PROPOSITIONSSmith – Haile Debate on Divorce and Remarriage
"The Bible teaches that if a man puts away his scriptural (faithful) wife for a reason other than fornication, and then commits fornication, the original wife may not remarry."Affirm J. T. Smith - Deny: Tim Haile
"The Scriptures teach that whenever fornication is committed, the faithful spouse may put away his fornicator-mate and marry another."Affirm: Tim Haile - Deny: J. T. Smith

Reasons For This Debate:
1. Brother Smith Made The Debate Challenge
I have personally avoided making these differences a test of fellowship.
I teach that an innocent spouse, one faithful to his marriage vows, may put away his fornicator-mate and marry another.
However, my position neither expects nor requires anyone to remarry.
My position does not bind – It allows one to do what Jesus said he may do.
Charts byTim Haile 5
Reasons For This Debate:
2. There Has Been Much Controversy Over The Question Of The Rights Of The Innocent Put-Away Party
3. This Controversy Has Resulted In Broken Friendships, Cancelled Meetings and Division
4. Brother Smith And I Are Good Friends, And Brethren In Christ
5. I Have Agreed To Take This Matter Up For The Sake Of Brother Smith, The Hearers, And Myself All Coming To A Better Knowledge Of The Truth
Charts byTim Haile 6
Another Perspective
Brother Smith and I Agree That The Only Cause For Putting Away and Remarriage Is Fornication.Brother Smith and I Agree That When Fornication Is Committed, The Innocent Spouse May Put Away The Fornicator-Mate And Marry Another. This Is What Jesus Taught In Matthew 19:9!It Would Appear That There Is No Need For This Debate! But Brother Smith Adds His Provisos!

This Debate Is NOT About:
Condoning The Sin Of Adultery – He And I Both Condemn and Combat Adultery!
Arguments Based Upon Emotions, Feelings or Fairness – I Make None!
“Mental Divorce” – A False and Misleading Label – A Term of Derision – A Prejudicial Concoction – “Apoluo” Is A Verb of Action Involving Determination and Declaration

This Debate Is NOT About:
The Waiting Game:
Matthew 5:32: “But I say unto you, That whosoever shall put away his wife, saving for the cause of fornication, causeth her to commit adultery: and whosoever shall marry her that is divorced committeth adultery.”
One Commits Adultery If He Puts Away His Mate Not For Fornication, Waits For That Mate To Commit Fornication, Then Marries Another.
If Two Mates Put Each Other Away Not For Fornication, Neither May Remarry

This Debate Is NOT About:
The Waiting Game:
Is One Guilty Of Playing “The Waiting Game” If He Plans To Remarry After The Death Of A Mate Who Has Unlawfully Put Him Away? (Rom. 7:2)
Is One Guilty Of Playing “The Waiting Game” If He Plans To Remarry His Spouse Who Had Put Him Away And May Be Reconciled To Him? (1 Cor. 7:11)

This Debate Is NOT About:
A “Second Putting-Away” – a Misnomer and Misrepresentation – I Advocate Only ONE Putting-Away That Is For The Cause of Fornication!
Whether or Not Divorce Is “Real” – Some Divorces May Be Approved, While Other Divorces Are Unapproved, But ALL DIVORCES ARE REAL!
Fellowship – (Unless It Is Forced Upon Us) – I Respect The Scruples of Others!

Civil Law Must Be Obeyed, However Civil Law Involves Only The Legal Registration of Marriage and Divorce
Marriage Is God’s Law, Not Man’s

Who Has The Right To Remarry – We Both Agree
1) One Whose Mate Has Died, And
2) One Who Puts Away His Mate For Fornication

This Debate IS About:
The Right Of An Innocent Spouse To Do What Jesus Authorizes Him To Do, i.e. To Put Away (repudiate, renounce, reject, refuse, disavow, disown, disclaim, discard, divorce) His Fornicator-Mate And Marry Another Without Committing Adultery. Jesus Nowhere Conditioned His Permission Upon Any Unlawful Prior Divorce Action That Might Have Taken Place By The Godless or Fornicating Mate

This Debate IS About:
Whether Or Not A “Put-Away” Person Can Put Away:
An Innocent Spouse Can Lawfully Do What His Godless Mate Had Unlawfully Done
He Can Lawfully Repudiate The Mate Who Had Unlawfully Repudiated Him
He Can Lawfully Reject The Mate Who Had Unlawfully Rejected Him

This Debate IS About:
Inventing A Put-Away CLASSIFICATION This Is Done By Emphasizing The ACTION Of Putting-Away Over The CAUSE Of Putting-Away
Some Believe And Teach That One Is Forbidden The Right Of Remarriage Upon The Mere Basis That He Was “Put Away”
They Speak Of One Obtaining A “Put-Away Status” (not Bible language)
Charts byTim Haile 32
This Debate IS About:
We Hear Things Like: “All I Know Is What The Bible Says, or “The Words of Jesus Are Still True… – Whoever Marries A Put-Away Woman Commits Adultery.”
Why Don’t We Hear, “All I Know Is What The Bible Says – Whoever Marries A Putting-Away Man Commits Adultery” (Matt. 19:9; Mk. 10:11; Lk. 16:18)? THE BIBLE “SAYS” THAT TOO!
Charts byTim Haile 33
“ALL I KNOW IS”
“…Whosoever shall put away his wife, except it be for fornication, and shall marry another, committeth adultery…(Matt. 19:9a)
“…Whosoever shall put away his wife, and shall marry another, committeth adultery against her” (Mk. 10:11)
“Whosoever putteth away his wife, and marrieth another, committeth adultery…” (Lk. 16:18a)
Charts byTim Haile 34
I ALSO KNOW
THAT THE PRESENCE OF THE FORNICATION CAUSE CHANGES THE OUTCOME OF THE MAN’S PUTTING AWAY “…Whosoever shall put away his wife, except it be for fornication, and shall marry another, committeth adultery…(Matt. 19:9a)
IT EQUALLY CHANGES THE OUTCOME FOR THE INNOCENT PUT-AWAY WOMAN, Who Puts Away Her Fornicator-Husband (Matt. 19:9a)
Charts byTim Haile 35
This Debate IS About:
Some Brethren Turning A Bible Statement Into An Absolute (“whoever marries a put-away woman commits adultery”), Allowing Themselves Exceptions To That Absolute Statement (spouse dies, reconciliation, put away by unlawful mate…etc), But Not Allowing Others To Apply The Exception Clause of Matthew 19:9a In Cases Where Some Prior Unlawful Divorce Has Occurred
Charts byTim Haile 36
This Debate IS About:
Procedure – Brother Smith’s Position Empowers The Godless Mate To Take Some Divorce Action That Forever Nullifies His Innocent Spouse’s Right To Put Him Away For Fornication And Marry Another
Allowing A Godless Mate To Nullify A God-Given Permission
Allowing Godless Judges To Nullify A God-Given Permission
Charts byTim Haile 37
This Debate IS About:
Binding An Innocent Spouse To His Fornicator-Mate All The Days Of His Life (or for the life of his mate)
Making Fornication Irrelevant Because It Is Committed After The Fornicator Has Already Left His Innocent Spouse
Placing A Time Limit On How Much Time Is Allowed To Pass Between The Godless Mate’s Leaving (apheimi), and the Godless Mate’s Fornication

Matthew 19:3-9 - Observations
Some Brethren Reject Thayer’s Definition (“repudiate”), And Accept His Personal Comment (“from the house”)
Their Position Requires This In Order To Limit Putting-Away To What One Does To A Marriage (physical separation), Instead Of What He Does To A Mate (his woman, or her man)

Matthew 19:3-9 - Observations
If The Words “from the house” Are Inherent In Apoluo, Then No Putting-Away Can Take Place Anywhere Except In The House Of The One Doing The Putting Away!It Would Then Be Impossible and Unscriptural For One To Put Away His Mate At Some Other Location (such as the courthouse, unless “house” implies “court” house)

Matthew 19:3-9 - Observations
What About Cases Where The Fornicator Has Already Departed From The House? Does His Leaving Eliminate The Innocent Spouse’s Ability To Repudiate For Fornication?“Putting Away” (apoluo) Does Not Mean Merely Putting Distance – It Is More Than Just Spatial Separation
Charts byTim Haile 47
Why Use “Repudiate” of Divorce?
“Repudiate” Means:“1.To refuse to have anything to do with;
to disown; to cast off publicly, as a son, or divorce, as a wife.
“2. to refuse to accept, or acknowledge; to deny the validity or authority of.

• Jesus Spoke of What a Woman Does to Her “Husband” (Gr. “man”) (Mk. 10:12)

Woman Gets Divorce Papers 42 Years LaterMarch 1, 2004 Reuters
AMMAN (Reuters) - A Jordanian woman received formal divorce papers 42 years after her husband left, and long after she remarried and had children, the official Petra news agency said on Sunday.
The 68-year-old man divorced his wife verbally in 1962, but only registered his new marital status two weeks ago, when he needed to apply for an official identity card, Petra said.
In Islam, a man is considered divorced from his wife after declaring it to her verbally three times.
The man filed formal divorce papers only after a civil servant dealing with his ID card application asked for proof that he was no longer wed to his former wife.

Do the fornicator’s quick actions force God to retract the exception clause and withdraw His permission for the innocent spouse to remarry?

Some Observations:
Jesus used “apoluo” to describe what the husband would do to the wife (renounce, disown, disavow, repudiate her).
Though repudiation, spatial separation, and remarriage would have already occurred, his adultery would still be “against” his bound mate.
Adultery is a sin against a person (in this case against the bound wife) affecting the marriage covenant, and not just the physical union!

Some Observations:
Since Jesus placed no limit upon how much time may pass before the adultery ceases to be “against” the bound mate, we are forced to conclude that the amount of time must coincide with the marriage bond, however long that is.

(or consequence) for both men is adultery.Consequence of action, yes … “Sequence” of events, no

They Mean “After The Fact” of an Ungodly Mate Unlawfully Divorcing His Faithful and Sexually Innocent Spouse, And Has Now Committed Fornication!

“Mental Divorce”
I Know Of NO ONE In This Present Controversy Who Believes That Biblical Putting-Away Is a Mental Act Alone“Mental Divorcer” Is a Term of Derision Applied To Those of Us Who Deny That Covenant-Breakers, Fornicators and Human Courts Determine The Remarriage Rights of The Innocent Spouse Who Was Unlawfully Put Away By His Godless Mate“Apoluo” Is A VERB OF ACTION. It Involves The Rejection of One’s Bound Mate

“Ratification” (n) Means “making something valid by formally ratifying or confirming it” (AHD)

Biblical Putting Away Versus Civil ProcedureTWO FREQUENT MISTAKES:
1.Confusing the Marriage Relationship With The Marriage Bond
a.Herodias was “married” to Herod while bound to Philip (Mk. 6:17-18)
b.By “departing,” the woman was “unmarried,” yet still bound to her husband (1 Cor. 7:11)
c.See Rom. 7:2-3; Matt. 19:9

Biblical Putting Away Versus Civil ProcedureTWO FREQUENT MISTAKES:
2. Equating Biblical Putting Away With Civil Law Procedurea) Human authorities may forbid
marriage when God allows it (1 Tim. 4:3 - Still a “doctrine of devils”)
b)Jewish civil law made no provisions for a woman to put away her husband (Deut. 24:1-4), but Christ’s law did (Mk. 10:12)

God’s Views Of “Putting Away”
When the Fornicator Puts Away His Innocent Mate:
God Sees The Putting Away But He DOES NOT APPROVE IT
God Does Not Loose The Fornicator From The Marriage Bond
When the Innocent Puts Away His
Fornicating Mate:
God Sees The Putting Away And He DOES
APPROVE IT
God Then Looses The Innocent From The Marriage Bond

What We Are “Accustomed” To:“However, not all men have this knowledge; but some, being accustomed to the idol until now, eat {food} as if it were sacrificed to an
idol; and their conscience being weak is defiled” (1 Corinthians 8:7, NASB)
• Some had “conscience” of the idol (KJV)
• They were “accustomed” to the idol (NASB)
• Many Americans are “accustomed” to linking “marriage” and “divorce” to civil law protocol and procedure

What We Are “Accustomed” To:• Some Corinthians could not separate the
“meat” that was sacrificed to the “idol” from the “idol” itself. They thought of the idol as something
• Paul and others thought of idols as being “nothing in the world” (1 Cor. 8:4)
• Brethren who feel strongly that civil or cultural procedure is directly linked to the marriage bond should abide by the dictates of their consciences

Remarriage: No “Waiting Game”
• Essential To Define Terms Properly and Consistently – Words Mean Things!
• A “Game” Is A Competitive Activity or Sport In Which Players Contend “With Each Other”
• Traditionally, the “waiting game” position has been defined as a divorce scenario in which either party is potentially authorized to remarry.
• The New Testament Does Not Allow BOTH Parties The Right of Remarriage
Charts byTim Haile 162
Remarriage: No “Waiting Game”
• Traditionally, brethren have understood the “waiting game” as a scenario in which, following a consensual divorce, each person “waits” on the other one to either remarry, or engage in sexual relations.
• It is then alleged that the one who refrained from sexual relations may then repudiate the other and remarry.
• This position opens the door for remarriage to either putting-away party – the Bible does not allow for this potential
Charts byTim Haile 163
Remarriage: No “Waiting Game”
• Matthew 5:32 Disallows The Waiting Game:• “But I say unto you, That whosoever shall put
away his wife, saving for the cause of fornication, causeth her to commit adultery: and whosoever shall marry her that is divorced committeth adultery.”
• If one repudiates his mate for a cause other than sexual immorality, he “causes” her to commit adultery when she remarries.
• He is the “cause” because he repudiates and rejects his bound wife for no scriptural cause.
Charts byTim Haile 164
Remarriage: No “Waiting Game”
• Matthew 5:32 condemns a man if he repudiates his wife without the scriptural cause
• Matthew 5:32 condemns a woman if she marries another without a scriptural putting-away of her husband
• Matthew 5:32 condemns the second man if he marries a woman who has no scriptural right to remarry
• Matthew 5:32 teaches two types of guilt and two types of innocence

Remarriage: No “Waiting Game”
By Combining The Principles Stated In Matthew 5:32, 19:9, and Mark 10:11, In Marriages In Which Fornication Is Committed, One Who Is Innocent of Putting Away His Mate, And Who Is Innocent of Fornication, May Exercise His Right To Repudiate His Fornicator-Mate And Marry Another
Again, Biblically, Only One Party Ever Has The Right Of Remarriage, Possibly Neither, But Never Both!
Charts byTim Haile 169
Remarriage: No “Waiting Game”
One should not be charged with a “waiting game” position just because he says the innocent may repudiate the guilty even when the fornication is committed after the fornicator leaves the marriage first
In most cases, the fornicator does leave his spouse in order to commit fornication
Jesus did not specify how much time may pass between the fornicator’s “departing” from his innocent mate, and the commission of his sin (fornication)
