Presidents report for newsletter

Hello everyone.

I hope this finds everyone in good health. Right now ABATE of Florida Inc. Is losing membership across the board. If our chapter is going to continue we need to get our membership numbers up.

Also we need members to get involved and help plan a fundraising event for the near future. The current board of directors are working diligently to correct issues and improve communication. The BOD has spoken about and is considering reducing the number of newsletters we print. And going to an on line newsletter. Please if everyone would email membership (and cc the newsletter trustee) and update you email address to receive the monthly newsletter.

Thank you all and I hope to see everyone at our next chapter meeting.

Hello ABATE Forest Chapter Legislative Warriors!

I’m excited about some upcoming changes to the Forest Chapter Board and my hope is you all will get your scoots out and come see everyone at the next meeting. We miss your cute, sexy and handsome Biker faces. Every one of you has an important role in Forest Chapter of ABATE.

On a serious note, it’s going to take each and every one of us to fight these Legislators wanting to mandate lids on every Biker in Florida and Nationally. It isn’t a joke! Last session a Senator proposed to repeal our Freedom of Choice HB1911 Law. He almost got away with it! That vote was 19 in favor and 22 against. That vote had support on both sides of the aisle.

As your Acting Secretary I am pleading with you for the love of our freedom, that many Men and Women died to protect…. Come on out and be a part of your ABATE Forest Chapter Family. Support your Board Officers. They volunteer to protect Biker’s Rights and give many selfless hours without asking for anything in return. Come out and share and socialize—you mean a lot to us as your Brothers and Sisters – Most of all we need your Legislative Warrior Spirit!

GENERAL MEETING May 7, 2016Discussed the Forest Chapter State Delegate Meeting and reminded Members to bring in items like sodas and desserts. Everyone is welcome to drop stuff off at Bridgette and Russ’ house. James Hanes will be dropping off some soda. Everything else is on task for the state meeting in August.

Acting Secretary Bridgette Pace – Please fill out the Officer Update Form since there have been changes. A new one will need to be completed as soon as the New Board is seated in June.Please make sure to state your name for the Secretary’s minutes.A motion was made by Frank to accept the Secretary’s Minutes as read, 2nd by Bryan, no discussion was held and the motion passes with no abstain votes.Treasurer Nicole Bushnell – absent working.A Discussion was held on which months motions were needed to accept which months of treasury reports. January through March was accepted in previous minutes “as read”.The Treasury Report was tabled until April and May are completed.A discussion was held about the Advertisement payments.The Sgt @ Arms announced that the Treasurer was on the phone till 3am with the State Treasurer and requested an Audit of the books.

Sgt @ Arms Pierre LaDuc – Discussed the trailer and asked who wanted to take the trailer. Held a discussion about the good job of the Treasurer and the President. Announced will not be running for an Office again.

Judyann Antonio –We have 77 Life Members and 53 Annual Members. We lost 7 members in March for non-renewals, 0 for non re new also in April; we had 2 renewals in April. We have 7 due in May, 6 due in June, 3 due in July and 4 due in August.I have the membership printout if you want to look at it to see when you are due. We need our membership numbers back up. Please help us get our membership numbers back up.I need to get started getting these quilts done. I need to go by the stuff to get the quilts done. A discussion was held on who are signors on the Forest Chapter Bank Account. The Treasurer and the State Treasurer and the State President are the only available account signors. The others on the account as signors are no longer Executive Board Officers and need to be taken off the account. VP Albert Riccio went to the bank to verify some information. He is still not a signor on the account, neither are others on the current Executive Board only the Treasurer Nicole Bushnell.The discussion went back to making the quilt and Judyann announced she doubted the quilt would be done in time for the August State Delegate meeting. A discussion was held on who would be receiving the moneys for the quilt ticket sales. Bridgette {ace and Bob Hambidge suggested this information is gotten from state because in the past items sold at state were to make money for the State Treasury. Judyann will be contacting state to ask who will accrue the quilt ticket sales Forest Chapter or the State Treasury. A check needs to be made out so Judyann can go an purchase the quilt materials. VP Albert Riccio will donate the funds for the backing.

Bridgette Pace reported for Russ Pace- I brought some materials from the local Marion County Supervisor of Elections Office. The District lines are changing in the Northern corridor and the SE Corridor due to a Lawsuit by a Legislator. It will not affect a lot of Voters; polling places will change for them. Part of the lawsuit was making sure the SOE Office sends every Marion County Voter a new card—new card holders are up front too.

Newsletter Editor Joe Wieland- We are down to six unpaid Advertisers. I‘ll keep meeting with them. I’m still working hard at it to get the Advertisers caught up. A discussion was held on the amount of Newsletters delivered.

All the books are signed out see Greg Smale if you would like to purchase a ticket. The drawing is in early December 2016.State took a vote to go to Tally and we are having the Freedom Rights Rally this next April. A discussion was held by old Members informing the new members what and how we ride in Tallahassee and visit our Legislators.We need to take a vote on the four Proposed Bylaw changes to Membership fees at the next meeting so we can take the vote from our chapter to the next State Delegate Meeting. Please read the Newsletter and get informed to bring your vote back to the next meeting. You can also go to the state website and find them there.State conducted there last round of nominations- there will be some changes on the State Board. Everyone is encouraged to read the Masterlink and the State Reports. We brought back some Masterlink State Newsletters they are up front.Bridgette read the Lobbyist’s Proposal letter from Doc Reichenbach and a motion was made Bridgette to accept the Lobbyist Proposal, 2nd by Albert a discussion was held the vote passed with no one abstaining.

Old Business-Bridgette reminded we need Delegates for the next state meeting and volunteered to be one.A reminder that our vote for the Bylaw Proposal was to be sent back to state along with the Lobbyist Proposal Vote.

New Business- The President asked for a Supervisor of Elections and the volunteer from the last meeting Glenn Myers was in attendance. Glenn Myers announced His intent to run for President and Russell Fascenda volunteered to be the Supervisor of Elections.

Good of the Order-The 50/50 winner was drawn Mrs. Dunlap, a Member and Veteran won the 50/50.

As of April 2nd, 2016 The Forest Chapter has 60 Annual, 77 Life. That gives us 137.

Since the February State meeting they called it an illegal vote since the person that ask to raise the membership dues did not summit the proper paper work to state before bringing this motion to the delegation to vote on we were asked to STOP collecting the $30 & $600 membership fees till voted on at the April state meeting.

WE are still collecting the $20.00 and or the $150.00 till FURTER NOTICE. Please renew as early as possible to get in on this savings. So far we have 2 new members for March. WE lost 4 due in Feb, 7 due in March, 2 due in April, 7 due in May, & 6 due in June.

OKAY so far as you see we are still collecting the normal membership dues til we send our DELEGATE to the April state meeting where there are to Vote on the membership fee’s going up we really need you to show up at the next meeting and place your vote on this New membership fee and if you wish too you can also pay your membership dues up front and early if you wish to save money. Hope to see you at the next general meeting.

I have never heard of them and most of you probably never have either, so here is how they describe themselves. This group was started in 1989 and is based in Washington DC. JUSTICES GIVE GREEN LIGHT TO STOPS OVER LICENSE PLATES

In a case that started with a dangling tag light, the Florida Supreme Court made clear Thursday that police officers have broad authority to pull over motorists whose license plates are not fully visible.

Justices, in a 5-2 decision, rejected an appeal from Jermaine D. English, who was stopped by Orlando police because a tag light and wires were hanging down over the license plate on a vehicle he was driving. Evidence found during the stop led to English being charged with possession of cocaine, marijuana and paraphernalia.

In seeking to suppress the evidence, an attorney for English contended that police did not have cause to stop the vehicle. But the Supreme Court upheld a 2014 decision by the 5th District Court of Appeal, which found that state law requires numbers and letters on license plates to be "plainly visible at all times."

A major part of the dispute centered on whether the law applies only to license plates that have been defaced or covered in substances, such as grease, that would prevent them from being easily read --- or whether it also applies to situations such as bulbs and wires hanging down.

"We conclude that the plain language of (the section of state law) is clear and unambiguous, and requires that a license plate be plainly visible and legible at all times

without regard to whether the obscuring matter is on or external to the plate,'' said Thursday's ruling, written by Chief Justice Jorge Labarga and joined by justices R. Fred Lewis, Peggy Quince, Charles Canady and Ricky Polston.

But Justice James E.C. Perry, in a dissent joined by Justice Barbara Pariente, wrote that the law was intended to prevent motorists from "physically altering or obscuring the license plate."

"Under the majority's view, the licensing statute could lead to potentially outrageous results," Perry wrote. "For example, families and avid bikers who utilize rear bike racks will now be guilty of unlawful activity if any part of the bicycle or bicycle rack --- or the nylon straps which are used to secure the bike to the rack --- covers the license plate. The possibilities under which law enforcement may now detain drivers under this statute are limited only by the imagination, potentially placing in the hands of law enforcement unfettered discretion to enforce the statute."

In going to the Supreme Court, English's attorney argued that the 2014 ruling by the 5th District Court of Appeal conflicted with an earlier decision by another appeals court. That decision, by the 2nd District Court of Appeal, found that police could not stop a vehicle because a trailer hitch blocked the view of a license plate, according to a brief filed last year by English's attorney.

The Supreme Court majority, however, sided with the 5th District Court of Appeal and rejected the earlier ruling.

"The plain language of (of the section of law) requires that a license plate be 'clear and distinct' and 'free from defacement, mutilation, grease, and other obscuring matter;' it does not suggest that matter external to the license plate may constitute a permissible obstruction under the statute,'' Labarga wrote.

News from The AMA

U.S. Reps. Bill Flores (R-Texas), Peter Welch (D-Vt.), Bob Goodlatte (R-Va.), Jim Costa (D-Calif.), Steve Womack (R-Ark.) and Cedric Richmond (D-La.) introduced H.R. 5180, the “Food and Fuel Consumer Protection Act of 2016” today. The American Motorcyclist Association supports this bill.

The bipartisan legislation would cap mandated ethanol content in the nation’s fuel supply at 9.7 percent and institute a provision that automatically reverts the U.S. Environmental Protection Agency’s annual Renewable Volume Obligations to the previous year’s percentage if the EPA misses its Nov. 30 deadline. And, finally, the bill would ensure commercially available cellulosic and advanced ethanol has a place under the 9.7 percent cap.

In other words, the bill would stop the federal government from forcing E15 fuel (15 percent ethanol by volume) into the market. Capping the ethanol mandate helps ensure the availability of safe fuels like E10 and a continuing place in the market for ethanol-free gasoline (E0) for older motorcycles. This is important, because the last RVO rule issued by the EPA decreased the E0 supply to just 130 million gallons from 9.2 billion gallons in 2016, despite the fact that the demand for E0 doubled.
