That trend hos continued thisyeor ond everyone ossocioted with the Troining Bronch should be congratuloted not,only for that, but olso for receiving d nominotion os NTETA NT Provider of the Yeor.Although not the ultimate winner, my congratulations are extended to Dr Solomon,Brendan Quirke ond oll the guys dnd iadies in Training Bronch. Well done.

Since the last edition of OutbatkAmbulance Cour.rcil has held meet-ings in both Katherine and AliceSprings and Councillors were able tomeet with most staff and members ina social setting, as well as from a

fonnal perspective. The re-opening

of t}le Katherine Centre was a par-ticular highlight ar-rd the magnificentplaque presented by His Excellencythe Governor-General holds prideof place.

meetings; Cadets pausing and mak-ing sure the musical notes they areplayr.g are the right ones; ContractParamedics rolling with the waves inthe Timor Sea, or swallowing dust inthe Thnami Desert.

All this and more happens on a

regular basis during a day in the lifeof St John Ambulance AustraliaQtrT) Inc. It happens in places likeAlice Springs, where typical CentralAustralian hospitality was again laidon. The occasion was the Augustmeeting of Council and BernKilgariff and Steve Peers combinedwith staff and members to play hostfor Council's visit. It was an oppor-

tunity for both work and social com-mitments to be met and AliceSprings again laid on the best.

Staff will by now have come faceto face with our 1999 - 2002Strategic Plan, a plan which was ini-tially started at a special eveningmeeting of Council. It is absolutelycritical that everyone understandsand participates in the developmentof the plan, as we all need to be con-fident and clear of the directionSt John in the Northern Territory isheaded. There seems to be just somuch happening presently, I hopestaffare as excited and positive aboutour future as I am.

reflection of the growing costs wehave had to meet without compen-sating increases income. Our agree-ment negotiations with TerritoryHealth Services to provide theAmbulance Service for allTerritorians are still continuing andthrough these discussions St Johnplans to address some areas of thepresent cost escalations.

As readers may have seen we have

recently conducted a strong TVadvertising campaign on all stationsthroughout the Territory. Therewere six (6) new ads produced rang-ing from "would you know what to

do scenarios ", "kit and subscriptionscheme" ads to a "Corporate style"ad depicting every thing StJohn does

in the NT It is the first time we haveproduced a corporate style ad and itis pleasing to see Service staff andvolunteers being promoted in theirrespective roles. The campaignbegan during StJohn week and coin-cided with some National advertisingon Darwin's channel 8. All in all ithas been a good campaign and therehas been significant increases in ourtraining area and recognition of"what we do" by the Community atlarge. I would like to thank DavidRosenberg for his efforts in the pro-duction of these advertisements.

St John week this year had anemphasis on'first aid training for dri-vers" and there were some amazingstatistics produced about the benefitsof *ris training at road accident sites.

StJohn in the NT have for a numberof years been making representations

to the relevant authorities regardingthis idea and combined with thisrecent St John week focus, increasesin the numbers of drivers first aidtrained is predicted.

The fleet replacement programcontinues with a further four (4)imported category I ambulancesintroduced with another two (2)vehicles on-line in March 1999. Atthis time it will mean that over 60%of the fleet has been upgraded. Thetwo (2) commodores - I in TennantCreek and 1 in Katherine - have just

been replaced. These Regions use

the commodores for long distancerendezvous and they are certainlymore economical than the category 1

vehicles.In closing I would like to wish all

and the LawDUTY OF CAREAmbulance officers are trained andemployed to provide a specificservice to the public. This has theconsequence that they have a duty totake care in providing that service.

In law there is an important dis-tinction between civil and criminalliabilities. Civil liabilities are involvedwhen a member of the public sues

an ambulance officer for a breach of

duty of care, such as assault or negli-gence. Criminal liabilities areinvolved when a breach of a duty ofcare owed by an ambulance officercomes within the criminal law, andcriminal prosecution can follow.

CRIMINAL LIABILITYASSAULT

The criminal offence of assault canarise where an ambulance officer

makes or threatens physical contactwith another person without thatperson's consent. Even if a personrequires medical treatment orfirst aid to maintain life, that person

is allowed by law to refuse to receive

such treatment or aid. HoweverSection 187 of the NorthernTerritory Criminal Code providescertain exceptions when rescuing orresuscitating a person or in providing

medical treatrnent or first aid reason-ably needed by the person, sothat the assault is no longer treatedas a criminal assault. Nevertheless,providing first aid or other treatmentto somebody against their wishesis always going to present prob-lems, and might give rise to a civilaction against the ambulance officerby the person being treated, evenif it doesn't give rise to criminalliability.

Everybody, an ambulance officeror anyone else, is entided to use rea-sonable and necessary force todefend themselves or some otherperson. Where reasonable and neces-sary force is used in such a situation,the law does not treat the force as

an assault.

DUTY TO PROVIDEASSISTANGE

At common law there is no duty onanybody, including a medical practi-tioner or an ambulance officer, torescue any other person whether byproviding medical services or first aidor in any other way. In the NorthernTerritoryhoweveq Section 155 oftheCriminal Code creates a criminaloffence where a person who is able toprovide rescue, resuscitation, medicaltreatment, first aid etc to a personurgendy in need ofit callously fails todo so. The elements of this offencewhich have to be proved in any pros-ecution are (l) that a person is inurgent need of rescue or resuscita-tion etc; (2) that the person's life maybe endangered if it is not so provid-ed; (3) that another person callouslyfailed to provide such rescue orresuscitation etc.

The maximum penalty in such a

case is seven years' imprisonment.This Section has been considered bythe Courts in the Northern Territoryin at least one case - Salmon a Cbutedt Anor. In that case, the Court ruledthat the requirement that the rescuerhas "callously" failed to assistrequires a deliberate and consciouschoice by an informed person not toassist. Furthermore, the failure toassist must offend common standardsof respect, decency and kindnesssuch that a reasonable person wouldregard that failure to assist as beingttcallous",

The bottom line is that ambu-Iance officers, medical practitionersand the like are not required to pro-vide assistance when they are offduty, every single time they becomeaware that there is somebody who

might need resuscitation or first aidor the like. Of course, if an off-dutyambulance officer nevertheless inter-feres with the situation and finds outwhat is going on, and if the situationis life-threatening to an injured per-son unless resuscitation or first aid isprovided, then criminal liabilitymight be involved if the ambulanceofficer fails to take the next step andprovide the necessary resuscitation orfirst aid.

CVIL LIABILITYIf an ambulance officer provides careto a person and provides that carenegligendy or carelessly or recklessly,or provides it against the person'swishes, and the person suffers dam-age as a result of that, then theinjured person can sue the ambu-lance officer. This right to sue arisesout of a breach of the duty of careowed by the ambulance officer to theinjured person.

Ambulance officers are welltrained and in most cases are wellaware of what assistance they can andcannot provide at the scene. When indoubt, it is wise to communicate withthe ambulance base or with a doctorif there is time to do that under allthe circumstances. If there is no timebecause the situation is urgent, thenaction has to be taken and anincorrect decision leading to furtherdamage will not necessarily amountto negligence or recklessness or care-lessness. The standard of care anambulance officer must apply is thatof a properly trained ambulanceofficer possessing typical know-ledge and skill and adopting therecognised procedures, protocolsand systems developed for theirwork.

aw^re, the biggest risk of furtherinjuring an injured person arises inmoving that person without firstvery carefirlly assessing the situation.Ambulance officers are all welltrained in assessing these risla.

In the rare cases where an injuredperson wishes to sue an ambulanceofEcer, it is in fact the ambulance ser-vice that must pay for any damages

and legal costs awarded in favour ofthe injured person. This is becauseambulance of0cers are all employedby an ambulance service, and theiremployer is "vicariously" liable forthe actions of its employees per-formed in the course of theiremployment. In the NorthernTerritory Section 22A of the LawR fo* (Aliscellaneous Proaisions) Lctspecifically provides that the employ-er is responsible for paying any dam-ages and costs awarded against theemployee, and further provides thatthe employer is not entitled to tryand get these damages and costs backfrom the employee.

INJURIESTO AMBULANCE

OFFICERS

Ambulance officers can be injured intJre course of their emplol.rnent. Thismight arise out of an assault by aninjured person or his friends, or itmight involve contracting a blood-borne disease such as HIV orHepatitis B or C. Where theseinjuries occur, the ambulance officeris entitled to benefits under theNorthern Territory Work Heabh Actbut is not otherwise entided to suethe employer, because Section 52 ofthe Work Health lcr prohibits allcommon law actions against employ-ers by injured workers or theirfamilies. The remedies to the injuredambulance officer are limited toWork Health actions, actions underthe Crimes (ictims Assistance) Actwhere the injury arose as a result of a

crime, or common law actionsagainst third parties (that is anybodyother than the employer) whocaused the injury. Of course, manythird parties responsible for injuriesin the course of the employmentof an ambulance offrcer are unlikelyto have any money or any insurancecover to pay any common lawdamages.

Q'{T) Inc decides to export its ser-vices in foreign countries, manage-ment must select an organisationalstructure for operating in thosemarkets. According to Stanton,Miller and Layton (1994), there are

four distinct methods of entering a

foreign market, each representingsuccessively greater internationalinvolvement, leading ultimately to a

truly multinational operation. St

The simplest way of operating inforeign markets is by exportingthrough export/import agentintermediaries. Very little risk orinvestment is involved and littletime or effort is required on the partof the exporting producer. On theotler hand, the exporter has litde orno control over its agent intermedi-aries. Furthermore, these intermedi-aries are not generally aggressivemarketers and do not generate a

large sales volume.(Stai'ton, Miller and Lalton I 494, p.584).

To counteract some of these defi-ciencies, management can move tothe second stage exporting throughcompany sales branches or othersales subsidiaries located in foreignmarkets. Bypassing the export/import agent intermediaries enables

a company (1) to promote its prod-ucts more aggressively, (2) to devel-op its foreign markets more effec-tively and (3) to control its saleseffort more completely. Of course,management now has the time-con-suming and money-consuming taskof managing a salesforce. The diffi-culty here is that these salespeopleare eit-her (l) foreign nationals unfa-miliar with the product and thecompany's marketing practices or (2)Australian salespeople unfamiliarwith the market.(Stanton, Miller and Lalton 1994, p.585).

As foreign markets expand, man-agement may enter licensingarrangements whereby foreign man-ufacturers produce the goods or inthe case of St John Ambulance,deliver t}le technology such as train-ing courses. Licensing meansgranting to another producer for a

fee or royalty payment the right touse the licensor's productionprocess, patents, trademarks orother assets.

Contract manufacturing isrelated to licensing: an Australianmarketer, such as a clothing manu-facturer, simply contracts wit-h a for-eign producer to supply the prod-ucts that the Australian firm willmarket in that producer's country. St

John Ambulance could adopt thisstructure in relation to supply of4WD ambulances to the Asia PacificResion.1Sran"rcn, tuliller and Lalton 19s4, p.586).

Licensing offers manufacturers a

flexible arrangement with a minimalinvestrnent. Yet they can still enjoythe advantages of their patents,research and know-how. Throughlicensing or contract manufacturing,producers can enter a market thatmight otherwise be closed to thembecause of exchange restrictions,import quotas or prohibitive tariffs.At the same time, by licensing man-ufacturers may be building futurecompetitors. A licensee may learn allit can from the manufacturer andthen proceed independently whenthe licensing agreement expires.lStanton, Miller and Lalton I 994. p.586).

In the fourth method, the com-pany builds or otherwise acquires itsown production facilities in a for-

eign country. The stmcture can be a

joint venture or a wholly-owned for-eign subsidiary. A ioint venture is apartnership arrangement in whichthe foreign operation is owned inpart by the Australian company andin part by the foreign company. Theforeign ownership share may be anypercentage - more than, less than,or exactly 50 percent. Obviously,when the controlling interest isowned by foreign nationals, theAustralian firm has no real controlover any of the marketing or pro-duction activities. At the same time,a joint venture may be the onlystructure (other than licensing)through which an Australian firm is

allowed to enter a given market.(Stanton, Miller and Layton 1994, p.586).

ANALYSIS OFFOREIGN MARKETSThroughout the world, marketdemand is determined by the num-ber of people, the ability to buy andbuying behaviour. Also, humanwants and needs have a universalsimilarity. People need food, cloth-ing and shelter. They seek a betterqualiry of life in terms of lighterwork loads, more leisure time andsocial recognition and acceptance.But at about this point, the similari-ties in foreign and domestic marketsseem to end, and the differences inculrure, the economic environmentand political and legal forces mustbe considered.(Stanton, Miller and Laltoo 1994, p.587).

CULTURECulture is a set of shared valuespassed down from generation togeneration in a society. Many cul-tural values can influence an organi-sation's approach to internationalcontracting.

Language is the most obviousdifference berween cultures. Inexui-cably linked with all other aspects ofa culture, language reflects thenature and values of that culture. IfSt John Ambulance is to contractextensively, with any one countryand culture within the Asia PacificRegion, it is imperative to learn thelanguage. Learning a language wellmeans learning the culture because

the words of the language are mere-ly concepts reflecting the culturefrom which it derives. For represen-tatives if St John Ambulance tocommunicate well with politicalleaders, employees, suppliers cus-tomers and officials they must

assimilate this one aspect of culturemore than any other.(Terpsua. V. and Saiathy. R. 1997, p.l2J).

Business customs and Practicessuch as, ownership patterns, size,impact of lobby groups, decisionmaking practices and processes,negotiating, techniques, bribery andpricing policies make up a countriesculture, and can govern the success

of an international contractor withinany country.

ECONOMIC ANDFINANCIAL ENVIRONMENT

To enter into international contract-ing within the fuia Pacific Region, St

John Ambulance management mustclosely examine the economic condi-tions in that region. The nature ofbanking systems, foreign exchangerisks and rate variation, exchangecontrols, payment records, perfor-mance bonds, tariff and non-tariffbarriers and price controls are criticalfactors for successful contracting andSt John management must measurethe risks and load profit marginsaccordingly.ftrmp://w.ausnade. com.au).

Most countries in the AsiaPacific Region have enjoyed highrates of economic growth in recenttimes, and have provided attractive,growing markets for a wide range ofAustralian Exports. However, in mid1997 Thailand began to experiencefinancial instabiliry. This has nowspread to other countries in theregion, causing:o currency depreciarions. falling asset prices including

shares and property. rising interest rates. financial and banking sector

problems. tightening of credit. problems with debt repayments

and trade finance. slowdowns in economic growth. considerable uncertainty about the

The currency depreciations inmarkets such as Singapore andTaiwan have been relatively small.Other markets such as Indonesiahave experienced quite severedepreciations. In Thailand,Indonesia and South Korea theInternational Monetary Fund is pro-viding financial support associatedwith the implementations of policyreforms. The Australian govern-ment has contributed to these sup-port packages. Ilowever, the ongo-

The principal political concerns forSt John Ambulance Australia (|JT)Inc are the stability of governmentsand their attitudes towards freetrade. Obviously, an unstable gov-ernment adds to risk of doing busi-ness in a country or region. Thenature of political system, degree ofnationalism, government planningobjectives and relations withAustralia and ot-her countries are allareas which need to be consideredbecause they will have an impact onthe successful implementation ofinternational contracting.

For example the situation inIndonesia has been volatile overrecent weeks, especially in Jakarta.On the 21st May 1998, PresidentSoeharto announced his resignationand Vice-President Habibie wassworn in as President. A clearer viewon business opportunities in theregion will not become availableuntil there is a stabilisation of thecurrendy dysfunctional banking sec-

Four countries stnrck by currentturmoil - Thailand, Malaysia,Indonesia and the Philippines -accounts for up to l2 percent ofAustralia's exports and 27 percent ofthe Northern Territory's totalexports. The difference between legalsystems, whose law may prevail indisputes, rules of competition,patent registration, extra-territorial-ity of overseas legislation and prod-uct liability are important issues tobe considered and when gatheringthis type of information, manage-ment must look beyond tJre obvious.

By applying 'systematic analysis'differences should become less for-midable t}lan they might appear ini-tially and may be reduced to man-ageable proportions. AII markets inthe fuia Pacific Region have certainsimilarities: first, a buyer orientationis essential; and second, the market-ing decision mix will be the same.Austrade (http://www.austrade.com.au) suggests that it is advisableto adopt an approach that a foreignmarket is merely a different envi-ronment to the domestic market.

ASSISTANCEAND AGREEMENTS

The Australian and NorthernTerritory governments havedesigned and coordinated the intro-duction of various assistance pro-grams and trade agreements, toassist Australian businesses with theprospect of going international.

If St John Ambulance Australia(NT) Inc decides on internationalcontracting as an option and meansof reaching organisational goals, andpersonal ambitions are not involved,managemenr can starr identifuingsuitable markets. Management's aimshould be to select markets withhigh potential and low risk.

One way in which economiccooperation is being strengthened isthrough the creation of the ASEANFree Tiade Area. Originally plannedto remove internal barriers andachieve a common effective prefer-ential tariff by the year 2008 (nowmoved to 2003). Ambulance ServiceWhilst on holiday in England introducing my wife Yasi to family and friends I wosable to cotch up with o friend I grew up with but hod not seen for five yeors. lamesHeap is a Poramedic Officer with the Eost Anglion Ambulonce Service formerly theSuffolk Ambulonce Service however due to finonces three seryices omalgomated.

The PTS works on a differentradio system but all AmbulanceService vehicles monitor an emer-gency channel throughout the (IK.The common channel assists Officersin Emergencies, inter-hospital trans-fers and directions (should you benot too sure where to go). TheEmergency Ambulance Serviceswork via UHF on a selcall system.Once dispatched Officers answerwith their initials to confirm themessage was received followed by

pressing a button upon arrival attheir destination. Another button ispressed upon leaving the scene en-route to hospital with a button

pressed on arrival at the hospital.Once clear and ready for another jobthe Officers contact the radio base

via voice.The East Anglian Emergency

Ambulance Service has two types ofjobs, Red and Urgent. A doctor cancall for an Ambulance with instmc-tion to the radio dispatcher torespond with either Red or Urgent.Red is equivalent to our Code Oneand lJrgent is equivalent to our CodeTivo. All Clinics (our Code Three's)are done by the PTS Officers except-ing stretcher patients.

The Mildenhall Station operatestwo Emergenry Service Shifts sevendays a week as follows:

0800hrs to 1900hrs1900hrs to 0600hrs

The remaining two hours are cov-ered by another Ambulance Station.The reason for this is again financialwith the East Anglian EmergencyAmbulance Service wanting to closethe Mildenhall Station. Forrunatelydue to complaints from the local

An example of the roster for anOfficer at the Mildenhall Stationfollows:

requires six weeks Basic Tlainingfollowed by two weeks DriverTiaining then on-road trainee forone year. On-road trainees are super-vised by a Paramedic or a Technicianand are part of a two-person crew(not a third person). A tainingOfficer assesses the trainee everythree months on-road and upon suc-cessful completion the traineebecomes an Ambulance Technician.After one year as a Technician appli-cation can be made for theParamedic entrance exam.

The Paramedic Course consists oftwo mont-hs including hospital time.The new Paramedic returns on-road

with no supervision and possiblysupervising a trainee.

Before I started the shift I was

advised, by James's wife thatMildenhall is a quiet Centre with theOfficers drinking tea all day. Ithought she was joking, surelynowhere could be as quiet as TennantCreek!

On arrival at the Station I noticedthere were no Ambulance Signs on

the road, in fact the Station is locatedoff the main road in a cul-de-sac.This is apparently normal as thegeneral public are not encouraged toenter the Centre. The day beganwith a cup of tea and introductions tothe Technician Mike Sharp and tothe PTS Officers, full time and pantime were on Station. A vehiclecheck followed and I took the oppor-tunity to get a couple of photos.

There is quite a lot of room in theback of these vehicles with a onestretcher patient set-up however theycan carry two if required.

The Centre then went on stand-

by covering two towns due to theother Ambulance being out of thearea for rwo hours so another cup oftea was made including a snack.There were no jobs for the next fivehours (similar to a day shift atTennant Creek) so several cups of tea

were made and conversation revolved

around comparisons of UK and NTServices. Apparently UK manage-ment is concerned that response

times are too slow however, theOfficers at the Station were amazed

at the vast area the Tennant CreekCentre covers (about the size ofEngland). This can cause response

times to vary from rwo minutes tofour hours depending on the job and

location.At lunch time (when all

Ambulance Officers around theworld generally sit down to eat) the

phone rang and there followed twoReds and two IJrgents which kept us

busy up unril the last fifteen minutes

of the shift.I really enjoyed the Observer

Shift and would like to take thisopportunity to thank my OC BradGough for helping me organise theShift and the East AnglianAmbulance Service and the Directorof Paramedic Services for allowingme to do the Shift. Finally a bigthank you to ParamedicJames Heap,Technician Mike Sharp and the staffat Mildenhall for making me feelwelcome. If anyone here gets a

chance to do an Observer Shift inEngland I would recommend theEast Anglian Ambulance Service,especially Mildenhall Station.

Unfortunately thetime is whizzing by and it seems that I will no sooner have my heod oround thecomplexity of the Operotions Branch ond the time will be up.

ince I started with theOperations Branch I have hadthe opportunity to travel toA.lice Springs and Katherineto visit the Ambulance

Centres. My visit to Alice Springscoincided with the Alice Springsshow and it was a unique experienceto attend a Territory show wearing a

jacket with the temperature at only12 degrees. I would like to thankSteve Peers and the staff at AliceSprings for making my trip such a

pleasure.The purpose of my trip to

Katierine was to not only meet thestaff, but also to attend the officialreopening of the KatherineAmbulance Cenre after the devastat-ing floods inJanuary this year. LenaireBrown was presented with her l2-yearmedal at a celebration dinner. Thankyou to Kevin Blake and staff for theirhospitaLity.

In Darwin, St John has entered anew era with the induction of a rural

division of StJohn Ambulance Cadets.The Humpty Doo Cadet Division hadis induction ceremony inJuly and the25 cadets received their lapels and cer-tificates. Brian Maden is the DivisionalSuper-intendent of the Humpty DooCadets with Therese Peck and JoanFlunt as Divisional Officers. Thecadets were very excited marching inthe Territory Day Parade as their firstofficial public duty.

On other cadet news, Jenny Kirbyhas taken a six-month break from herposition as Divisional Super-intendent of the Darwin Cadets. DiMunro has agreed to take over theposition until the end of the year. Dihas also been coordinating theManagement Tiaining Course thatwill be held in September and Octoberso she has a very busy six monthsahead ofher.

The National Cadet Camp will beheld in Alice Springs from 31stDecember 1998 to the 8th January1999.The camp venue will be at Yirra

College just outside Alice Springs andCadet competitions will be held on

January 2nd. Planning is well underway and it sounds like a great time willbe had by all those forrunate enoughto attend.

Public Duties continue to be verybusy with an average of l2 dutiesbeing covered each week by theDarwin Adult Division. Whilst someof the dry season sports are coming toa close the football season is just aboutto conunence so the public duties are

likely to continue to be busy for sometime to come.

As this may be my only chance tocontribute to an article n the Outback

Ambulance I would like to take thisopportunity to thank everyone in St

John and particularly in theOperations Branch for making me so

Studles One 1998I have recently hod the pleasure of coordinating the second closs of AdvancedClinicol Studies One (ACS I) for 1998. There were two closses for 1998 involvingseventeen students who came from Gove, Alice springs ond Darwin.

I r:i;"-:'T?" ri: : ; i ^3:n: :i(Ambulance, Pre-Hospital Care). Itrequires the students to give up threeweeks of their time and devote itcompletely to study. It has that ten-dency to send partners and familymembers around the twist as a bud-ding student sticks protocols andhelpful hints on walls, windows, mir-rors and listens to protocol tapeswhile they sleep.

It is a mentally draining coursewith very little practical work sowhen it comes time to test the practi-cal side all stops are pulled our, toensure the students are put throughevery possible scenario.

One of the highlights of thecourse was the scenario day held atthe National Safety Council inBerrimah (who generously donatedthe use of all their facilities for theday). By the morning of the scenariothe students had some idea that therewas something big in the aiq howev-er no one really knew how big. Withthe participation of the year 1 IDrama Students from CasuarninaSecondary College, we set up a simu-lated bus accident involving 20patients. This was dramatised veryprofessionally by the drama students,and the simulation of injuries wasperformed (with realistic results), byTanya Griffiths, Pat Murray and JanRowell.

To successfully run a course suchas this involves the participation of

many people.
