    COMMUNITY DEVELOPMENT DEPAR MESUBJECT: CITY COUNCIL WARDS REAPPORTIONMENTISSUE:Should the City Council direct staff to present the following three alternative scenarios forCouncil Wards Reapportionment for consideration at a public hearing set for September26,2011?RECOMMENDATION:Staff recommends that the City Council direct staff to present the following three alternativescenarios (Attachment A) for Council Wards Reapportionment for consideration at a publichearing set for September 26, 2011.BACKGROUND:Every ten years following the enumeration by the U.S. Census Bureau, the Council wardboundaries of the City of Salem are adjusted to equalize the population represented byeach ward. This equalization of representation is known as reapportionment.On June 27, 2011, the City Council authorized staff to move forward with the council wardsreapportionment process, appointed Mayor Peterson as the council liaison for wardsreapportionment, and directed staff to retain the Mid-Willamette Valley Council ofGovernments (COG) to assist the City Council in the development of these new wardboundaries (Attachment B).On July 11 and 12, 2011, City Councilors attended interviews with COG redistricting staff,providing feedback regarding reapportionment criteria, potential ward boundary changes,and identifying additional considerations to be taken into account in the reapportionmentprocess. A City Council work-session was held at the Salem Main Library on August 8,2011, to provide an informal opportunity for the public and members of the City Council toreview and discuss alternatives for the ward boundaries and ask questions of staff andCOG redistricting staff prior to a formal meeting.Through the interviews and work-session the Council provided considerations andsuggestions to COG redistricting staff regarding potential ward boundary changesCouncil Ward Boundaries Page 1 September 12,2011

    including but not limited to the following: the treatment of ward boundaries with respect tothe downtown core and Ward 8 (West Salem), maintenance of communities of commoninterest and adherence to neighborhood, urban renewal area and current Council wardboundaries where practical.Feedback from the councilor interviews and work-session was used by COG staff toprepare three alternative ward boundary scenarios for consideration at a public hearing setfor September 26, 2011. It is anticipated that the alternative ward boundary scenarioscontained in 'Attachment A,' or modifications to them as determined by City Council, will bepresented for consideration at a public hearing before City Council on September 26, 2011.

    FACTS AND FINDINGS:1. The U.S. Census Bureau released their redistricting data files from the 2010Census in March, 2011, facilitating updates to Oregon legislative and congressionaldistrict boundaries, which concluded in July, 2011.2. Upon completion of state legislative boundary redistricting, local governments andspecial government bodies are directed by the Oregon Secretary of State toreapportion ward and/or election district boundaries.3. City Councilors attended interviews with COG redistricting staff on July 11 and 12,2011, to discuss the wards reapportionment criteria and the reapportionmentprocess.4. A City Council work-session regarding the wards reapportionment criteria andprocess was held on August 8, 2011.5. Based on the considerations identified in the councilor interviews and at thework-session, COG redistricting staff has prepared three alternative wardboundary !:;cenarios.6. The three alternative scenario maps and tables containing demographicinformation (population by ethnicity, deviation from current wards) for the existingand proposed ward boundaries are attached herein (Attachment A).7. Following the September 26, 2011, public hearing it is anticipated that the CityCouncil will select a new wards boundary map.8. The new ward boundaries must be finalized and submitted to the CountyElections offices by November 1, 2011.

    Should the City Council direct staff to move forward with the council wardreapportionment, appoint Mayor Peterson as the council liaison and approve MidWillamette Valley Council of Governments (COG) staff to perform the council wardreapportionment services.RECOMMENDATION:Staff recommends that City Council direct city staff to move forward with the councilward reapportionment, appoint Mayor Peterson as the council liaison and approve COGstaff to perform the council ward reapportionment services.BACKGROUND:On January 11, 2011, the City Council was provided with an "information only" reportwhich outlined the reapportionment process (Attachment A). In order to move forwardwith the reapportionment process City Council action is required for the following:1. Appointment of Mayor Peterson as the council liaison to serve as a single point ofcontact between the City Council and the COG, and2. Approval of consultant services to perform the council ward reapportionmentservices.In December 1975, the Congress passed Public Law (P.L.) 94-171 which requires thatthe federal Census Bureau make special preparation to provide redistricting data. TheP.L. 94-171 data is used by each state to redraw legislative district boundaries andused by local governments to redraw ward and/or election disfrict boundaries. Thisequalization of representation or balancing of population between ward and/or electiondistricts is known as reapportionment.

    The current Salem city council ward boundaries were developed in 2001 following the2000 Census. The 2010 census population information is now available. Analysis ofthe ward boundaries has been performed to determine where population needs to bebalanced due to population growth or decline over the past decade. In order todetermine the optimum population for each council ward, the total population (154,637)for the city is divided by the number of council wards (8), and the resulting number(19,329) becomes the target population.Below is a table which summarizes the current population of each ward and thedeviation from target population (Attachment B - Current Wards Chart).

    Following the 1990 and 2000 decennial censuses, the City of Salem contracted with theCOG staff to perform the ward reapportionment services. In general, thereapportionment services provided by COG included preparation of draftreapportionment plans, maps and data describing that plan, staff report, access tosoftware and data, and attendance at several public meetings including an informalpublic open house, City Council meetings and public hearing.FACTS AND FINDINGS:

    . 1. COG is uniquely qualified to perform the services because they are familiar with thepast project; has special access to redistricting data prepared by the CensusWard Reapportionment Page 2 June 27, 2011

    Bureau, and has the technical expertise to utilize redistricting software.2. The ward reapportionment process begins after the state legislative districtboundaries are updated in July 2011. Therefore, it is anticipated that the ward

    reapportionment activities will take place during July, August, and September 2011.3. One of the initial steps of the reapportionment process is the City Council reviewand adoption of the criteria utilized as a guideline for readjusting the wardboundaries.4. The COG's ward reapportionment services will include:

    Develop the draft criteria to be utilized for readjusting the ward boundaries; Facilitation of a work session to brief the City Council on the reapportioningprocess, review the draft criteria, and address any questions or concerns; Preparation of three redistricting plan alternatives, including maps andsummary data; Presentation ofthe alternatives at a City Council meeting; and Preparation of the final plan maps and tables in electronic format.

    5. Following the work session staff will present the criteria for adoption by the CityCouncil.6. Special efforts will be made by staff with assistance from COG to identify Title VIpopulations, formulate public involvement strategies, and report outreach efforts toand participation by Title VI communities.

In the past, the followingcriteria contained in the Oregon Revised Statue (ORS) 188.010 formed-the basis forreapportioning the City Council ward boundaries:

    1. Each district, as nearly as practicable, shall:(a) Be contiguous;(b) Be of equal population;(c) Utilize existing geographic or political boundaries;(d) .Be connected by transportation links.2. No district shall be drawn for the purpose of favoring any political party, incumbentlegislator or other person. 3. No district shall be drawn for the purpose of diluting the voting strength of anylanguage or ethnic minority group.. .As part of this reapportionment process, the City Council will be asked to provide guidance onthe following issues:

    1. Approval of consultant services to perform the ward reapportionment services;2. Appointment of Mayor Peterson as the council liaison to assist with the reapportionment efforts;.3. Review and adoption of the criteria to be used in updating the ward boundaries;4. Approval of protocols for individual councilor input and/or briefing;5. Approval of City Council wards reapportionment tasks and timeline; and6. Review and approval of wards reapportionment plan including alternative wardboundaries.     Following the last decennial census (2000), the City of Salem contracted with the Mid-Willamette Valley CounciJ.of Governments (MWVCOG) staff to perform the wardsreapportionment services. In general, the primary reapportionment services provided by COGinclude the assistance in the development of criteria; and preparation of draft reapportionmentplans, maps and data describing that plan.FACTS AND FINDINGS:

    1. The MWVCOG has expressed an interest to again work with the City of Salem toupdate the City's ward boundaries utilizing the 201 0 Census Data.2. The ward reapportionment process begins after the state legislative district'boundaries are updated in July 2011. Therefore, it is anticipated that the CityCouncil be involved in wa'rd reapportionment activities during July, August, and

    September 2011.3. The new ward boundaries must be finalized and submitted to the Marion CountyElections by .November 1, 2011.
