Conditioning

Allowable Summer Benefits – current student-athletes• Continuing SAs may receive the following benefits,

regardless of whether they are enrolled in summer school:▫ Academic Support▫Training Room▫Weightlifting/Conditioning Activities▫Medical Exams▫Safety Exception▫Apparel/Equipment▫ Institutional Camps – note football SA’s cannot work

our own institutional camps/clinics▫Employment – SA’s must complete required paperwork

Allowable Summer Benefits – PSA’s• Enrolled in Summer School• Bylaw 13.02.11(c) – no longer considered a prospect (PSA)

if the student officially registers and enrolls and attends classes during the summer prior to initial enrollment. Therefore, as long as enrolled, may be provided the same benefits allowed in Bylaw 16 for continuing students and not subject to contact restrictions in Bylaw 13.

• Not Enrolled in Summer School▫ We may only provide necessary pre-enrollment

information regarding orientation, conditioning, academics, and practice activities to a PSA, provided he/she has signed an NLI OR institutional Financial Aid Agreement OR has been officially accepted for enrollment.

Allowable Summer Benefits• Academic Support

▫ An institution may provide academic support services to a SA who is enrolled in the institution’s summer term prior to the student’s initial full-time enrollment at the certifying institution.

• Training Room Facilities• An institution may allow a SA who is enrolled in the

institution’s summer term prior to the student’s initial, full-time enrollment at the certifying institution to use the institution’s training room facilities.

• A student not enrolled in summer school is still considered a PSA and therefore; may not receive academic support or access to training room facilities.

Allowable Summer Benefits• Weightlifting/Conditioning Activities – enrolled in

summer school• A PSA may participate in voluntary summer workouts

conducted by the institution’s strength and conditioning coaches prior to the student’s initial full-time enrollment at the certifying institution, provided he or she is enrolled in the institution’s summer term (does not have to be on aid though) and the activities meet the definition and criteria of summer voluntary workouts.

• Football PSA’s may participate if they have signed an NLI OR signed the institution’s written offer of admission and/or financial aid OR if they are enrolled in summer school.

• Basketball PSA’s may participate if they have signed an NLI OR if they are enrolled in summer school.

Allowable Summer Benefits• Weightlifting/Conditioning Activities – not enrolled in summer

school▫ A PSA may participate in these activities in the presence of a

strength and conditioning coach if they signed an NLI (or a four-year college-transfer has signed an offer of financial aid and/or admission) on the institution’s campus, provided such activities are not prearranged, strength and conditioning coach is performing only supervisory duties, and does not work directly with the PSA. Involvement by the strength and conditioning coaches (other than supervisory) or the involvement of any coaching staff member in any capacity would constitute a tryout.

▫ Coaching staff member may not engage in any practice activities with the PSA.

▫ A PSA who has NOT signed an NLI or written offer of financial aid and/or admission may NOT participate in voluntary weightlifting or conditioning activities on the institution’s campus, unless such facilities are open to the general public.

Allowable Summer Benefits• Mandatory Medical Exams – enrolled in summer school

▫ Prior to participation in any weightlifting or conditioning workouts, a first-time participant is required to have a medical exam or evaluation administered or supervised by a physician. The exam or evaluation must have been administered within six months prior to participation in any weightlifting or conditioning activity.

▫ An institution may finance medical expenses for a PSA who sustains an injury while participating in such workouts.

• Medical Exams – not enrolled in summer school▫ It is permissible to administer medical exams at any time to

PSA’s who have either signed an NLI or have been accepted for enrollment at the institution, provided the exams occur during an official paid visit, attendance at summer school, or a visit to the institution at the PSA’s own expense for any purpose.

Allowable Summer Benefits•Safety Exception – Applies to Rowing and Track

(field events, jumping hurdles, or the jumping element of the steeplechase) ONLY!▫A PSA who is enrolled in summer school prior to

their initial full-time enrollment at the certifying institution may participate in voluntary workouts in the presence of the institution’s coach and in the institution’s regular practice facility when the PSA uses equipment related to the sport. The coach may provide safety of skill instruction but may not conduct the workout.

Allowable Summer Benefits• Apparel/Equipment – enrolled in summer school• A PSA who is enrolled in the institution’s summer term prior

to their initial full-time enrollment may receive workout apparel (on an issuance and retrieval basis) regardless of whether the PSA is receiving aid to attend summer school.

• Football PSA’s may receive if they have signed an NLI OR written offer of admission and/or financial aid OR they are enrolled in summer school.

• Basketball PSA’s may receive if they have signed an NLI OR are enrolled in summer school.

• Apparel/Equipment – not enrolled in summer school▫ An institution may NOT provide workout apparel to a PSA

who wishes to participate in weightlifting or conditioning activities during a visit to an institution’s campus.

Allowable Summer Benefits• Institutional Camps

▫ An institution may not employ an individual who officially registers and enrolls and attends classes during the summer prior to initial enrollment as a camp counselor in an institution’s camp.

▫ An institution, staff members, or boosters may not employ or give free or reduced admission privileges for a high school, prep school, or two year college athletics award winner or any individual being recruited by the institution to attend an institution’s camp.

▫ A PSA who was a high school, prep school, or two year college award winner or who is being recruited by the institution may not be employed (either salary or volunteer basis) at that institution’s sports camp/clinic.

▫ In all sports except football, a senior PSA may participate as a member of the institution’s camp/clinic.

Allowable Summer Benefits• Employment – applies to those enrolled and those not enrolled in

summer school▫ An institution may arrange for employment or employ a PSA,

provided the employment does not begin prior to the completion of the PSA’s senior year in high school, the opportunity for employment is available on an equal basis to all applicants who qualify for the position and the PSA is paid only for work actually performed and at a rate commensurate with the going rate in that locale for similar services.

▫ A booster may employ a PSA, provided the institution does not arrange the employment, the opportunity for employment is available on an equal basis to all applicants who qualify for the position and the PSA is paid only for work actually performed and at a rate commensurate with the going rate in that locale for similar services.

▫ If a TU Athletics staff member arranges employment for any PSA (other than with booster), a student-athlete employment form must be completed and submitted to the Compliance Office.

Voluntary Summer Workouts• In order for any athletically related activity to be considered voluntary,

all of the following conditions must be met:▫ SA must not be required to report back to a coach or other athletics

department staff member (e.g., strength coach, trainer, manager) any information related to the activity. In addition, no athletics department staff member who observes the activity (e.g., strength coach, trainer, manager) may report back to the SAs coach any information related to the activity;

▫ The activity must be initiated and requested solely by the SA. Neither the institution nor any athletics department staff member may require the SA to participate in the activity at any time. However, it is permissible for an athletics department staff member to provide information to SAs related to available opportunities for participating in voluntary activities (e.g., times when the strength and conditioning coach will be on duty in the weight room or on the track). In addition, for students who have initiated a request to engage in voluntary activities, the institution or an athletics department staff member may assign specific times for SAs to use institutional facilities for such purposes and inform the SAs of the time in advance;

▫ SAs attendance and participation in the activity (or lack thereof) may not be recorded for the purposes of reporting such information to coaching staff members or other SAs;

▫ The SA may not be subjected to penalty if he or she elects not to participate in the activity. In addition, neither the institution nor any athletics department staff member may provide recognition or incentives (e.g., awards) to a SA based on his or her attendance or performance in the activity;

▫ An institution’s coach may only be present for a voluntary workout in the institution’s regular practice facility (without the workouts being considered as countable athletically related activities) if the sport has a safety exception;

▫ In Football all strength and conditioning coaches conducting voluntary weight-training or conditioning activities shall be required to have cardiopulmonary resuscitation and first aid certification. In addition, a member of the institution’s sports medicine staff (e.g., athletic trainer, physician) must be present during all voluntary conditioning activities (running, not lifting) conducted by the institution’s strength coach. This sports medicine staff member must be empowered to have the unchallenged authority to cancel or modify the workout for health and safety reasons, as he or she deems appropriate.

Nutritional Supplements & Fruits, Nuts, and Bagels

▫Nutritional Supplements An institution may provide permissible nutritional

supplements to a SA for the purpose of providing additional calories and electrolytes. Permissible nutritional supplements do not contain any NCAA banned substance and are identified according to the following classes: Carbohydrate/electrolyte drinks, energy bars, carbohydrate boosters, and vitamins and minerals.

▫Fruits, Nuts, and Bagels An institution may provide fruit, nuts, and bagels to a SA

at any time.▫ If you are unsure of what is permissible ask Dave

Polanski or the Compliance Office.

Medical Hardship Waiver Criteria for C-USA• Coaches will notify Compliance Office of potential medical hardship

waivers to be filed;• Compliance Office will notify Athletic Training so that the following

material may be collected and attached with a medical hardship waiver application:▫ Letter signed by treating physician that includes:

Diagnosis, explanation of treatment, including status of participation approved (e.g., rehab, practice);

Statement that SA’s injury resulted in incapacity to compete the remainder of the season;

Reason SA discontinued participation for remainder of season▫ Contemporaneous medical documentation that substantiates the injury or

illness for the remainder of the season which may include the following: Applicable operation report(s), surgical report(s) or emergency room

document(s); Documentation of follow-up doctors visits in which SA is not cleared to resume

playing; Treatment logs or trainer’s room notes (indicating continuing rehabilitation

efforts)

Medical Hardship Waiver, continued…

• Additionally, we may ask you the following questions in order to complete the waiver:▫Specific Date injury occurred▫Explanation of injury▫If the SA was cleared for competition/practice after

the injury/illness, how many competitions/practices did he participate in and how were they limited, if in any way.

• If Athletic Training is aware of any other waivers that may need to be filed which have not yet been discussed, please communicate this with the Compliance Office.

New Legislation

•Ethical Conduct▫Proposal 2009-9 will amend Bylaw 10.1 and

add a piece to the definition of unethical conduct. To specify that knowingly influencing others

to furnish the NCAA or an individual’s institution false or misleading information concerning an individual’s involvement in or knowledge of matters relevant to a possible violation of an NCAA regulation constitutes unethical conduct.

Adopted, effective immediately.

New Legislation• Playing & Practice Seasons and Recruiting

▫Proposal 2009-75B requires a sickle cell solubility test or documentation of results with the mandatory medical exam. To specify that the required medical examination or

evaluation that SA’s who are beginning their initial season of eligibility and students who are trying out for a team must undergo prior to participation in voluntary summer conditioning or voluntary individual workouts pursuant to the safety exception, practice, competition, or out-of-season conditioning activities shall include a sickle cell solubility test (SST), unless documented results of a prior test are provided to the institution.

Adopted after comment period, effective August 1, 2010.

New Legislation•Playing & Practice Seasons and Time Limits

▫Proposal 2009-76 restricts countable athletically related activities between midnight and 5 a.m. To specify that countable athletically related

activities shall not occur between midnight and 5 a.m., except for during participation in a conference championship or an NCAA championship, in any competition that begins prior to midnight and concludes after midnight, or a promotional practice activity (e.g., first practice of the season).

Adopted, effective immediately.

New Legislation• Playing & Practice Seasons – Football

▫ Proposal 2009-81 allows flexibility in the scheduling of summer the conditioning period. In football, to permit an institution to designate nine

consecutive weeks between the conclusion of the academic year and the institution’s reporting date for pre-season practice as its summer conditioning period (must still designate one discretionary week during specified period).

Changes it from counting back nine weeks from the pre-season report date in order to determine the start date of the summer conditioning period TO determining nine weeks from time school is out until the pre-season report date. Doesn’t effectively change it for us.
