1 BHARTIYA POST JULY, 2009 As we have no other option except to embrace the three ACP scheme, applicable to all Central Government employees at this juncture and even opted for that too, We could not answer to the questions such as will it be the salvation for the long awaited promotional avenues which is lacking in the postal services or will it replace the existing TBOP, BCR which were earlier called as regular promotions as per the agreement made with the service unions then. Yes. ACP cannot be equated with the regular promotions. They are only financial up gradations with many riddles and riders. What is the position of promotional avenues existing in the Postal? Will it be sufficient or at least equivalent to the extent of 50% available in other Govt departments like Income tax, Railways etc? Will it be at least equal to the extent available in the Postal Accounts in our same organization? Not at all. Promotional avenues are plenty everywhere including the Postal accounts except others in postal department. Promotional avenues are too meager palpably very low in the case of postal employees. During 1974, the 20% LSG scheme was introduced with the good intention to provide minimum of 20% operative staff shall be elevated to the LSG to avoid stagnation and frustration in the minds of the employees in the absence of required regular promotions. To improve the position further, the staff unions accepted the TBOP and BCR promotions which were equated with the regular LSG and HSG II promotions by accepting the staff cut to the extent of 20% in the supervisory and 6% in the operative sides. It was the accepted on the basis of agreement made after discussions in the JCM. The Postal department violating the agreement made with the Staff side had declared in 1999 that the TBOP and BCRs are not regular promotions and they are only financial up gradations at par with ACP ignoring the fact that the schemes were part of cadre reviews with the acceptance of staff cut at the time of its implementation which should not be equated with the two ACP promotions scheme introduced by the Govt to all its employees without any staff cut. We have miserably failed to counter the same and the department had once again revived the old LSG, HSG II schemes during 2002 and digging out the old files to grant notional promotions right from 1983 resulting in chaos and confusions which is still a never ending process. Now what is the position on promotions? Is the assured 20% LSG vacancies available or restored after rolling back to the pre 1983 position? No. The WHAT WILL HAPPEN? present posts available in LSG are less than 9 percent of the total basic posts. As a model employer, will it not be the responsibility of the department to restore pre 1983 position while rolling back and deviating unilaterally the agreement at least by ensuring 20% LSG posts. Will it not its responsibility to revive the posts abolished at the time of implementation of TBOP and BCR promotions since it were equated with the normal ACP promotions available for others. The irony in this case, even after 1999, the perennial staff cut agreed for TBOP and BCR in establishment review every time is continuing till today and there are no orders to stop the review so far. Much water have flown under the bridges and we were the mute spectators because of the negative attitude of the postal board in deciding the promotional avenues for the lower cadres even though they have implemented five cadre reviews for the higher officers. Since the TBOP and BCR are now equated as ACPs, virtually there is no cadre review exercised for the operative staff. After adopting the three ACP promotions which are only financial up gradations, what is the way out to restore pre 1983 position by reviving 20% LSG and reviving the post surrendered earlier. The Cadre review is the only option available before us after adopting the three ACP promotions. Promotional posts should be enhanced in the service to off shoot the matching savings we already surrendered at the time of TBOP and BCR schemes. We should not allow the department to shut its eyes over the operative toiling employees of the department after the implementation of the three ACP without restoring the staff cut and 20% LSG but exert pressures and compulsions to make them to discuss with the Staff side seriously for a cadre restructuring by providing more regular promotions to the employees and settle the issues like PO & RMS Accountants, Systems Administrators etc. The Central working committee is meeting shortly to take stock of the situation and decide future course of action and it is the time to act to wrest our foremost demand of cadre review by our concerted moves of the rank and file at all levels. We must involve all the workers and muster their strength to wrest the same. We must challenge the decisions of the department taken unilaterally without any discussions with the respective representative trade unions like in the case of Postmasters cadres etc duly ignoring the theory of collective bargaining. If this is not done, we will forfeit our credibility. What will happen if we fail to do this? Trade unions will be rendered irrelevant. Editorial

The General Secretary Com. K. V. Sridharan hasattended the Union Network International - Asia PacificRegional Organization (UNI - APRO) sponsored seminarson Posts & logistics held at Bangkok and Ayottaya as arepresentative of NFPE on the invitation. The Seminarswere held at Bangkok on 08.06.09 & 09.06.09 and atAyottaya from 10.06.09 to 11.06.09. The delegates fromIndia, Indonesia, Korea, Singapore, Nepal, Phillipines,Vietnam. Srilanka and Vietnam. The members of the UNISecretariat, Japan also participated.

On 08.06.09, the Joint Seminar organized by UNIAPRO Post & Logistics & Appear began with the inauguraladdress of Mr. Somchai Reopanichkul Director, APPUBureau who dealtelaborately about theinternational Dimension ofPost and the need for betterunderstanding betweenthe manager of PostalServices with the TradeUnion representatives. Mr.Chandrasekear, Director ofIndia Post on deputation at APPC which in the trainingcentre for Postal Managers under APPU has dealt thesubject of 'Changing Scenario of Postal business andthe Business Excellence'. In the after noon he explainedabout the Mail parcel & logistics management.

There was a group discussions of participantsalongwith the Managers, IT personnel of variouscountries deputed to APP college for training etc on thesubject of how to make the Post profitable under theEconomic crisis. It lasted for two hours and Mr. Chandra& Mr. Wasim, Lecturers of APPU College hold thediscussions and made the Seminar as useful andpurposeful.

The Participants of the Seminar visited the LaksiMail Centre Bangkok in the evening to know about theirSorting and the logistic services.

On 09.06.09, Mr. Lim, Profesional Expert onPostal Services has dealt about the reforms in KoreaPost. Thereafter Mr. Wasim, lecturer of APPC covered boththe topics of operationalExcellence & Humanresource managementelaborately which was veryuseful to know about theservices of variouscountries in the region. Thedetails collected duringgroup discussions,interactions, with the participants are furnished in thisissue for the academic interest of all.

On 10.06.09, the participants moved toAyotthaya, the former capital of Thailand and around 70Kms away from Bangkok to take part in the UNI Apro

Posts & Logistics/SEWU - THP Joint seminar which wasalso sponsored by UNI Japan Post. Morethan 25 Unionmembers of SEWU- THP and UNI - TLC officialsparticipated the Seminar. The debates, on 'EconomicCrisis and Labour Movement in Thailand and the lectureof Prof. Lac Dilokvidhyarat, Faculty of Economis.Chulalangkorn University of Thailand was note worthy. Inthe after noon Br. Rah Joon-hwan, Coordinator for sector& Research Activities, UNI APRO has delat the topic of'Economic Crisis impact on UNI affiliates and PostalBusiness in Asean.

Thereafter, the participants were divided in toregional groups (Aseam, East Asia, South Asia &Thailand) and discussed to make presentations on 'Whatthe impacts of Economiccrisis on Post & Logisticservices & How can post &Logistics services tacklewith the Economic crisis.On behalf of India, Nepal &Sri Lanka forming theSouth Asian Contingent,General Secretary Com. K.V. Sridharan made the presentation.

On 11.06.2009 morning the Representation ofThailand Post explained about the improvement onPostal logistic Services and its three fold expansion withinsix years. Interactions revealed many facts about theThailand Posts.

In the afternoon,the representatives werepresented their groupdiscussions on the topicand it was the uniqueexperience to present ourstrong views to keep thePostal as GovernmentService in the midst of many advocates of privatization,corporatization policies.

The General Secretary made a powerfulpresentation about our organizational status in the IndiaPost, challenges, the impact of globalization on Indianworking class, our future plans etc. The adverse impactof globalization could be very well seen in the Postalservices adopting its policies in other countries.

On 11.06.09, Broter Eiichi, ITO Director of UNIApro Post & logisticsparticipated in the farewelldinner and exchanged theviews of the UNI with allparticipants on all issues.The services of sister YokoMarikawa, Staff of UNI AproTokyo office is simplysuperb and ever

rememebrable.The participation of the seminars is no doubt

very purposeful to exchange the views of other countriesparticipants and to know about their services and the roleof Postal Trade Unions in protecting the interest of thetheir workers.

OUR OBSERVATIONS ABOUT THE FUNCTIONS OFPOST OFFICES IN OTHER COUNTRIES

KOREAAt present, the Postal Service is a Government

organization and the New Government has recentlyannounced the necessity of corporatization of PostalServices. Letter mails is the monopoly of Post officesand brought under universal service with reasonablerates. Korea post is under the Ministry of Knowledge.Korea post set up the price of Postal products andGovernment set up the basic Postal rates.

Basic Standard of the speed of the Delivery: -Non priority D+3 Priority D+1 Korea Post is a governmentprofit making organization. During 2007, it had the earningof 24300 billion won by Postal business and Rs.20901billion won by Financial Business. The expenditure was22857 & 19914 billion Won. It was 25409 & 24336 BillionWon earning during 2008 while the expenditure was25010 & 24192 billion Wons in Postal & financialbusiness respectively.INDONESIA

Postal Service has been corporatized since 20June 1995. It is being considered for privatization in 2010.However 100% share still belongs to Government.Monopoly of letters is retained upto 500 grams. Ministryof Information of Communication is the regulatoryauthority. Same Day delivery & Next Day delivery (D+O &D+I) is in existence. During 2008, it was having the netloss to the extent of IDR 57.90 billions.PHILIPPINES

The Postal is corporatized on 03.04.1992 andnow it is included in the privatization list of Governmentoffices/agencies. It operates 60% and the private couriersare controlling 40% of remaining traffic. The employeesof the Phil Post are treated as civil servants enjoying allbenefits, rights and privileges like other Governmentemployees. In the total work force, 88% are rank & fileemployees and 12% are supervisors & managers.Commission on Information and communicationTechnology (CKT) is the main regulator of Phil Post. Thebasic standard of delivery is prescribed as D+1 for local& intra region mails and D+3 for inter - regional mails.SINGAPORE

The Service is corporatized since 2003 andfurther liberalized from 01.04.2007. The monopoly ofdelivery has been reserved for the articles weighting500gms and below for domestic & international mails.Singpost is designated as Public Postal Licensee andthe Info - Communications Development Authority ofSingapore will be the regulator of Singpost. It was havingthe revenue of 5 $ 472.6 Million and operating profit of $

175.3 M for the financial year ending 31.03.2008. 99%mails are delivery by next working day within & outsideCBD areas.THAILAND

It is corporatized during 2003 under the name ofThailand Post Co. Ltd. Privatization is under consideration.Now Thai Government is 100% share holder and it is aState owned enterprise. It is under the Ministry ofInformation & Communication technology. Thai Post isthe monopoly in communication market in respect ofletters and Post cards. After corporatization it has 300%revenue increase and more profits in logistic services.The standard of delivery stipulated as D+1 for local,Regional to regional D+2. Allowance for child Birth is thenew area introduced to the employees as one of the fringebenefits.VIETNAM

Postal Service of Vietnam is corporatized during1990. There is no consideration for its privatization.Vietnam Post works under the Law on companies &Ministry of Information & Communication is the regulatorof Postal Services. However the Vietnam Post allowsprivate agents to deliver Postal articles to end-usersthroughout the country. This is having only 50% marketonly. The remaining traffic are handled by Viettel & SaigonPost Private operators. Under the Law, Vietnam Post hasto pay a part of its income to the state. The Governmentalso facilitates financial assistance (as soft loans) forinfrastructure and for the favourable policies to theVietnam Post.

Basic standard for delivery is D+1 for local & D+2for others. Rewards on the Occasion of Festivals, NewYear, cash prizes for increase in the production are the twonew areas in respect of fringe benefits to its employees.NEPAL

There is a proposal for corporatization of PostalServices. Now it is a Government department. TheExpenditure for last financial year was 86, 25, 73, 675whereas the revenue stands as 23,10,50,729. The Postalworkers have no additional holidays. However they arereceiving one month extra salary per year. The ExtraDepartmental Employees are the most exploited labourwith lesser pay equal to Rs.1000/- to 1500/- per monthwithout any other benefits.SRI LANKAIt is the Government owned Department and there is noproposal for privatization or Corporatization. For lettermails, Postal Service is retaining the total monopoly. Totalincome $ 39.82 (Million) Expenditure $ 62.76 & Deficit $22.94 & (Million).

SOME INTERESTING INFORMATIONS - WITHOUTCOMMENTS

v Thailand Post is not recruiting any workers overthree years. Temporary workers sponspored by privatecompanies are being engaged for two months andthereafter by subsequent renewals for same periods of twomonths. More Temporary employees are now in the rolls.

v Collective bargaining is applied only for 'breadand butter' issues in Thailand. Right for collectivebargaining and freedom of association is not applied forCivil Servants, Schools and university staff.v Sri Lanka Postal Service is launching its owntelegraph service to compete with the Sri Lanka Telecom.Both are Government departments.v As a National Policy, Sri Lanka Governmentannounced that the Postal Service is a State Service andthere will not be any corporatization or privatization.v In Thailand, total number of Post offices is 1233.Whereas it is having 3364 licensed Post offices; Postagestamp agencies 2188; Franchise Post offices 23.v There are 657,000 Post offices world wide; 191member countries: 5.549 million Postal Employees. USAhandles top in the mail volumes; France stands second.v Rationalization plan in philiphines starts inOctober 2009 and 2000 employees will be effected byretrenchment or voluntary retirement. This is due torecession of economic policy.v Thailand Post outsourced the Track & TraceSystem. For each transaction, money is disbursed to thecompanies.v Korea Post introduced internet banking during2000. Now Korea Post Bank is number 1 while comparingother leading banks of its country.v In Pakistan, for recruitment of Postman, arunning test will be conducted among the candidatesand one has to run 1 Km. within six minutes. Similarly heshould possess a motor cycle licence.v 'Post Foundations' was formed during 1981 byPostal pensioners in Pakistan. Now this is the biggestorganization than postal and deals printing, Steels,Fabrications, Furnitures, wools etc. it started it functionby supplying uniforms to Army and Furniture to schools.v Now the Director General, Pakistan Post is thehonorary Chair person of the Postal Foundations and thePakistan Post & its employees are being subsidized by thePost Foundations. The employees are given marriage gift

free furnitures for marriage, Education fees to children etc.v The Post Foundation of Pakistan provided jobsto the wards of the Postal employees to the extent of45%. It provided free housing to the Postal officials; Oldage pension to discharged ED Agents.v The Extra Departmental Employees of Pakistanare being paid Rs.2000/- per month. No leave; Nomedical; No pension; No civil status; No DA. It is only theconsolidated amount. The EDAs may opt to for to workcommission basis at the same Bo by quitting from thepost if it is advantageous.v Thailand post has outsourced its transport. Thevehicles being used by the contractors should not bemore than 7 years old. But in Philippines, the departmentalvehicles are used and managed on their own. Sri Lankais planning to ply more public services on its own.v In Korea Post, there is no recruitment over twoyears. The workers are engaged on contract basis.v In Pakistan, the Post was corporatized during1992. Business went down. There was huge expenditureafter corporatization. It was brought back as GovernmentService during 1996. Six to seven months, the postmenwere asked to work for 4 hours on Government duty forhalf pay and remaining period in private job. Ban oncreation of posts is continuing in Pakistan over ten years.v In the survey conducted on health hazard topostmen, it was found that 16% postmen are sufferingwith tuberculosis; 12% Hepatitis B, 7% Hepatitis C, 16%throat problems. Therefore Postal Foundation is providingone glass of milk in the morning and one glass lemonjuice in the evening to all postmen.v In Pakistan, providing security guards, workrelated to conveyance of cash and upkeep of office wereoutsourced in the Postal department.

In the process of workforce planning, to reducethe labour supply, 'inducement to quit' is one of the option(i.e.) making the employees to fed up due to overwork orbad environment and make them to decide quitting theorganization.

MODIFIED ACP PROMOTIONSModified ACP scheme ensures three Financial upgradations on completion of 10, 20 & 30 years ofservice with effect from 01.09.2008. We have opted for the modified ACP scheme and communicatedour consent to the Department on 28.05.08. The DOPT OM No. 35034/3/2008-Estt (D) dt. 19.0509 onMACPs is reproduced hereunder: -

OFFICE MEMORANDUM

l MODIFIED ASSURED CAREER PROGRESSIONSCHEME (MACPS) FOR THE CENTRAL GOVERNMENTCIVILIAN EMPLOYEES.

The Sixth Central Pay Commission in Para6.1.15 of its report , has recommended Modified AssuredCareer Progression Scheme (MACPS). As per therecommendations, financial upgradation will be availablein the next higher grade pay whenever an employee hascompleted 12 years continuous service in the samegrade. However, not more than two financial upgradationsshall be given in the entire career, as was provided in theprevious Scheme. The Scheme will also be available toall posts belonging to Group "A" whether isolated or not.However, organized Group "A" services will not be coveredunder the Scheme.

2. The Government has considered therecommendations of theSixth Central Pay Commissionfor introduction of a MACPS and has accepted the samewith further modification to grant three financialupgradations under the MACPS at intervals of 10, 20 and30 years of continuous regular service.

3. The Scheme would be known as "MODIFIEDASSURED CAREER PROGRESSION. SCHEME (MACPS)FOR THE CENTRAL GOVERNMENT CIVILIANEMPLOYEES. This Scheme is in supersession ofprevious ACP Scheme and clarifications issued thereunder and shall be applicable to all regularly appointedGroup "A", "B", and "C" Central Government CivilianEmployees except officers of the Organised Group "A"Service. The status of Group "D" employees would ceaseon their completion of prescribed training, asrecommended by the Sixth Central Pay Commission andwould be treated as Group "C" employees. Casualemployees, including those granted 'temporary status'and employees appointed in the Government only onadhoc or contract basis shall not qualify for benefits underthe aforesaid Scheme. The details of the MACP Schemeand conditions for grant of the financial upgradation underthe Scheme are given in Annexure-1.

4. An Screening Committee shall be constituted ineach Department to consider the case for grant of financialupgradations under the MACP Scheme. The ScreeningCommittee shall consist of a Chairperson and twomembers. The members of the Committee shallcomprise officers holding posts which are at least onelevel above the grade in which the MACP is to beconsidered and not below the rank of Under Secretaryequivalent in the Government. The Chairperson should

generally be a grade above the members of theCommittee.

5. The recommendations of the ScreeningCommittee shall be placed before the Secretary in caseswhere the Committee is constituted in the Ministry/Department or before the Head of the organisation/competent authority in other cases for approval.

6. In order to prevent undue strain on theadministrative machinery, the Screening Committee shallfollow a time-schedule and meet twice in a financial year- preferably in the first week of January and first week ofJuly of a year for advance processing of the casesmaturing in that half. Accordingly, cases maturing duringthe first-half (April-September) of a particular financial yearshall be taken up for consideration by the ScreeningCommittee meeting in the first week of January. Similarly,the Screening Committee meeting in the first week ofJuly of any financial year shall process the cases thatwould be maturing during the second-half (October-March) of the same financial year.7. However, to make the MACP Schemeoperational, the Cadre Controlling Authorities shallconstitute the first Screening Committee within a monthfrom the date of issue of these instructions to considerthe cases maturing upto 30th June, 2009 for grant ofbenefits under the MACPS.8. In so far as persons serving in The Indian Auditand Accounts Departments are concerned, these ordersissue after consultation with the Comptroller and AuditorGeneral of India.9. Any interpretation/clarification of doubt as to thescope and meaning of the provisions of the MACPScheme shall be given by the Department of Personneland Training (Establishment-D). The scheme would beoperational w.e.f. 01.09.2008. In other words, financialupgradations as per the provisions of the earlier ACPScheme (of August, 1999) would be granted till 31.08.2008.10. No stepping up of pay in the pay band or gradepay would be admissible with regard to junior gettingmore pay than the senior on account of pay fixation underMACP Scheme.11. It is clarified that no past cases would be re-opened. Further, while implementing the MACP Scheme,the differences in pay scales on account of grant offinancial upgradation under the old ACP Scheme (ofAugust 1999) and under the MACP Scheme within thesame cadre shall not be construed as an anomaly.

(MACPS)

1. There shall be three financial upgradation asunder the MACPS, counted from the direct entry grade oncompletion of 10, 20 and 30 years service respectively.Financial upgradation under the Scheme will beadmissible whenever a person has spent 10 yearscontinuously in the same grade-pay.

2. The MACPS envisages merely placement in theimmediate next higher grade pay in the hierarchy of therecommended revised pay bands and grade pay as givenin Section 1, Part-A of the first schedule of the CCS(Revised pay) Rules, 2008. Thus, the grade pay at thetime of financial upgradation under the MACPS can, incertain cases where regular promotion is not betweentwo successive grades, be different than what is availableat the time of regular promotion. In such cases, the highergrade pay attached to the next promotion post in thehierarchy of the concerned cadre/organization will begiven only at the time of regular promotion.

3. The financial upgradations under the MACPSwould be admissible up-to the highest grade pay of Rs.12000/- in the PB-4.

4. Benefit of pay fixation available at the time ofregular promotion shall also be allowed at the time offinancial upgradation under the Scheme. Therefore, thepay shall be raised by 3% of the total pay in the pay bandand the grade pay drawn before such upgradation. Thereshall, however, be no further fixation of pay at the time ofregular promotion if it is in the same grade pay as grantedunder MACPS. However, at the time of actual promotion ifit happens to be in a post carrying higher grade pay thanwhat is available under MACPS, no pay fixation would beavailable and only difference of grade pay would be madeavailable. To illustrate, in case a Government Servantjoins as a direct recruit in the grade pay of Rs. 1900 inPB-1 and he gets no promotion till completion of 10years of service, he will be granted financial upgradationunder MACPS in the next higher grade pay of Rs. 2000and his pay will be fixed by granting him one incrementplus the difference of grade pay (i.e. Rs. 100). Afteravailing financial upgradation under MACPS, if theGovernment servant gets his regular promotion in thehierarechy of his cadre, which is to the grade of Rs.2400, on regular promotion, he will only be granted thedifference of grade pay between Rs. 2000 and Rs. 2400.No additional increment will be granted at this stage.

5. Promotions earned/upgradations granted underthe ACP Scheme in the past to those grades which nowcarry the same grade pay due to merger of pay scales/upgradations of posts recommended by the Sixth PayCommission shall be ignored for the purpose of grantingupgradations under Modified ACPS.

Illustration-I

The pre-revised hierarchy (in ascending order)in a particular organization was as under :-

Rs. 5000-8000, Rs. 5500-9000 & Rs. 6500-10500

(a) A Government servant who was recruited in thehierarchy in the pre-revised pay scale Rs. 5000-8000 andwho did not get a promotion even after 25 years of serviceprior to 1.1.2006, in his case as on 1.1.2006 he wouldhave got two financial upgradations under ACP to thenext grades in the hierarchy of his organization, i.e., to thepre-revised scales of Rs. 5500-9000 and Rs. 6500-10500.

(b) Another Government servant recruited in thesame hierarchy in the pre-revised scale of Rs. 5000-8000has also completed about 25 years of service, but he gottwo promotions to the next higher grades of Rs. 5500-9000 and Rs. 6500-10500 during this period.

In the case of both (a) and (b) above, thepromotions/financial upgradations granted under ACP tothe pre-revised scales of Rs. 5500-9000 and Rs. 6500-10500 prior to 1.1.2006 will be ignored on account ofmerger of the pre-revised scales of Rs. 5000-8000, Rs.5500-9000 and Rs. 6500-10500 recommended by theSixth Pay Commission. As per CCS (RP) Rules, both ofthem will be granted grade pay of Rs. 4200 in the payband PB-2. After the implementation of MACPS, twofinancial upgradations will be granted both in the case of(a) and (b) above to the next higher grade pays of Rs.4600 and Rs. 4800 in the pay band PB-2.

6. In the case of all the employees granted financialupgradations under ACPS till 01.01.2006, their revisedpay will be fixed with reference to the pay scale granted tothem under the ACPS.

6.1 In the case of ACP upgradations grantedbetween 01.01.2006 and 31.08.2008, the Governmentservant has the option under the CCS (RP) Rules, 2008to have his pay fixed in the revised pay structure either (a)w.e.f. 01.01.2006 with reference to his pre-revised scaleas on 01.01.2006; or (b) w.e.f. the date of his financialupgradation under ACP with reference to the pre-revisedscale granted under ACP. In case of option (b), he shallbe entitled to draw his arrears of pay only from the date ofhis option i.e. the date of financial upgradation underACP.

6.2 In case where financial upgradation had beengranted to Government servants in the next higher scalein the hierarchy of their cadre as per the provisions of theACP Scheme of August, 1999, but whereas as a result ofthe implementation of Sixth CPC's recommendations,the next higher post in the hierarchy of the cadre hasbeen upgraded by granting a higher grade pay, the pay ofsuch employees in the revised pay structure will be fixedwith reference to the higher grade pay granted to the post.To illustrate, in the case of Jr. Engineer in CPWD, whowas granted 1st ACP in his hierarchy to the grade ofAsstt. Engineer in the pre-revised scale of Rs. 6500-10500 corresponding to the revised grade pay of Rs.4200 in the pay band PB-2, he will now be granted grade

pay of Rs. 4600 in the pay band PB-2 consequent uponupgradation of the post of Asstt. Enggs. In CPWD bygranting them the grade pay of Rs. 4600 in PB-2 as aresult of Sixth CPC's recommendation. However, fromthe date of implementation of the MACPS, all thefinancial upgradations under the Scheme should bedone strictly in accordance with the hierarchy of gradepays in pay bands as notified vide CCS (Revised Pay)Rules, 2008.

7. With regard to fixation of his pay on grant ofpromotion/financial upgradation under MACP Scheme, aGovernment servant has an option under FR22 (I) (a) (I)to get his pay fixed in the higher post/grade pay eitherfrom the date of his promotion/upgradation or from thedate of his next increment viz. 1st July of the year. The payand the date of increment would be fixed in accordancewith clarification no.2 of Department of Expenditure'sO.M.No.1/1/2008-IC dated 13.09.2008.

8. Promotions earned in the post carrying samegrade pay in the promotional hierarchy as per RecruitmentRules shall be counted for the purpose of MACPS.

8.1 Consequent upon the implementation of SixthCPC's recommendations, grade pay of Rs. 5400 is nowin two pay bands viz., PB-2 and PB-3. The grade pay ofRs. 5400 in PB-2 and Rs. 5400 in PB-3 shall be treatedas separate grade pays for the purpose of grant ofupgradations under MACP Scheme.

9. 'Regular service' for the purposes of the MACPSshall commence from the date of joining of a post indirect entry grade on a regular basis either on directrecruitment basis or on absorption/re-employment basis.Service rendered on adhoc/contract basis before regularappointment on pre-appointment training shall not betaken into reckoning. However, past continuous regularservice in another Government Department in a postcarrying same grade pay prior to regular appointment ina new Department, without a break, shall also be countedtowards qualifying regular service for the purpose ofMACPS only (and not for the regular promotions). However,benefits under the MACPS in such cases shall not beconsidered till the satisfactory completion of the probationperiod in the new post.

10. Past service rendered by a Governmentemployee in a State Government/statutory body/Autonomous body/Public Sector organization, beforeappointment in the Government shall not be countedtowards Regular Service.

11. 'Regular service' shall include all periods spenton deputation/foreign service, study leave and all otherkind of leave, duly sanctioned by the competent authority.

12. The MACPS shall also be applicable to workcharged employees, if their service conditions arecomparable with the staff of regular establishment.

13. Existing time-bound promotion scheme,including in-situ promotion scheme, Staff Car Driver

Scheme or any other kind of promotion scheme existingfor a particular category of employees in a Ministry/Department or its offices, may continue to be operationalfor the concerned category of employees if it is decidedby the concerned administrative authorities to retain suchSchemes, after necessary consultations or they mayswitch-over to the MACPS. However, these Schemes shallnot run concurrently with the MACPS.

14. The MACPS is directly applicable only to CentralGovernment Civilian employees. It will not getautomatically extended to employees of CentralAutonomous/Statutory Bodies under the administrativecontrol of a Ministry/Department. Keeping in view thefinancial implications involved, a conscious decision inthis regard shall have to be taken by the respectiveGoverning Body/Board of Directors and the administrativeMinistry concerned and where it is proposed to adopt theMACPS, prior concurrence of Ministry of Finance shall beobtained.

15. If a financial upgradations under the MACPS isdeferred and not allowed after 10 years in a grade pay,due to the reason of the employees being unfit or due todepartmental proceedings, etc. this would haveconsequential effect on the subsequent financialupgradation which would also get deferred to the extentof delay in grant of first financial upgradation.

16. On grant of financial upgradation under theScheme, there shall be no change in the designation,classification or higher status. However, financial andcertain other benefits which are linked to the pay drawnby an employee such as HBA, allotment of Governmentaccommodation shall be permitted.

17. The financial upgradation would be on non-functional basis subject to fitness, in the hierarchy ofgrade pay within the PB-1. Thereafter for upgradationunder the MACPS the benchmark of 'good' would beapplicable till the grade pay of Rs. 6600/- in PB-3. Thebenchmark will be 'Very Good' for financial upgradation tothe grade pay of Rs. 7600 and above.

18. In the matter of disciplinary/penalty proceedings,grant of benefit under the MACPS shall be subject to rulesgoverning normal promotion. Such cases shall, therefore,be regulated under the provisions of the CCS(CCA)Rules, 1965 and instructions issued there under.

19. The MACPS contemplates merely placement onpersonal basis in the immediate higher Grade pay/grantof financial benefits only and shall not amount to actual/functional promotion of the employees concerned.Therefore, no reservation orders/roster shall apply to theMACPS, which shall extend its benefits uniformly to alleligible SC/ST employees also. However, the rules ofreservation in promotion shall be ensured at the time ofregular promotion. For this reason, it shall not bemandatory to associate members of SC/ST in theScreening Committee meant to consider cases for grant

of financial upgradation under the Scheme.

20. Financial upgradation under the MACPS shallbe purely personal to the employee and shall have norelevance to his seniority position. As such, there shallbe no additional financial upgradation for the senioremployees on the ground that the junior employee in thegrade has got higher pay/grade pay under the MACPS.

21. Pay drawn in the pay band and the grade payallowed under the MACPS shall be taken as the basis fordetermining the terminal benefits in respect of the retiringemployee.

22. If Group "A" Government employee, who wasnot covered under the ACP Scheme has now becomeentitled to say third financial upgradation directly, havingcompleted 30 year's regular service, his pay shall be fixedsuccessively in next three immediate higher grade paysin the hierarchy of revised pay-bands and grade paysallowing the benefit of 3% pay fixation at every stage. Payof persons becoming eligible for second financialupgradation may also be fixed accordingly.

23. In case an employee is declared surplus in his/her organization and appointed in the same pay-scale orlower scale of pay in the new organization, the regularservice rendered by him/her in the previous organizationshall be counted towards the regular service in his/hernew organization for the purpose of giving financialupgradation under the MACPS.

24. In case of an employee after getting promotion/ACP seeks unilateral transfer on a lower post or lowerscale, he will be entitled only for second and third financialupgradations on completion of 20/30 years of regularservice under the MACPS, as the case may be, from thedate of his initial appointment to the post in the neworganization.

25. If a regular promotion has been offered but wasrefused by the employee before becoming entitled to afinancial upgradation, no financial upgradaion shall beallowed as such an employee has not been stagnateddue to lack of opportunities. If, however, financialupgradation has been allowed due to stagnation and theemployees subsequently refuse the promotion, it shallnot be a ground to withdraw the financial upgradation. Heshall, however, not be eligible to be considered for furtherfinancial upgradation till he agrees to be considered forpromotion again and the second the next financialupgradation shall also be deferred to the extent of periodof debarment due to the refusal.

26. Cases of persons holding higher posts purelyon adhoc basis shall also be considered by the ScreeningCommittee alongwith others. They may be allowed thebenefit of financial upgradation on reversion to the lowerpost or if it is beneficial vis-à-vis the pay drawn on adhocbasis.

27. Employees on deputation need not revert to theparent Department for availaing the benefit of financial

upgradation under the MACPS. They may exercise a freshoption to draw the pay in the pay band and the grade payof the post held by them or the pay plus grade payadmissible to them under the MACPS, whichever isbeneficial.

28. Illustrations

A. (i) If a Government servant (LDC) in PB-1in the Grade Pay of Rs. 1900 gets his first regularpromotion (UDC) in the PB-1 in the Grade Pay of Rs.2400 on completion of 8 years of service and thencontinues in the same Grade Pay for further 10 yearswithout any promotion then he would be eligible for 2ndfinancial upgradation under the MACPS in the PB-1 in theGrade Pay of Rs. 2800 after completion of 18 years (8+10years).

(ii) In case he does not get any promotionthereafter, then he would get 3rd financial upgradation inthe PB-II in the Grade Pay of Rs. 4200 on completion offurther 10 years of service i.e. after 28 years (8+10+10).

(iii) However, if he gets 2nd promotion after5 years of further service in the pay PB-II in the Grade Payof Rs. 4200 (Asstt. Grade/Grade "C") i.e. on completion of23 years (8+10+5 years) then he would get 3rd financialupgradation after completion of 30 years i.e. 10 yearsafter the 2nd ACP in the PB-II in the Grade Pay of Rs.4600.

In the above scenario, the pay shall be raised by3% of the total pay in the Pay Band and Grade Pay drawnbefore such upgradation. There shall, however, be nofurther fixation of pay at th time of regular promotion if it isin the same Grade Pay or in the higher Grade Pay. Onlythe difference of grade pay would be admissible at thtime of promotions.

B. If a Government servant (LDC) in PB-I in theGrade Pay of Rs. 1900 is granted 1st financialupgradation under the MACPS on completion of 10 yearsof service in the PB-I in the Grade Pay of Rs. 2000 and 5years later he gets 1st regular promotion (UDC) in PB-I inthe Grade Pay of Rs. 2400, the 2nd financial upgradationunder MACPS (in the next Grade Pay w.r.t. Grade pay heldby Government servant) will be granted on completion of20 years of service in PB-I in the Grade Pay of Rs. 2800.On completion of 30 years of service, he will get 3rd ACPin the Grade Pay of Rs. 4200. However, if two promotionsare earned before completion of 20 years, only 3rd financialupgradation would be admissible on completion of 10years of service in Grade Pay from the date 2nd promotionor at 30th years of service, whichever is earlier.

C. If a Government servant has been granted eithertwo regular promotions or 2nd financial upgradationunder the ACP Scheme of August, 1999 after completionof 24 years of regular service then only 3rd financialupgradation would be admissible to him under the MACPSon completion of 30 years of service provided that he hasnot earned third promotion in the hierarchy.

Apropos reference, I wish to inform that exceptin Chattisgarh Circle, the work related to Speed PostCentres are being entrusted only with the RMS in order toensure cent percent perfection in sorting & dispatchingarticle. But work has been totally entrusted with the Postoffice staff only in this Circle.

As there is acute shortage of staff alreadyprevailing in the Postal operative offices, the attachmentof sorting office work of post offices has further aggrevatedthe sufferings of Postal staff due to unbearable work load.If the work is transferred to RMS, it will not only ensurebetter and effective control of operation but also to givesome relief to the operative staff of Post offices who aresuffering with heavy work brunt. It will further ensure theuniform observation of the work related to Speed Postcentres throughout the nation.

It is therefore requested to kindly consider theissue and cause appropriate orders at the earliest.

lllll Problems of System Administrators - Reg.

While appreciating the kind gesture of theDepartment in taking up a proposal for augmentation ofseparate establishment of System Administrators andrecognise the services of the existing SystemAdministrators, it is requested to consider the followingon a war footing basis.

1. Issue uniform Duties & responsibilities to the

System Administrators:-

At the transition stage of introduction ofcomputers in post offices, the Circle heads wereinstructed to fix duties and responsibilities for their circleson their own. This has resulted in various contradictionsand this varies even among the regions in the same circle.The voluminous duty and responsibilities assigned toSystem Administrators by PMG, Tamil Nadu SouthernRegion and the copy of which is enclosed for your kindperusal. There are some impractical responsibilities,which are given to the System Administrators with a soleintention of fixing the System Administrator in the event ofany shortcomings. It should be noted that this order hasbeen given after the SB fraud reported from the Region inVedasandur P.O, Dindigul division. A uniform viable duties

LETTERS TO DEPARTMENT& responsibilities across the country may be circulatedfrom the directorate.

2. Avoid harassing the System Administrators:-

All the work pressure given to the divisional heads due tothe implementation of eMO and for the project arrowoffices are directly pushed into the System Administratorsby the divisional heads and in some cases by the regionaldirectors. All this responsibility should be shouldered bythe middle level management officers but which aredirectly passed on to the System Administrators. Forinstance the delivery of eMOs was asked to monitor bythe System Administrator for the sole reason it appearsin the web site. This leads to a lot of pressure &unbearable work load to the System Administrators.Suitable instructions may be issued to all circle headsthat the responsibilities fixed on the Aspos/IPos/Postmasters should not be transferred unofficially to theSystem Administrators.

3. Providing laptop to the SystemAdministrators:-

The department is issuing a lot of software andpatches very frequently and there is already shortage ofcomputers in all the post offices. The system managersfind it very difficult to download & test the given patchesand software with the non-availability of the systems. Alaptop may be provided to the System Administrator whichwill not only ensure smooth facilitation of the aboveprocess but also facilitates the mobility aspect.

4. Provide installation / upgradation incentives tothe System Administrators:-

New software and upgradation of new modulesare frequently released by the department and this has tobe installed in all the computerised offices and this hasto be done only after the closing hours of the office whichin many cases is 7 pm. In the above scenario theinstallation / upgradation gets completed by 11pm to 12pm. There is no monetary or any other compensationgiven for this work in late night hours. Worst part is it isnot even noticed by the divisional administration or by thePost masters concerned since this work is done in thereabsence. An installation / upgradation incentives or someother feasible monetary compensations should beworked out and communicated to all circles which willmotivate the above process & will also avoid the backlogof the updated versions prevailing in the various offices.

5. Provide training allowance / honorarium to theSystem Administrators for imparting training atWCTCs:-

The System Administrators are engaged by theregional & divisional administration to impart variouscomputer related trainings at the respective WCTCs. No

kind of monetary compensation in the form of trainingallowance / honorarium is paid for them. Suitableinstructions may be issued to the circle heads to puruseon this issue and provide the feasible to the SystemAdministrators who are deputed for imparting training atWCTCs.

6. Provide accidental insurance to the SystemAdministrators :-

The System Administrators in the divisions travelextensively through two-wheelers to attend the technicalproblems irrespective of the climatic conditions. Thiscannot be compared with some other field staff alreadyin the department considering the account of the urgencyof the issues. There are many cases where the SystemAdministrators meeting with minor & major accidents. Anaccidental insurance package by the department may begiven to the System Administrators.

It is therefore requested to cause necessaryorders to this effect at the earliest convenience.

Instances are being brought from Tambaram &Kovilpatti Divisions in Tamilnadu Circle. The Divisionalheads have not granted child care leave to the employeesdespite fulfilling the conditions. It is further learnt that somedivisional heads are insisting the women employees toproceed on EXOL in continuation of maternity leave insteadof granting Child care leave which is highly irregular.

Suitable instructions may please be caused tocircle heads not to deny the child care leave if theemployees have no leave at their credit.

This union is constrained to note that themisdeeds and misdemeanous of the divisional head ofNamakkal division are crossing all levels of toleranceand limits. The irregular appointments of GDS that invitedwrath from the R.O which directed cancellation of suchappointment orders is a print in case.

The criss-cross R. T. orders issued has createddiscontentment amongst officials. Even the DivisionalPresident was transferred out of the divisional union'sjurisdiction and posted to Tiruchengodu sidelining therequirements of the organization. He has appealedagainst this unjust orders which is yet to be disposed of.

His various acts of setting right the grievancesof the employees routed through certain employees whoact as his power agents by way of behind the sceneoperations is creating lot of suspicion in the minds ofemployees.

lllll Ordering all Holidays and Sundays as Workingdays against the ILO norms - case of divisions underChennai City region in Tamilnadu Circle.

Recently, the regional administration of ChennaiCity region has ordered to deliver Speed Post articles onSundays and Holidays. Accordingly, many designatedPost offices are being kept open on Sundays andHolidays. Simultaneously, certain offices were orderedto keep open of MPCM Counters too. When the matterwas taken up by the circle Unions with the RegionalAdministration explaining the non-viability of MPCMcounters financially, it was accepted that the countertransactions would be exempted. Some offices got therelief too. But, as far the delivery branch is concerned, theRegistered articles are also now ordered to be issuedfor delivery even on Sundays and holidays. For thispurpose, a supervisor, system administrator, couple ofclerical staff and Group 'D' staff along with delivery staffare being brought to office on Sundays and holidays.

This effectively makes that the Post Office tofunction throughout the year without a break. This is verymuch against the labour laws of our country and the muchhyped ILO norms as the recent move snatches away theweekly off from the employees. The grant of C-OFF isonly on paper as its implementation creates furtherproblems on week days owing to acute andunmanageable staff strength.

It is therefore requested to review the entirethings and cause appropriate action to drop such delivery/counter work on Sundays and holidays except the speedPost as a special case in the interest of the departmenttill the normal staff strength is restored in the operative

It is intimated that in offices under Chennai CityRegion, the OAP money orders are ordered to be bookedand delivered as eMOs. At booking point no majorproblem is witnessed. But at delivery point many problemsare being faced. We list below the problems.

1. Owing to non-availability of high speed printers, thethousands of MOs received for payments underthe OAP could not be printed quickly resulting indelay in payment of Mos. Hence, the recipients ofsuch Mos who are the beneficiaries of Govt'sbenevolent scheme are agitated over the delaycaused.

2. The over workload on the existing printers makethem jammed and other branch work also suffersdue to this.

3. As nearly 35% of such MOs are withdrawn, thesame has to be redirected. Redirection is timeconsuming and tedious because long hours haveto be spent on the systems for this work.

4. The compulsion imposed to effecting paymentwithout delay and so many impractical instructionslike returning the MOs to the sender after 3 daysand issuing only those MOs which could be paidare very much against customer interest and ourmotive to serve them better. The aged beneficiarieswho are receiving the money sent by the StateGovernment to alleviate their poverty are beingdenied their benefit if they could not receive thepayment within 3 days thereby defeating thebenevolent scheme of the Government

5. 18 digits of eMO involves exhaustive work whiletaking returns. It consumes more hours to feed thereturns resulting need of more man power

6. Deposit Money Orders are shown only asDESPATCHED and the MO disappears in thescreen. During the days acute shortage this workinvolved unnecessary repetition of work on thesystem.

7. The sub standard quality of papers used to takeprint out would prove preserving it very difficult.

8. The flimsy portion of acknowledgement makes it acasualty and the senders seldom get theacknowledgment portion.

9. The font size on the eMO is so small and print is

invisible

10. Above all, it incurs perennial loss to the Departmentin the means of stationary, printing cost etc sincethe OAP money orders are now supplied on E formby the State Government. A huge exchequer of theDepartment will be drained in booking of such OAPmoney orders through e-MOs.

It is requested to intervene and ensure thatspeedy action may be taken to mitigate the problemslisted above and drop the system of booking of OAPmoney orders under e-MOs.

In accordance with the letter No.95-25/2003-SBC (P) (FS Division) dt. 28.11.03 the incentive for retailingMutual Funds and Bonds granted to the Postal Assistant& Supervisor has been restricted to the individualemployees to the extent of not exceeding 1/3 of his Basicpay plus DA in a year.

Similarly in respect of individual employees, whomobilized more threshold will not be granted any incentiveup to 1.5 lakh per year.

Further, it is dismayed to note that even after thereceipt of commission from the Mutual fund companiesto Department of Post like SBI, MIF, Reliance M/F, PrincipalM./F, the commission due to the officials over three yearshave not been paid to the officials so far causingdemotivation and a concern.

It is pertinent to note that the officials whopossess AMFI certificate for dealing mutual funds andbonds are entitled for the commission to the extent of25% and out of which, the above said two conditions arecurtailed their due incentives which is one of the factorsdemotivating the employees who are denied of their duesbecause of these conditions.

There is no such condition is in existence inrespect of PLI Development officers. They are entitled forfull commission. As such restricting the due incentive byimposing such conditions is arbitrary and unjust.

It is requested to consider the same and removethe two conditions stated is pre paras and pay dueincentives to the employees without any restriction as ifpaid to PLI Development officers which will motivate theemployees to canvas more business in this area.

It is therefore requested to cause considerationof our request in removing the ceiling and also effect

payment of commission bills to the officials for the workperformed on mutual funds.

This is highly ridiculous and causing a seriousconcern. The SSPOs has flouted all the norms and orderson the subject. When the officials completing tenure areentitled for TA/DA even on own requests as per the MOForders, seeking such declarations is arbitrary, unjust andagainst to the provisions of Government orders.

It is requested to intervene and set right mattersand if such insistence of undertaking for transfer &postings is sought for, this will disturb the peace andamity prevailing hitherto and cause immediate action toarrest such unwarranted autocrat stylish attitude of suchdivisional administrations.

Things are becoming bad to worst and theunbridled horse style functioning of the said officer hasnot been arrested so far. There is a total panic and unrestprevailing in the division.

This is arbitrary and against to the FinanceMinistry's instructions contained in letter No. G I MF (CGA)OM No. 1 (1)/2005/TA/42-45 dt. 24.01.2006 where in it isclarified that the salary of the government employees shallbe allowed to be drawn and paid in cash irrespective oftheir grade and scale.

Com. P. J. Patel, Divisional Secretary,Mahesana sought information under RTI Act aboutthe norm based LSG and its present position of hisdivision. The PIO, the SPOs, Mahesana refused tofurnish such informations as they are not in publicinterest and further commented that calling informationunder RTI Act is sheer misuse of the Act and alsotried to abuse his position of staff representative ashe used union letter head. He further cautioned theDivisional Secretary to refrain from such act ofmisconduct thereafter.

Com. P. J. Patel appealed to Chief PMG andthe Appellete Authority has directed the SPOs to

UNION REPRESENTATIVES CAN SOUGHT INFORMATIONS UNDER RTI ACTfurnish the required informations. He observed thatas per OM No.1/69/2007-IR dt. 27.02.2008, anapplication made by a citizen of India who is anemployee or office bearers of any Corporation,Association, Company, NGO etc. indicating his nameis to be replied. For non furnishing the informationand usage of undiplomatic language in letter of thePIO (i.e SPOS, Mahesana), that will be noticedsuitably.

Finally the SPOs Mahesana has furnishedall the information sought for under the RTI Act to theDivisional Secretary.

Imprudent Utilisation of the GOODWILL of DOPfor selling M/s RML gold coins

World Gold council had approached theDepartment of Posts for selling gold through the PostOffices. However, instead of selling Gold coins directly bythe Department of Post (by importing the same throughWorld Gold Council as being done by M/s MMTC,Nationalised/Scheduled Banks etc.) the Dept of Postshad chosen to sell the gold coins imported by privatefirms.

It was stated that the DOP had sought 'BusinessPresentation' from some companies, and the offer of M/sRML was acceptable.The DOP is selling the Gold coins imported by M/s RMLat the rates fixed by RML and in turn, the DOP is getting4% as commission/service charges for the same.However, the DOP is advertising that DOP is selling Goldcoins "in association with M/s RML and with World GoldCouncil" through Post offices which gives theimpression to the General Public that the DOP itself isselling the Gold coins by importing directly inassociation with M/s RML as "Business Partner".However in actual terms, the role of DOP was limited onlyto the level of selling the Gold coins supplied by M/s RML.

The trust of the general public with the Postoffices as well as the "Good will" earned by the Post Officesare utilized for the sale promotion of M/s RML's Gold coins,for which the proceeds earned by the DoP in the form of'commission' at 4% on the sale value of the gold coinswas not commensurate in realistical values of the "GoodWill" of the DoP. It seemed the sharing of revenue (betweencurrent Indian market rate and selling rate fixed by M/sRML) was 3:1 ie 3/4th revenue taken by M/s RML and 1/4the revenue only earned by DoP.

The huge profit margin was shared by M/s RMLunreasonably by the company. The effort of the RML wasonly importing and distributing the Gold coins to thedesignated Post offices only.

Had the DOP taken decision for selling the gold

coins by directly importing the same from the world goldcouncil like MMTC/Nationalised banks, the Departmentcould have full benefited and earned the gross profit onthe sales. The Department's Good will is beingimprudently utilized for the undue benefit of M/s RML.

Contract agreement entered by DoP with M/sRML and World Gold Council was not available in thePost Offices as well as with the Circle Office.The Sivakasi HO had sold 759gms of gold coins from13.3.2009 to 07.05.09. The difference in price for 1 gm ofpure gold (24crt) between Indian market rate and RML'srate was Rs. 200/- and hence DOP was deprived ofpotential revenue of Rs 151,800/-(759 X 200) [Differencein cost Rs. 277-discount given to DOP Rs. 70-Avg takenas Rs 200/-].

The quantity of gold coins sold by all the 51designated post offices in Tamil Nadu Circle during"Akshya tirthiya" alone i.e. during 14.4.2009 to 04.05.2009was 11299.5 gms. The potential loss of revenue on thisquantity worked out Rs. 22.599 lakh (11299.5 X 200).

With reference to your above cited letter, on thesubject, I am directed to inform you that, the official ShriV.P. Gurav is residing at Vakola, Santacruz East, Mumbai.On 26-07-2005 and 27-7-2005 there was a heavy rainfalland heavy water was accumulated in the Vakola areas.The house of the official was totally under water. Theofficial along with his two friends have helped to saveand rescued many lives of the locality. On 07-08-2005,the official had Fever, hence he approached to his familyDoctor, and after some preliminary treatment, he felt better.

On 10-08-2005, at around 8.30 hours,he suddenly felt restless and hence he once againapproached to his family Doctor, who advised him forimmediate medical treatment at Nanavati Hospital. Butdue to non-availability of bed in the Nanavati Hospital, hewas admitted in the R.K. Hospital, Santacruz West, foremergency Medical treatment. He was admitted in ICU.By taking into consideration the seriousness of the case,and request of the Family members, medical advancewas sanctioned in the case. However, the condition ofthe patient was worsened, he was shifted to PD HindujaHospital and Medical Research Center, Mumbai on 13-8-2005. The said hospital had given on estimate ofRupees 150000/- for medical treatment on'LEPTOSPIROSIS'. Since this is being a Private Hospitaltreatment, the case was received in the Circle Office,requesting for grant of Medical Advance on the basis ofemergency, which was approved by this office as per rules.

On receipt of MR Claims underrelaxation of rules, both claims were scrutinized as perlatest orders of the Chief PMG at CS (MA) rates and claimswere sanctioned for an amount of Rs. 48617/- againstthe amount claimed by the official Rs. 93845/-. But theofficial has represented the case in the followingcircumstances.

During the period of flood, his whole belongingswere rush out in the flood and himself and his familywere alive only with cloth, which were wearing and had tosurvive with the help of charitable people, and had tomake purchases of utensils, cloth and all other things

required for living again from the savings and help of therelatives.

In the light of above information, the official hadrequested to consider his case as a special case withhumanitarian ground and sanction total amount of claim.However by taking into consideration, the gravity of thesituation, as well as life saving aspect, the case wassubmitted to the competent authority for consideration ofclaims at CGHS rates, where the official will be somehowbeneficial. The same has been considered and orderedthat the difference can be met from Welfare Fund, if it isnot high.

As per orders of the Chief PMG, both claims hasbeen got calculated as per CGHS rates and differencebetween CGHS rates and CS (MA) rates amounting toRupees 17206/- was put up for approval of the Chief PMG,Mumbai. The Chief Postmaster General, MaharashtraCircle, Mumbai has approved for Payment of differenceof Medical bills from the Welfare Fund of the Circle OfficeMumbai. In fact, the context of changes in the field ofInternational Mail Transmission sector that formulatedby the Union Government will encourage the privateCourier like "DHL" to expand their international market inthe field of Communications. On the other hand the aimand object of the state to enable common man tocommunicate at an affordable price will be diminishedgradually on withdrawn of Foreign Parcel booking facilityand on discontinuing of establishment thereto, asrecommended by Geethakrishnan Commission, yearsback. Further, such direct delivery system of incomingforeign articles/parcels may cause "DANGER" when Indiafacing acts of violent terrorism in different corner of thestate.

In conclusion, this may therefore urges to theUnion Government to reconsider their policies in the fieldof International Mails Services in a lenient view whichprotect the right and privileges of common people. Thepolicy of diversion of International Mails (both Export andImport) from Foreign Post Offices as enumerated inparagraphs ante should also be withdrawn in the interestof public and for sake of the staff of Foreign Postestablishments, since the International Postal businessboth Parcel and Letter Mails are monitored and regulateby Foreign Post Manual only.

The Comptroller and Auditor General said in areport that the government had been overstating

expenditure on anti-poverty and development schemes.

Over Rs. 51,000 crore allocated for theseschemes in 2007-2008 was transferred to the bank

accounts of NGOs autonomous bodies and districtauthorities whereas it was not aware of the actual

expenditure by these organizations.

"The aggregate amount of the unspent balances in theaccounts of the implementing agencies kept outside

government accounts is not readily ascertainable. Thegovernment expenditure as reflected in the accounts to

that extent is, therefore, overstated, "the CAG report said.

LEAKY FLAG SHIPS? (Proposals in interim Budget for

2009-10)

- Over Rs. 51000 cr allocated for flagship schemesin 2007-08 transferred to bank accounts of NGOs,

autonomous bodies and district authorities.

The official auditor also made it clear that it

would not be held accountable for any misrepresentationof facts in Union accounts.

It also pointed out how the Social &

Infrastructure Development Fund (SIDF)-created in 2006for funding initiatives such as the employment of

physically challenged, insurance cover for rural poor, etc- was diverted to unspecified programmes and towards

grants to various cultural organizations.

The government had transferred Rs. 6,500

crore in 2007 and Rs. 6,000 crore in 2008 to the SIDF. Anexamination of Rs. 3,500 crore expenditure under this

account by the CAG revealed that atleast Rs. 1500 crorein 2006-07 and a similar amount the following year was

diverted to celebrations and giving aid to NGOs and otherexpenditure rather than creating infrastructure.

Pointing out the CAG report said of the Rs.

20,000 crore collected under the Universal Service

Obligation Fund between 2003-08 towards subsidizing

rural telephony, only Rs. 6,000 crore was spent; the

remaining amount was not there in the fund.

The Government levies 5% from the gross

revenue of a telecom licensee under the USO to be usedfor subsidizing rural telephony. It is believed that the

government used the remaining money to fund its deficit.

19.1 The Scheme for Joint Consultation andCompulsory Arbitration for the Central GovernmentEmployees was introduced in the year 1966 on the linesof the Whitely Councils in the U.K. This is a declaration ofjoint intent regarding the common approach of theGovernment of India on the one hand and the employees'organistions on the other for joint consultation andsmooth working.

The basic objectives of the Joint ConsultativeMachinery (JCM) are as under:-v To promote harmonious relations between theGovernment and its employees.v To secure the greatest measure of cooperationbetween the Government in its capacity as employer andthe general body of its employees in matters of commonconcern; andv To increase the efficiency of the public services,through a collaborative endeavour, narrow the area of"unresolved differences" and widen the ambit ofagreement on substantive issues of common concern.19.2 The JCM Scheme provides for a three tiermachinery:-

(i) the National Council as the apex body; (Chairedby the Cabinet Secretary)

(ii) Departmental Councils at the level of individualMinistries/Departments including their attachedand subordinate offices and (chaired byrespective Secretaries)

(iii) Regional/Office Councils to deal with mainly thelocal problems at the level of each individualoffice, depending on its structure. (chaired byHead of office of respective organizations)

19.3 The scope of the JCM scheme includes allmatters relating to:v Conditions of service and work,v Welfare of the employees andv Improvement of efficiency and standards of work,Provided, however, that

(i) in regard to recruitment, promotion anddiscipline, consultation is limited to matter ofgeneral principles; and

(ii) individual cases are not considered.19.4 Under the JCM Scheme, there have beencontinuous interactions with staff unions at the Nationallevel as well as at the Departmental level and a numberof important issues have been resolved amicably throughmutual discussions. 45 meetings of the National Council(JCM) have been held since the inception of the Schemein 1966. The last meeting of the National Council washeld on 14th October, 2006. In 2007 three meetings withthe Staff Side were held to discuss the pending Board ofArbitration Awards.

19.5 Standing Committee- There have been frequent

interactions with the staff side through the meetings ofthe Standing Committee of National Council (JCM). Manyissues of the employees of the major Ministries/Departments like Ministry of Railways, Ministry ofDefenses and Department Unions/Federations at theDepartmental level.

During the year 2007, a meeting of StandingCommittee of the National Council (JCM) has been heldon 14.12.2007.

19.6 Arbitration- An important feature of the JCMScheme is the provision for Arbitration in cases wherethere is no agreement on an issue between the OfficialSide and the Staff Side on matters relating to:-

v Pay and allowances;

v Weekly hours of work' and

v Leave

of a class or grade of employees.

19.7 Board of Arbitration (BOA)- A Board of Arbitration(BOA) comprising of a chairman (who is an independentperson) and two members, (nominated one each by staffside and official side) is functioning under theadministrative control of the Ministry of Labour. Awards ofthe Board of Arbitration are binding on both the sides,subject to the over-riding authority of Parliament to rejectof modify the awards.

19.8 Under the JCM Scheme, 259 references havebeen made to Board of Arbitration, so far, for settlement ofdisagreement cases. Out of these 259 references, 257have been decided by BOA. Most of the awards whichwere in favour of the employees have been implemented,except a few which could not be accepted due to adverseaffect on National economy/ social justice. Detailedposition of the references made to Board of Arbitration isgiven in the table at Annexure.

1. The Applicant filed an RTI application dt.11.11.08 with CPIO, DoP, Mayiladuthurai. Herequested for photocopy of valued English DictationAnswer paper w.r.t. the Postman Examination heldon 28.9.08. On not receiving any reply, he filed anappeal dt. 24.12.08 reiterating his request forinformation. The Appellate Authority replied on19.1.2009 stating that the CPIO has already repliedvide his letter dt. 8.12.08 denying the information u/s8(1)(j). The Applicant filed a second appeal dt.12.3.2009 before CIC.

2. The Bench of Mrs. Annapurna Dixit,Information Commissioner, scheduled the hearing on

May 1,2009.

This was due to the fact that wehad been finalizing the national anomaly itemscomprehensively and we thought that the points madeby you could be considered for preparation of suchitems. We have placed the anomaly items introducedin the national council in our website.

The question of grant of family planningallowance to the pensioners as has been demandedby the Tirunelveli unit of the Pensioners Associationhas been found to be infeasible. Therefore, this matterwould be difficult to be pursued. Regarding grant ofchildren education allowance to the persons who arein receipt of family pension (due to the death ofGovernment servants in harness). It has been decidedto take up this issue as an item in the NationalCouncil, not as an anomaly item. We shall preparean item and a copy thereof would be sent to you indue course. We have been informed that such facilitieshas been granted by the Government to the Ex-Servicemen family pensions where the armedpersonnel had been killed in action. We are trying toget a copy of the said order and shall prepare theitem on the basis of the said order.

nnnnn Revision of rates of subscription under CentralGovernment Health Scheme due to revision of pay andallowances of Central Government employees andrevision of pension / family pension on account ofimplementation of recommendations of the SixthCentral Pay Commission

The undersigned is directed to invite referenceto the Office Memoranda, No: S.11011/18/99-Desk.I/CGHS(P) dated the 3rd July, 2000; and No. S-11011/6/98-CGHS(P) dated the 27th May, 1998, 20th September,2004 and 28th October, 2005, issued by the Ministry ofHealth &Family Welfare, vide which orders were issuedrevising the rates of monthly subscription for availingCGHS facility, as also the entitlement for free diet,entitlement of accommodation in private empanelledhospitals under CGHS, etc. On the basis of therecommendations of the Sixth Central Pay Commission,pay and allowances of serving employees and pensionof civil pensioners/ family pensioners have been revisedby the concerned authorities.2. The upward revision of pay/pension of doctorsand other staff in the CGHS has increased the cost ofoperating the Central Government Health Scheme. It has,therefore, been decided to revise the rates ofsubscriptions, to be made by employees / pensioners,for availing benefits under the CGHS, with effect from 1stJune, 2009. It has also been decided to revise themonetary ceiling limits for various entitlements of thebeneficiaries for availing CGHS facilities.3. In supersession of all earlier instructions, the

following revisions are being made, in so far as it relatesto the facilities mentioned below:(A) Monthly Contributions for availing CGHS facility:

(B) Entitlement of wards in private hospitals empanelledunder CGHS:-

4. It is clarified that the reference to pay in this orderrelates to the pay drawn in the pay band.

5. Pensioners have an option to get their CGHSpensioner card made by either making CGHScontribution on an annual basis (twelve months) or bymaking contribution for 10 (ten) years 120 (one hundredand twenty) months for getting a pensioner CGHS cardwith life-time validity. It is clarified that:

(i) Contributions to be made by pensioners/ familypensioners would be the amount that they weresubscribing at the time of their retirement or at the time ofdeath of the Government servant;

(ii) Pensioner beneficiaries, who have alreadyobtained CGHS card with life time validity by paying alump sum amount equivalent to 10 years contribution,will not be required to pay any additional amount as aresult of the revision in the rates of contribution for availingCGHS facility;

(iii) Entitlement of pensioner/ family pensioners. whohave already deposited their contribution for life timeCGHS facility, will not be changed;

(iv) Pensioners/ family pensioners who arecontributing to the CGHS on an annual basis and wish tocontinue to avail CGHS benefits will have to contribute atthe revised rates upto the time of contribution needed tocover a period of a total of ten years from the timepensioner CGHS card was issued for the first time tothem. The revised rate of contribution for the remainingperiod would be with reference to the grade pay that he/she would have drawn in the post held by him/ her (at thetime of his/her retirement/ death) had he/ she continuedto be in service now but for his/her retirement/ death' and

(v) Any pensioner/ family pensioner who is entitledto avail CGHS facility has not so far got his/ her pensionerCGHS card made, the rate of contribution in such caseswill be with reference to the grade pay that he/ she wouldhave drawn in the post held by him/ her (at the time of his/her retirement/death) had he/she continued to be inservice now but for his/ her retirement/ death.

nnnnn Additional Relief on death/disability ofGovernment servants covered by the new DefinedContribution Pension System (NPS)

The undersigned is directed to say that thepension of the Government servants appointed on or after1.1.2004 is regulated by the new Defined ContributionPension System (known as New Pension Scheme),notified by the Ministry of Finance (Department ofEconomic Affairs) vide their O.M. No. 5/7/2003-ECB 2 PRdated 22.12.2003.

2. On introduction of the New Pension Scheme,among others, the Central Civil Services (Pension) Rules,1972 and the Central Civil Services (Extraordinarypension) Rules were amended on 30-12-2003. Underthe amended Rules, the benefits of Invalid Pension/Disability Pension and Family Pension/ExtraordinaryFamily Pension/ Liberalized Pensioner Award relief arenot available to the Government servants appointed onor after 1.1.2004.

3. Ministry of Finance (Department of EconomicAffairs) has subsequently clarified that the New pension

Scheme is a replacement for only pension under normalcircumstances and family pension in case of death of

employees after retirement.

4. A High Level Task Force (HLTF) Constituted by

the Government has recommended certain additionalbenefits that can be provided on death or discharge on

invalidation/ disability of a Government servant coveredby the New Pension Scheme. It is likely to take some

time before the Rules regulating these benefits underthe New Pension System are put in place.

5. Meanwhile, considering the hardships beingfaced by the employees appointed on or after 1.1.2004who are discharged on invalidation/disablement and bythe families of such employees who have died duringservice since 1.1.2004, the President is pleased to extendthe following benefits to Central Civil GovernmentServants covered by the New Pension Scheme, onProvisional basis till further orders:

1. Retirement from Government service oninvalidation not attributable to Government duty:

a) Invalid Pension calculated in terms of Rule 38and Rule 49 of the Central Civil Services(Pension) Rules, 1972

b) Retirement gratuity calculated in terms of Rule50 of the Central Civil Services (Pension) Rules,1972.

2 Death in service not attributable to Governmentduty:-

a) Family Pension (including enhanced familypension) computed in terms of Rule 54 of the

b) Death gratuity computed in terms of Rule 50 ofthe Central Civil Services (Pension) Rules,1972.The employee/ his family will also be paid

Dearness Pension/Dearness Relief admissible fromtime to time in addition to the above benefits, on provisionalbasis.6. The above provisional payments will be adjustedagainst the payments to be made in accordance with theRules framed on the recommendations of the HLTF andrecoveries, if any, will be made from the future paymentsto be made on the basis of those rules.7 The recommendations of the HLTF envisagepayment of various benefits on death/discharge of aGovernment employee after adjustment of the monthlyannuities pension form the accumulated funds in the NPSAccount of the employee. Therefore, no payment ofmonthly-annuitised pension will be made to theemployees/family of the employee during the period he/she is in receipt of the provisional benefits mentioned inpara-58 In cases where, on discharge/death of theemployee, the amount of accumulated funds in the NPSAccount have been paid to the employee/family of theemployee, the amount of monthly-annuitised pensionfrom the date of discharge/death will be worked out inaccordance with the rules/regulations to be notified bythe Department of Financial Services/PFRDS and thesame will be adjusted against the payment of benefits/relief after the notified rules in this respect are in place.9 There instructions will be applicable to thoseGovernment servants who joined Government service onor after 1.1.2004 and will take effect from the same datei.e. 1.1.2004.10 This Order issues with the concurrence of Ministryof Finance (Department of Expenditure) vide their U.O.No. 127/EV/2009 dated 13.4.2009.(No. 38/41/06/P&PW(A) Dated 5-05-2009 of Dept of

Pension & Pension Welfare)

nnnnn Tariff for "Certificate of Posting" for foreignmails, regarding clarification there on.

Rule 195 (1) (b) of IPO Rules 1933 regulatesthe tariff of " Certificate of posting" The tariff of the servicewas last revised w.e.f. 1st February 2002 vide circular No.1-9/2001-Rates dated 17-1-2002 from Rs. 2/- to Rs. 3/- .The said Rule was amended vide GSR 23 (E) 11th January2002, the last amended rule is reproduced as under:" The Certificate shall contain in exact copy of theaddressee on the articles to which it relates and shallhave a postage stamp or stamps affixed thereto inpayment of a fee to be charged at the rate of Rs.3 /- forevery three articles or for any less number"

The above rule is common for both domesticand foreign articles to be sent under the service.Therefore, the tariff for the article both for domestic andforeign mail should be the same.

Keeping the above facts in view, it is clarifiedthat the tariff for foreign mails transmitted under UCPshould be charged at the rate @ Rs. 3/- for every threearticles or for any less number.

This may kindly be brought to the notice of allconcerned, to ensure that the correct rates are charge.

This letter supersedes the orders for UPCcontained in our previous circular No. 1-49/91-R dated24-12-1994.(DG(P) No.1-2/2009-Rates Dated:-09-04-2009)

nnnnn Recommendations of the Sixth Central Paycommission-implementation of decisions relating togrant of Children Education Assistance andReimbursement of Tuition fee.

Of late it has been observed that claim forChildren Education Allowance are being made by theofficers and staff of Department of Posts, Dak Bhawanwithout submitting all the documents required inaccordance with the revised Scheme of ChildrenEducation Allowance.2. Accordingly attention is invited to Department ofPersonnel & Training' Office Memorandum No. 12011/03/2008-Estt. (Allowance) dated 2nd September, 2008on the above subject and to say that consequent uponthe decisions taken by the Government on therecommendations made by the Sixth Central PayCommission and in supersession of all earlier orderson the subject of Children Education /allowance andReimbursement of Tuition Fee, the claim for grant ofChildren Education Allowance and Reimbursement ofTuition Fee, the claim for grant of Children EducationAllowance should be submitted by the Governmentservant after observing the following guidelines:-(i) The claim be submitted in Form 1 giving fulldetails of the child viz., Name, Date of Birth, Class/ Schoolin which studying and the period of which CEA claimed.(ii) The earlier procedure of getting the certificatecountersigned by the School authorities has since beendiscontinued.

(iii) The reimbursement would be made on the

submission of original receipts for payment of Tuition feeetc. duly self-certified by the Government servantconcerned.

(iv) Reimbursement can be claimed once everyquarter.

3. Accordingly all the officers and staff in theDepartment of Posts, Bak Bhawan are requested tosubmit their claims after ensuring that the aboveprocedure is appropriately followed.

nnnnn Maintenance and preparation of AnnualPerformance Appraisal Reports-communicationof all entries for fairness and transparency inpublic administration.

The undersigned is directed to invite theattention of the Ministries/Departments to the existingprovisions in regard to peparation and maintenanceof Annual Confidential Reports which inter-alia providethat only adverse remarks should be communicatedto the officer reported upon for representation, if any.The Supreme Court has held in their Judgement dated12.5.2008 in the case of Dev Dutt vs Union of India(Civil Appeal No. 7631 of 2002) that the object of writingthe confidential report and making entries is to givean opportunity to the public servant to improve theperformance. The 2nd Administrative ReformsCommission in their 10th Report has alsorecommended that the performance appraisal systemfor all services be made more consultative andtransparent on the lines of the PAR of the All IndiaServices.

2 Keeping in view the above position, the matterregarding communication of entries in the ACRs inthe case of civil services under the Government ofIndia has been further reviewed and the undersignedis directed to convey the following decisions of theGovernment:-

(i) The existing nomenclature of the AnnualConfidential Report will be modified as Annualperformance Assessment Report (APAR).

(ii) The full APAR including the overall grade andassessment of integrity shall be communicated tothe concerned officer after the Report is completewith the remarks of the Reviewing Officer and theAccepting Authority wherever such system is in vogue.Where Government servant has only one supervisorylevel above him as in the case of personal staffattached to officers, such communication shall bemade after the reporting officer has completed theperformance assessment.

(iii) The Section entrusted with the maintenance

of APARs after its receipt shall disclose the same tothe officer reported upon.

(iv) The concerned officer shall be given theopportunity to make any representation against theentries and the final grading given in the Report withina period of fifteen days from the date of receipt of theentries in the APAR. The representation shall berestricted to the specific factual observationscontained in the report leading to assessment of theofficer in terms of attributes, work output etc. Whilecommunicating the entries, it shall be made clearthat in case no representation is received within thefifteen days, it shall be deemed that he/ she has norepresentation to make. If the concerned APARSection does not receive any information from theconcerned officer on or before fifteen days from thedate of disclosure, the APAR will be treated as final.

(v) The new system of communicating theentries in the APAR shall be made applicableprospectively only with effect from the reporting period2008-09 which is to be initiated after 1st April 2009.

(vi) The competent authority for consideringadverse remarks under the existing instructions mayconsider the representation, if necessary inconsultation with the reporting and/or reviewing officerand shall decide the matter objectively based on thematerial placed before him within a period of thirtydays from the date of receipt of the representation.

(vii) The competent authority after dueconsideration may reject the representation or mayaccept and modify the APAR accordingly. Thedecision of the competent authority and the finalgrading shall be communicated to the officer reportedupon within fifteen days of receipt of the decision ofthe competent authority by the concerned APARSection.

3. All Ministries/Departments are requested tobring to the notice of all the offices under them forstrict implementation of the above instructions.

Divisional Secretary Narasaraopet suddenly lost hisbreath on 10.06.09 in the Post Office premises due toheart attack. He was a wonderful comrade with morededication and conviction. His demise is the great lossto A. P. Circle and the comrades of Narsaraopet. Wecondole the death and convey our deepest condolencesto the bereaved family members and comrades ofNarasaraopet division.
