Approval has been accorded by State Forest Dept. vide their letter no. 1122/FCA/FEWMD/792-94 dated 13.09.2010 for diversion of 22.5069 Ha of forest land.

We have paid Rs. 59, 27,917/- through cheque No. 074954 on 23.08.2010 towards Compensatory Afforestation to Forest Department, Government of Sikkim.

ANNEXURE-A

CONDITIONS AND COMPLIANCES TOWARDS ENVIRONMENTAL CLEARANCEMOEF Letter No. J-12011/64/2006-1A-1 dated 15.05.2007

PART-A: Specific Conditionsi) The Biodiversity Conservation Plan as

proposed in the EMP on Page 63 to 66 should be followed in to.

We have already deposited an amount of Rs. 37,25,000/- in CAMPA fund vide Axis Bank cheque no 079139 dated 29.09.10 as proposed in the EMP. The Biodiversity Conservation Plan is in process by the State Forest Department.

ii) Controlled blasting with very low charge and mild explosives should be used under close supervision. The quantity of explosive per delay to used should be informed within one month from the date of issue of this letter

Controlled blasting with mild explosive charge and using delay detonators is being done under close supervision of a licensed explosive blaster. Report regarding consumption of explosive is regularly uploaded on the website of PESO with a hard copy to District Collector, SDM Pakyong & Police Station Pakyong.

iii) Catchment Area Treatment plan as has been proposed should be completed in three years and as proposed by Chief Wildlife Warden in his letter dt.09.04.2007, wildlife & bio diversity conservation within the catchment area should be incorporated in consultation with him or his representative

Catchment Area Treatment Plan is under process by the State Forest Department as we have already deposited the complete amount in CAMPA fund under Axis Bank cheque no 079140 dated 29.09.10 as proposed in the EMP. As per the comments of the Chief Wildlife Warden vide letter no. GOS/FEWMD/ CWLW/282 dted 04.06.2010, the project site does not fall within the Wildlife Protected Area network.

iv) A Survey to be undertaken to find the extent of population and infrastructure that may be affected within the stipulated flood zone of 2.5m over & above the normal flow for rainfall run-off flood in the event of a dam break and the findings to be submitted within the three months

Dam break analysis has already been done and submitted to the Government of Sikkim and Ministry of Environment & Forest, New Delhi .

v) Consolidation and compilation of the muck should be carried out in the muck dump sites and the dump sites should be above high flood level.

The muck dumping and consolidation is being done in the designated dumping yards of the project.

vi) Creation of a hatchery for fisheries development in Rangpo and Rongli Chu as proposed in the EMP for conservation of fishes should be implemented-

The provision is already existing in the EMP and design of fish ladder is included in dam construction. The execution will be done with the support of GOS.

vii) Commitment made during public hearing should be fulfilled-

Commitments made during public hearing are continuously being looked into by us.

viii) It is noted that the land required for the project will be acquired and registered in the name of Government of Sikkim through land Acquisition Act and then leased to the project proponent. Therefore much before submergence of land in question the land acquisition proceeding should be completed and possession of the land will be taken from Government of Sikkim –

The land acquisition including possession of land for the project has already been completed under Land Acquisition Act as per norms of GOS.

PART-B: General Conditionsi) Adequate free fuel arrangement

should be made for the labour force engaged in the construction work at project cost so that indiscriminate felling of trees is prevented

ii) A fuel depot may be opened at site to provide the fuel (Kerosene Wood & LPG).Medical facilities as well as recreational facilities should also be provided to the labourers

A fuel depot already existing at site to provide fuel (Kerosene & LPG). We have also provided a dispensary and medical staffs with free medicines and ambulance facility both for the local people and the workers engaged in the construction works.

iii) All the Labourers to be engaged for construction works should be thoroughly examined by health personal and adequately treated before issuing the work permit

All the Labourers engaged for construction works are medically examined by competent person before deployed.

iv) Restoration of construction area including dumping site of excavated material should be ensured by levelling, filling up of burrow pits, landscaping etc. The area should be properly treated with suitable plantation

The construction area including dumping site of excavated material are regularly being levelled by filling up of pits etc. Landscaping and treatment with suitable plantation will be taken up once the dumping of muck is completed.

v) Financial provision should be made in the total project budget of the project for implementation of the suggested safeguard measures

An amount of Rs. 337.89 Lakhs in the EMP is kept in the total budget cost for implementation of all the suggested safeguard measures.

vi) A multidisciplinary committee in consultation with the ministry should be constituted with ecologists, environmental scientists, various disciple of forestry, ecology, wildlife, soil conservation, NGO etc to oversee the effective implementation of suggested safeguard measures-

We have already sent our letter no. GI/BHEP/CA/42/10 dated 25.10.10 to The Additional Director, MoEF, New Delhi for constitution of Multi disciplinary committee for this project. The case has been further pursued vide our letter no GIL/BHEP/CA/96/11 dated 08.09.2011 to the CCF-cum-Nodal Officer, GoS. In continuation of above subject we have further pursued vide our letter no GIL/BHEP/CA/169/15 dated 27.11.2015 to Principal Secretary MOEF.

vii) Six monthly monitoring reports should be submitted to the Ministry and its regional Offices, Shillong for review regularly

Six Monthly Reports is regularly being submitted to Ministry of Environment & Forest New Delhi, Regional MOEF and State Forest Department. The last Six Monthly Report was submitted on dated 25.05.2015

4) Officials from Regional Office MOEF, Shillong who would be monitoring the implementation of environmental safeguards will be given full cooperation, facilities and documents/ data by the project proponents during their inspection

We will extend our full cooperation, facilities and documents/data to Officials from Regional Office MOEF, Shillong who would be monitoring the implementation of environmental safeguards during their inspection.

5) The responsibility of implementation of Environmental safeguards rests fully with Gati and Government of Sikkim

The Environmental safeguards are being implemented with the help of Forest, Environment and Wildlife Management Department, Government of Sikkim and the progress is constantly being reviewed.

6) In case of change in the scope of the project, project will require a fresh appraisal

The construction work has already started from October, 2010.No change in the scope of project is envisaged.

7) The Ministry reserves the right to add additional safeguards measures subsequently, if found necessary and to take action including revoking of the clearance under the provisions of the Environment(Protection) Act, 1986 to ensure effective implementation of the safeguards, measures in a time bound and satisfactory manner

Any additional safeguard measures as and when suggested by the Ministry / MOEF Dept will be incorporated effectively.

8) The clearance letter is valid for period of five years from the date of issue of this letter for commencement of construction work

9) A copy of clearance letter will be marked to concerned Panchayat / local NGO, if any from whom any suggestion/ representation has been received while processing the proposal

A copy of the clearance letter has been given to all the concerned Panchayats /NGO.

10) State Pollution Control Board/committee should display a copy of the clearance letter at the regional office, District Industries Center, Collector’s Office / Tehsildars Office for 30 days

A copy of clearance letter was displayed by State Pollution Control Board, Gangtok at the regional office, District Industries Center, District Collector(East) office as per the requirement.

11) The project proponent should be advertised at least in two local newspapers widely circulated in the region around the project one of the which shall be in the vernacular language of the locality concerned informing that project has been accorded environmental clearance and copies of clearance letters are available with State Pollution Control Board /Committee may also be seen at website of the Ministry of Environment and Forests at http://www.envfor.nic.in

We had advertised in two local newspapers widely circulated in the region around the project 1. “HAMRO PRAJASHAKTI” in Nepali 2.”NOW” in English, dated 01.06.2007 informing that project has been accorded environmental clearance and copies of clearance letters are available with State Pollution Control Board, Gangtok.

Project Progress

Bhasmey Hydro Electric Power Project is being developed in East district of Sikkim State and as per MoU

signed between Government of Sikkim and Gati Infrastructure Ltd on dated 14.11.2003, the land required for

the project is already acquired by the Government in accordance with the provisions of Land Acquisition Act

Compliance Report of Agreement with the Govt. of Sikkim dated 14th Nov, 2003

Gati Infrastructure Bhasmey Power Private Ltd is strictly adhering to the terms & conditions as stipulated in the MoU signed with Government of Sikkim on dated 14.03.2003. The details in brief are as under:

1. Employment to Locals:

27 locals are employed directly by the company and the employment has been given as per the consent and instruction of local area MLAs. Preference of employment is given to the landowners who have parted their land for the project. In addition, indirect employment is provided to locals as per para 2 below.

2. Preference to locals for contracts, supply, hiring of houses & vehicles:

Preference has been given to locals by giving 14 contracts till date, 7 houses and 15 vehicles are hired from locals for the project. Apart from this, we have given opportunity to the locals for sand supply, boulders supply, spalls supply, supply of stationary ets.

3. Benefits to Local employees :

• We are following Sikkim Minimum Wages Act.

• Our employees covered under the Workman Compensation Policy.

• Maternity leave & other facilities and benefits are being extended to the employees

• All employees consult our Resident Doctor and our qualified clinic staff to attend to their day-to-day medical requirements at the Project Location and an additional medical allowance of Rs.6000 p.a as per company Policy.

ANNEXURE-E

Health, Safety and Social Welfare Measures

Gati Infrastructure Bhasmey Power Pvt. Ltd is committed to protect employees/workers working in the project and the local residents getting affected by construction activities. Following measures have been taken:

1. Health & Safety Measures:

a) Establishment of site offices to ensure strict adherence to safety norms.

b) All workers/employees engaged at construction sites are provided with Personal Protection

Equipments (PPE) such as Helmet, Safety shoes, Dust mask, Safety belts, Fall arrester, Gumboots,

Ear plugs, Safety jackets and Ear muffs. It is mandatory for all employees to ensure that the PPE is

worn in their day to day activities.

c) Safety training programs are organized for the workers to create awareness and importance of

safety measures and provide guidelines to ensure work progress without any mishap.

d) Ensure that the contractor/workers strictly adhere to all the safety rules & regulations.

e) We have organised several Safety & Health camps for the benefit of employees and villagers.

f) We have established clinic in centralised place to ensure that the required assistance is readily

available as and when required.

g) Lightning in all project components with specific instructions to all concerned HODs for strict

compliance of safety norms.

h) Arrangement of First Aid box, Fire extinguisher and safety shoes to curtail fire accident at

construction site.

i) A highly qualified Site In charge is kept at the construction sites to ensure that the work is carried out

in the prescribed manner.

Sign Boards

1. Animated sign boards have been designed and displayed at all construction sites.

2. Safety boards are displayed to educate workers and local villagers so that people take precautions

while entering that zone.

a) Health Check-up Camps:

Our project activities have been started from month of October 2010. Health camps are organized regularly in the project area for benefit of local villagers and workers. Various programmes are conducted to educate people on HIV-AIDS, Reproductive and Child Health. Expert doctors are invited from renowned hospital like Sikkim Manipal, Gangtok for health check-up and awareness programs. Through such camp, awareness is generated on basic health, hygiene and sanitation. We provide free medicines to employees/workers including local villagers of the vicinity.

A One day Health Camp was organised in our Village Education Centre on 06 th March, 2012 wherein all the children were examined by our Dr. Sudeep Pradhan, HOD_Health and free medicines were distributed free of cost.

b) Capacity building training Program :-

Capacity building trainings are conducted for local villagers to make jute products and handmade products. The centre at Rorathang has 12 trainees. Emphasis has been given on designing diverse jute products and some unique products [Bag, pen stand, basket, tray ] which have a good market potential. It will ultimately benefit the local artisans of this craft. After successful completion of the training the products such as door mats, dinner mats, carpets etc are sold in the market with the help of Self Help Groups initiated by Gati. The best student is absorbed by our training centre as trainer to train the upcoming batches. We are actively involved in local community development & women empowerment programme in our project area.

We have successfully completed 3 months Primary Level Training (PLT) on handmade paper craft for 20 tribal women sponsored by Ministry of Tribal Affairs, Government of India at Bhasmey and the evaluation report is submitted to TRIFED, Ministry of Tribal Affairs, Government of India.

Bamboo & Cane Craft training will be started from 1st week of July, 2012 and identification of trainees and collection of raw material is already completed for commencement of training as scheduled. Apart from this, field based preparatory work completed for two new projects- one is 90 days training on Jute Craft for 20 tribal women of Padamchey village of Upper Bhasmey and another is Hill Broom binding & value addition for 70 tribal women of Bhasmey, Rorathang & Padamchey. Both the projects have been sanctioned by Minitry of Tribal Affairs, Government of India and respective agreements signed. Training is scheduled to be started from July, 2012.

Primary Level Training on Handmade Paper Products

A school is started at our project site, Bhasmey with currently 40 students. The free schooling facility is being availed by children of the local villagers and all students are provided with learning materials, free mid day meal, school dress, shoes and books. Health Check up camps are organised for the children every quarter and medicines are distributed free of cost. Annual Examination & Sports Day conducted in January, 2012 and prizes distributed to all. World Environment Day celebrated in the school to create awareness among the children.

Apart from school for children an Adult Education Programme is being conducted for the benefit of local people.
