A letter to identify the course/program of interest will be sent out with the Enrollment Agreement. Please read, fill out, sign, and return the Enrollment Agreement to MITAGS. Once the Enrollment Agreement, Agreement Addendum and Release of Liability are received; the program will be confirmed (provided the candidate meets, and has enclosed all admission requirements. A MITAGS representative will sign and return a copy of the Enrollment Agreement to the candidate. Be sure to review and keep a copy of the Vocational Catalog for the specific admission requirements for the program. TUITION Tuition for MITAGS’ programs is charged per program. Vocational programs may be paid in advance or within a payment schedule that is agreed upon by the school and student, which will be provided to and signed by both. A signed copy will be provided to the student and another kept on file in the student record. Financial aid is available however, in the event that approval for such aid is pending; the student will be responsible for the tuition and must pay in accordance with the payment schedule. AGREEMENT IS BINDING This Enrollment Agreement will be binding when it has been fully completed, signed, and dated by the student and an authorized representative of the school prior to the commencement of instruction. NOTICE TO BUYER This is a legal document. Do not sign this Enrollment Agreement before you read it or if it contains any blank spaces. All pages of this Enrollment Agreement are binding. Read both sides of all pages before signing. You are entitled to an exact copy of this Agreement, the school catalog, and any other papers you may sign. You are required to sign this statement, which acknowledges your receipt of the Agreement and Catalog. JOB PLACEMENT AND SALARIES The MITAGS does NOT guarantee any job placement or salary upon completion of the program. PREVIOUS SEA SERVICE AND COMPLETED COURSES This program requires students to receive 360 days of sea service beyond the Boundary Line and attend all courses as included and approved by the U. S. coast Guard to successfully complete this program. The MITAGS cannot accept any prior sea service for inclusion within the program’s 360 days of sea service. Only the U. S. Coast Guard can consider or accept previous sea service for a merchant marine license qualification. If a student withdraws from the Workboat Mate Program prior to completion of the entire program they will be disenrolled as of their last day of attendance on the MITAGS campus. EFFECTIVE DATE OF ACCEPTANCE I certify that I have read and understand the cancellation policy, refund policy, confirmation policy, and complaint procedure. I have received a copy of the school catalog; I understand that I am entitled to an exact copy of this Enrollment Agreement, the school catalog, and any other papers I sign. I hereby agree to abide by the conditions set forth herein. I understand that this agreement will be effective upon signature of both me and the MITAGS official. NOTICE Maryland regulations require the following information to be supplied to each student when enrolling in a private vocational school that is licensed under COMAR Section 13B.01.01.15 A, “Each school shall have a catalog that shall be given to all students at the time of enrollment. The catalog shall describe comprehensively the schools facilities, educational offerings, activities, policies, and other information prescribed by the Secretary, and shall state the estimated length of the schools programs and courses in clock hours, weeks, and months.” ACKNOWLEDGEMENT BY SCHOOL Prior to being enrolled in this school, the applicant, whose signature appears below, has been made aware of the legal obligations he/she takes on by entering into a contract for the training. ACKNOWLEDGEMENT BY ENROLLEE I understand and accept that any contract for training that I enter into with the above named school contains legally binding obligations and responsibilities. I understand and accept that repayment obligations will be placed on me by any loans or other financing arrangements I enter into as a means to pay for my training. I understand that the Enrollment Agreement I am entering into will not be binding, or take effect, for at least seven (7) calendar days, provided that I have not entered classes sooner. UNFAIR BUSINESS PRACTICES It is an unfair business practice for the school to sell, discount, or otherwise transfer this contract or promissory note without the signed, written consent of the student or his/her parent or guardian and a written statement notifying all parties that the cancellation and refund policy continues to apply. CHANGES IN THE AGREEMENT Any changes in the Enrollment Agreement will not be binding on either the student or the school, unless such changes are acknowledged in writing by an authorized representative of the school and by the student. MEDICAL LIABILITY Students are required to sign a Release of Liability to participate in the program (separate document). MITAGS will not be responsible for any medical expenses incurred by the student while enrolled in the program. The student will be responsible for all medical expenses incurred. MITAGS recommends that you maintain an individual medical insurance policy. COURSE CANCELLATION BY STUDENT Students are required to provide 72-hours notice (3-business days) for cancellation. Cancellations may be given either verbally or in writing to the attention of the Registrar. Failure to provide such notice will result in a 10% administrative fee based on the cost of the course, or $100.00, whichever is less, per MHEC requirements.

COURSE CANCELLATION BY SCHOOL The school reserves the right to cancel a class if the number of students enrolled is insufficient. If this occurs, the student may request a full refund of monies paid for tuition or apply all monies paid to the next scheduled class, if there is one scheduled. GROUNDS FOR TERMINATION BY SCHOOL A student that fails to maintain satisfactory academic progress, attendance, violates safety regulations, interferes with other students’ work, is disruptive or obscene, and / or is under the influence of alcohol or drugs is subject to immediate termination form the program. Additional conditions apply in accordance with the policy in the Catalog. GROUNDS FOR TERMINATION BY ONBOARD TRAINING PROVIDER A student that fails to follow any direction, order, or command of the vessels master, maintain satisfactory progress, violates safety regulations, interferes with other crew members work, is disruptive or obscene, and / or is under the influence of alcohol or drugs is subject to immediate termination from the program. Additional conditions apply in accordance with the policy in the catalog. REASSIGNMENT OF STUDENT If the onboard training provider is not able to provide a training billet and onboard berth due to financial hardship, insolvency, or corporate decision to not participate in the program, the student may be reassigned by MITAGS to another onboard training provider, if possible and available, to complete their program. Reassignment may require the student to be reassigned and attend a future scheduled program to ensure continuity and integrity of the program. DISCONTINUED PROGRAMS If the school discontinues instruction of any program after a student enters the training, including circumstances where the school changes its location, students must be notified in writing of such events. In such circumstance, the student will be entitled to a pro-rata refund of all tuition and fees paid, unless comparable training is arranged for by the school and agreed upon, in writing, by the student. The student must make a request for such a refund within 30-days from the date the program was discontinued, or relocated. The refund must be paid within 30-days after receipt of such a request. REFUNDS MITAGS will issue a refund under the following circumstances: 1) If the school discontinues a course after the student has enrolled. 2) If the school cancels a course due to insufficient enrollment. 3) If the student cancels a course in accordance with the Student Cancellation Policy referenced above.

MITAGS will issue a partial refund if the student is terminated by the school in accordance with the Termination by the School policy referenced above. Refunds will be proportional to the following guidelines: 1) If the student completes less than 10% of the program, the school will refund 90% of the tuition cost, less the registration fee*. 2) If the student completes 10% of the program, but less than 20%, the school will refund 80% of the tuition cost, less the

registration fee*. 3) If the student completes 20% of the program, but less than 30%, the school will refund 60% of the tuition cost, less the

registration fee* 4) If the student completes 30% of the program, but less than 40%, the school will refund 40% of the tuition cost, less the

registration fee*. 5) If the student completes 40% of the program, but less than 50%, the school will refund 20% of the tuition cost, less the

registration fee*. 6) If the student completes more than 51% of the program, no refund will be made.

*"Registration fee" is a 10% administrative fee that is based on the cost of the course, or $100, whichever is less.

The student, or the student’s representative, must submit a request for refund within thirty (30) days of the date that notice of cancellation was submitted to the school Registrar. The request for refund must include the following information: the course and the date it was cancelled, student name and address for refund receipt, and student signature. Refund requests received later than thirty (30) days after the notice of cancellation will not be eligible for refund unless extenuating circumstances exist that prevented the request from being submitted in a timely manner. Any extenuating circumstances must be explained in the request for refund. The school Training Director will review all late requests and determine whether the circumstances merit a refund. When calculating refunds, the official date of a student’s termination is the last full day of recorded attendance.

Refund Denial Appeals Any student that is denied a refund may appeal the decision, in writing, to the school Training Director. Appeals must be received within thirty (30) days of the date of denial. The decision of the school Training Director, on appeal, is final. Refund Payouts Students awarded a refund of program costs will be reported to the accounting department within seven (7) calendar days of the date of approval. The accounting department will refund the appropriate program costs via company check, which will be sent to the refund receipt address that was provided by the student in the request for refund. CANCELLATION OF AGREEMENT If you have not started training, you may cancel this Enrollment Agreement by submitting written notice of such cancellation to the school at the address provided on the Agreement. Notice shall be submitted not later than midnight of the fifth business day (excluding weekends and holidays) following the signing this Agreement or the written notice may be personally delivered to the school within that timeframe. In the event of a dispute over timely notice, the burden of proof will rest on the sender. Enrollment Addendum for Students in the Workboat Mate Program

The following terms and conditions apply to all students that are currently enrolled in the Workboat Mate Program (“Program”) which is offered by the Maritime Institute of Technology and Graduate Studies (“MITAGS”):

A. Student Eligibility To be eligible for MITAGS’ Workboat Mate Program, each student must comply with the following: 1. Be enrolled in the Program and be recommended by the School’s Cooperative Education Official. 2. Be at minimum of nineteen (19) years of age. 3. Be a U. S. citizen, a national (resident of American Samoa or Swains Island), or a naturalized citizen with valid work

authorization certificate. 4. Hold a valid Transportation Workers Identification Credential (TWIC) issued by the Transportation Security Agency 5. Hold a valid and current Merchant Mariner Credential (MMC) issued by the U. S. Coast Guard 6. Hold a valid and current U. S. Passport. 7. Be drug-free and willing to participate in the Drug-Free Workplace Program, as required by the companies that provide the

shipboard training component of the program. Also, must be willing to submit to drug and/or alcohol testing as requested. Note: All testing is performed by approved government or contracted medical facilities.

8. Meet all regulatory qualification standards that are required for the position, and physical qualifications that are outlined by

the United States Coast Guard for licensed deck officers in 46 CFR Part 10.

B. Shipboard Work Assignments Unlicensed students in the Program will be provided with the opportunity, based on ship availability, to complete their U.S. Coast Guard (USCG) required three-hundred and sixty-five (365) days of sea service and the applicable competencies as detailed below: Officer in Charge of a Navigational Watch (OINCNW). Able Seaman, Limited (AB). Mate - 500 GRT, Oceans, or Mate 1600 GRT, Near Coastal. STCW-95 Certificate for OINCNW on Vessels 200 GRT (500 GT) or more. Each student in the program will have the opportunity to demonstrate that he/she has mastered the STCW competencies required for this license. MITAGS will provide each student with a Training Record Book (TRB) and Towing Officer Assessment Record (TOAR), if applicable. These documents contain the applicable Assessment Control Sheets that must be signed by the Company’s Ship Master. Students are also be expected to complete the following: Work alongside other Crew Members. Stand Watches. Participate in Drills. Perform the normal duties that are expected of members assigned to the Ship’s Crew .

C. Work Schedules

Depending on ship availability, each student will be employed as a cadet in a temporary, full-time training position by a Company. During this time students will be assigned to work regular schedules where they will perform various duties and watches for that Company. Each student will work fifty-six (56) hours per week onboard his/her assigned ship. Each student will be required to demonstrate competencies during the scheduled work hours. In keeping with the requirements of STCW and the Program, the Company will ensure that no less than one-hundred and eighty (180) days of each student’s onboard experience will be spent in the wheelhouse performing bridge watchkeeping duties under the direct supervision of the watch-keeper.

D. Pay and Benefits Each student will receive the following pay and benefits during the shipboard training portion of the program: 1. Each student will receive a salary from his/her assigned Company in an amount that is equal to “Cadet Wages” as determined

by the U. S. Maritime Administration for the hours worked. Students are paid in accordance with the company’s established pay schedule. Please Note: that students enrolled in the Workboat Mate program may not be employed in any other position while they are enrolled in this Program.

2. Any costs associated with sending students to their assigned ship, (such as transportation, meals, and/or lodging) will be the responsibility of the Company.

3. All students are entitled to medical, surgical, and/or hospital services/supplies that are required for treatment relating to any personal injury that is sustained while in the performance of job related duties, including employment related diseases and injuries sustained during transport to and from the vessel. The Jones Act provisions apply to participants in this program. Furthermore, benefits are also provided under the Federal Employee’s Compensation Act (FECA) and are administered by the U.S. Department of Labor, Employment Standards Administration, and the Office of Worker’s Compensation Programs (OWCP). FECA also provides for the payment of benefits to the student’s dependents if the injury or disease results in death. Benefits may be denied if the injury or death is caused by the willful misconduct of the student or by the student’s intention to bring about his/her injury or death or that of another, or if intoxication (by alcohol or drugs) is the proximate cause of the injury or death.

4. No employment relationship will exist between the student and MITAGS. E. Promotions and Pay Increases

Promotions and pay increases are not expected for any student while enrolled in this Program.

F. Employment After Completion of the Workboat Mate 500/1600 Ton Program Requirements Within one-hundred and twenty (120) calendar days after the successful completion of the program’s educational requirements, a student may be non-competitively promoted and/or converted to a permanent position with his/her assigned Company, contingent upon the student meeting the qualification standards for the higher grade, performance management, the position classification requirements of the Company, and supervisory recommendations. All promotions are at the discretion of the Company and are not guaranteed.

G. Student Responsibilities Each student is required to comply with the following: 1. Adhere to all Workboat Mate Program policies and procedures and the policies and procedures of his/her assigned Company,

including assigned work schedules. 2. Assume personal and professional responsibility for all actions and activities.

3. Meet the academic, performance, and conduct standards that have been established by MITAGS and/or the Company.

4. Provide MITAGS and the Company with periodic progress reports on the quality of work and study assignments.

5. Notify MITAGS and the Company of any changes in status.

H. Termination A student’s enrollment in the Program (including shipboard training assignments) may be terminated at any time for any of the following reasons: 1. Resignation.

2. Change to a field of study that does not qualify the student for a career position as a licensed deck officer.

3. Suspension, expulsion, or withdrawal from the Program.

4. Unsatisfactory performance in the classroom or during the shipboard training.

5. Medical disability.

6. Administrative reasons (e.g. budget constraints, misconduct, lack of work, etc.).

7. Failure to successfully complete the program in a timely manner. In the event that a student’s enrollment is terminated for any reason, MITAGS’ liability, if any, is limited to a refund of all or a portion of the tuition that was paid by the student, as required by the Enrollment Agreement or by law. To the extent that no refund is required by the Enrollment Agreement or by law, liability is limited to the portion of the tuition that was paid by the student that is in MITAGS’ sole discretion as being appropriate.

I. Waiver and Release Each student agrees to comply with the following: I am aware of the inherent dangers of, and the general health considerations presented by, all activities that are connected

with the Workboat Mate Program.

I further understand, and agree, that it is not the function of the instructors to serve as the guardians of my health and safety. I agree, on behalf of me, my family, personal representatives, heirs, successors, and assigns (collectively “Releasors”), that MITAGS, its trustees, administrators, directors, officers, servants, employees, agents, representatives, and their respective heirs, personal representatives, and assigns (collectively “School Releasees”) shall not be liable for injuries, death, or other damages or losses in connection with my participation in the Program. I hereby waive, on my behalf, and on behalf of my Releasors, any claims related thereto.

I assume all risks in connection with the Workboat Mate Program and all related activities. I further release and discharge, on behalf of myself, my family, my personal representatives, heirs, successors, and assigns, the School Releasees from any and all harm, injury, damage, or loss arising out of my participation in the Program, whether foreseen or unforeseen, known or unknown, present or future, and however caused.

I agree to indemnify, and hold harmless, the School Releasees from any claims, damages, demands, costs, or losses to them, or to any one or more of them, arising out of my participation in the Program; including, but not limited to, those resulting from, or arising out of, any personal injury to me or from my death.

STUDENTS IN THE MITAGS WORKBOAT MATE PROGRAM [THE “PROGRAM”] , WILL BE REQUIRED TO PARTICIPATE IN RIGOROUS PHYSICAL ACTIVITY IN A SWIMMING POOL, AT FIRE FIGHTING TRAINING FACILITIES, AND SHIPBOARD RELATED ACTIVITIES IN ALL TYPES OF WEATHER AND SEA CONDITIONS; WHICH WILL INCLUDE, BUT IS NOT LIMITED TO, THE FOLLOWING ACTIVITIES:

• JUMPING INTO POOL FROM HEIGHT OF APPROXIMATELY ONE METER.

• SWIMMING A DISTANCE OF APPROXIMATELY 20 FEET WHILE WEARING A PFD OR IMMERSION SUIT.

• STAYING AFLOAT FOR APPROXIMATELY 1 MINUTE WITHOUT THE USE OF A PFD OR SIMILAR AID.

• DEPLOYING AND ENTERING A LIFERAFT AND RIGHTING A CAPSIZED LIFERAFT WHILE WEARING A PFD OR IMMERSION SUIT.

• CONDUCT SEARCH & RESCUE OF SIMULATED PERSONNEL CASUALTIES WEIGHING APPROXIMATELY 150 POUNDS FROM AN

ENCLOSED SPACE-SMOKE/FIRE ENVIRONMENT WHILE WEARING BREATHING APPARATUS AND PROTECTIVE CLOTHING.

• EXTINGUISH FIRES WITH AND WITHOUT THE AID OF BREATHING APPARATUS. THIS WILL INCLUDE MOVING QUICKLY AND

CLIMBING UP AND DOWN LADDERS WHILE HOLDING FIRE FIGHTING EQUIPMENT, SUCH AS HEAVY HOSES.

• BENDING, STOOPING, LIFTING, AND TURNING REAL OR SIMULATED PATIENTS.

• PERFORMING CARDIO-PULMONARY RESUSCITATION ON A MANIKIN.

• LIFTING, PULLING, AND PUSHING HEAVY WIRE, SYNTHETIC, AND NATURAL FIBER LINES, ROPES, AND CABLES.

• BEING UNDERWAY ONBOARD COMMERCIAL TOWING VESSELS IN ALL TYPES OF WEATHER CONDITIONS, SEA CONDITIONS,

AND EXTREME TEMPATURES, BOTH HOT AND COLD, IN RAIN, SNOW, AND OTHER INCLEMENT WEATHER.

• CLIMBING ON, OVER, AND THROUGH LADDERS, STAIRS, FIXED RIGGING, TOW LINES, MOORING LINES, BRIDLES, ANCHOR

CHAIN AND GROUND TACKLES, LINE HANDLING WINCHS, CAPSTANS, AND ALL OTHER TYPES OF RELATED VESSEL

EQUIPMENT IN VARIOUS LOCATIONS.

• JUMPING TO AND FROM TUGBOATS, BARGES, PIERS, DOCKS, SHIPS, BOATS, FLOATING AND FIXED PLATFORMS.

Each participant is urged to consult with his/her doctor if any question exists regarding his/her physical ability to participate in the Program. Individuals who feel that the Program may be hazardous to their health should not apply for, or participate, in the Program. The Maritime Institute of Technology & Graduate Studies (MITAGS) does not provide insurance of any type for participants in the Program.

MITAGS RESERVES THE RIGHT TO DENY TRAINING TO TERMINATE THE TRAINING OF ANY INDIVIDUAL, AT ANY TIME, WHEN SUCH TRAINING APPEARS TO CONSTITUTE A HAZARD TO SUCH PERSON OR TO OTHERS.

In the event of such denial or termination of training, MITAGS will return all, or the appropriate pro rata portion, of any paid fee.

I also understand and agree, on behalf of me, my family, personal representatives, heirs, and assigns (collectively “Releasors”) that MITAGS, its trustees, directors, officers, servants, employees, agents, and representatives, and their respective heirs, personal representatives, and assigns (collectively the “MITAGS Releasees”) shall not be held liable in any way for any occurrence in connection with my participation in the Program, which may result in personal injury, death, or other damages to me or my property.

In consideration of being allowed to enroll in the Program, I hereby personally assume all risks in connection with it, and the

Releasors further release and discharge the MITAGS Releasees from any harm, personal injury, or damage that may befall me or my property while I am enrolled in the Program, including all risks connected therewith, whether foreseen or unforeseen, known or unknown, present or future, and however caused.

I agree to save, and hold harmless, the MITAGS Releasees from any claim by the Releasors or any of them, arising out of my

enrollment and participation in the Program, and any damages, claims, demands, costs, fees, rights, or causes of action resulting from or arising out of any personal injuries sustained by me in connection with, or as a result of, my enrollment and participation in the Program.

I further state that I am of lawful age and legally competent to sign this Consent and Release Form. I understand that the

terms herein are contractual and not merely a recital. I have fully informed myself of the contents of this Consent and Release Form by reading it before I signed it; and that I have signed this document as my own free act.
