When properly designed and cared for, cemeteries are places of beauty. Peace-fulness. Serenity. They provide a place for contemplation; for genealogists, a place to trace one’s heritage. Like no other dedicated quiet haven, a cemetery provides an appropriate atmosphere a person can go to in order to pay his

respects and recall fond memories of beloved family and friends.Adorned in seasonal flowers and the flags, the veterans’ cemetery that graces the cover

of this month’s Bulletin serves as a symbolic reminder of the important role we in the burial vault industry play in memorialization of loved ones. More than at any other time of the year except for Memorial Day, the holiday season that stretches from Thanksgiving to New Year’s Day is a time when many individuals continually think of loved ones who have passed from this earth. During this time, a person may also have a compelling urge to visit his/her loved one’s final resting place to honor and pay tribute to someone who, in life, had meant so much to them.

But what if there is no gravesite to visit? What if you had to rely on a hand-held GPS to show you where your loved one is buried? Don’t laugh. This is a scenario that is increasing all across the country.

As we have reported in recent issues, traditional funerals and burials are being thrown aside in favor of “green” burials and little or no memorialization. According to Aging America Resources (www.agingusa.com), “. . . accepting the unacceptable is what the griev-ing process is all about.” Individuals who may need a specific place to go to (a cemetery or mausoleum) in order to remember a loved one or have closure about the death are, by ever-growing numbers, being denied access to an important symbol in the grieving process.

There are many variations on the theme in which traditional funerals and permanent memorialization are losing ground. Here’s a recent example I can cite because I know the family. In October, a long-time acquaintance of mine who had spent many years in the aerospace industry passed away. Prior to his passing, “Joe” had made it clear to his daughter that he wanted to be cremated and asked her to scatter his ashes in the Atlantic Ocean. A stubborn individualist and tradition-bucker, he probably would not have elected to have a memorial service either, but his daughter realized the importance of a memorial ceremony to help surviving relatives achieve closure. So, whether he would have preferred it or not, Joe had a fitting send-off in the daughter’s church, complete with photo boards that depicted stages of his life and his interests, brief messages by family members and colleagues from work, and, because he was a veteran, a presentation of the American flag that flew over Kennedy Space Center on the day of his memorial service. Later that day, his ashes were scattered as he wished.

Joe’s example is sadly representative of the current trend against traditional funerals. No casket. No burial vault. No urn. No urn vault. No cemetery plot. No cross or monument of any kind, anywhere, records his time on this earth.

Little did Joe know that in shunning a traditional funeral and burial, he was in fact participating in a new trend that is threatening the funeral industry as we know it.

Bottom line: We’ve got to do a better job of upholding the concept of traditional funerals and memorialization. Traditional funerals help people through the grieving process.

Georgia Lawsuit Appeal Threatens Concrete Burial Vault Manufacturers

Not only are traditional funerals and memorialization being threatened, the role of the concrete burial vault is being jeopardized on yet another front. This threat must not be ig-nored by our membership. In the October 2009 issue of The Bulletin (p. 8) J. Scott Calkins, NCBVA’s legal counsel, warned of a case in Georgia that has potential nation-wide impact for the manufacturers of concrete burial vaults. (If you have this issue of The Bulletin avail-able, we suggest you read Scott’s article again and let the impact sink in. If you don’t have a copy, please go to the NCBVA website, where you will find it prominently displayed.)

In a nutshell, the owner of five cemeteries in Chatham County, GA (which includes the city of Savannah) decided to increase his revenue by becoming a dealer in steel and plastic burial vaults. He took this action one step further by banning concrete burial vaults in his

Exhibit Freeat The NCBVA Convention

We know that the economy has seriously affected everyone’s budget and sometimes the first items to be cut are your marketing opportunities. But it is important to NCBVA members to learn about new products and services in the industry, so we’re working very hard to provide affordable, alternative ways for Associate Members/Suppliers to participate.

This year NCBVA is offering Associate Members/Suppliers the opportunity to exhibit FREE* at the Annual Convention. You can’t get any better than that! In order to make this possible, there will not be pipe and drape booths. There will only be table-top or stand- alone displays. There will be no exhibit company involved, so shipping and storage of any materials will be the sole responsibility of the exhibitor.

Each exhibitor will be provided a 6-ft draped table on which to display literature or samples and two chairs in the main convention meeting area––Partnership Plaza. All of the educational programs take place in this area and special time is allocated for attendees to visit with Exhibitors.

A Free table will be offered to any registered associate/supplier attendee. Additional personnel at the table must also be a registered. Please join us at the NCBVA Convention February 2-4, 2010, which is being held in conjunction with World of Concrete. Details and registration forms are on pages 12-14.

cemeteries. Two local concrete burial vault manufacturers and a number of local funeral homes collectively obtained a permanent injunction against the concrete ban. The cemetery owner has since hired new counsel from Atlanta and filed motion for a new trial. If the lower court denies the new motion, it is expected that the case will then be appealed to the Supreme Court of Georgia. If the cemetery owner wins the case at the Supreme Court level, a precedent will be set for the ban of concrete burial vaults in other states.

The litigants in Savannah have already expended more than $150,000 in legal fees. Let me make it clear that they have not asked NCBVA for any assistance. In the opinion of NCBVA’s legal counsel and President Steve Hatfield, NCBVA should assist in some way because of the far-reaching consequences of a negative decision. It is anticipated that an additional $25,000 in legal fees will accrue if the case goes to the Georgia Supreme Court.

As Mr. Calkins predicted in his column, the NCBVA Board had a teleconference on October 30 to discuss appropriate action to be taken by NCBVA. While the NCBVA cannot afford to be in the position of helping any number of burial vault companies with various types of litigation, this case is different in that it will set a precedent that will ultimately threaten ALL concrete burial vault manufacturers in the U.S.

An assessment levied on all NCBVA members was discussed by the Board, but it was felt that the importance of the cause would be recognized and that members would donate money because it’s the right thing to do.

Therefore, by unanimous vote, the Board agreed that NCBVA should establish a legal fund for the lawsuit in Savannah, GA. Money contributed to this fund will be received by the NCBVA and not co-mingled with any other funds. The NCBVA Board will recom-mend how much of the fund is spent at any given time. The President of NCBVA was authorized to send a fund-raising letter under his signature to all NCBVA member firms and to any concrete vault manufacturing firms that may have been NCBVA members in the past five years.

A secure site has been set up on line for the purpose of receiving donations for this important cause (www.regonline.com/Checkin.asp?EventId=791970). As of this writing, the letter has been sent out, and affiliate members, individuals, other associations and burial vault manufacturers are contributing their support.

An on line survey of funeral directors conducted by Wilbert Manufacturers As-sociation (WMA) indicates that more than 60 percent are indecisive about green/envi-ronmentally friendly burial vaults.

WMA, the voice of the Wilbert licensee network, conducted this landmark survey on funeral director attitudes regarding both consumer product interests and burial vault companies. In addition to gathering internal intelligence specific to Wilbert Burial Vault products and services, respondents were also polled about their families’ “green” or environmentally-friendly burial interests.

When asked, “Do you think the families you serve would have interest in a green/environmentally-friendly burial vault?,” funeral home professionals answered as follows:

to periodically measure response to this sub-ject to determine if interest in “green” burials increases, decreases, or stays as is.

“The purpose of the research was two- fold,” stated Steve Turner, WMA president. “First, we wanted our customers and pros-pects to provide us with a report card on our efforts to serve them and the families with quality burial vaults and cremation products. Second, we wanted to gauge our customers on consumer interest for environmentally-friendly burial vaults.”

The survey, which was conducted over the summer months, yielded responses from 480 funeral professionals from across the United States & Canada – both customers and non-customers of Wilbert. Funeral di-rectors were asked to rate Wilbert on several performance metrics such as product quality, customer service, and breadth of product line as well as industry issues such as the potential impact of the green movement.

“The customer rating for our perfor-mance in most areas has been very gratify-ing,” continued Turner. “Overall, Wilbert and the local licensees scored very well. With this said, both our customers and prospects identified one or two components of our relationship where improvement is possible.” He continued, “We are pleased with the results of the survey and the feed-back we received and are now taking ad-ditional steps to meet and exceed customer expectations.”

Vincent and Son,

Galena, IL; and Jim Wiens, Concrete Vaults Inc., Newton, KS.

The new Board then voted officers into position for the 2009-2010 year. Those elected were: Steve Vincent, President; Jim Wiens, Vice President of Finance and Treasurer: Mike Crummitt, Vice President of Manufacturing: and Gerald Hardy, Secretary. The Executive Committee will again consist of Crummitt, McQuestion, Vincent and Wiens.

New to the Doric Board of Directors is Charles “Chuck” Foskey. Chuck was voted into the seat that was left vacant when his father, Charlie, passed away this summer.

He currently serves as President of Wicomico Vault.Carolina-Doric Inc. (Florence, SC) was the recipient of Doric’s #1 Dealer Sales Award

and also the Greatest Number Sold award that is presented to the Doric licensee with the largest sales total for the prior fiscal year and the greatest number of liners sold.
