Our processes are built around managing our debtor relationships with the same commitment to excellence that we apply to managing our client relationships.

Most of our clients measure our performance not only on how effectively we collect their accounts but also on integrity, debtor sensitivity, ease of interaction, communications and other factors.

Claims Management Process

At Convergent we follow a disciplined process to maximize the return for our clients on each claim.

Attorney Service: If it becomes apparent that persuasion is not going to do the job, we will refer the claim to one of our network attorneys.

Internal Legal: Convergent’s legal department excels in working with issues relating to contract terms. Understanding the contract puts the legal department in a better position to encourage a debtor to pay on the contract or, as a second resort, negotiate a settlement based on the interpretation of the contract.

Disputes & Settlements: Our collectors will work through disputes with debtors, and when appropriate, initiate settlement discussions. We ask our debtors to prove all disputes and support claims of financial hardship.

Payment Arrangements: We accept payments through the mail, over the phone, by wire, check or credit card. We remit payments upon clearance, once a week.

Personal Contact: We treat each claim as a sale and assign it to a collector who understands that industry and the type of claim. If that collector is unsuccessful, we will assign the claim to another collector to try a different approach. Sometimes just a different voice is enough to get a payment.

In today’s environment, the right talent and techniques won’t get you far without the right technology.

Recognizing the unique nature of the commercial receivables management process, over the years we have invested heavily in our proprietary commercial collection system, which operates on reliable IBM hardware and software. Our system operates completely in real time, including real time messaging, and provides a comprehensive claim history. Over the years we have continued to refine the user interface to maximize user productivity and ease of use.

We have made major investments to web-enable our business so our clients can submit claims and track progress electronically. We also maintain off site backup and have a disaster recovery plan in place.

“We negotiate before you litigate”

Each attorney works under the direction of Jaclyn P. Brodie and has a broad range of experience with the full array of contractual issues, underpayment issues and each possesses superb negotiation skills. Convergent’s legal department excels in working with issues involving the application of contract terms, which may put the legal department in a better position to encourage a debtor to pay on the contract or, as a second resort, negotiate a settlement based on the interpretation of the contract.

� Immediate Demand for Payment: When accounts are referred to Convergent’s legal department, a prelitigation demand for immediate payment is drafted and submitted to the debtor to increase the pressure on the payer to resolve the matter and also to ensure that administrative remedies have been appropriately exhausted.

� Faster Resolution: By forwarding an account to a trained and experienced attorney who is familiar with the issues of specific clients, you are taking advantage of the respect others give to attorneys, which may encourage debtors to pay. At the same time we utilize special skills on hand that an attorney may possess enabling the attorney to negotiate resolution with debtors in order to avoid a lengthy and costly litigation process.

� Local Counsel: Once a claim is forwarded to the legal department, and is reviewed by General Counsel, if no payment is able to be collected after all pre-litigation efforts have been exhausted, Convergent’s legal department will close the account if it does not meet the suit parameters of the client or is deemed uncollectible. If the account does meet suit parameters, Convergent will make a recommendation to forward to bonded, CLLA member local counsel available world wide to pursue all appropriate litigation action.

� Attorney - Attorney Service: As noted earlier, all claims in which a debtor is an attorney or is represented by an attorney should be immediately forwarded to Convergent’s legal department to maximize our chances of success. Although once in a while a collector may be able to get immediate payment from an attorney, this is an unlikely scenario, comparable to a collector calling any debtor and immediately obtaining payment.

� Teamwork: The legal department was created after years of successfully collecting on accounts with collectors. Convergent’s success is best attributed to its effective, seasoned collectors. However, as debtors become more immune to conventional collection efforts Convergent recognized the need to do more. Such an addition is the legal department. By adding experienced, trained attorneys, most claims, if they meet the criteria, will get attorney review sooner than in the past. This often results in earlier collections and benefits our clients by eliminating the additional costs, fees and time associated with litigation.

PERSONAL COLLECTION SERVICE: Collection efforts by experienced, professional personnel, consisting of various types of demands for payments including field visits when deemed appropriate, selected and employed on an individual account basis by Convergent. Unless otherwise specified, all claims will be acknowledged and accepted commencing with Personal Collection Service.

INTERNAL LEGAL SERVICES: When accounts are referred to Convergent’s legal department, a pre-litigation demand for immediate payment is drafted and submitted to the debtor to increase the pressure on the payer to resolve the matter and also to ensure that administrative remedies have been appropriately exhausted. Each attorney works with Jaclyn P. Brodie and has a broad range of experience with the full array of contractual issues, underpayment issues and each possesses superb negotiation skills.

FORWARDING SERVICES: Automatically forwarding, on client’s behalf, accounts for legal or other action, and serving as liaison on behalf of client and subject to client’s instructions. When suit is authorized there may be additional charges, including costs, administrative and suit fees and, at times, a retainer. These charges include attorney’s fees and also our service charges which are separate and apart from the attorney’s fees. There are no additional costs or suit fees unless suit is authorized by client.

GENERAL CONDITIONS: Each account forwarded to Convergent may be collected directly or forwarded by Convergent in the name, on behalf of, and for the account of the client to one or more attorneys or other agents for collection. The services described above apply to commercial accounts generally, except where prohibited, and to non-commercial accounts solely at the election of Convergent. Commercial accounts are defined as an amount payable by going businesses, determined at the time the accounts are placed for collection by the client. The relationship between the client and Convergent is one of the principal and agent and in connection therewith Convergent shall, as agent, exert its good and proper efforts to effect collections and, with respect to accounts forwarded to attorneys, or other agents, Convergent shall not be responsible for any loss caused by the acts or omissions of any such attorneys or other agents. Client agrees to indemnify and defend Convergent from any loss or expense arising out any preference claim made under applicable bankruptcy and insolvency laws with regard to amounts collected by Convergent for client. Convergent shall have the right to endorse for deposit and/or collection in the name of and on behalf of the client, remittances received on accounts placed for collection and to deduct and retain from such remittances all appropriate fees and charges. Accounts withdrawn or settled directly by the client are subject to charges for the service the account is in at the time Convergent receives written notice from the client, or otherwise learns of such withdrawal or settlement. Merchandise or credit accepted by the client is considered to be a direct settlement. Unless otherwise provided, a rate of 50% will apply on collections where accounts are non-commercial, where debtor is not in business or the account has previously been handled by others. Special fees may apply in some areas, where local rates have been established or where extra work and expenses may be necessary and the regular charges are found to be inadequate.
