ON-ROAD REGULATION Title 13 CCR 2020-2022.1

• Adopted December 8, 2005 to reduce Diesel engine Particulate Matter exhausted into the air.• Final mandate January 2007

• Applicable to Municipalities and Utilities who own, lease, or operate in California.

• Applicable to On-Road diesel-fueled heavy-duty vehicles >14,000 lb GVWR, 1960-2006 model year.

• Must bring engines into compliance with clean engine standards according to specified schedule• Must use “Best Available Control Technology” (BACT) to retrofit exhaust.• If cannot retrofit, then must be retired, replaced or repowered

CLEAN ENGINE STANDARDS

1. Engine is certified to a diesel particulate emission standard of 0.01 grams/brake horse power hour (g/bhp-hr). If not, then:

2. Engine is certified to a diesel particulate emission standard of 0.1 g/bhp-hr, and is equipped the most effective diesel particulate control device, or uses an alternative fuel certified to reduce diesel particulates; if not, then:3. Engine uses an alternative fuel; if not, then;

4. Engine uses most effective diesel emission control certified for the Engine.

If the engine can not meet the above options it must be retired, replaced or repowered.

COMPLIANCE DEADLINES

Engines are grouped according to engine age (model year) and compliance deadlines apply to all engines within a given group.

Group 1 – 1960 – 1987 20% of group by Dec. 31, 2007

MISC. INFORMATION PERTAINING TO ON-ROAD

• Low Usage Vehicle exemption.

• Snow Removal exemption.

• Rental Vehicles operated for more than a year are subject to rule.

• Exceptions to Rule; Solid Waste Collection, School Buses, Military Tactical, Emergency Vehicles and Off-Road Vehicles.

• Contractor Compliance Requirement; contracts effective Dec 31,2007 or later must include ARB compliance language.

• Record Keeping; In depth record keeping must be readily available for inspection by ARB staff.

• Must accomplish a VIN stop, Out-of-State Sales Verification and Buyer notification of ARB mandates upon sale or surplus of Vehicle.

OFF-ROAD EMISSION REDUCTION REGULATION

• Became California Law June 15, 2008

• Regulation effective April 1, 2009

• Purpose; to reduce diesel engine Particulate Matter (PM) and Oxides of Nitrogen (NOx)

• Applicable to any person, business, or government agency operating in California except Agricultural or personal use or for use at Ports or Rail-yards.

• Applies to Self-propelled Off-Road Diesel driven equipment >25 horsepower (hp).

•Out-of-State of companies doing business in California must comply

• Must schedule and install BACT as per fleet average established by total fleet horsepower

• Emission level rated in Tiers

Low Population Counties are considered small fleets and exempt from NOx.

Low Use (100 hrs or less annually), dedicated snow removal and emergency vehicles excluded from total fleet hp but still labeled and reported.

Mar 1, 2009 Fleets cannot add a Tier 0 engine to it’s fleet (model yr <97).

Reporting is done through the ARB DOORS program on line.

All equipment must be reported and labeled by deadlines.

MISC. OFF-ROAD INFO

In depth recording keeping must be available for ARB inspections.

Mar 1, 2009 must have a written engine Idling policy in place.

Non-compliance fines can be $10,000 per day per vehicle.

Contract language must be included in equipment bids and sales.

VIN stop not required for OFF-ROAD equipment, just update DOORS
