E. Nominating CommitteeRecommendation: President appoint a Nominating Committee to recommend tothe Board of Directors three candidates for the odd-numbered election yearseats.

BACKGROUND & OVERVIEW:This time is being reserved to discuss the Net Position at June 30, 2019.

As previously reported to the Executive Committee and Board of Directors, the claimliabilities under the Liability program have increased significantly this past year resulting ina low net position compared to past years.

The General Manager will review the attached in detail at the meeting.

Financial Improvement PlanIn anticipation of the financial shift due to increased liabilities, the Board has taken stepsto improve the net position by approving a higher 72.5% confidence level in 2019-20funding for the Liability program (previous years the confidence level was 65%) with theunderstanding that the confidence level will increase to 80% for the 2020-21 funding of theprogram. The Workers’ Compensation program funding is at an 80% confidence level.

Additional steps to be considered will be whether to issue any dividends (return of

contributions), declare assessments, and/or increase the current discount interest rate of2.0%.

The net position of the Liability program represents a 70% confidence level, so dividendsshould not be expected to be declared at the December Board meeting. The Target EquityPolicy adopted June 1, 2006 states the programs may pay dividends when surplus exceedsthe 90% confidence level.

However, ERMA did declare a $3,000,000 dividend this year for release and PERMA’sshare of that dividend is $544,301. The distribution of these funds will be on the DecemberBoard agenda for approval. Attached is the allocation of the dividend by Member.

Staff is reviewing the net position of each policy year and will be making theirrecommendation regarding assessments at the December Board meeting. Since theoverall funding is at a 70% confidence level, any recommended assessments should beminimal.

The impact of increasing the discount interest rate from 2.0% to 2.5% or 3.0% is alsominimal. If the rate was increased to 2.5%, the net position at June 30, 2019 would ofincreased by $76,895 and if the rate was increased to 3.0%, the net position would ofincreased by $157,486. The weighted average return of PERMA’s portfolio is 2.22% as ofJuly 31, 2019.

BACKGROUND & OVERVIEW:This time is being reserved to continue the discussion of the upcoming retirements of thePERMA Claims Manager and General Manager.

Job postings for the Claims Manager position were published the first week of August 2019with the following national-based associations: Association of Governmental Risk Pool(AGRiP) and Public Risk Management Association (PRIMA), and with the followingCalifornia-based associations: California Association of Joint Powers Authorities (CAJPA)and Public Agencies Risk Management Association (PARMA), and on the PERMA website. We also advised PERMA defense attorneys, industry contacts, and other pooladministrators of the job opening. The closing date for applicants to make application isJanuary 3, 2020.

Eleven (11) applications have been received to date. Interviews have been scheduled withtwo of the candidates qualified for the position for October 31, 2019.

Staff has also met with claims administration firms to discuss contracting out the servicesand will update the Executive Committee on this matter at the meeting.

BACKGROUND & OVERVIEW:It has been the practice of the organization to conduct a Membership Satisfaction Surveyevery three years. The last survey was conducted in 2017.

Attached is a Membership Satisfaction Survey for Executive Committee consideration.

The survey is essentially the same as previous years and will be completed on-line.

If approved, the survey would be distributed in late December 2019 with approximately 30days to complete, so that the results can be shared with the Executive Committee at itsMarch 5, 2020 meeting.

The results of the survey will be incorporated into a revised Strategic Plan which will alsobe submitted for Executive Committee consideration at the March meeting.

AGENDA ITEM 6D: Salary Survey

RECOMMENDATION:Accept the 2019 Salary Survey and approve to continue with adjusting salaries by 2% or theCPI-U, whichever is greater, for at least another 3 years.

FISCAL IMPLICATIONS:No cost incurred to conduct salary survey.

BACKGROUND & OVERVIEW:At the December 1, 2016 Board of Directors meeting, the Board took the following actionsbased on a Total Compensation Study conducted by Creative Management Consultants:

1) Approved a proposed 7-step pay structure effective July 1, 2017, with theexception of the General Manager pay plan which will remain a low/high rangeformat based on the study;

2) Approved to adjust the pay structure by 2% or the All Urban Wage EarnersConsumer Price Index for Los Angeles-Riverside-Orange counties in March,whichever is greater, effective July 1st for the next two years (2018-19 and2019-20) and conduct a total compensation analysis in three years;

3) Approved to place each employee at the next closest step, or a minimum of 5%above current step based on performance, of the new pay structure effectiveJuly 1, 2017 with the exception of the Claims Manager and Financial Analyst,these two employees will remain at Step 7 of the new pay structure effective July1, 2017, and in exchange, these positions will be changed from For CauseEmployees to At-Will Employees;

4) Approved a monthly cell phone/data allowance of $45 for the following positions:General Manager, Claims Manager, Financial Analyst, and Claims Specialist;and

5) Approved a wellness reimbursement allowance of up to $35 per month for gym/fitness membership fees and/or recognized diet programs (e.g., JennyCraig, NutriSystem, Weight Watchers).

Please note action item 2 above states that another total compensation analysis will beconducted in three years from the 2016-17 study.

Since it has only been three years since the last Total Compensation Study, the GeneralManager recommends the Executive Committee accept the attached salary survey in lieu ofa total compensation analysis and approve to continue with adjusting salaries by 2% or theCPI-U, whichever is greater, for another 3 years.

The results of the survey indicate that salary ranges are on par with surveyed pools especiallywhen the composite geographic pay differential is factored in. According to the 2016 study,the geographic pay differentials range from 3% to 11%, but a composite of 4% was used inthe study. An annual cost of living allowance will keep salary ranges competitive until a full TotalCompensation Study is conducted, which can cost $5,000 to $7,500.

RECOMMENDATION:President appoint a Nominating Committee to recommend to the Board of Directors threecandidates for the odd-numbered election year seats.

FISCAL IMPLICATIONS:Not applicable for this report.

BACKGROUND & OVERVIEW:In accordance with the Bylaws, the Board shall hold an annual organizational meeting forthe purposes of the election of Executive Committee members and the transaction of otherbusiness. Election of four Executive Committee seats shall be conducted in even-numbered years, and the other three shall be elected in odd-numbered years.

The annual organizational meeting is scheduled for December 5, 2019.

Staff recommends the President appoint the Executive Committee members not up forelection to a Nominating Committee (Kevin Kane, Marjorie De La Cruz, Charles Buquet,and Kathleen Sanchez) and meet prior to the annual December meeting to develop arecommended slate for Board consideration.

Attached is the current list of Board members and years served on the Board of Directors.

Incumbents Matthew Schenk, March JPA, and Darcy Wigington, City of Barstow, haveindicated their desire to continue to serve on the Executive Committee. Saida Amozgar,City of Perris, will not be seeking re-election.

Pamela Meuse, City of Desert Hot Springs, and Tami Scott, City of Cathedral City, haveexpressed interest in serving on the Executive Committee.

The election of the President and Vice-President will be held at the first ExecutiveCommittee meeting following the annual meeting (March 5, 2020).
