A. PRICE

The Contractor shall complete all work, including furnishing all labor, material, equipment and services required under this contract for the following firm fixed price and within the time specified. This price shall include all labor, materials, overhead and profit.

B. SCOPE OF WORK

B.1 INTRODUCTION

The U.S. Embassy Seoul plans to convert one single 5 bedroom house to two separate (former) 3 bedroom houses at residence address #4932 of the Yongsan Embassy Housing (YEH) Compound, Seoul, Korea.

The Contractor shall provide demolition work, re-installation of front porch, housing expansion work including concrete masonry unit (CMU) walls, concrete floor slab, roof extension, architectural finish work, and kitchen cabinetry/counters and related electrical and plumbing work per the drawings.

The Contractor’s employees will be escorted by the Embassy staff throughout the time they are at the work site. The Contracting Officer’s Representative (COR) will oversee the performance of the work in progress.

The project drawings will be provided at the pre-quotation conference.

B.2 DESCRIPTION OF WORK

B.2.1 TEMPORARY WORK AND DEMOLITION WORK

B.2.1.1 The Contractor shall provide temporary safety barriers and construction signage at the construction area.

B.2.1.2 The Contractor shall provide appropriate personal protection equipment (PPE) for workers and visitors at the construction area.

B.2.1.3 All cutting devices including metal and wood cutting portable or circular saws that are table mounted shall be installed with proper safeguards to prevent injuries or safety hazards. All hand operated cutting and grinding devices shall be equipped with proper safeguards and inspected daily for safe conditions of the device and wiring.

B.2.1.4 The Contractor shall provide fire extinguishers and welding flash safety screens to protect against personnel injury to personnel or passersby during arc or gas welding/ soldering operations.

B.2.1.5 Prior to any demolition work, the Contractor shall take out all household furniture and items in demolition area and return them to their original location after completion of the work. A protective covering shall be used to protect from dust or damage.

B.2.1.6 The Contractor shall protect all items including doors, windows, and finishes of ceiling, wall, and floor in the construction site from the construction dust by covering them with clear plastic sheeting material.

B.2.1.7 The Contractor shall be responsible for any damages caused by contractor personnel and shall make repairs at the Contractor’s own expense.

B.2.1.8 The Contractor shall keep the site clean and organized on a daily basis during the working period.

B.2.1.9 The Contractor shall, upon approval of the COR, remove all abandoned lighting fixtures, switches, receptacles, electrical conduit, wiring, water pipe, drain pipe and miscellaneous materials from the construction site.

B.2.1.10 During demolition and during any work that causes dust and smells, the Contractor shall provide two (2) sets of ventilating fans with flexible vinyl hoses to exhaust construction dust and odor from the working area.

B.2.1.11 The Contractor shall, upon approval of the COR, dispose of all the construction debris and submit a certificate citing the legal disposal of said debris.

B.2.1.12 The Contractor shall perform the following demolition work as per the demolition plan A-01;

B.2.2 EARTH WORK

B.2.2.1 Before excavation, the Contractor shall inspect the existing utility lines as per the drawing C-01.

B.2.2.2 If there are unidentified underground utilities found during the excavation work, the Contractor shall immediately stop excavation, mark the site, and report the findings to the COR.

B.2.2.3 The Contractor shall provide earth work including excavation, backfilling, compaction, and leveling to install concrete slab of sidewalk, entrance step, kitchen, maid room, and outdoor storage, and concrete footing for new block wall as per the drawing A-02, 03.

B.2.2.4 The Contractor shall provide and compact 100mm thick base course under the concrete slab and footing as per the drawing A-02, A-03. The base course shall be 10 cm thick layer of aggregate and meet the specified gradation requirements. The aggregates shall have a maximum size of 37.5 mm (1-1/2 inches) and shall be continuously well graded within the limits.

B.2.2.5 The Contractor shall reuse the excavated soil for backfilling. Backfill shall be placed in layers not exceeding 150 mm loose thickness for compaction by hand operated compaction machine, unless otherwise specified.

B.2.2.6 The Contractor shall install 6 mil vapor barrier over the base course as per the drawing A-02, A-03.

B.2.2.7 The total quantity of excavation, backfilling, aggregate, and vapor barrier are 16 m3, 3m3, 7m3, and 63m2 respectively.

B.2.2.8 The Contractor shall apply 6 mm thick polyethylene insulation with reflective aluminum underneath the new concrete slab as per the drawing A-02, A-03. The total area of the polyethylene insulation with reflective aluminum is 39 square meters.

B.2.3 CONCRETE WORK

B.2.3.1 The Contractor shall provide concrete slab, entrance step, sidewalk, and footing of the CMU wall as per the drawing A-02, A-03. The compressive strength of the concrete shall be 210kgf/cm2.

B.2.3.2 The thickness of the concrete slab, entrance step, sidewalk, and footing of block wall shall be 20cm, 10cm, 10cm, and 50cm as per the drawing A-02, A-03. The total volume of concrete to be placed is 29m3.

B.2.3.3 The Contractor shall provide form work and install reinforcing bar for the concrete slab, concrete bond beam, concrete wainscot, and footing of block wall and welded wire mesh for entrance step and sidewalk as per the drawing A-02, A-03. The reinforcing bar for the concrete slab shall have 4000kgf/cm2 tensile yield strength and meet the KSD 3504 requirement. The welded wire mesh for sidewalk and entrance step shall have 150mm by 150mm space and 5mm thickness.

B.2.3.4 Before pouring the concrete for footing of CMU block wall, the Contractor shall embed the dowel bar for block installation.

B.2.3.5 The Contractor shall install concrete bond beam on the top of the new CMU wall as per the drawing A-03, A-04.

B.2.3.6 The Contractor shall install concrete wainscot under the bottom of the new CMU wall as per the drawing A-03, A-04.

B.2.3.7 The Contractor shall install 10mm compressed Styrofoam between the new concrete slab and the existing concrete slab and apply caulking on the top of the Styrofoam.

B.2.3.8 The Contractor shall install control joint every 1.8m interval at the new concrete sidewalk and shall use concrete saw cutter for the clean cut face. The control joint shall have 8mm width and 30mm depth.

B.2.3.9 The Contractor shall provide troweled concrete finish on a surface of the concrete slab, entrance step, and footing. The Contractor shall provide broom finish on the surface of the sidewalk.

B.2.4 CONCRETE MASONRY UNIT (CMU) BLOCK WORK

B.2.4.1 The Contractor shall lay 8” CMU block wall as per the drawing A-02, A-03.

B.2.4.2 The CMU block shall be 390mm wide, 190mm high, and 190mm thick and shall meet KSF 4002 (Hollow Concrete Blocks) and shall have following characteristics

- Compressive Strength at 28 days: More than 80kg/cm2.- Water Absorption in 24 hours: Less than 10% by Weight of Block- Water permeability: Less than 300ml/m2.h- Core: Three cores.

B.2.4.3 Before starting laying CMU blocks, the Contractor shall string a line and drop a plumb bob down to mark the block location.

B.2.4.4 The Contractor shall be sure to use the corner block or half block at the end of each course. When cutting the block, the Contractor shall draw a line on both sides of the block where the cut to be made and use a power masonry saws.

B.2.4.5 The Contractor shall spread the mortar out about 1” deep and 8” wide in the marked area of the footing and shall set each corner block first and check them both horizontally and vertically and take time to get them positioned correctly.

B.2.4.6 The Contractor shall tie a line and stretch it between corner blocks. The Contractor continues to lay the base mortar on the footing as the course continues and shall apply mortar to the ends of the blocks with a trowel and place the block in position.

B.2.4.7 The Contractor shall keep all mortar joints at 3/8” (10mm). After laying four or five blocks, the Contractor shall use a long mason’s level to check the alignment of both top and outside edge of blocks. Any alignment correction of a block shall be performed while the mortar is still wet. The Contractor shall never attempt to move a block after the cement mortar begin to set.

B.2.4.8 The Contractor shall always keep the corner blocks about one or two block higher than other runs until completion of block installation.

B.2.4.9 The Contractor shall keep turning the mortar throughout the work and shall keep the mortar covered with a piece of plastic sheet to hold in moisture. The mortar reached its initial set of over 1 hour after mixing shall be discarded.

B.2.4.10 The Contractor shall continue to stagger the blocks and build the wall to the desired height.

B.2.4.11 After all blocks are laid and while the mortar can still be pressed with the fingers, the Contractor shall finish the mortar joint to the appearance desired with a jointer. The joint shape between blocks shall be concave. During the joint work, the Contractor shall keep jointer wet.

B.2.4.12 The Contractor shall install corrugated buck anchor at every three layers of the block wall for the connection between the new block wall and the existing block wall.

B.2.4.13 The Contractor shall install horizontally 8” welded block mesh at every two layers and 10mm reinforcing bar at every other core in blocks vertically. The Contractor shall fill all cores in blocks with mortar.

B.2.4.14 The blocks disturbed by mortar, dust, other materials shall be removed.

B.2.4.15 The total area of block wall to be installed is 82m2.

B.2.4.16 The Contractor shall apply cement mortar over the block wall at the living room and dining room at the 4932A and 4932B as per the drawing A-02, A-03. The total quantity of cement mortar to be applied is 37m2.

B.2.4.17 The Contractor shall install asphalt roofing sheet on the inside of perimeter block wall in accordance with manufacturer’s specification.

B.2.4.18 The asphalt roofing sheet shall be “Star-sheet SM-A type (Unexposed type one layer waterproof A class first grade)” manufactured by “Sungmoon Inc. co., Ltd” and having following characteristics or equivalent.

The glass-wool insulation shall have 0.033 W/mk heat conduction rate, 32kg/m3 density, and 1st grade flame resisting (incombustible material). The Contractor shall submit laboratory tests fact sheet, manufacturer’s specification and Material Safety Data Sheet (MSDS) of glass-wool insulation, gypsum board, metal runner, and metal stud for COR’s approval prior to work commencement.

B.2.5.8 The Contractor shall install gypsum board flush with the adjoining boards and apply approved joint tape and putty to the seams for painting.  No surface deflections or set-backs shall be accepted.

GYPSUM CEILING SYSTEM

B.2.5.9 The Contractor shall install gypsum ceiling system at the following area as per the drawing A-02, A-03. The new gypsum ceiling system shall consist of two (2) plies of 9.5mm gypsum board, M-bar, carrying channel, minor channel, thread bolt, hanger, and 300mm glass-wool. The total area of gypsum ceiling system is 64m2.

B.2.5.12 The suspended ceiling framing system shall be standard type and shall conform to ASTM C 635 for intermediate-duty systems. The suspended ceiling framing system shall have the capability to support the finished ceiling, light fixtures, air diffusers, and accessories, as shown A-03, A-04. The suspension system shall have a maximum deflection of 1/360 of span length.

B.2.5.13 The Hangers of suspended ceiling framing system shall be galvanized steel wire. Hangers and attachment shall support a minimum 1330 N (300 pound) ultimate vertical load without failure of supporting material or attachment.

WOOD MO L DING AND BASEBOARD

B.2.5.14 The Contractor shall install wood molding and baseboard on a gypsum board wall as per the drawing A-03, A-04.

B.2.5.15 The wall baseboard and ceiling moulding shall be made of solid wood. The wall baseboard shall have 12 mm thickness and 100mm height, and the ceiling moulding shall have 10 mm thickness and 70mm height. The Contractor shall apply caulking along the top of the baseboard and bottom of the ceiling molding.

B.2.5.16 The total length of baseboard and molding to be reinstalled are 158m each.

B.2.6 FINISHING WORK

PAINTING WORK

B.2.6.1 The Contractor shall paint all block walls, cement plaster, gypsum ceiling, gypsum walls including the inside of closet, molding, baseboard, closet shelves, and doors as per drawing A-02, A-03.

B.2.6.2 The Contractor shall cover all items that are not to be painted with clear vinyl sheet and masking tape prior to surface preparation and painting.

B.2.6.3 The Contractor shall fill cracks, joints, holes and gaps with putty throughout the painting area.  Fiber mesh tape shall be used for the gaps and cracks to protect against future exposed cracking.  The Contractor shall use the proper weight/grit sand paper for smoothing the putty surface after the putty dries completely.

B.2.6.4 The Contractor shall remove door hardware and hardware accessories, electrical outlet plates, and light fixtures that are not to be painted, or provide them with taping protection prior to surface preparation and painting. 

B.2.6.5 The Contractor shall apply one layer of primer coat and a minimum of two layers of finish coat.

B.2.6.8 Total quantity of block wall, cement plaster, gypsum ceiling, gypsum wall, ceiling molding, and wall baseboard to be painted are 59m2, 37m2, 106m2, 409m2, 158m, and 158m respectively.

TILE INSTALLATION

B.2.6.9 The Contractor shall install tiles as per the drawing A-03, A-04.

B.2.6.10 The Contractor shall submit a shop drawing for the tile layout to the COR for approval prior to work commencement.

B.2.6.11 The Contractor shall submit the catalogue source, material data, cut sheets, sample, and Material Safety Data Sheet (MSDS) of tile material and tile bonding material to the COR for approval prior to work commencement.

B.2.6.12 The floor tile to be installed at the entrance, kitchen, and breakfast room shall be 300mm by 300 mm abrasive ceramic tile, and wall and floor tile to be installed at the restroom after demolition of wall and sanitary wares such as commode and lavatory shall be the same as existing tile.

B.2.6.13 Before installing tile, the Contractor shall remove the existing tile, tile bond, and foreign material, and make the substrate level by use of a cement mortar mixture.

B.2.6.14 The Contractor shall examine substrates, areas, and conditions where tile will be installed, with installer present, for compliance with requirements for installation tolerances and other conditions affecting performance of installed tile.

B.2.6.15 The Contractor shall not install tiles until surface preparation is complete and ambient temperature and humidity conditions are maintained at the levels indicated in referenced standards and manufacturer's written instructions.

B.2.6.16 The Contractor shall apply grout sealer to joints between tiles according to grout-sealer manufacturer's written instructions. As soon as grout sealer has penetrated joints, the Contractor shall remove excess sealer from the tile face by wiping with soft cloth.

WATERPROOFING WORK

B.2.6.21 After demolition of floor tile at the restroom, the Contractor shall conduct cement mortar plastering work for the substrate preparation. After plastering work, the Contractor shall apply waterproofing material and install floor tile at the restroom.

B.2.6.22 The Contractor shall apply two (2) coats of waterproofing product over the concrete floor of the restroom before tile installation. The waterproofing product shall be a “SikaTop Seal 107” or equivalent and following characteristics

B.2.6.23 The Contractor shall perform surface preparation work in accordance with the manufacturer’s specification. All waterproofing work shall be performed in accordance with the manufacturer’s specification.

B.2.6.24 The total area of cement mortar plastering and waterproofing to be conducted shall be 18m2 each.

CARPET INSTALLATION

B.2.6.25 The Contractor shall install new carpet with carpet cushion pad per the scope of the work. The carpet and carpet cushion padding will be provided by USG (See Attachment 4 in Section I).

B.2.6.26 The concrete subfloors shall comply with ASTM F 710 “Standard Practice for Preparing Concrete Floors to Receive Resilient Flooring.”

B.2.6.27 The Contractor shall provide water-resistant, mildew-resistant, non-staining type of adhesives to suit products and subfloor conditions indicated, that complies with flammability requirements for installed carpet and is recommended or provided by the carpet and carpet padding manufacturers. The Contractor shall provide adhesives that comply with the following limits for VOC content when tested according to ASTM D 5116:

a) Total VOCs: 10.00 mg/sq.m x hb) Formaldehyde: 0.05 mg/sq.m x hc) 2-Ethyl-1-Hexanol: 3.00 mg/sq.m x h

B.2.6.28 The Contractor shall provide tackless carpet stripping of water-resistant plywood as required to match cushion thickness and that comply with CRI 104, Section 12.2.

B.2.6.29 The Contractor shall provide hot-melt adhesive tape or similar product as a seam adhesive recommended by the carpet manufacturer for sealing and taping seams and butting cut edges at backing to form secure seams and to prevent pile loss at seams.

B.2.6.30 The Contractor shall provide extruded aluminum with mill finish of width shown, of height required to protect exposed edge of carpet, and of maximum lengths to minimize running joints. The Contractor shall receive the approval for the metal edge and metal divider from the COR before the work commences.

B.2.6.31 The Contractor shall use trowelable leveling and patching compounds, according to the carpet manufacturer’s specifications, to fill cracks, holes, depressions, and protrusions in substrates. The Contractor shall fill or level cracks, holes and depressions 3mm wide or wider, and protrusions more than 0.8 mm, unless more stringent requirement are required by the manufacturer’s written instructions.

B.2.6.32 The Contractor shall remove coatings, including curing compounds, and other substances that are incompatible with adhesives and that contain soap, wax, oil, or silicone, without using solvents. The Contractor shall use mechanical methods recommended in the manufacturer’s specification.

B.2.6.33 The Contractor shall sweep with a broom and vacuum clean all substrates to be covered, immediately before carpet installation.

B.2.6.34 The Contractor shall proceed with the carpet installation only after all unsatisfactory conditions have been corrected.

B.2.6.35 The carpet and carpet padding installation shall comply with CRI 104 and the carpet and carpet padding manufacturers’ specification.

B.2.6.36 The Contractor shall cut and fit carpet to butt tightly to vertical surfaces, permanent fixtures, and built-in furniture including cabinets, pipes, outlets, edgings, thresholds, and nosings. The Contractor shall bind or seal cut-edges as recommended by the carpet manufacturer.

B.2.6.37 The Contractor shall install carpet padding seams at 90-degree angle with carpet seams.

B.2.6.38 After installing carpet, the Contractor shall immediately remove excess adhesive, seam sealer, and other surface blemishes using a cleaner recommended by the carpet manufacturer; remove yarns that protrude from carpet surface; and vacuum carpet using a commercial machine with face-beater element and HEPA filtration.

B.2.6.39 The Contractor shall protect against damage from construction operation and placement of equipment and fixtures during the remainder of the construction period. The Contractor shall use protection methods indicated or recommended in writing by the carpet manufacturer and carpet padding and adhesive manufacturers.

B.2.6.40 The total area of carpet to be installed is 64m2.

LINOLEUM INSTALLATION

B.2.6.41 The Contractor shall install linoleum as per the drawing A-03, A-04. The linoleum to be used shall be the same type as the existing linoleum.

B.2.6.42 All installation processes shall comply with the manufacturer’s written specifications or instructions. The Contractor shall provide a water resistant type adhesive recommended by the carpet manufacturer.

B.2.6.43 While installing the linoleum, the ambient temperature shall be maintained above 10 degrees Celsius, and substrate flooring moisture level shall not exceed 5%.

B.2.6.44 The Contractor shall provide a smooth, true, level plane for surface preparation of flooring by applying poly putty over the concrete floor.

B.2.6.45 The Contractor shall affix the linoleum to the concrete floor by using a full spread coating of adhesive applied to the substrate to comply with manufacturer’s specifications or written instructions, including adhesive mixing, application methods, and the shelf life of the product.

B.2.6.46 The Contractor shall produce a completed installation without open cracks, voids, raising, and puckering at joints, telegraphing of adhesive spreader marks, and other surface imperfections.

B.2.6.47 The Contractor shall not move heavy or sharp objects directly over flooring surfaces while adhesive is drying. The Contractor shall place plywood or hardwood panels over flooring and under objects while they are being moved across the surface. The Contractor shall slide or roll objects over panels without moving panels.

B.2.6.48 The total area of linoleum to be installed is 8m2.

B.2.7 DOOR AND WINDOW INSTALLATION

STEEL DOOR INSTALLATION

B.2.7.1 The Contractor shall install steel doors, aluminum screen door, and hardware per the drawing A-05, A-06.

B.2.7.2 The size of steel door and screen door shall be 1.0m wide and 2.1m high, and the total quantity of 8 steel doors and 6 screen doors are to be installed.

B.2.7.3 The Contractor shall install three (3) sets of steel frames with glass at the entrance per the drawing A-05, A-06. The size of steel frame to be installed at the entrance shall be 2.0m wide, 2.2m high, and 0.2m thick.

B.2.7.4 The Contractor shall apply one (1) coat of anti-corrosive paint and two (2) coats of enamel paint on the surface of each steel door, door frame, and steel frame.

WOOD DOOR INSTALLATION

B.2.7.5 The Contractor shall install two (2) sets of double leaf door with glass, two (2) sets of sliding doors, two (2) sets of swing doors, four (4) sets of closet doors, six (6) sets of room door and their door frames, trims and hardware as per the drawing A-05, A-06.

B.2.7.6 All doors to be installed shall be flush hollow core door with wood-veneer and shall have an inside reinforcement frame.

B.2.7.7 The Contractor shall package doors individually in cardboard cartons and wrap bundles of doors in plastic sheeting packaging and deliver them as required.

B.2.7.8 The Contractor shall ensure that jambs, heads, and sills of the doors are level, plumb, and square.

B.2.7.9 The Contractor shall align and fit doors in frames with 3.2mm clearance at heads, jams, between pairs of doors, and from bottom of door to top of decorative floor finish or covering.

B.2.7.10 The Contractor shall rehang or replace doors that do not swing or operate freely.

B.2.7.11 The Contractor shall replace doors that are damaged or do not comply with requirements.

WINDOW INSTALLATION

B.2.7.12 The Contractor shall install Poly Vinyl Chloride (PVC) coated window frames as per the drawing A-05, A-06. The window shall be “HI-SASH Smart Window S115V” manufactured by LG or equivalent. The Contractor shall submit laboratory tests fact sheet, catalogue cut sheet, data sheet, and shop drawings of window and glass for COR’s approval.

B.2.7.13 The window shall be composed of single sash and window frame, 22mm Low-E pair glass, insect screen, and hardware such as handle, crescent, button.

B.2.7.14 The Low-E pair glass shall be composed of 5mm thick tempered glass, 12mm air, 5mm tempered glass and 6 Mil shatter resistant film. The glass will meet the KS L 2003 (Sealed Insulating Glass) and shall have less than 1.8 W/m2k heat transmission coefficients. All glass to be installed shall be Low Emissivity Glass (Low E glass).

B.2.7.15 The Contractor shall firmly install the PVC window to the CMU wall opening with set anchors per the manufacturer’s specification with a minimum of three set anchors per each side.

B.2.7.16 The Contractor shall fill the gap or voids between the window and the CMU wall with urethane foam and apply sealant between CMU wall and window frame.

B.2.7.17 The size of PVC window shall be 1.2m wide and 1.0m high, and the total quantity of PVC windows to be installed is 8 each.

B.2.7.18 The Contractor shall install a wood frame inside the CMU opening of each PVC window per the drawing A-05, A-06. The thickness of wood frame shall be 300mm.

B.2.8 KITCHEN CABINET INSTALLATION

B.2.8.1 The Contractor shall provide two (2) sets of kitchen cabinets per the drawing A-07. The kitchen cabinets to be installed shall be composed of upper and lower cabinets, two sets of 3 drawers each, sink bowl, sink faucet, and artificial granite countertop. The Contractor shall submit the catalogue reference, material data, cut sheet, and shop drawing of kitchen cabinet to COR for approval prior to work commencement. The total length of kitchen cabinet shall be 10 meter each. The shop drawing shall reflect the location of the dish washer, kitchen sink, microwave oven, range hood, refrigerator, and electric range/oven.

B.2.8.2 The kitchen shall be made of same material as existing kitchen cabinet and shall have engravings on the door. The artificial granite countertop shall be “Staron” manufactured by “SAMSUNG SDI CHEMICAL” or “HI-MACS” manufactured by “LG Hausys” or equivalent.

B.2.8.3 The Contractor shall install a stainless steel plate as a protective shield on the wall at the top/back area of the electric oven.

B.2.9 ROOF WORK

B.2.9.1 The Contractor shall extend the existing roof frame and finish materials over the new entrance of the 4932A and new kitchen, maid room, and outside storage of the 4932A and 4932B per the drawing A-05, A-06.

B.2.9.2 The Contractor shall install a roof frame, fascia board, soffit board, wood column, plywood, asphalt roofing, wood strip, cementitious roof tile, gutter with strap, and downspout with strap over the new entrance of the 4932A. The total roof area to be extended over the entrance of the 4932A is 6m2.

B.2.9.3 The roof frame shall be made of 50mm wide and 100mm deep lauan, and roof finish material shall be composed of 25mm thick and 300mm high lauan fascia board, 12mm thick and 800mm wide waterproof plywood soffit board, “Star-sheet SM-A type (Unexposed type one layer waterproof A class first grade)” or equivalent asphalt roofing, 10mm wide and 10mm deep lauan wood strip, cementitious roof tile that is the same as the existing roof tile, 5m long gutter that is the same as the existing gutter, and one (1) set of 100mm diameter of galvanized sheet metal downspout.

B.2.9.4 The Contractor shall install one (1) wood column to support the new roof structure. The wood column shall be made of 100mm wide and 100mm long lauan.

B.2.9.5 The Contractor shall install roof frame, waterproofed plywood, asphalt roofing sheet, corrugated galvanized metal sheet, fascia board, soffit board, gutter with strap, downspout with strap over the new kitchen, maid room, and outside storage of the 4932A and 4932B. The total roof area to be extended over the new kitchen, maid room, and outside storage of the 4932A and 4932B is 25m2 each.

B.2.9.6 The roof frame shall be made of 50mm wide and 100mm deep lauan, and roof finish material shall be composed of 12mm waterproofed plywood, “Star-sheet SM-A type (Unexposed type one layer waterproof A class first grade)” or equivalent asphalt roofing, 1.2mm corrugated galvanized metal sheet, 25mm thick and 300mm high lauan fascia board, 12mm thick and 800mm wide waterproof plywood soffit board, gutter that is the same as the existing gutter, and 100mm diameter of galvanized sheet metal downspout. The total length of the gutter to be installed at the 4932A and 4932B is 19m each. The quantity of downspout to be installed at the 4932A and 4932B is 2 each.

B.2.9.7 All the wood material to be installed outside shall be preservative treated lauan.

B.2.9.8 The Contractor shall provide sanding and apply putty, one (1) coat of wood preservative, and two (2) coat of oil paint all over the surface of wood material to be installed on the exterior of the residence.

B.2.9.9 The Contractor shall apply two (2) coats of enamel paint all over the surfaces of the gutter with strap, downspout with strap, and corrugated galvanized metal sheet.

B.2.10 ELECTRICAL WORK

B.2.10.1 The Contractor shall install electrical wire, conduit pipe, receptacles, switches, and lighting fixtures per the drawing E-01, E-02.

B.2.10.2 The Contractor shall install twenty four (25) sets of lighting fixtures and associated electrical wire, conduit pipe, and switches per the drawing E-01, E-02.

B.2.10.4 The Contractor shall install receptacles and associated electrical wiring with conduit pipe for the dish washer, washing machine, laundry dryer, microwave oven, microwave oven combo, range hood, and electric oven. The Contractor shall relocate existing receptacles, GFCI, and associated electrical wiring and conduit in restroom #2 of the 4932A and 4932B.

B.2.10.5 The Contractor shall relocate the existing thermostatic control and associated electrical wiring and conduit in the living of the 4932A and 4932B.

B.2.10.6 The Contractor shall install chime bell and associated electrical wiring and conduit at the entrance of the 4932A.

B.2.10.7 The Contractor shall re-arrange the main power feeder wiring and conduit to residence 4932A before the existing block demolition work.

B.2.10.8 The Contractor shall install main power feeder wiring and conduit from the existing junction box located on the exterior wall of the storage of 4932A to the utility room of 4932B. The new main power feeder wiring shall go through the attic space of 4932A and to the main panel board at the utility room of 4932B. The Contractor shall install a junction box at the area where the wires are to be connected. The wire size shall be the same as the existing wire, and the length of new main feeder wire shall be 30m. All spliced wiring must meet prescribed NEC requirements.

B.2.10.9 The Contractor shall relocate the existing outdoor main Internet and Telephone panel of the 4932A before the existing block demolition work. The Contractor shall relocate underground grounding rods, conduit, and grounding wire that are connected to the Internet and Telephone panel of the 4932A during the panel relocation work.

B.2.10.10 The Contractor shall change the existing LAN, TEL, cable TV and power wiring system into two separate wiring system as per the drawing E-01, 02, 03.

- Outdoor Cabling work The Contractor shall install a stainless steel waterproof terminal box under the eave including accessories at the 4932A and 4932B. The terminal box size shall be 300mm wide, 400mm high, and 200mm deep. The Contractor shall install two grounding rods underneath the new outdoor terminal box for LAN/Tel and Cable TV systems. The grounding rods shall be 18mm diametric and 2400mm long copper rods. The Contractor shall install a spiral guard wire between the utility pole and the new outdoor terminal box as needed. The Contractor shall remove all the old wires and perform touch up paint to match the existing color of all affected areas of the house.

The Contractor shall install two stainless steel terminal boxes in the utility room for LAN/TEL and cable TV systems including accessories at the 4932A and 4932B, one for LAN/Tel and the other one for cable TV system. The stainless steel terminal boxes shall be 400m wide, 500mm high, and 200 deep. The Contractor shall install 21mm diameter of Hi-PVC conduit pipes between the indoor and outdoor terminal boxes including 2/CAT6 and cable TV wires at the 4932A and 4932B. The Contractor shall install 21mm diameter of Hi-PVC conduit pipes between the new terminal boxes and the combined outlets including 2/CAT6 and cable TV wires. The Contractor shall install two combined outlets for internet, telephone and cable TV in the master bedroom, second bedroom, living room and family room at the 4932A and 4932B as per the drawing E-01, 02, 03. The Contractor is responsible for repairing all the damaged interior walls and ceiling caused by the cable installation.

B.2.10.11 All power wiring and cables shall run into the metal conduit, pull box, other fittings, and concealed in the wall or ceiling.

B.2.10.12 The Contractor shall ensure that electrical system is correctly grounded.

B.2.10.13 The Contractor shall not use flexible metal conduit pipe for power systems connections of more than 1.8 meter long.

B.2.11 MECHANICAL, PLUMBING, AND HVAC WORK

B.2.11.1 The Contractor shall install faucets and associated hot and cold water piping for the washing machine, dish washer, kitchen sink, irrigation, mop sink, commode, and lavatory per the drawing M-01, M-02.

B.2.11.2 The hot and cold water pipes shall be 15mm thick copper pipe and shall have 20mm artilon insulation. All hot and cold water supply pipes shall have an air chamber to prevent water hammering.

B.2.11.3 The Contractor shall install floor drains and associated drain pipes for the washing machine, dish washer, kitchen sink, and mop sink, and shall connect them to existing sewer pipe per the drawing M-01, M-02.

B.2.11.4 The floor drain shall be 100 mm by 100mm. Each drain shall have P-trap and be connected to the vent pipe. All drain pipes shall have a clean-out for the maintenance.

B.2.11.5 The Contractor shall relocate the existing commode, lavatory, glass shelf, toilet cabinet, medicine cabinet, and toilet tissue holder at restroom #2 of the 4932A and 4932B as per the drawing M-01, M-02.

B.2.11.6 The Contractor shall install a transition vent pipe for laundry dryers of the 4932A and 4932B. The transition vent piping shall be made of 6” (150mm) galvanized sheet metal pipe and shall be painted with white two (2) coats of enamel paint. The transition vent piping shall be extended through the house roof, be provided with rain

protection, and shall be designed for disassembly and reassembly for ease of maintenance.

B.2.11.7 The Contractor shall install a flexible duct for the range hood of residence 4932A and 4932B. The flexible duct shall have a 4” (100mm) diameter and shall be extended through the roof to the proper height with appropriate rain and vent protection.

B.2.11.8 The Contractor shall install a mop sink at the utility room of 4932A and 4932B.

B.2.11.9 The Contractor shall install a supply and return duct with diffusers and connect the new duct to the existing duct line at 4932A and 4932B per the drawing M-01, M-02.

B.2.11.10 The new duct shall be made of galvanized sheet metal and shall be covered with 100mm glass-wool insulation.

B.2.12 MISCELLANEOUS WORK

B.2.12.1 The Contractor shall reinstall the existing house appliances such as dish washer, microwave oven, microwave oven combo, washing machine, laundry dryer, and electric oven at 4932A and 4932B.

B.2.12.2 The Contractor shall repair the lawn area of both residences that has been damaged during the construction.

B.2.12.3 The Contractor shall install four (4) sets of catch basins and 40m length of storm water pipe as per the drawing A-02, A-03. The catch basin shall have 300mm width, 300mm length, and 500mm depth, and the storm water pipe shall be 100mm diameter of VG2 pipe.

B.2.12.4 After completion of all project work, the Contractor shall repair any damages that occurred during the construction work and shall match all repair finishes to the existing surfaces.

B.3 EXAMINATION OF THE SITE

The Contractor acknowledges that he has satisfied himself as to the nature of materials and methods of the existing construction noted for repair or replacement, and to the obstacles likely to be encountered, insofar as this information is reasonably ascertainable from an inspection of the specified structures and or premises. The Contractor shall carefully study and compare the

Contract Documents with each other and with information furnished by the USG. Before commencing activities, the Contractor shall: (1) take field measurements and verify field conditions; (2) carefully compare this and other information known to the Contractor with the Contract Documents; and (3) promptly report errors, inconsistencies or omissions discovered to the USG.

B.4 QUALITY CONTROL

B.4.1 Quality Control is the means by which the Contractor ensures that the construction, to include that of subcontracts and suppliers, complies with the requirements of the contract. The controls shall be adequate to cover all construction operations, including both on site and off site fabrication, and will be keyed to the proposed construction sequence.

B.4.2 The Quality Control Program shall be based on a three-phase control process including, Preparatory Phase, Initial Phase and Follow-up Phase.

B.4.2.1 Preparatory phase: Contractor shall prepare and explain their construction plan (man-power schedule, working schedule in detail, surface treatment method, safety plan, fire protection plan etc.)

B.4.2.2 Initial phase: Contractor shall make one sample area for each case such as; paint color etc. for approval by the COR.

B.4.2.3 Follow-up phase: Contractor shall perform their work according to Preparatory phase and Initial phase.

B.4.3 Submittals: The Contractor shall submit a Quality Control plan for acceptance by the COR. The plan shall identify and describe the site organization, personnel, records, and forms to be used. The Embassy reserves the right to require the Contractor to make changes in his plan and operations, including removal of personnel, as necessary, to obtain the quality specified.

B.5 SAFETY MANAGEMENT PLAN

Contractor shall submit safety management plan based on the latest version of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-5-5, in effect on the date of the solicitation.

B.5.1 Safety (FAR 52.236-13 Accident Prevention)

The Contractor shall provide and maintain work environments and procedures which will- (a) Safeguard the public and Government personnel, property, materials, supplies, and

equipment exposed to Contractor operations and activities.(b) Avoid interruptions of Government operations and delays in project completion dates.(c) Control excess costs in the performance of this contract.

Contractor shall comply with all pertinent provisions of the latest version of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation.

Whenever the Contracting Officer becomes aware of any noncompliance with these requirements or any condition that poses a serious or imminent danger to the health or safety of the public or Government personnel, the Contracting Officer shall notify the Contractor orally, with written confirmation, and request immediate initiation of corrective action.

This notice, when delivered to the Contractor or the Contractor's representative at the work site, shall be deemed sufficient notice of the noncompliance and that corrective action is required. After receiving the notice, the Contractor shall immediately take corrective action.

If the Contractor fails or refuses to promptly take corrective action, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be entitled to any equitable adjustment of the contract price or extension of the performance schedule on any stop work order issued under this clause.

D. INSPECTION AND ACCEPTANCE

The COR, or his/her authorized representatives, will inspect from time to time the services being performed and the supplies furnished to determine whether work is being performed in a satisfactory manner, and that all supplies are of acceptable quality and standards.

The Contractor shall be responsible for any countermeasures or corrective action, within the scope of this contract, which may be required by the Contracting Officer as a result of such inspection.

D.1 Substantial Completion

(a) "Substantial Completion" means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:

(1) do not interfere with the intended occupancy or utilization of the work, and (2) can be completed or corrected within the time period required for final completion.

(b) The "date of substantial completion" means the date determined by the Contracting Officer or authorized Government representative as of which substantial completion of the work has been achieved.

Use and Possession upon Substantial Completion - The Government shall have the right to take possession of and use the work upon substantial completion. Upon notice by the Contractor that the work is substantially complete (a Request for Substantial Completion) and an inspection by the Contracting Officer or an authorized Government representative (including any required tests), the Contracting Officer shall furnish the Contractor a Certificate of Substantial Completion. The certificate will be accompanied by a Schedule of Defects listing items of work remaining to be performed, completed or corrected before final completion and acceptance. Failure of the Contracting Officer to list any item of work shall not relieve the Contractor of responsibility for complying with the terms of the contract. The Government's possession or use upon substantial completion shall not be deemed an acceptance of any work under the contract.

D.2 Final Completion and Acceptance

D.2.1 "Final completion and acceptance" means the stage in the progress of the work as determined by the Contracting Officer and confirmed in writing to the Contractor, at which all work required under the contract has been completed in a satisfactory manner, subject to the discovery of defects after final completion, and except for items specifically excluded in the notice of final acceptance.

D.2.2 The "date of final completion and acceptance" means the date determined by the Contracting Officer when final completion of the work has been achieved, as indicated by written notice to the Contractor.

D.2.3 Final Inspection and Tests - The Contractor shall give the Contracting Officer at least seven (7) days advance written notice of the date when the work will be fully completed and ready for final inspection and tests. Final inspection and tests will be started not later than the date specified in the notice unless the Contracting Officer determines that the work is not ready for final inspection and so informs the Contractor.

D.2.4 Final Acceptance - If the Contracting Officer is satisfied that the work under the contract is complete (with the exception of continuing obligations), the Contracting Officer shall issue to the Contractor a notice of final acceptance and make final payment upon:

Satisfactory completion of all required tests, a final inspection that all items by the Contracting Officer listed in the Schedule of Defects

have been completed or corrected and that the work is finally complete (subject to the discovery of defects after final completion), and

submittal by the Contractor of all documents and other items required upon completion of the work, including a final request for payment and a final acceptance (Request for Final Acceptance)

E. DELIVERIES OR PERFORMANCE

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to:

(a) Commence work under this contract within 1 calendar day after receiving contract award.(b) Prosecute the work diligently, and,(c) Complete the entire work ready for use not later than 40 calendar days after receiving

contract award.

The time stated for completion shall include final cleanup of the premises and completion of punch list items.

52.211-12 LIQUIDATED DAMAGES - CONSTRUCTION (SEP 2000) – RESERVED.

E.1 CONTRACTOR'S SUBMISSION OF CONSTRUCTION SCHEDULES

(a) The time for submission of the schedules referenced in FAR 52.236-15, "Schedules for Construction Contracts", paragraph (a), is hereby modified to reflect the due date for submission as "three (3) calendar days after receipt of an executed contract".

(b) These schedules shall include the time by which shop drawings, product data, samples and other submittals required by the contract will be submitted for approval.

(c) The Contractor shall revise such schedules (1) to account for the actual progress of the work, (2) to reflect approved adjustments in the performance schedule, and (3) as required by the Contracting Officer to achieve coordination with work by the Government and any separate contractors used by the Government. The Contractor shall submit a schedule, which sequences work so as to minimize disruption at the job site.

(d) All deliverables shall be in the English language and any system of dimensions (English or metric) shown shall be consistent with that used in the contract. No extension of time shall be allowed due to delay by the Government in approving such deliverables if the Contractor has failed to act promptly and responsively in submitting its deliverables. The Contractor shall identify each deliverable as required by the contract.

(e) Acceptance of Schedule: When the Government has accepted any time schedule; it shall be binding upon the Contractor. The completion date is fixed and may be extended only by a written contract modification signed by the Contracting Officer. Acceptance or approval of any schedule or revision thereof by the Government shall not:(1) Extend the completion date or obligate the Government to do so,(2) Constitute acceptance or approval of any delay, or(3) Excuse the Contractor from or relieve the Contractor of its obligation to maintain the

progress of the work and achieve final completion by the established completion date.

E.2 Notice of Delay

If the Contractor receives a notice of any change in the work, or if any other conditions arise which are likely to cause or are actually causing delays which the Contractor believes may result in late completion of the project, the Contractor shall notify the Contracting Officer. The Contractor’s notice shall state the effect, if any, of such change or other conditions upon the approved schedule, and shall state in what respects, if any, the relevant schedule or the completion date should be revised. The Contractor shall give such notice promptly, not more than ten (10) days after the first event giving rise to the delay or prospective delay. Only the Contracting Officer may make revisions to the approved time schedule.

E.3 Working Hours

All non-disruptive work shall be performed Monday through Saturday, 08:00 to 17:00.

Noisy and disruptive work will be scheduled through the COR.

The Contractor shall submit his/her work schedule including holiday work three days in advance for the COR’s approval.

No extra compensation or payments will be made to the Contractor for any change requests in working hours made to the COR by the Contractor.

Any request to perform work before 08:00 or after 17:00 on any day must be approved by the COR in advance.

F. ADMINISTRATIVE DATA

652.242-70 CONTRACTING OFFICER'S REPRESENTATIVE (COR) (AUG 1999)

(a) The Contracting Officer may designate in writing one or more Government employees, by name or position title, to take action for the Contracting Officer under this contract. Each designee shall be identified as a Contracting Officer’s Representative (COR). Such designation(s) shall specify the scope and limitations of the authority so delegated; provided, that the designee shall not change the terms or conditions of the contract, unless the COR is a warranted Contracting Officer and this authority is delegated in the designation.

(b) The COR for this contract is the Engineer.

(End of clause)

F.1 Payment

The Contractor's attention is directed to Section H, 52.232-5, "Payments Under Fixed-Price Construction Contracts". The following elaborates on the information contained in that clause.

Requests for payment may be made no more frequently than monthly. Payment requests shall cover the value of labor and materials completed and in place, including a prorated portion of overhead and profit.

After receipt of the Contractor's request for payment, and on the basis of an inspection of the work, the Contracting Officer shall make a determination as to the amount, which is then due. If the Contracting Officer does not approve payment of the full amount applied for, less the retainage allowed by in 52.232-5, the Contracting Officer shall advise the Contractor as to the reasons.

Under the authority of 52.232-27(a), the 14 day period identified in FAR 52.232-27(a)(1)(i)(A) is hereby changed to 30 days.

The Contractor shall submit invoices in an original and one (1) copy to the Financial Management Office at the following address:

G. SPECIAL REQUIREMENTS

G.1 Performance Protection - The Contractor shall furnish a performance and guaranty bond as described in 52.228-13 in the amount of 50% of the contract price.

G.1.1 The Contractor shall provide the information required by the paragraph above within ten (10) calendar days after award. Failure to timely submit the required security may result in rescinding or termination of the contract by the Government. If the contract is terminated, the Contractor will be liable for those costs as described in FAR 52.249-10, Default (Fixed-Price Construction), which is included in this purchase order.

G.1.2 The bonds or alternate performance security shall guarantee the Contractor's execution and completion of the work within the contract time. This security shall also guarantee the correction of any defects after completion, the payment of all wages and other amounts payable by the Contractor under its subcontracts or for labor and materials, and the satisfaction or removal of any liens or encumbrances placed on the work.

G.1.3 The required securities shall remain in effect in the full amount required until final acceptance of the project by the Government. Upon final acceptance, the penal sum of the performance security shall be reduced to 10% of the contract price. The security shall remain in effect for one year after the date of final completion and acceptance, and the Contractor shall pay any premium required for the entire period of coverage.

G.2 Insurance - The Contractor is required by FAR 52.228-5, "Insurance - Work on a Government Installation" to provide whatever insurance is legally necessary. The Contractor shall at its own expense provide and maintain during the entire performance period the following insurance amounts:

G.2.1 General Liability (includes premises/operations, collapse hazard, products, completed operations, contractual, independent contractors, broad form property damage, personal injury)

The Contractor shall obtain any other types of insurance required by local law or that are ordinarily or customarily obtained in the location of the work. The limit of such insurance shall be as provided by law or sufficient to meet normal and customary claims.

G.2.3 The Contractor agrees that the Government shall not be responsible for personal injuries or for damages to any property of the Contractor, its officers, agents, servants, and employees, or

any other person, arising from an incident to the Contractor's performance of this contract. The Contractor shall hold harmless and indemnify the Government from any and all claims arising therefrom, except in the instance of gross negligence on the part of the Government.

G.2.4 The Contractor shall obtain adequate insurance for damage to, or theft of, materials and equipment in insurance coverage for loose transit to the site or in storage on or off the site.

G.2.5 The general liability policy required of the Contractor shall name "the United States of America, acting by and through the Department of State", as an additional insured with respect to operations performed under this contract.

G.3 Document Descriptions

G.3.1 Supplemental Documents: The Contracting Officer shall furnish from time to time such detailed drawings and other information as is considered necessary, in the opinion of the Contracting Officer, to interpret, clarify, supplement, or correct inconsistencies, errors or omissions in the Contract documents, or to describe minor changes in the work not involving an increase in the contract price or extension of the contract time. The Contractor shall comply with the requirements of the supplemental documents, and unless prompt objection is made by the Contractor within 20 days, their issuance shall not provide for any claim for an increase in the Contract price or an extension of contract time.

G.3.1.1 Record Documents. The Contractor shall maintain at the project site:

(1) a current marked set of Contract drawings and specifications indicating all interpretations and clarification, contract modifications, change orders, or any other departure from the contract requirements approved by the Contracting Officer; and,

(2) a complete set of record shop drawings, product data, samples and other submittals as approved by the Contracting Officer.

G.3.1.2 "As-Built" Documents: After final completion of the work, but before final acceptance thereof, the Contractor shall provide:

(1) a complete set of "as-built" drawings, based upon the record set of drawings, marked to show the details of construction as actually accomplished; and,

(2) record shop drawings and other submittals, in the number and form as required by the specifications.

G.4 Laws and Regulations - The Contractor shall, without additional expense to the Government, be responsible for complying with all laws, codes, ordinances, and regulations applicable to the performance of the work, including those of the host country, and with the lawful orders of any governmental authority having jurisdiction. Host country authorities may not enter the construction site without the permission of the Contracting Officer. Unless otherwise directed by the Contracting Officer, the Contractor shall comply with the more stringent of the requirements of such laws, regulations and orders and of the contract. In the event of a conflict between the contract and such laws, regulations and orders, the Contractor shall promptly advise the Contracting Officer of the conflict and of the Contractor's proposed

course of action for resolution by the Contracting Officer.

G.4.1 The Contractor shall comply with all local labor laws, regulations, customs and practices pertaining to labor, safety, and similar matters, to the extent that such compliance is not inconsistent with the requirements of this contract.

G.4.2 The Contractor shall give written assurance to the Contracting Officer that all subcontractors and others performing work on or for the project have obtained all requisite licenses and permits.

G.4.3 The Contractor shall submit proper documentation and evidence satisfactory to the Contracting Officer of compliance with this clause.

G.5 Construction Personnel - The Contractor shall maintain discipline at the site and at all times take all reasonable precautions to prevent any unlawful, riotous, or disorderly conduct by or among those employed at the site. The Contractor shall ensure the preservation of peace and protection of persons and property in the neighborhood of the project against such action. The Contracting Officer may require, in writing that the Contractor remove from the work any employee that the Contracting Officer deems incompetent, careless, insubordinate or otherwise objectionable, or whose continued employment on the project is deemed by the Contracting Officer to be contrary to the Government's interests.

G.5.1 If the Contractor has knowledge that any actual or potential labor dispute is delaying or threatens to delay the timely performance of this contract, the Contractor shall immediately give notice, including all relevant information, to the Contracting Officer.

G.5.2 Personnel Security Clearance

After award, the Contractor has 3 calendar days to submit to the Contracting Officer certificates of satisfactory criminal records check of the individuals assigned to this project for the Government. The certificate must be obtained from the police station where the individual maintains his/her residence. A separate list of all the individuals assigned to the project must accompany the certificates and the list should include the following information.

Failure to provide the certificates of satisfactory criminal records check may be considered grounds for rejection and/or require resubmittal of the application. Once the certificates of the applicants have been received and verified, the Government will issue project site access badges to the individuals on the list within 3 working days of the receipt of certificates. The badges may be revoked at any time for falsification of data, or misconduct on site.

The Contractor shall submit a list of all vehicles that require access to the U.S. Embassy property on a weekly basis. Information required is as follows:

The COR and the U.S. Embassy security officer have the right to deny access to any person and or vehicle that are deemed unacceptable.

G.5.3 The Contractor shall provide an English speaking supervisor on site at all times. This position is considered as key personnel under this contract.

G.6 Materials and Equipment - All materials and equipment incorporated into the work shall be new and for the purpose intended, unless otherwise specified. All workmanship shall be of good quality and performed in a skillful manner that will withstand inspection by the Contracting Officer.

G.7 Special Warranties

G.7.1 Any special warranties that may be required under the contract shall be subject to the stipulations set forth in 52.246-21, "Warranty of Construction", as long as they are not in conflict.

G.7.2 The Contractor shall obtain and furnish to the Government all information required to make any subcontractor's, manufacturer's, or supplier's guarantee or warranty legally binding and effective. The Contractor shall submit both the information and the guarantee or warranty to the Government in sufficient time to permit the Government to meet any time limit specified in the guarantee or warranty, but not later than completion and acceptance of all work under this contract.

G.8 Equitable Adjustments

Any circumstance for which the contract provides an equitable adjustment that causes a change within the meaning of paragraph (a) of the "Changes" clause shall be treated as a change under that clause; provided, that the Contractor gives the Contracting Officer prompt written notice (within 20 days) stating:

(a) the date, circumstances, and applicable contract clause authorizing an equitable adjustment and

(b) that the Contractor regards the event as a changed condition for which an equitable adjustment is allowed under the contract

The Contractor shall provide written notice of a differing site condition within 10 calendar days of occurrence following FAR 52.236-2, Differing Site Conditions.

G.9 Zoning Approvals and Permits

The Government shall be responsible for:

Contract performance may require contractor personnel to attend meetings with government personnel and the public, work within government offices, and/or utilize government email.

Contractor personnel must take the following actions to identify themselves as non-federal employees:

1) Use an email signature block that shows name, the office being supported and company affiliation (e.g. “John Smith, Office of Human Resources, ACME Corporation Support Contractor”);

DOSAR 652.236-70 ACCIDENT PREVENTION (APR 2004)

(a) General. The Contractor shall provide and maintain work environments and procedures which will safeguard the public and Government personnel, property, materials, supplies, and equipment exposed to contractor operations and activities; avoid interruptions of Government operations and delays in project completion dates; and, control costs in the performance of this contract. For these purposes, the Contractor shall:

(1) Provide appropriate safety barricades, signs and signal lights;

(2) Comply with the standards issued by any local government authority having jurisdiction over occupational health and safety issues; and,

(3) Ensure that any additional measures the contracting officer determines to be reasonably necessary for this purpose are taken.

(4) For overseas construction projects, the contracting officer shall specify in writing additional requirements regarding safety if the work involves:

(i) Scaffolding;

(ii) Work at heights above two (2) meters;

(iii) Trenching or other excavation greater than one (1) meter in depth;

(iv) Earth moving equipment;

(v) Temporary wiring, use of portable electric tools, or other recognized electrical hazards. Temporary wiring and portable electric tools require the use of a ground fault circuit interrupter (GFCI) in the affected circuits; other electrical hazards may also require the use of a GFCI;

(vi) Work in confined spaces (limited exits, potential for oxygen less that 19.5 percent or combustible atmosphere, potential for solid or liquid engulfment, or other hazards considered to be immediately dangerous to life or health such as water tanks, transformer vaults, sewers, cisterns, etc.);

(vii) Hazardous materials – a material with a physical or health hazard including but not limited to, flammable, explosive, corrosive, toxic, reactive or unstable, or any operations which creates any kind of contamination inside an occupied building such as dust from demolition activities, paints, solvents, etc.; or

(viii) Hazardous noise levels.

(b) Records. The Contractor shall maintain an accurate record of exposure data on all accidents incident to work performed under this contract resulting in death, traumatic injury, occupational disease, or damage to or theft of property, materials, supplies, or equipment. The Contractor shall report this data in the manner prescribed by the contracting officer.

(c) Subcontracts. The Contractor shall be responsible for its subcontractors’ compliance with this clause.

(d) Written program. Before commencing work, the Contractor shall:

(1) Submit a written plan to the contracting officer for implementing this clause. The plan shall include specific management or technical procedures for effectively controlling hazards associated with the project; and,

This notice, when delivered to the Contractor or the Contractor’s representative on site, shall be deemed sufficient notice of the non-compliance and corrective action required. After receiving the notice, the Contractor shall immediately take corrective action. If the Contractor fails or refuses to promptly take corrective action, the contracting officer may issue an order suspending all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be entitled to any equitable adjustment of the contract price or extension of the performance schedule on any suspension of work order issued under this clause.

(1) that it has obtained authorization to operate and do business in the country or countries in which this contract will be performed;

Any notice or request relating to this contract given by either party to the other shall be in writing. J. QUOTATION INFORMATION

A) QUALIFICATIONS OF OFFERORS

Offerors/quoters must be technically qualified and financially responsible to perform the work described in this solicitation. At a minimum, each Offeror/Quoter must meet the following requirements:

(1) Be able to understand written and spoken English;(2) Have an established business with a permanent address and telephone listing;(3) Be able to demonstrate prior construction experience with suitable references;(4) Have the necessary personnel, equipment and financial resources available to perform the

work;(5) Have all licenses and permits required by local law;(6) Meet all local insurance requirements;(7) Have the ability to obtain or to post adequate performance security, such as bonds,

The Offeror/Quoter shall identify and explain/justify any deviations, exceptions, or conditional assumptions taken with respect to any of the instructions or requirements of this request for quotation in the appropriate volume of the offer.

DETAILED INSTRUCTIONS

Volume I: Standard Form (SF) 1442 and Section L. Complete blocks 14 through 20C of the SF 1442 and all of Section L.

Volume II: Price quotation. The price quotation shall include a completed Attachment #1 "BREAKDOWN OF PRICE BY DIVISIONS OF SPECIFICATIONS" and Attachment #2, “LIST OF MATERIAL ONLY WITH QUANTITY TO BE USED WITH NO PRICES”. Complete all applicable portions of this form in each relevant category.

Volume III: Performance schedule and Business Management/Technical Proposal.

(a) Present the performance schedule in the form of a "bar chart" indicating when the various portions of the work will be commenced and completed within the required schedule. This bar chart shall be in sufficient detail to clearly show each segregable portion of work and its planned commencement and completion date.

(b) The Business Management/Technical Proposal shall be in two parts, including the following information:

Proposed Work Information - Provide the following:

(1) A list of the names, addresses and telephone numbers of the owners, partners, and principal officers of the Offeror;

(2) The name and address of the Offeror's field superintendent for this project;

(3) A list of the names, addresses, and telephone numbers of subcontractors and principal materials suppliers to be used on the project, indicating what portions of the work will be performed by them;

(4) Business License which can show the company’s basic information issued by local tax office; and,

Experience and Past Performance - List all contracts and subcontracts your company has held over the past two years for the same or similar work. Provide the following information for each contract and subcontract:

(1) Customer's name, address, and telephone numbers of customer's lead contract and technical personnel;

(2) Contract number and type;

(3) Date of the contract award place(s) of performance, and completion dates;

(4) Contract dollar value;

(6) Any litigation currently in process or occurring within last 5 years; and

Financial Statement - The offeror shall provide a current statement of its financial condition, certified by a third party, that includes:

(1) Income (profit-loss) Statement that shows profitability for the past two (2) years;

(2) Balance Sheet that shows the assets owned and the claims against those assets, or what a firm owns and what it owes for the past two (2) years; and

(3) Cash Flow Statement that shows the firm’s sources and uses of cash during the most recent accounting period. This will help the Government assess a firm’s ability to pay its obligations.

(4) The Government will use this information to determine the offeror’s financial responsibility and ability to perform under the contract. Failure of an offeror to comply with a request for this information may cause the Government to determine the offeror to be non-responsible.

C) 52.236-27 SITE VISIT (FEB 1995)

(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed

(b) A site visit has been scheduled right after the pre-quotation conference on June 3, 2015 at 2:00 P.M.

(c) Participants will meet at the GSO Conference room, U.S. Embassy Seoul.

D) MAGNITUDE OF CONSTRUCTION PROJECT

K. EVALUATION CRITERIA

Award will be made to the technically acceptable, lowest priced, responsible quoter. The Government reserves the right to reject quotations that are unreasonably low or high in price.

The Government will determine acceptability by assessing the offeror's compliance with the terms of the RFQ. The Government will determine responsibility by analyzing whether the apparent successful quoter complies with the requirements of FAR 9.1, including:

ability to comply with the required performance period, taking into consideration all existing commercial and governmental business commitments;

satisfactory record of integrity and business ethics; necessary organization, experience, and skills or the ability to obtain them; necessary equipment and facilities or the ability to obtain them; and otherwise qualified and eligible to receive an award under applicable laws and

regulations.

L.1 52.204-3 TAXPAYER IDENTIFICATION (OCT 1998)

(a) Definitions."Common parent", as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member.

"Taxpayer Identification Number (TIN)", as used in this provision, means the number required by the IRS to be used by the offeror in reporting income tax and other returns. The TIN may be either a Social Security Number or an Employer Identification Number.

GOVERNMENT–FURNISHED CONTRACTOR-INSTALLED PROPERTY

Embassy’s Responsibilities: The Embassy will arrange and pay for product delivery to the site in accordance with the construction schedule. The Embassy and the Contractor shall jointly inspect the deliveries for shortages, damaged, or defective items if needed. The Embassy will arrange for replacement of damaged, defective, or missing items.

Contractor’s Responsibilities: The Contractor shall unload, uncrate, and store the products at the site and shall secure and protect them from exposure to the elements and other damage. Items lost or damaged after acceptance by Contractor shall be replaced at the Contractor’s expense.
