Tsunami quota in educationhas no relevance now: HC

Port Blair/ Chandigarh, Aug27: The Punjab and Haryanahigh court has held that con-tinuance of quota for “tsu-nami victims” for admissionin educational institutions hasno relevance now.

“Tsunami was a one-time event and a separatereservation for all futureyears is a sure plea for arbi-trary exercise of reservationto get admission in any

course,” held Justice KKannan of the HC while dis-missing a plea filed by a girlseeking admission in MBBS/BDS course under “tsunamivictims” category.

Justice Kannan alsoobserved that a decade haspassed since tsunami hit theIndian coast. It must be re-membered that there exists nofundamental right for reser-vation other than what is con-

templated under Article 15 ofthe Constitution for the fieldof education, which shall en-able the government to makespecial provisions for sociallyand economically deprived,women and children.

“Any category otherthan what is provided underArticle 15 must comethrough special notificationwhich shall have reasonablecriteria for reservation and

nexus to the object sought tobe achieved to save fromchallenge for arbitrarinessunder Article 14,” the courtsaid.

Ravinder Kaur Saini,a resident of Cambell Bay,Great Nicobar Island, hadapproached the high courtafter being denied admissionin medical course by BabaFarid University of HealthSciences, Faridkot.

The petitioner in-formed the HC that therewas a provision of reserva-tion for tsunami victims(wards/children of all ex-ser-vicemen settlers of Punjabiorigin at Cambell Bay islandin Andaman & Nicobar Is-lands) for admission in medi-cal courses in Punjab.

She had applied foradmission in medical courseat BFUHS under the tsunamivictim category but was de-nied on the grounds that the

said quota was removedfrom 2014.

Aggrieved by this,she filed a petition before theHC on the grounds that nonotice of revocation of res-ervation was issued by thePunjab government.

Hearing the petition,the HC held that if there everexisted a reservation for aparticular year, there is noright for a candidate to seekcontinuation of the same forsubsequent years.

On the contention ofcounsel for petitioner to callupon the university whetherthere existed a reservation ornot, the HC in its August 11order held, “before I call forany explanation from the uni-versity, I leave it to thepetitioner’s own wisdom andstrength to prove what thepetition contains as the ba-sis. I find the petition to belame and dismiss it”.

Lalu Prasad undergoesheart surgery in Mumbai

MUMBAI: Rashtriya JanataDal chief Lalu Prasad is un-dergoing two major heart sur-geries — one to replace anaortic valve and the other torepair the aorta — at a hos-pital here on Wednesday.

“The surgery beganthis morning,” a spokesper-son for the Asian Heart In-stitute, located in suburbanBandra Kurla complex, said.

The former Biharchief minister has been diag-nosed with ‘aortic stenosis’.

Asian Heart InstituteMedical director VijayD’Silva had said on Tuesdaythat the surgical procedurewill take over five hours.

EDITORIAL.....Lalu-Nitish success: Can other

alliances sprout from the ground?For most upper caste orupper crust people , aLalu-Nitish alliance inBihar was unthinkable.After all, how could themascot of administrativeefficiency and law and or-der, Nitish Kumar, tie upwith Lalu Yadav, the mes-siah of backward, lathi-wielding, backward casteuprising?

Yet i t happened .And it delivered a crush-ing blow to the BJP’sModi-Amit Shah narra-tive in 10 seats in Bihar,where the BJP lost foursitting seats out of 10.Lalu won three of the fourseats he contested, Nitishand the Congress got a50% win record. And whatabout Modi-Shah and theBJP? With four seats outof 10, it is a poor third inBihar, which it had sweptin the Lok Sabha polls.

The margins storyis more palpable: the BJPwon no seats with a mar-gin over 20,000 votes. Itwon one seat with just a700-p lus lead . Two o fLalu’s victories were witha near-24,000 vote mar-gin. Nitish’s party won aseat wi th a margin o fnearly 57,000 votes. In anassembly by poll, whereturnouts were low.

Lalu and Ni t ishhave formed an alliance,with deadly consequencesfor the Modi-Shah ledBJP, after 20 odd years.Can other al l iancessprout from the ground tobeat it?Lalu has called onMulayam Singh Yadav,leader of the ru l ingSamajwadi Party (SP) inUttar Pradesh andMayawati, the heroine ofUP’s Dali t ou tf i t , theBahujan Jamaj Party

(BSP) to form an alliance.This is unlikely.

The SP and BSP areat loggerheads over casteequations. Mulayam Singhprobably sees Mayawatiand not the BJP as his mainrival. That option – unlesssomething incredible hap-pens – is out of the ques-tion.

In Bengal, the rulingTrinamool Congress (TMC)is fee l ing the heat o f agrowing BJP. Its two tradi-tional rivals, the Congressand the Le ft are d imin-ished. Bengal politics is notmarked by caste, but by asystem of loot of publicmoney by vested interests.In this might is right sys-tem, the TMC might try foran alliance with the Con-gress or the Left. Aligningwith both, though ideal,will be tough.

In Orissa, the partyin charge is the Biju JanataDal (BJD) led by NaveenPatnaik. Its main rival usedto be the Congress, but withthe Modi wave, i t hasswitched attentions to theBJP. It can tie up with theCongress, if the latter partyis resurgent in other states,but not a threat in Orissa.

In the south, DMKcannot tie up with AIADMKin Tamil Nadu, nor can TDPalign with YSR Congress ofJagan Reddy in AndhraPradesh. In Telangana, whowill tie up with KCR of theTelangana movement, un-less it is the Congress?

Apart from the statesthat have alliances – andMaharshtra is one – everystate can do with somethingranged against the currentgovernment. But local poli-tics and complexities makeit tough to form nationalties.

Inaugural flight delayed, Bihar CM fliesback without flagging off Haj pilgrims

GAYA: Bihar chief minister JitanRam Manjhi on Wednesday flew backto the state capital without flaggingoff the first batch of Haj pilgrims fromthe state as the inaugural flight wasdelayed by nearly five hours.

Manjhi flew in shortly afternine in the morning to flag off the firstflight of Haj pilgrims scheduled for10.50 in the morning. But the five-hour delay forced the CM to fly backwithout performing the flagging-offritual. The long delay caused confu-sion and management problems at theairport. Quite a few pilgrims ex-pressed resentment at the delay.

According to Dr FarasatHussain, coordinator of health ser-vices to the Haj pilgrims, said the de-layed departure of the pilgrims causedmore inconvenience to the older pil-grims.

Before leaving, he CM indi-vidually met the pilgrims and offeredhem flowers and asked them to prayfor the welfare of the state. Address-ing the Haj pilgrims, volunteers andofficials present at the airport, the CMpromised to speed up the land acqui-sition work for the expansion of therunway to facilitate the landing andtake off of A-310 type of planes witha passenger capacity of 250. On ac-count of the existing shorter runwayonly A-320 type planes with 140-seatcapacity can make a safe landing andtake-off.

Land acquisition process raninto rough weather first on accountof a war between the state govt andAirport Authority of India on the is-sue of land cost.

When the cost issue was

settled and the AAI and Bihar govtreportedly reached an understandingto share the land cost on 50:50 basis,the local farmers offered resistanceand demanded high compensation aswell as jobs for parting with their land.

The CM also promised to geta Haj Bhawan constructed at Gayato avoid problems for the pilgrims whohave to first report at the Patna HajBhawan. Construction of a HajBhawan in Gaya will ensure bettercoordination and smooth movementof the pilgrims. The CM also said thathe will also see to it that the accom-modation problem of the Pitrapkshapilgrims is solved on a permanentbasis.

According to A M Karimi,local Haj coordinator, the first batchof 128 Haj pilgrims from the state in-cluding 58 women left for Medina forthe performance of the pilgrimage. 55of the pilgrims hail from Gaya district.The flight took off at 3.33pm. Alto-gether 6667 pilgrims have registeredthemselves with the Haj Committeeand they will be flown in batches be-tween August 27 and September 25.

Over 12 lakhaffected in Assam floods

GUWAHATI: Over 12 lakh peoplehave been affected in floods in 16districts of Assam. Many rivers, in-cluding the mighty Brahmaputra andits tributaries, continue to flow abovethe danger level, the authorities saidon Wednesday.

Officials said at least 10people have died since August 18. Inthe latest casualty, two people dieddue to floods in Lakhimpur andMorigaon districts on Tuesday.

According to the State Di-saster Management Authority(SDMA), a total of 1,265,449 peoplewere affected due to floods as thesurging waters of Brahmaputra andits tributaries inundated 2,093 villagesin the 16 districts.

This has forced 163,052people to take shelter in 212 reliefcamps set up by the administrations.

Officials said floods havealso damaged standing crops in112,635.25 hectares of land. TheNational Disaster Response Force

(NDRF) and the State Disaster Re-sponse Force (SDRF) have beenpressed into service.

Over 100 boats of theNDFR, SDRF and the Inland WaterTransport department were engagedin relief and rescue operations inMorigaon, Barpeta Kamrup, Nalbari,Dhemaji, Tinsukia and Sonitpur dis-tricts, the officials said.

Officials said theBrahmaputra river is flowing abovethe danger level in Jorhat, Guwahati,Tezpur, Goalpara and Dhubri areas.

Cataractsurgery is the removal of thenatural lens of the eye (alsocalled “crystalline lens”) thathas developed an opacifica-tion, which is referred to asa cataract. Metabolic changesof the crystalline lens fibersover time lead to the develop-ment of the cataract and lossof transparency, causing im-pairment or loss of vision. Acataract is a clouding of thelens of the eye. Cataracts areextremely common, and mostcataracts are a result of theaging process. A cataract canoccur in either or both eyes.

Individuals with a cataract inone eye usually go on to de-velop a cataract in the othereye as well. Factors otherthan ageing may cause cata-ract as well. Cataract some-times occurs relatively earlyin life due to factors such asinjury, excessive sunlight,toxic chemicals, changes inthe body metabolism, drugsor secondary to other eye dis-eases, such as glaucoma andinflammations.

There can also be he-reditary predisposition toearlier occurrence of cata-racts. Following surgical re-moval of the natural lens, ana r t i f i c i a l   i n t r a o c u l a rlens implant is inserted. Nowwith modern phaco-emulsi-fication, quick post-op recov-ery has become the standardof care in cataract surgery allover the world.

Similarly to provide af-fordable travel for islanders inthe Port Blair and mainlandsector, efforts have been accel-erated for introduction of char-ter flight services. The ACCI isexamining the proposal forflight connecting Port Blair andPhuket and the administrationwill support the proposal iffound viable,” the CS informed.
