BOARD OF COUNTY COMMISSIONERS, SARPY COUNTY, NEBRASKA
APPROVE FINAL PLAT – RIVER OAKS (Lots 81-192, Outlots K – N)
WHEREAS, pursuant to Neb. Rev. Stat. § 23-104, the County has the power to do all acts in
relation to the concerns of the County necessary to the exercise of its corporate powers; and,
WHEREAS, pursuant to Neb. Rev. Stat. § 23-103, the powers of the County as a body are exercised by the County Board of Commissioners (County Board); and,
WHEREAS, the County Board has the authority to adopt Subdivision Regulations, which shall have the force and effect of law pursuant to Neb. Rev. Stat.' 23-374; and,
WHEREAS, said Subdivision Regulations require the County Board to approve applications
for final plats; and
WHEREAS, the applicant, River Oaks Development, LLC, applied for approval of a final plat for Lots 81-192, and Outlots K – N, on property generally located south of Harrison Street between 184th Street and 186th Street and legally described as follows, herein after “the Property”:
A replat of Lot 28 and Outlots B, G, I, and J, River Oaks, a platted and recorded subdivision located in Sarpy County, Nebraska and a Part of Tax Lot 1 in the NW ¼ of the SE ¼ of Section 17, Township 14N, Range 11E of the 6th P.M., Sarpy County, Nebraska WHEREAS, the Sarpy County Planning Department staff reviewed the application of the
final plat of a subdivision to be known as River Oaks (Lots 81-192, Outlots K - N) for compliance with the Subdivision Regulations; and
WHEREAS, the Planning Department staff made a recommendation of approval as noted in
Exhibit A, attached hereto and incorporated by reference, which Exhibit A includes the Planning Department reports, the aerial map of the Property and a copy of the final plat of the subdivision to be known as River Oaks (Lots 81-192, Outlots K - N).
NOW, THEREFORE, BE IT RESOLVED BY THE SARPY COUNTY BOARD OF COMMISSIONERS
THAT this County Board makes the following findings of fact:
I. A public hearing regarding the approval of the final plat was held on February 21, 2017 before the Sarpy County Planning Commission. The Planning Commission provided their recommendation to the County Board.
II. A public hearing regarding the approval of the final plat was held by this County Board. III. Notice of each of the public hearings described above was published at ten (10) days
prior to each respective public hearing, and the proof of publication has been filed in the Office of the Sarpy County Clerk.

IV. The Planning Department staff recommends approval. V. The proposed final plat of a subdivision to be known as River Oaks (Lots 81-192, Outlots
K - N) is in conformity with the Zoning Regulations, the Subdivision Regulations, and the Sarpy County Comprehensive Plan.
BE IT FURTHER RESOLVED THAT the Final Plat of a subdivision to be known as River Oaks
(Lots 81-192, Outlots K - N) and as further described in the attached Exhibit A is hereby approved subject to the following condition:
1. All of the platted lots be located outside of the 3:1 + 50 ft. drainage buffer. The above Resolution was approved by a vote of the Sarpy County Board of Commissioners

RELEVANT CASE INFORMATION: A Change of Zone application from AG (agricultural) to RD-50 PD (Two family
residential Planned Development) was approved in 2015 to become effective with the filing of the applicable Final Plat. The original Preliminary Plat, approved in 2015, had three phases with a total of 283
single-family residential lots and 20 outlots set aside for creek channels, drainage stormwater management areas and to provide trail amenities. The Final Plat for Phase 1 of the development, consisting of 80 single family
residential lots and 10 outlots, was approved by Resolution 2051-351. The approved Subdivision Agreement for Phase 1 required that the Emiline Street
creek crossing be constructed with Phase 2 of the development. Proposed access points to the subdivision are as follows:
- 184th Street (existing access into River Oaks Phase 1 and Sunridge West to the north)
- 184th and Black Walnut Streets (connections into Garden Oaks to the east) - Briar and Willow Streets (connections into Whitetail Creek to the west) - S. 184th Terrace, S. 184th Avenue, and S. 184th Street (connections into Garden
Oaks to the south) Development will be served with utilities as follows: water by MUD, natural gas by
Black Hills Energy, sanitary sewer by City of Gretna, and electrical power by OPPD.

III. ANALYSIS / STAFF COMMENTS
A. COMPREHENSIVE PLAN: The Comprehensive Plan designates the area as Urban Residential. The proposed development is consistent with the Comprehensive Plan.
B. OTHER AGENCY REVIEW/COMMENTS: The applications were sent to various jurisdictional agencies and departments within Sarpy County that may have an interest. Comments received are attached for your review. Should any additional comments be received, they will be provided to you at the public hearing.
C. GENERAL COMMENTS:
Revised Preliminary Plat - The Revised Preliminary Plat includes Phases 2 and 3 of the overall development
and proposes 211 single-family residential lots and 8 outlots to be utilized for drainage and storm water management areas, buffer, and green space/creek channel.
- This revision reconfigures the street connection crossing the creek within the development area. The original Preliminary Plat showed S. 184th Street crossing the creek in a north-south alignment and tying into Willow Street on the south. The Revised Preliminary Plat now shows the creek crossing along Lillian Street running east-west and connecting S. 184th Street to S. 184th Avenue.
- The Lillian Street creek crossing was originally planned to be constructed during Phase 3 of the development and the Emiline Street creek crossing was to be completed with Phase 2. The applicant has proposed to swap the timing of the construction of the two creek crossings with Lillian Street being constructed prior to Phase 3 and Emiline Street being completed no later than 2022.
- Applicant has worked the Sarpy County Attorney’s office to amend the language in the Subdivision Agreements to reflect these changes. They have also committed to add language with regards to the SID levy to secure the construction of the Emiline Street crossing no later than 2022.
Final Plat (Phase 2) - The Final Plat of Phase 2 has 112 single-family lots with access via Whitetail Creek
and Garden Oaks Subdivisions. - The Lillian Street creek crossing will provide additional access points and the
applicant has stated it will be constructed by the end of 2018 or prior to Phase 3. If not completed by end of 2018, applicant understands that no further building permits will be issued until crossing is completed.
- The developer is requesting a reduction in the rear yard setback requirement on Lots 88 and 89 to a minimum of fifteen (15) feet due to their limited depth and adjacency to the creek. This is allowable under the PD (Planned District) Zoning Overlay which was approved for this project previously. The minimum setback requirement of fifteen (15) feet needs to be noted on the exhibit provided, however.
- Applicant must upload the Post Construction Stormwater Management Plan to the Omaha Permix Website for review and approval.
- A copy of the approved Wastewater Sewer Agreement with the City of Gretna has been submitted to Sarpy County.
- The Subdivision Agreement has been finalized and has been submitted to the County board for consideration.
IV. PLANNING COMMISSION RECOMMENDATION: The Planning Commission held public hearings on these applications at their February 21, 2017 meeting and recommended APPROVAL to the County Board.
Amended Motion: Sotak moved, seconded by Lichter, to recommend APPROVAL of the proposed Revised Preliminary Plat of a subdivision to be known as River Oaks Lots 81 through 291 and Outlots K through R inclusive subject to, 1) the comments contained in the Planning Department’s Recommendation Report, and 2) all of the platted lots be located outside of the 3:1 plus 50 ft. drainage buffer. This recommendation is being made as the Revised Preliminary Plat meets the requirements of the Sarpy County Comprehensive Development Plan, Zoning Regulations, and Subdivision Regulations. Ballot: Ayes – Torczon, Sotak, Davis, George, Whitfield, Ackley, Huddleston, Giff, Korth, Malmquist and Lichter. Nays: None. Abstain: None. Motion carried.

PLEASE NOTE THE FOLLOWING PROCEDURES:
1. The Planning Department will review the application material along with other appropriate departments and/or agencies and provide a recommendation report to the Planning Commission and County Board.
2. The Planning Commission will hold a public hearing and make a recommendation to the County Board. 3. The County Board will hold a public hearing and make a final decision on the Final Plat application. 4. All necessary agreements/drawings are to be recorded with the Sarpy County Register of Deeds, the cost of which
will be borne by the applicant or the property owner. 5. Upon approval of the Final Plat, a certification of approval by the Board shall be endorsed thereon by the County Clerk, and
eight (8) copies of the Final Plat shall be filed with the Register of Deeds office within 90 days. (3 mylar and S paper copies with signatures).
6. If a Change of Zoning application is applied for concurrently with the Preliminary Plat or Final Plat, the conditional approval of the plat also allows for conditional approval of the rezoning request, however, the rezoning does NOT become official until the Final Plat is approved and filed with the Register of Deeds office.

We are requesting the following waivers as they relate to the River Oaks Phase 2 Subdivision generally located at 1841h and Harrison Street:
Pursuant to Section 16.4 of the Sarpy County Zoning Regulations, the minimum reaT yaTd setback shall be 25'.
River Oaks Phase 2 Due to the numerous site constraints such as the steep topography, the Beadle Creek channel and surrounding existing development we are requesting that all lots within the River Oaks Subdivision that have a depth of 11 O' or less receive a reduced rear yard setback of 15'.

December 11, 2016 Kyle Graham Olsson Associates 2111 S 67th Street, Ste 200 Omaha, NE 68106 RE: RIVER OAKS REVISED PRELIMINARY PLAT AND FINAL PLAT SUBMITTAL The corrected submittal of the River Oaks Revised Preliminary Plat and Final Plat of Lots 81 through 192 has been reviewed and we have the following comments: Final Plat Draft Subdivision Agreement for Lots 81-192 and Outlots K – N with applicable exhibits must be
submitted in word format for review. Approved Waste Water Service Agreement with the City of Gretna will need to be submitted before
applications will be submitted for consideration by County Board. Post Construction Stormwater Plan must be submitted to Permix website for review and approval. Please provide an exhibit identifying those lots that are less than 110” in depth in which you are requesting
a rear yard setback of 15 feet. Please confirm in writing that the creek crossing on Emiline Street will be constructed with Phase Two
pursuant to the Subdivision Agreement approved by the Sarpy County Board for River Oaks Lot 1 -80.
Additional question - 1. When will the creek crossing on proposed Lillian Street be constructed allowing traffic from proposed phase
two to access Harrison Street via the River Oaks development?
