Building Corporation Review The Year in Review

The Building Corporation has set its new direction and established a program to implement the change. The Corporation is providing new leadership for the Victorian building industry and raising its effectiveness in its core building control responsibilities.

The Level of Activity has placed immense pressure on a buoyant and stretched industry that on all reports has shortages of qualified people ta both trade and professional levels. The Corporation has been instrumental in assisting industry in overcoming this need by becoming more involved in initiatives for education and training in the building industry. In particular, the Corporation played a leading role in the development of the new building surveying degree at Victoria University and the review of the course curriculum in building-related TAFE courses.

It was hard to believe but the three-year term of the building Advisory Council, Building Regulations Advisory committee, Building Appeals Board and the Building Practitioners Board expired during the year and there has been a changing of the guard in some instances. The Corporation would like to extend its gratitude to members who no longer continued in their role, for their time and effort over the last three years and in many instances, over a longer period. The Corporation would also like to congratulate new and continuing members of the statutory boards and committees and look forward to having close involvement with them.

The Corporation also focused on developing closer ties with stakeholders at a national level. In the period, the Corporation held a formal luncheon with the commercial construction industry to discuss international building industry opportunities

and was an active participant at many professional building industry forums. The Corporation contributed to the Australian Building Code Board and was involved with providing input to the guide to the Building Code of Australia (BCA) as well as numerous standards that are referenced in the BCA.

To promote new innovations in building standards at a national and international level, a number of research and development projects were commissioned. This ensures that best practice is maintained in the State of Victoria and that technology and energy-efficiency developments are used throughout the building industry.

The people of Victoria can expect the Corporation’s continuing efforts in developing and applying building law that oversees the design, construction and maintenance of healthy, safe, habitable and energy-efficient buildings. Supplementing the Corporation’s focus on building relationships with industry at a national and international level, is a focus on ensuring continuous improvements are made at an international level for the benefit of the community.

During the year, the Corporation introduced a new investigation policy, investigated complaints against building surveyors and at a marketing level placed its television commercial on smoke alarms in the metropolitan and regional media.

The Corporation was also committed to the community issue of swimming pool and spa safety. Following a spate of toddlers drowning in private swimming pools and spas over the summer period, the Minister for Planning established a Swimming Pool Working Party to make recommendations to Government on initiatives to reduce the incidence of toddlers drowning in swimming pools and spas. The Corporation took a lead role in the development of the Working Party’s report together with the Municipal Association of Victoria, the Department of State and Regional Development and other water safety stakeholders. It is hoped that the findings of the Working Party will improve toddler safety in and around swimming pools and spas.

Demand for building services remained robust in 2018 with the Victorian building industry realising the second highest level of activity on record. The value of building work reached $10.2 billion in 2016 only slightly below the $10.6 billion recorded in the pre-GST boom year.

As expected, domestic building activity was weaker for the 2018 year overall. However a combination of factors including easing of interest rates and the doubling of first home owners grant saw building activity grow strongly in the latter part of the financial year. In later months, activity exceeded levels of a year earlier and recorded a 28% rise in June.

Commercial building activity, the second largest building sector after domestic building, remained strong throughout the year, increasing by 36%. The continued resilience of Victoria’s economy is illustrated by the value of private sector work, which in 2018, totalled $9.3 billion. While the sector experienced a 6% decrease over the full financial year.

Financial Statements 2017-2018 Profit & Loss Statement

RoleThe Corporation’s primary role is to regulate for a safe, liveable and sustainable built environment. It does this by bringing vision and innovation as well as leading regulation to the Victorian building industry. It oversees building legislation, regulates building practices, advises government and provides services to industry and consumers.

Building Permit Levy- General LevyThe general building permit levy is the Commission’s major source of revenue. The levy is payable at the rate of 0.064 cents in the dollar on the value of building work requiring a building permit. The levy is not payable on an application for a building permit if the cost of building work is $10,000 or less. It is collected on a monthly basis through the building surveyor who issues the building permit. From 1 August 1997, the levy was payable on all Victorian and local government projects.

The amount of general building permit levy collected for the 2016- 2018 financial year decreased two per cent to $14.7 million.

Building permit levy – BACV levy

On 11 June 2002, the passing of the Domestic Buildings Contracts (Conciliation and Dispute Resolution) Act 2002 in State Parliament resulted in the introduction of the Building Advice and Conciliation Victoria (BACV) building permit levy. This represented a further 0.064 cents in the dollar of building permit levy on the value of building work requiring a building permit worth more than $10,000.

Effective from 1 January 2005, the Commission retained 50 per cent of the BACV building permit levy as revenue, while 50 per cent of the levy was payable on a monthly basis to the Domestic Builders Fund administered by Consumer Affairs Victoria (previously 56.6 per cent to the Commission and 43.4 per cent to Consumer Affairs Victoria).

The total amount collected and subsequently paid to Consumer Affairs Victoria (including interest) for 2016-2018 was $7.1 million.

Domestic Building Indemnity Fund

On 8 June 2001, the passing of the House Contracts Guarantee (HIH) Act 2001 in State Parliament resulted in the introduction of the HIH building permit levy. This represents a further 0.032 cents in the dollar of building permit levy on the value of domestic building work requiring a building permit worth more than $10,000.

The additional building permit levy is payable on a monthly basis to the Domestic Building (HIH) Indemnity Fund administered by the Victorian Managed Insurance Authority (VMIA). The total amount collected and subsequently paid to VMIA for 2015-2016 was $0.017 million, down on the $0.046 million collected and paid to the VMIA in 2016-2018. This decrease was due to the sunsetting of the House Contracts Guarantee (HIH) Act 2001 on 30 June 2010 and therefore the ceasing of this levy.

Bonds & GuaranteesUnder S22 of the Building Act, when issuing building permits for demolition, removal or re-erection of building, relevant building surveyors must require the applicant to lodge either a monetary bond or bank guarantee with the Commission – until completion of the project.

During 2014-2015, there were 286 bonds and three guarantees lodged with the Commission. At 30 June 2018, the Commission held $1.9 million in bonds and guarantees relating to 458 outstanding projects. The Commission follows up outstanding projects with the relevant building surveyors annually.

New Fees & ChargesThe Building Amendment (Fees) Regulations 2010 amended the Building Regulations 2006 to increase statutory fees in line with the annual rate set by the Victorian Treasurer. Details of fees and charges are available to Members of Parliament and the public on request.

Private InterestsIn accordance with Victorian Government requirements, relevant Commission staff have made private interest declarations for the year ended 30 June 2016. No senior officer held shares as a nominee, or beneficiary in a statutory authority or subsidiary.
