BACK NEXTWhat is a CLW Reference?Each digest in a Criminal Law Week issue is assigned a unique Criminal Law Week reference. For example, CLW/13/08/3 refers to item 3 of issue 8 of 2013. You’ll see CLW references all over Criminal Law Week Online. Clicking on a CLW reference takes you straight to that digest. Sometimes CLW references appear without the CLW/ in front (e.g. 13/08/3).

Special FeaturesWhile the Criminal Law Week issues in PDF format are perfect for printing, Criminal Law Week digests in HTML format are packed with features that are not available in the PDF format.

Click on the feather icon to open a transcript of the judgment, provided by CASETRACK. Full-text judgments are available for Court of Appeal and High Court cases digested in Criminal Law Week issues from 2001 onwards.

Click on the clipboard icon to add the digest to your clipboard – for more information, see CLIPBOARD.

Click on the Table of Cases (ToC) icon to bring up a pop-up box with information from the Criminal Law Week table of cases, so you’ll know the best citation to use in court.

The update box tells you how a case has been subsequently treated (upheld, reversed, considered, applied, distinguished, etc.) and the current status of legislation (amended, repealed, revoked, etc.). Clicking on a CLW reference in the Update box will take you to the relevant digest. Clicking on the clipboard icon at the end of a list of updates will add all the digests in the list to your clipboard – for more information, see CLIPBOARD.

The general rule is:

[ words in square brackets ] – indicate that whatever is in the brackets has been inserted by an amendment.

words struck through – indicate that whatever is struck through has been repealed or revoked by an amendment.

[ underlined words in square brackets ] – indicate that whatever is in the brackets will be inserted by an amendment that is not yet in force.

underlined words – indicate that whatever is underlined will be repealed or revoked by an amendment that is not yet in force.

But it can get more complicated. You should always look at the Amendments/ Repeals tab together with the provision to get the full picture.

The Statutes Service shows you not only what a particular statutory provision looks like today; it also shows you what the provision used to look like, and changes that will be made in the future.

There are many ways to search Criminal Law Week Online. How you search depends on what information you are looking for, and what information you have. The wealth of information in Criminal Law Week digests and the Statutes Service has been indexed by criminal practitioners so that you have all the information you need at your fingertips.

Wherever you are on Criminal Law Week Online, you will see a SEARCH box on the right hand side of the page. Click the Select search options drop-down menu or the Advanced link to begin your search.

BACK NEXTSearch the subject indexCriminal Law Week Online’s subject index has been created by criminal lawyers for criminal lawyers. Criminal law week digests are indexed by reference to intuitive key terms. If you are searching within a particular subject area (e.g. hearsay, bad character, sentencing for fraud), then the subject index is a good place to start. To search, select Subject index from the drop-down menu, then type your search term in the box.

TIP: The subject index looks like an alphabetical index in a book, and our search engine searches each line of the index for your search word. For best results, stick to one key word when searching.

TIP: A good way to start searching is with a name from the case title and the year the case was decided or reported, e.g. Clinton 2012.

TIP: Avoid using punctuation in a search term. When it comes to citations, instead of [2012] 3 W.L.R. 515, type 2012 515.

TIP: You cannot search on a word that is less than four characters. So if you are looking for a case called R. v. X., for example, search by the citation or use the Advanced Search to search by judge name and/ or judgment date.

Search by case name or citation

If you have some details of the name or citation of the case you are looking for, select Table of cases from the drop-down menu.

For example, you might know that one of the appellants was called Clinton and the case was reported in 2012. Type Clinton 2012 into the search box and click SEARCH. Or, if you know that the case was reported at [2012] 3 W.L.R. 515, type 2012 515 into the search box.

The table of cases can be browsed as well as searched. Hover over the TABLES & INDEX menu at the top of the page, and click on Table of cases. The orange box that appears on the right below the search box allows you to navigate the table of cases alphabetically, based on the name of the case.

Click on a Criminal Law Week reference to go to the digest of that case. From there you can access the transcript.

You will see where and under what name a case has been reported, so you can use the best citation in court.

If you are interested in a particular provision, and the Act is one included in our Statutes Service, then the Statutes Service is the best place to start your research. Each provision is fully annotated with information about amendments and repeals, and all relevant cases reported in the Criminal Law Week Case Sources will be listed in the Authorities section. For more information, see STATUTES SERVICE.

Select Statutes Service from the drop-down menu. You can go directly to a specific provision in the Statutes Service by selecting the Act name from the drop down menu, typing the provision number into the Prov. No. field, and clicking SEARCH. Alternatively, you can search a particular Act or the entire Statutes Service for a key word, words, or phrase.

If the statute you are looking for is not in the Statutes Service, you can still find all the information you need. Select Table of statutes from the drop-down menu. The table of statutes not only directs you to the Criminal Law Week digest of that statute (if 1997 or later), but will give you links to Criminal Law Week digests of cases that have considered particular statutory provisions, and of subordinate legislation made under that statute.

For example, if you are looking for the Powers of Criminal Courts (Sentencing) Act 2000, type powers in the Act name field, and 2000 in the Year field, or powers sentencing in the Act name field.

For example, if you want to find the Coroners and Justice Act 2009 (Commencement No. 5) Order 2010 (S.I. 2010 No. 1858), type Coroners into the SI name field and 2010 into the Year field, or 2010 into the Year field and 1858 into the Number field.

BACK NEXTTop Tips for SearchingCriminal Law Week Online uses the standard Boolean operators AND, OR, NEAR and NOT. These operators make it possible to search not only for items that contain a specific keyword or exact phrase, but also:

• Search for items that contain all of a specified combination of keyword(s)/ exact phrase(s) (AND).

• Search for items that contain at least one of a number of different keywords/ phrases (OR)

• Limit a search to keywords/ phrases that appear within 50 words of each other (NEAR)

• Exclude specific keywords/ phrases from a search (NOT)

• Carry out complex searches using combinations of a number of Boolean operators

Exact phrases

A phrase consisting of a number of words in a specified order must be surrounded by double quotes, e.g. ”bad character”.

Small words

The site cannot search on words that are less than four characters, such as to, of and for. Should you wish to search for abuse of process, be sure to surround your search query with double quotes (”abuse of process”).

AND

To search for items that contain a number of keywords/ phrases, separate search terms with a space, e.g. ”false impression” implied assertion or with the word AND, e.g. ”false impression” AND implied AND assertion.

OR

To search for items that contain at least one of a number of keywords/ phrases, separate search terms with the word OR, e.g. ”bad character” OR ”hearsay evidence” OR retrial.

NEAR

To search for items that contain keywords/ phrases within 50 words of each other, separate search terms with the word NEAR, e.g. ”false impression” NEAR assertion.

NOT

To search for items that contain one keyword/ phrase but which do not contain another keyword/ phrase, separate search terms with the word NOT, e.g. to search for items that contain the phrase bad character, but do not contain the keyword defendant, type ”bad character” NOT defendant.

The use of brackets with Boolean operators permits more complex searching.

Example 1: to search for items containing either:

robbery AND ”offensive weapon”

or:

robbery AND firearm,

or both, type: robbery AND (”offensive weapon” OR firearm)

Example 2: to search for items which either contain both:

”abuse of process” AND ”agent provocateur”

or contain:

entrapment

or both, type: entrapment OR (“abuse of process” AND ”agent provocateur”)
