R. Yosi HaGlili taught: Is it appropriate for this child to be stoned by the Bais Din (court) for eating some meat and drinking some wine? In truth the Torah is anticipating his end, for after his appetites con- sume all of his father's money, he will need to resort to thieveries which will ulitmately lead him to murder. And so the Torah said, let him die in relative innocence rather than con- tinue on to greater guilt.(TB Sanhedrin 71b-72a) R. Yitzchak taught: A man is judged according to what he has done at that time, as it says that G-d heard the voice of Yishmael "ba'asher hu sham", as he was, then and there. The Midrash records that the angels protested to G-d, "Are you going to save this person (Yishmael) whose children will ultimately kill yours?" To which G-d responded, "Being that at the current time he is indeed a Tzaddik, I will not destroy him based on his future, because I only judge in the present. (TB Rosh Hashana 16b, with Rashi) These two sources present an obvious contradiction. If G-d only judges us based on the present and ignores what is anticipated in the future, how can the Bais Din give this drastic punishment to the rebellious son based only on the future? Fur- thermore, is it fair to assume that this is indeed to be the future of this child? Does he no longer have the free will to change his course, to do Teshuva? HALACHA OF THE WEEK: A FEATURE OF THE BJSZ DAILY HALACHA SHIUR: DRINKING THE WINE OF KIDDUSH The Kiddush cup should contain a Revi’is of wine, which corresponds to a minimum of 3 – and possible as much as 5 - ounces. After reciting the Kiddush, ideally the one who made the Kiddush should drink a nice amount – a good cheekful – from the wine, and then distribute portions of the remaining wine to others who followed along with his Kiddush, as it is appropriate for everyone to taste of that wine. If the one who made the Kiddush cannot drink the cheekful himself, ideally he should have one of the others at the table drink that amount while distributing minimal portions to the others. However if necessary it is possible to have all the participants together drink the requisite cheekful without any individual drink- ing that much. It is appropriate that the one – or ones – who are drinking the requisite cheekful drink directly from a cup that contains a full Revi’is, meaning either the original cup or another cup to which 3 ounces has been poured. If the one who usually makes Kiddush cannot drink any of the wine, it may be appropriate for him to ask someone else to make Kiddush, or to make the Friday night Kiddush over Challah (OC 271:13-14). PARSHA QUESTION OF THE WEEK:

THE REBELLIOUS SON & TESHUVA

The rebellious son is judged (punished) based on his future ... R. Yosi HaGlili taught: Is it

appropriate for this child to be stoned by the Bais Din (court) for eating some meat and

drinking some wine? In truth the Torah is anticipating his end, for after his appetites con-

sume all of his father's money, he will need to resort to thieveries which will ulitmately lead
