home and make copies of when and if required and to be handed over to Heavenly

AGREEMENT

THIS IS AN AGREEMENT ENTERED INTO BY AND BETWEEN:

(Hereinafter called “the Baby Nursery”)

IN THEIR CARE, SUBJECT TO THE FOLLOWING CONDITIONS:

REMUNERATION

1. REMUNERATION FOR CARE The remuneration for the care of the Child is: Full day R1050.00 per month, Yes Half day R750.00 per month and Yes Part time R120 per hour Yes (Please tick “YES” on the service you require) Subject to increase from time to time agreed upon. Fees are payable in advance in cash or EFT on the first day of every month. No cheques are accepted. If the Parent does not comply timorously with the conditions of this clause, the Baby Nursery is entitled to charge a penalty of 5% on each and every payment which is late and may also refuse to take the Child into her care until such monies and penalties have been paid. No refunds will be allowed for such periods during which the Child is not placed in the care of the Baby Nursery, during the existence of this agreement. 2. TERMINATION





This agreement can be terminated by either party giving one calendar months’ notice, which must be given on the last working day of the preceding month. 3. REGISTRATION FEE The Parent shall pay a non refundable registration fee of R500 for Full Day and registration fee of R250.00 for Half Day. Registration fee could be paid over the 1st 2 months that the Child is placed in the care of the Baby Nursery. 4. LEAVE 4.1 The Baby Nursery Owner/Manager is entitled to twenty two (22) working days paid leave per annum. A minimum of ten continuous days must be taken in one session, unless otherwise agreed to by the Parent. The Parent will be notified three (3) months in advance prior to the Day mother taking leave. The Parent hereby agrees to pay the Day mother for twelve (12) months of the year. 4.2 The Baby Nursery Owner/Manager may decide herself when such leave shall be taken during the year but this will usually be in accordance with school holidays. 4.3 Should this agreement be terminated for any reason whatsoever, the Baby Nursery Owner/Manager shall be compensated for any leave due to her, subject to a maximum of twenty two (22) days. The compensation for such twenty two working days leave shall be calculated in proportion to the remuneration per month as set out in clause 1 above. 4.4 If an emergency arises relating to the family of the Baby Nursery Owner/Manager or the Day mother herself, the Baby Nursery Owner/Manager shall be entitled to take the necessary compassionate leave. Compassionate leave will be paid for by the Parent. 4.5 If an extreme emergency or serious illness or death arises, the Nursery will remain open and the parent do not have to make alternative arrangements for the care of their child. 4.6 Heavenly Cradle Baby nursery will only be closed between 16 December and first working day of January the next year. 5. SICK LEAVE The Baby Nursery Owner/Manager is entitled to fifteen (15) days paid sick leave per annum, subject to the condition that such sickness is a serious contagious disease certified by a medical practitioner or in the case of hospitalization and recuperation. During this period, the Parent do not have to arrange for alternative care for the Child / Children as supervision would be in place. 6. TIME OF CARE From Monday to Friday, with the exclusion of public holidays when no service shall be rendered, the Child will remain in the care of the Baby Nursery Owner/Manager from 06:30 to 17:30. A penalty of R50





per hour or part thereof shall be charged and shall be payable immediately should the Child be collected late, unless sufficient prior arrangement to the contrary have been made with the Baby Nursery Owner/Manager . The latest time to fetch the Child is 17:30. The Parent to state here hours of care:______________________________





7. DAILY NECESSITIES All clothes and possessions of the Child must be clearly marked. Sufficient alternative clothing and all daily necessities not included in the care option and necessities as determined by the Baby Nursery Owner/Manager must be supplied. Should the Parent not comply with these provisions the Baby Nursery Owner/Manager may refuse to receive the Child for such care. 8. HEALTH RULES The following health rules shall be applicable: 8.1 If the Child suffers from any ailment, or incurable illness the Parent shall inform the Baby Nursery Owner/Manager thereof and arrangements in respect of the administration of medicine shall be made in accordance with the provisions of clause 8.7 hereof. 8.2 If the Child contracts a children’s disease or any contagious sickness including any contagious alimentary canal disorder, the Parent shall remove the Child immediately from the care of the Baby Nursery Owner/Manager and further arrangements shall be made in accordance with the legislation of the applicable health regulations. A Child’s recovery from the above mentioned sickness or disorder must be confirmed by a medical practitioner, before the Child is once again placed in the care of the Baby Nursery Owner/Manager. 8.3 If the Baby Nursery Owner/Manager own children contract a contagious sickness as described above, they shall be separated from other children. The Parent will be notified of such sickness as soon as possible. 8.4 Immunization and vaccination must be done in accordance with the prescribed laws and the Parent must present the necessary certificates at the request of the Baby Nursery Owner/Manager. 8.5 If the Child is sick, the Parent shall inform the Baby Nursery Owner/Manager as soon as possible that the Child will not be brought for care. 8.6 The Baby Nursery Owner/Manager shall inform the Parent immediately should the Child, while he/she is in the care of the Baby Nursery Owner/Manager, fall ill or be injured. If the Baby Nursery Owner/Manager is reasonably of the opinion that the Child is at any stage too ill to be accepted for care, the Baby Nursery Owner/Manager may refuse to receive such Child for care. 8.7 All medicines to be administered to the Child must be provided and recorded by the Parent in the daily report diary, which shall be supplied by the Baby Nursery Owner/Manager. Instructions regarding the type of medicines and the quantity to be administered to be included. 8.8 In the event of an emergency, the Baby Nursery Owner/Manager shall be entitled to refer the Child for the necessary medical treatment at the expense of the Parent.





9. FOOD The Baby Nursery Owner/Manager shall provide such food to the Child as prescribed by the Health Department. If the Child is in any way allergic to specific foods, the Baby Nursery Owner/Manager must be notified thereof and the Parent must supply such special food as is necessary. Baby milk, special cereals, and bottled food shall be supplied by the Parent to the Day mother. 10. VISITORS Unless otherwise arranged with the Baby Nursery Owner/Manager, the Parent and relatives shall not visit the Day mother and / or the Child during the hours of care as this may upset the Child and prohibits the Baby Nursery Owner/Manager from performing her duties. held responsible for the payment of medical and/or hospital accounts, where applicable, should an

injury be sustained at the day care.

I therefore undertake on behalf of myself, the Executors, my wife/husband and my Child aforesaid to

indemnify and absolve the owner, helpers and paid or unpaid temporary staff/ assistants against and

from any or all claims whatsoever that may arise in connection with any loss or damage to the property

or injury to the person of my Child aforesaid in the course of such activities.

I cede my powers as Parent/guardian to the owner of the school or representatives should medical

treatment be deemed necessary for my Child. As far as I know, he/she is in good health.

This general indemnity shall remain in force for the full duration of my Child’s enrolment at Heavenly

Cradle Baby Nursery. I further undertake to furnish the school with the relevant information should any

details alter or change.
