Die erste Hälfte der Veranstaltung will einen Überblick über das deutsche Privatrecht verschaffen. Der Schwerpunkt der Vor- lesung liegt im allgemeinen Privatrecht (Allgemeine Regeln, Vertrags- und Sachenrecht des Bürgerlichen Gesetzbuchs). Er- gänzend wird auf Sonderprivatrechte wie etwa dem Handelsrecht als Sonderprivatrecht der Kaufleute Bezug genommen. Die zweite Hälfte der Veranstaltung soll einen ersten Einblick in das System des deutschen öffentlichen Rechts verschaffen. Der Schwerpunkt der Vorlesung liegt im Verfassungsrecht und betrifft die Kernfragen des Staatsorganisationsrechts und der Grundrechtslehre. Darüber hinaus werden die Grundlagen des allgemeinen Verwaltungsrechts behandelt und exemplarisch einige Bereiche des besonderen Verwaltungsrechts (z.B. das Polizeirecht) vorgestellt. Fragen des Verfassungs- und Verwal- tungsprozesses werden ergänzend angesprochen. Es ist jeweils eine der vier Vorlesungen am Montag und am Mittwoch bei demselben Dozenten/ derselben Dozentin (sprich Mo und Mi bei Prof. Kerkhof ODER Mo und Mi bei Prof. Peitz/ Prof. Trenkler) sowie eine Übungsveranstaltung nach Wahl zu besuchen. Weitere Hinweise finden Sie auf der Homepage von Herrn Prof. Falk http://www.uni-mannheim.de/fakul/jura/ls/falk/index.htm Text des Aushangs HWS 2011: Die Veranstaltung wird jeweils dienstags von 17.15 – 18.45 Uhr im EW 95 alle zwei Wochen stattfinden; erstmals am 6. September 2011. Die Teilnehmer erhalten im ersten Teil eine kompakte Einführung in die wissenschaftlichen Grundlagen der Rhetorik (insb. Wahrnehmungspsychologie). Im zweiten Teil werden sich zunehmend praktische Übungen anschließen. Bei dem Proseminar handelt es sich um eine Dauerveranstaltung, die im nachfolgenden Semester ihre Fortsetzung finden wird, da der Erwerb rhetorischer Fertigkeiten nur durch längerfristige Schulung möglich ist. Die Teilnehmerzahl ist auf 20 begrenzt. Die Themen der einzelnen Sitzungen werden zusammen mit begleitenden Materialien jeweils frühzeitig auf der Homepage ver- öffentlicht. Interessenten können sich bereits jetzt am Lehrstuhl mit einem kurzen Motivationsschreiben und einer Notenübersicht bewer- ben. Das Proseminar steht nicht nur den Studenten der Rechtswissenschaft, sondern auch allen Studierenden im Bereich des Historischen Instituts offen.

This course offers an introduction into main areas of EU competition law illustrated by practical examples which in part reflect the lecturer’s own experience as an eminent German antitrust practitioner. Core elements of EU competition law treated inclu- de the concepts of horizontal and vertical restraints of competition, the importance of market definitions and the various tech- niques used therefore, the role of market power for Articles 101 and 102 TFEU and the basic outlines of merger control. Stu- dents will be required to understand the specific economic approach to the application of competition law favoured by the EU Commission. They will become familiar with original decisions by the EU Commission and the European Courts dealing with competition aspects. The course aims to allow a basic understanding of how competition law affects business decisions. The students will be required to draw comparisons between the system of EU competition law and their own national competition law. To the extent possible the students will be invited to contribute skills developed in neighboring subjects such as economics and institutional law of the European communities.

This course will offer access to both the theory and the practice of human rights. The focus will be on global and regional human rights systems. An overview will be provided with regard to the historical and philosophical background of international human rights protection, the content and legal nature of the respective instruments – including different dimensions and generati- ons of human rights – as well as existing implementation mechanisms. At the universal level the course will touch on the trea-

ty-based as well as the Charter-based systems. At the regional level emphasis will be put on the European system of human rights protection as established by the Council of Europe. A comparative look will especially be taken at human rights and basic freedoms within the framework of the European Union. After a theoretical introduction into the protection of human rights in public international law, the students will work on case studies. In this practical part, the course will, if possible, in co-operation with a practicing attorney at law, concentrate on the Euro- pean Convention on Human Rights. The cases to be discussed will be real cases which are either still pending before the Eu- ropean Court of Human Rights at Strasbourg or have been decided.

The course addresses students who take a particular interest in business law. It focuses on international aspects of business transactions and their legal and commercial requirements, and allows students to get an initial understanding of what legal ad- vice in practical terms is like. In a first step several important principles of German civil law are introduced and discussed in class and compared to similar principles under foreign law like, e.g., French or English law. This may result in comparing, for example, the advantages and disadvantages of a floating charge under English law as opposed to individual security under German law, or the rules on financial assistance under the German and English regime. In a second step case studies with a cross-border background are prepared at home and talked through in class. Students are required to understand not only the importance of the relevant legal aspects but also the commercial dynamics of a transaction. As the course is in English, students have also the opportunity of familiarising themselves with the relevant legal terms.

Section 1: The course makes the nature of Comparative Law as well as its functions and aims accessible to students from different legal backgrounds. The students will be taught the philosophical and logical background of comparisons in general and the course will especially reflect on the tertium comparationis of the comparison of laws and on the question "what is law?". Students will read various texts by philosophers who have investigated the "nature of law" and discuss examples from comparative constitutional law. Section 2: This section will deal with constitutional aspects of comparative law. After an introduction to comparative constitutional law as such the course will proceed by comparing the treatment of specific constitutional law issues in selected countries. The sessions will concentrate on comparative federalism, analyzing various aspects of the systems chosen in Germany, Au- stralia, the United States and Canada. Furthermore, the electoral systems of Germany, Australia, the United States and Gre- at Britain will be analyzed, with particular regard to problems of gerrymandering/redistricting. Finally, the case of Caroline von Monaco as decided by the German Constitutional Court and the European Court on Human Rights will serve as an example of the protection of fundamental rights in different legal systems. Some changes to this tentative schedule may occur at short no- tice. Section 3:This part of the course deals with private law aspects of comparative law. The traditional grouping of legal families of the world will be discussed with students and alternative systems will be elaborated. Furthermore the course will give comparative legal insights to laws in transition (i.p. in former socialist societies) as well as legal transplants. Global and European har- monisation of laws will be discussed. In a workshop session the students will work on and present a small project of legal comparison.

Grundprinzipien des Zivilrechts, aber auch des Strafrechts und des öffentlichen Rechts werden kurz erläutert. Auf die Durchsetzung des Rechts vor den Gerichten wird ebenfalls eingegangen. Die Veranstaltung dient insbesondere auch dazu, die Sprachkompetenzen im juristischen Bereich zu erweitern. dents will be required to understand the specific economic approach to the application of competition law favoured by the EU Commission. They will become familiar with original decisions by the EU Commission and the European Courts dealing with competition aspects. The course aims to allow a basic understanding of how competition law affects business decisions. The students will be required to draw comparisons between the system of EU competition law and their own national competition law. To the extent possible the students will be invited to contribute skills developed in neighboring subjects such as economics and institutional law of the European communities.

Die Vorlesung findetvoraussichtlich meist 14tätig statt. Herr Prof. Cremer teilt den Studierenden in der Vorlesung jeweils den nächsten Termin mit. This course will offer access to both the theory and the practice of human rights. The focus will be on global and regional human rights systems. An overview will be provided with regard to the historical and philosophical background of international human rights protection, the content and legal nature of the respective instruments – including different dimensions and generati- ons of human rights – as well as existing implementation mechanisms. At the universal level the course will touch on the trea- ty-based as well as the Charter-based systems. At the regional level emphasis will be put on the European system of human rights protection as established by the Council of Europe. A comparative look will especially be taken at human rights and basic freedoms within the framework of the European Union. After a theoretical introduction into the protection of human rights in public international law, the students will work on case studies. In this practical part, the course will, if possible, in co-operation with a practicing attorney at law, concentrate on the Euro- pean Convention on Human Rights. The cases to be discussed will be real cases which are either still pending before the Eu- ropean Court of Human Rights at Strasbourg or have been decided.

Die Veranstaltung beginnt am 22.10.2012. The course is designed to provide an overview of the principles of intellectual property law including the context with international treaties and EU legislation. Students will learn the legal concepts of patent protection and utility models, the rules on the protection of trademarks and designations of origin, the basics of copyright law and of design protection. Where appropriate the course will also highlight certain rules under unfair competition law providing ancillary remedies for avoiding unfair exploi- tation of work results. German intellectual property law will be seen as a set of rules which is paradigmatic. Participants from other jurisdictions will be encouraged to analyze differences to the corresponding legal concepts in their home jurisdictions.

The course addresses students who take a particular interest in business law. It focuses on international aspects of business transactions and their legal and commercial requirements, and allows students to get an initial understanding of what legal ad- vice in practical terms is like. In a first step several important principles of German civil law are introduced and discussed in class and compared to similar principles under foreign law like, e.g., French or English law. This may result in comparing, for example, the advantages and disadvantages of a floating charge under English law as opposed to individual security under German law, or the rules on financial assistance under the German and English regime. In a second step case studies with a cross-border background are prepared at home and talked through in class. Students are required to understand not only the importance of the relevant legal aspects but also the commercial dynamics of a transaction. As the course is in English, students have also the opportunity of familiarising themselves with the relevant legal terms.

Die Veranstaltung wird von Herrn Nandor Knust durchgeführt. This course will offer an overview of international criminal law, including its origins and current trends. It will address the legal regimes of international criminal courts and tribunals, and will cover the main substantive crimes (genocide, crimes against hu- manity, war crimes and aggression). The role of the prosecution, basic rights of the defendant and the role of victims will be ex- amined, with particular focus on the ad hoc tribunals and the International Criminal Court. Jurisprudence of international criminal courts and tribunals will be drawn on to illustrate foundations and procedure. Issues that tend to arise in the practice of international criminal law will be the subject of discussions, and the primary interests to be balanced when considering procedu- ral issues will be taken into account. State co-operation and the impact on national jurisdictions will also be considered. In addi- tion, the course will touch on the topic of post-conflict and transitional justice in a more general manner.
