No matter how lazy Satan makes you feel, read this booklet for the

    betterment of your Hereafter.

    Excellence of Durd Sharf*

    Amr-ul-Mminn, arat Sayyidun iddq-e-Akber

narrates that reciting Durd Sharf upon the beloved and blessedProphet removes sins more (quickly) thancold waters extinguishing fire; and sending Salm on him isbetter than freeing a slave. (Kitb-ul-fajr-il- Munr fi-al-ta-AlalBashr-un-Nar, P.49)

    1. It is Far (obligatory) for both the employer as well as theemployee to learn the rulings of Shara pertaining toemployment as and when required. If they dont learn,

they will be sinner. (Detailed rulings about employmentcan be found in Bar-e-Sharat Volume 14).

*Sharif refers to anything or anyone that is Noble and Holy.

    2. At the time of hiring, it is mandatory to fix the durationof employment, working hours, salary etc.

    3. Al arat says that there are three differentpaces of work. (1) Lazy. (2) Average. (3) Very Fast. Duringhis stipulated working hours, if the employee works lazily(not even with the average pace), he will be sinner andreceiving full wage in this case is arm for him. He can

receive the wage only for the amount of work which hehas done. He must return the excess wage to the employer.(Fatw-e-Razavyya, V19, P407)

    4. If the employee ever gets lazy at work he should ponder asto how much work could have been done working with

the average pace. For instance, he is a computer operatorand gets hundred dollars daily as wage. He manages tocompose hundred lines daily working with the averagepace but ninety lines were composed some day owing tolaziness or unnecessary conversation, so he must get tendollars deducted from his wage of that day. If he does not

have the excess money deducted, he will be sinner anddeserving of Hellfire.

    5. If an employee gets deliberately late for work in a way thatis contrary to the norms or leaves earlier or gets absent[unduly], he will be committing the sin of deliberately

violating the employment contract. Further, if he receivedfull salary in such a case, he would be more sinner andwould deserve the torment of fire.

    6. The employee should remain active during his duty andavoid the acts causing laziness. For instance, if late sleepingat night or even Nafl (supererogatory) fast causessluggishness in work he is to avoid such acts as the onedeliberately being lazy at work, though he gets the moneydeducted from his wage or salary, will be sinner for he hasmade employment contract according to which he is

bound to work at least with the average pace. It hasalready been described with the reference of Fatw-e-Razavyya (V. 19, P. 407) that the employee workinglazily during working hours is a sinner. Obviously, theemployees undue laziness and absences bring about lossto the employers work. Anyway, whether there is someone

to monitor or not, the employee should fear Allah and get his salary deducted in proportion to the reductionin work that took place as a result of laziness. Further, heshould repent of it and apologize to the employer as well. However, if it is a privately owned organisation and theemployer forgives the amount of deduction either, the

employee will not be sinner .

    7. The employee who is bound to work solely for a particularemployer or organization during fixed timings cannot doeven his personal work during his stipulated work hours. He can offer Far and Sunnat-e-Makkada al during

al timings, however, it is not permissible for him tooffer Nafl (supererogatory) al during his duty hours.Further, he is allowed to go to offer al-tul-Jumua on

Friday. If the Jme Masjid is situated far from his workplaceand more time will be spent for this reason, the wage ofthat duration will be deducted. If the Jme Masjid issituated in the vicinity, no deduction will be made; he willreceive full wage. (Rad-dul-Mutr, V9, P118, Dr-ul-MarifaBeirut)

    8. Each employee should assess his performance about workdaily such as how much time he wasted during dutytimings in unnecessary conversations or unnecessary work, how late he reached etc. Moreover, he should also calculatehis undue leaves and get his salary deducted himself eachmonth accordingly. In Dawat-e-Islamis Jmia-tul-Madnaetc., there are some cautious Islamic brothers who getsome amount of their salary deducted each month as aprecaution. Their spirit is highly appreciable! Everyoneshould follow such pious people in this matter. If one lefta bit of his money in the organization he can bear it but ifhe received even a single unlawful dollar, it might result

in severe torment which no one can bear.

    9. The supervisor should supervise and observe all theemployees properly. He should submit a detailed reportto the relevant department or official on the performanceof the employees committing misconduct at work orduty-timings or showing laziness in work. If the supervisordeliberately covers up such misconducts, he would beconsidered disloyal and sinner and get deserving of thetorment of fire.

    10. Despite being aware, if the supervisors and inspectors ofreligious or social organizations turn a blind eye to theemployees misconduct and absences, and consequentlythe employees would be given full salaries from endowedmoney, both the employees as well as the relevant officialswill be deceivers, sinners and deserving of the torment ofHellfire.

    11. It is extremely inappropriate to evade doing a job in areligious organization due to strict implementation of therules of employment over there. Similarly, resigning fromthe job of a religious organization on account of theforegoing reason and getting a job in such an organizationin which there is no one to monitor is also very regrettable.

One should have the mindset of working for such anorganization where the rules of Shara pertaining toemployment are strictly implemented so that, by theblessings of doing so, he could avoid sins and earn allsustenance.

    12. If the employee cannot do work as per the contract ofemployment, for example, he is unable to do the assignedwork, he should inform the employer about it forthwith.

    13. It is forbidden for a Muslim to do the job of serving adisbeliever (non-Muslim). Similarly, a Muslim should notmake the contract of such employment with a disbelieverthat causes insult to a Muslim as such employment is notpermissible. (Alamgr, V4, P435, Quetta, Bar-e-Sharat, Part 14,P153)

    14. The employee should avoid making personal use of office-stationery such as pen, paper, envelope and other things.

    15. Due to illness, if the employee gets absent or does not doas much work as he usually does, the employer has theright to deduct salary. (For detailed information, pleaseread Fatw-e-Razavyya, Vol. 19, Pgs. 515-516)

    16. Besides the leaves observed according to the norms, if theImm and Main get absent they should get their salarydeducted accordingly. For example, if the Imm whosemonthly salary is three thousand dollars gets absent, heshould get twenty dollars per al deducted. Likewise, the Main should also make calculation for deduction.

(In case of deliberately violating employment contractwithout a valid exemption, one will be sinner.)

    17. The employee working for a privately owned organizationwill be allowed to offer Sunnat-e-Ghar Muakkada,Nawfil (supererogatory al) and invocations during

working hours provided the owner of the organization orhis deputy permits to do so. Further, in case of permission, the employee can participate in Mustaab deeds such asDars, Sunna-inspiring Ijtima etc.

    18. If the watchmen, security guards or policemen etc. whosejob is to guard (a house, building etc.) remaining awake,go to sleep deliberately during duty hours, they will besinner. Further, they will have to get their salary deducted

for the amount of time during which they (deliberately orunintentionally) slept or remained heedless to their job.

    19. If the employee gets free time during his duty, there is noharm for him to do ikr, recite Durd and go throughbooks etc. within this duration provided it does not affecthis responsibilities. The summary of a saying ofadr-ush-Shara Badr-u-arqa arat Allma Mauln Muft

Amjad Al Aam is as follows: It is notpermissible to be in two different employments with thesame working hours, i.e. if someone is already in paidemployment at an organization etc., he cannot do paidwork for any other organization etc. during the sametimings. (Bar-e-Sharat, Part 14, P144, Madna-tul-MurshidBareilly Sharf)

    20. The employer cannot make his employee work during theholidays observed according to the norms. If he does soby force, he will be sinner. However, if he requests hisemployee in a polite manner, not in a commanding voice,

and the employee works willingly or if he is paid forworking overtime, it is permissible to do so. Rememberthe ruling that it is Wjib to fix the wage if it is explicit orimplicit that wage has to be paid. (idya, P.230, Vol. 2) Onsuch an occasion, instead of fixing the wage, it isinsufficient to say such sentences as come and start work,we will see; we will give you whatever wage is appropriate;we will make you happy; we will give you pocket-moneyetc. Remember! It is a sin to give and take wage without

specifying it. Further, demanding the wage more than thefixed amount is also prohibited. However, if the onemaking someone work makes it clear in advance that hewould pay nothing and the worker agrees to it ether; butthen the former gives some money etc. of his own accord, there is no harm in such payments and earnings.

    21. If the one who had been receiving full salary despite beingabsent (unduly) or being lazy during duty, now feelsguilty, a mere verbal repentance is not sufficient for him.The matter of the undue wage or salary which he receivedto date will have to be dealt with according to Sharruling. With regard to the solution to this issue, Alarat says, (In case of receiving undue wage)

the employee has to return the excess money to theemployer. If the employer has passed away, the employeehas to return this amount to the employers heirs; if theemployee does not know the whereabouts of the heirs, hehas to donate this money to a Faqr or Miskn (destitute)Muslim as charity. It is arm for the employee to spendthis money on personal use or on any other cause whichis not adaqa (Charity). (Fatw-e-Razavyya, P.407, Vol.19)If the exact amount is not known, make a conservativeestimate and abide by the rulings of Shara accordingly.
