CONCERNING

AMENDMENT TO REGULATION OF PRESIDENT OF

THE REPUBLIC OF INDONESIA NUMBER: 77 of 2007 CONCERNING THE

LIST OF BUSINESSES CLOSED AND LIST OF BUSINESSES OPENED WITH

RESERVATION IN THE INVESTMENT SECTOR

WITH THE MERCY OF THE GOD ALMIGHTY

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering: a. That, with the issuance of the Presidential

Regulation Number 77 of 2007 concerning the

List of Businesses closed and the List of

Businesses opened to Investment,

constituting the implementation of paragraph

(4) of Article 12 and paragraph (1) of

Article 13 of the Law Number: 25 of 2007

concerning Investment, the arrangement of

business sectors closed and opened with

reservation in such Presidential Regulation

shall be made clearer in order to prevent

any possible misinterpretation from

happening;

b. that, with respect to point a above, in is

necessary to stipulate a Presidential

Regulation concerning an amendment to the

Presidential Regulation Number 77 of 2007

concerning the List of Businesses Closed and

the List of Businesses Opened to Investment;

In view of: 1. Paragraph (1) of Article 4 of the

Constitution of the Republic of Indonesia of

1945;

HEREBY DECREES

To

stipulate:

PRESIDENTIAL REGULATION CONCERNING AN AMENDMENT

TO THE PRESIDENTIAL REGULATION NUMBER: 77 of

2007 CONCERNING THE LIST OF BUSINESSES CLOSED

AND THE LIST OF BUSINESSES OPENED WITH

RESERVATION IN THE INVESTMENT SECTOR.

Article I

Several provisions in the Presidential Regulation Number: 77

of 2007 concerning the List of Businesses Closed and the List

of Businesses Opened with Reservation in the Investment

Sector are hereby amended as follows:

1. One (1) new article is inserted between Article 2 and

Article 3, namely Article 2A whose true content is as

follows:

“Article 2A”

(1) Investment in business sectors opened with reservation

set forth in Article 2 shall fulfill the requirements

for the domicile pursuant to the rules of law applicable

in the field of Space Layout and Environment.

(2) In the event of permit for investment set forth in

paragraph (1) above, whose business domicile has been

specified, and permit for any investors intending to

expand their business by running similar business

outside such domicile that has been specified in the

investment permit, the investors shall fulfill the

requirements for the domicile pursuant to paragraph (1).

(3) Any investors in fulfilling such domicile requirements

set forth in paragraph (2) above are neither required to

establish new business corporation nor obtained new

business permit.”

2. Provision Article 5 is amended so that it reads as

follows:

“Article 5”

Provision set forth in Article 1 and Article 2 of this

Presidential Regulation doesn’t apply to any investments

having been approved in certain business sectors prior

to the issuance of this Presidential Regulation, as

written in the letter of consent, as well as to their

amendments, if any.”

3. Appendix I regarding the List of Business Sectors Closed

to investment is amended so that the true content is

given in Appendix I hereof.

4. Appendix II regarding the List of Business Sectors

Opened to investment with Reservation is amended so that

the true content is given in Appendix II hereof.

Article II

This Presidential Regulation shall apply as of the date of

its issuance.
