Kate will provide an overview of the three tier system in the US and provide commentary on current trends in the regulatory sphere.

'Pursing legal excellence using metrics - TWE's journey'

There is conclusive evidence of business performance increasing for those organisations that measure operational activity using data and metrics. However, the adoption by the legal industry of performance metrics has been relatively slow in comparison to other sectors. This presentation will provide an insight into TWE’s journey in developing a unique system that applies performance metrics and continuous improvement principles from wine production to legal practice.

10:30am Session 5: Rachel Triggs, Legal Counsel, Wine Australia 'Australian Regulatory Update'

One of Wine Australia’s functions is to maintain the truth and the reputation for truthfulness of Australian wine. To achieve this object, Wine Australia administers the label integrity program and regulates the use of geographical indications and other terms pursuant to the Australian Grape and Wine Authority Act 2013. This session will examine the interpretation of the false and misleading provisions under Part VIB of the Act and revisit various rules around the use of business names containing GIs, pre-existing trade mark rights, and the use of terms such as ‘Burgundian clones’, ‘French oak’, ‘Sparkling’, ‘Pinots’, ‘Cabernets’ and ‘Apera’.

11:30am Session 6: Owen Malone and Anna Gibson 'The Counterfeit and Misappropriation Challenge'

The significant expansion and success of our business globally takes TWE squarely into the murky and challenging world of piracy, counterfeiting and general legal risk in business transactions.   The purpose of this presentation is to increase understanding of the significant issues and how risk can be sustainably mitigated to a level that does not severely impact our business plans and strategic objectives.

OIV, WWTG, FIVS, APEC, WRF and WTS. Many in Australia struggle to differentiate our domestic bodies, AGWA, WFA, WGGA, AWRI etc, so they have little chance with this array of acronyms. But what do these international bodies all do? (if anything). This presentation will update you on the latest developments at these international wine forums.

Scenario: A consumer is walking down a city street when their smartwatch/mobile phone buzzes saying that if the consumer turns right and proceeds for 250 metres they will find a wine cellar offering them their favourite wine. 

This presentation will consider the legal implications associated with this scenario and other forms of mobile marketing.

11:00am Session 9: Panel discussion – Mim Rizzo, Legal Counsel, Treasury Wine Estates; Jason Duldig, Senior Legal Counsel, Accolade Wines; Alicia Kinlay, Senior Corporate Lawyer, Australian Vintage Limited ‘Navigating advertising compliance – sharing recent experiences’

How do different wine companies navigate the advertising compliance landscape? This panel discussion will contemplate how wine companies engage with regulators such as ASB, ACCC and AARB (if at all) and consider the role of internal and external lawyers, external agencies and internal training in managing advertising compliance.
