than 25 MW, the overall

    efficiency is above 70 %. However, specification of thequantity of electricity from cogeneration produced insuch a production, for issuing a guarantee of origin andfor statistical purposes, shall be determined inaccordance with Annex II.

    Articolul 15 3. Until the end of 2010, Member States may, using analternative methodology, define a cogeneration as high-efficiency cogeneration without verifying that thecogeneration production fulfils the criteria in Annex III(a), if it is proved on national level that thecogeneration production identified by such analternative calculation methodology on average fulfilsthe criteria in Annex III(a). If a guarantee of origin is

    issued for such production then the efficiency of thecogeneration production specified on the guaranteeshall not exceed the threshold values of the criteria inAnnex III(a) unless calculations in accordance withAnnex III prove otherwise. However, specification ofthe quantity of electricity from cogeneration produced isuch a production, for issuing a guarantee of origin andfor statistical purposes, shall be determined inaccordance with Annex II.

    ANEXA III Values used for calculation of electricity fromcogeneration shall be determined on the basis of theexpected or actual operation of the unit under normalconditions of use. For micro-cogeneration units thecalculation may be based on certified values.

    (a) Electricity production from cogeneration shall beconsidered equal to total annual electricity production othe unit measured at the outlet of the main generators;

    (e) The Commission shall, in accordance with theprocedure referred to in Article 14(2), establish detailed

    guidelines for the implementation and application ofAnnex II, including the determination of the power toheat ratio.

    For the purpose of this Directive high-efficiencycogeneration shall fulfil the following criteria:
