SIGNIFICANCE OF THE CASE

India’s biggest crime story after the Nithari serial killing case of 2006, the double murder case created ripples in the media world.

A study by Centre for Media Studies (CMS) says six channels beamed news and special programmes on the double murder for 40 hours out of a total 92 hours prime time from 19:00 hrs to 23:00 hrs — between May 16 and June 7.

The Union Minister for Women and Child Development, Renuka Chowdhury, condemned the police for what she called the "character assassination" of a child victim.

The case was handled by both Noida police and CBI.

THE CASE

On the morning of May 16,2008, Aarushi Talwar the 14-year-old daughter of a successful dentist couple, was found dead with her throat slit.

Suspicion immediately fell on the family's live-in man-servant, Yam Prasad Banjade alias Hemraj, a 45-yr-old Nepalese national.

The Noida police announced a reward for information leading to Hemraj's apprehension and arrest..


Aarushi Talwar and the male servant Hemraj were very close—too close for Rajesh Talwar's liking .

Early policy reports claimed that when Rajesh Talwar came home, he found his daughter and servant in her bedroom in an "objectionable position".

EARLY INVESIGATION


TURNING POINT

A retired Noida police officer, accompanying a relative of the Talwars, and during his visit, detected blood stains on the stairs leading to the terrace of the flat.

Following the trail of blood, Noida police detected the dead body of the missing domestic help, Hemraj, on the terrace.

Police finally arrested Dr. Rajesh Talwar, the father of the deceased girl, on May 23, 2008, charging him with having committed the double murder.

His wife, Dr. Nupur Talwar, stoutly defended her husband, accused the Noida police of framing him, and requested Uttar Pradesh chief minister Mayawati to transfer the case to the Central Bureau of Investigation (CBI).


MOTHERS STATEMENT

“She is giving us strength. I keep seeing her (in my dreams) and she tells me ‘mother you have to be strong.” Go on, you have to keep your strength.’ That is our only reason to live today,." Nupur Talwar told IANS.

FRIENDS CLAIM


CBI INVESTIGATION The CBI took over the investigation into the murders of

Aarushi and Hemraj on June 1, 2008, forming a 25-member team.

Series of tests, including narcotic and psychological tests of Dr Rajesh Talwar, Krishna and other suspects.

The CBI took Dr Rajesh Talwar into judicial custody and tried to grill other suspects in the case.

The investigation team raided Talwar’s house, nearby

areas and drains etc in search of vital clues.

CBI arrested Dr Talwar’s compounder, Krishna suspecting his involvement in the twin murders.

CBI court has reserved its verdict on the bail plea of Dr Rajesh Talwar.

The Central Bureau of Investigation (CBI) arrested his medical assistant Krishna and accused him of committing the murders with the help of Raj Kumar and Vijay Mandal, both domestic helps in the neighbourhood.


The media hounded Aarushi's parents - dentist couple Nupur and Rajesh Talwar.- Mahendra (the driver).

"This case is a total failure of the CBI,“- D P Goel,(ground engineer) who lives in the area.He said that even media exposed the case.

Seema Sharma, a homemaker who was out for an evening walk, “blamed the police and the CBI.”

ROLE OF MEDIA

Hemraj was thought to have murdered Arushi and run away.

The other servants who had introduced him to Talwars were projected to be murderers.

That Arushi and Hemraj allegedly had sexual relations.

Dr. Rajesh Talwar was raping his daughter Arushi. Arushi threatened to tell about it to everybody. So, she was killed.


Dr. Rajesh Talwar had extramarital affair with Dr. Anita and Arushi was against it.

Balaji Telefilms claimed on record that they will incorporate the Aarushi killing as part of the popular daily soap 'Kahani Ghar Ghar Kii'.

FAILURE OF POLICE DEPARTMENT

The Noida police’ role is under scanner for its dubious handling of the case

It has been proved that two police constables identified as Rajpal and Pawan, who were entrusted with the responsibility of handing over Aarushi’s slide samples to the government hospital, had deliberately delayed the process.

In the past one year the case has seen several twists and turns and the police is still groping in the dark for valuable leads.

The responsibility for handing over the swab samples to the government hospital should have been taken by the Investigating Officers (IO), which was not done.

Aarushi's vaginal samples were substituted with those of an unknown woman.


TWISTS N TURNS….

Fresh evidence of tampering in the Aarushi Talwar murder case which has baffled investigators for over a year now.

NDTV has confirmed from the Central Forensic Laboratory in Hyderabad that Aarushi's samples were substituted with those of an unknown woman.

The slide substitution is believed to have happened at the time of the autopsy on Aarushi when the case was being investigated by the UP police.

And there have been other glaring lapses which could have changed the course of investigations.

Aarushi and Hemraaj were both cremated before DNA samples could be taken, effectively there is no DNA sample of Hemraaj till date.

Aarushi's clothes sent to the CFSL had no bloodstains which indicates that they were changed. Effectively evidence has been tampered with on various levels.


TIMELINE OF THE CASE

May 17, 2008:- Hemraj's body found on the terrace of Talwar's house.

May 19, 2008:- Talwar's former Nepalese domestic help Vishnu Sharma named suspect & compounder, Krishna arrested by CBI.

May 23, 2008:- Aarushi's father Dr. Rajesh Talwar arrested for the two murders.


June 25, 2008:- Second lie detection test was conducted on Dr. Nupur Talwar & Rajesh Talwar.

June 26, 2008:- The CBI declared the case to be a "blind case". Dr. Rajesh Talwar refused bail.

Sept 4,2009:- The clothes that Aarushi was found in were soaked in blood. But the forensic lab received clean clothes.

Dr Rajesh Talwar has been released and the three accused

arrested. Despite the many versions of truth making its

way to the media, the real truth is still at large and the

motive still remains hazy.

Delhi Police has handed over the mobile phone to CBI.

Supreme Court has asked the Central Bureau of Investigation (CBI) about the status of Aarushi murder case.

The apex court took up a public interest litigation where The petitioner wants police not to leak any information in sensitive cases like Aarushi's murder.

Yesterday Rajkumar accused Rajesh Talwar and said that he fears threat from Rajesh Talwar.


Agency probing: Some unanswered questions

CBI does not have any evidence against the three accused — Krishna, Rajkumar and Vijay Mandal .

CBI said it would contact authorities in Nepal to help locate evidence (mobile phones and murder weapon.

CBI announced Rs 1 lakh reward on information about Arushi and Hemraj’s cellphones and the murder weapon.

Eve teasing; harassing women, killing for dowry, the Tandoor case, Jessica Lal Murder, Nithari Case and Arushi murder ….& Saumya case.


A Lesson Learnt… !!

Unfortunately all the apologies in the world will not get their daughters back. Jessica , Aarushi or Soumya. They are gone forever. What happened was most unfortunate. It could have been very easily circumvented through proper safety and security measures.

May god give strength to the bereaved family.

Let us learn a lesson and move on. Let every event and incidence in the society not become a blame game.
