The All India PNB Employees Federation had raised an industrial dispute vide demand dated 20.06.2012 before the Regional Labour Commissioner (Central), New Delhi in respect of fitment of employees in Subordinate Cadre upon promotion as Clerks on and after 1.11.2007. The said dispute raised by All India PNB Employees Federation has been amicably settled during the course of conciliation proceedings held on 10.07.2012 and a conciliation settlement dated 10.07.2012 has been signed by the parties before Regional Labour Commissioner (Central), New Delhi. A copy of the Settlement dated 10.07.2012 arrived at between the parties during the course of conciliation proceedings is enclosed. 3. The Incumbent In charge are advised to make necessary fitment of promotee clerks in terms of conciliation settlement dated 10.07.2012 and arrear sheet be prepared as per Annexure-I to this circular and arrears, if any, be paid by 31.8.2012. The arrear sheet in respect of each promotee clerk shall be prepared in duplicate and shall be thoroughly checked before releasing the arrears, if any, and a copy thereof shall be sent to the concerned Circle Office for post audit purposes. The pay scales of workmen staff were revised under NinthBipartite Settlement w.eJ. 1.11.2007.

2. The All India PNB Employees Federation had raised anindustrial dispute vide demand dated 20.06.2012 before the RegionalLabour Commissioner (Central), New Delhi in respect of fitment ofemployees in Subordinate Cadre upon promotion as Clerks on andafter 1.11.2007. SHORT RECITAL OF THE CASE

WHEREAS the Management of Punjab National Bank (hereinafter referred to as the

Bank) and All India PNB Employees Federation (hereinafter referred as Employees

Federation) had signed a settlement on 06.6.2007 regarding fitment of salary on

promotion from subordinate cadre to clerical cadre in the course of conciliation

proceedings before the Regional Labour Commissioner (Central) New Delhi.

AND WHEREAS the said Employees Federation has raised an industrial dispute before

the Regional Labour Commissioner (Central) New Delhi vide its letter dated 20.6.2012,

inter alia, demanding that pay scale of the workmen staff have been revised w.e.f.

1.11.2007 by way of an industry level settlement dated 27.4.2010 and accordingly, the

fitment upon promotion from subordinate cadre to clerical cadre, as agreed to vide

settlement dated 06.6.2007 requires revision.

AND WHEREAS the bank has submitted its detailed reply dated 22.6.2012 to the

demands raised by the Employees Federation and sought the good office of the

Regional Labour Commissioner (Central) New Delhi to intervene in the matter to help

both the parties to resolve the matter amicably.

AND WHEREAS the Regional Labour Commissioner (Central) New Delhi had held

discussions with both the parties and held conciliation proceedings.

And now therefore, the parties have arrived at settlement described below, in the

conciliation proceedings, before the Regional Labour Commissioner (Central), New

TERMS OF SETTLEMENT

Note:(1) Those who are given fitment of salary on promotion to clerical cadre at theclubbing stages, the employee in the lower clubbed stage of clerical scale of Paywill get their next increment after promotion on the anniversary date of promotion.Those who are fitted at the higher clubbed stage, their increment after promotionshall be the anniversary date of their last increment in subordinate cadre.

(2) Promotees who are drawing Fixed Personal Pay in terms of Settlement dated27.04.2010 may continue to draw the same quantum of Fixed Personal Pay evenafter promotion which shall remain unaltered till revised.

(3) In case, consequent upon promotion to clerical cadre, the total gain in theemoluments (Basic Pay + Spl. Pay +DA) to a promotee clerk is for an amount ofless than Rs.350/- per month in that eventuality the difference between Rs.350/-and the gain on promotion shall be given by way of temporary personalallowance to be wiped off in three equal yearly installments from the date of hispromotion.

(4) That the arrears, if any, which shall become due on account of revised fitmentformula agreed upon under this settlement shall be paid to the promotee clerk by31.8.2012.

(5) That other terms of conciliation Settlement dated 18.8.2011 on Policy andProcedure in respect of Promotions from Subordinate Cadre to Clerical Cadreand all related matters shall remain the same.

(6) Both the parties agreed to submit separately a report on implementation of thesettlement so as to reach the Regional Labour Commissioner (Central) NewDelhi latest by 31.7.2012 failing which it shall be presumed that this settlementhas been fully implemented.

(7) If any doubt or difficulty arises regarding interpretation and implementation of anyof the provisions of the settlement, the matter shall be taken only at the level of
