South Africa’s well established legal framework offers first world security of title to foreign buyers of immovable property. There are no restrictions on the ownership by non-residents of property situated in South Africa, except of course that, foreigners who are in the country illegally may not own property here. There are, however, procedures and requirements which must be complied with and the next few paragraphs will provide answers to some frequently asked questions that foreign buyers of South African property may have.

CAN FOREIGN FUNDS BE BROUGHT INTO SOUTH AFRICA TO BUY PROPERTY?Yes, foreign funds can be paid into any bank account in South Africa. Usually the foreign purchaser will pay the purchase price for the property bought into the trust account of the estate agent that brokered the sale or into the trust account of the conveyancing attorney who attends to the registration of the transaction. Both estate agents and attorneys are covered by Fidelity Funds, which guard against theft or negligence on the side of the agent or attorney.

When a non-resident transfers funds from a foreign source into a South African bank account, a record known as a ‘Deal Receipt’ is issued by the South African bank. This is an important document and the non-resident will need to submit it to the Reserve Bank when, in future, he sells the property and wishes to return the funds to the foreign country.

CAN MONEY BE BORROWED INSOUTH AFRICA TO BUY PROPERTY?Non-residents purchasing a property in South Africa may borrow up to a maximum of 50% of the purchase price from a South African financial institution.

The remaining 50% of the purchase price will therefore need to be made up offoreign funds that the non-resident transfers to a South African account.

The total loan amount granted by a bank however remains within the bank’s discretion. A bank will generally require proof of the non-resident’s income as well as compliance with South African anti-‘money laundering’ legislation (the Financial Intelligence Centre Act), which involves the furnishing of proper identification and the submitting of certified copies of documents (such as a passport and proof of residential address).

CAN A FOREIGN COMPANYBE THE PURCHASER (OR SELLER)?Yes, a foreign company can buy and own land in South Africa. In certaininstances, this would require that the purchasing register itself as an entity in South Africa and, if the shares are owned

by the non-resident, the company must in addition appoint a public officer who is a South African resident.

MUST A PURCHASER BE PRESENT INSOUTH AFRICA TO SIGN THEDOCUMENTS OF THE TRANSFER?Fortunately a purchaser need not necessarily be personally present in South Africa to sign the documents that are required for the registration of transfer of ownership in the property. However, there are formalities that must be complied with in such a case, requiring that the docu-ments must be signed either before a Notary Public or at the South African Embassy in the foreign country. Both these options are unfortunately usually costly and time consuming. It is often to the non-resident’s best advantage, whether he is selling or buying, to execute a Special Power of Attorney prior to departing from South Africa in favour of a local friend, family member, or attorney so that this person can act and sign documentation on his behalf. It is important to remember that an affidavit cannot be signed by the person holding the Power of Attorney on your behalf. For this reason there will invariably still be some documents for such client to sign abroad.

WHEN A NON-RESIDENT SELLS A PROPERTY, CAN THE MONEY BE TAKEN OUT OFSOUTH AFRICA?Yes, money that was introduced to South Africa from a foreign source and any profit thereon, can be taken out of the country (repatriated) when the non-resident sells the property. Any sums still owing under a mortgage bond over the property must be paid as the sale transaction is registered so that only the net proceeds will be repatriated.

Note that such repatriation of funds is subject to South African Exchange Control Regulations which means, amongst other things, that the Reserve Bank will investigate the initial source of the non-resident’s investment in South Africa.

Furthermore, if a foreigner takes up permanent residency in South Africa and signs a Declaration and Undertaking at a South African bank (namely declaring whether they are in possession of foreign funds and undertaking not to place same at the disposal of anyone resident in the Republic), they will be considered a resident for Exchange Control purposes and accordingly will only be able to freely repatriate funds within five years of their immigration. Thereafter they will be considered to be a South African resident and subject to the same regulations and limitations. Finally, the repatriation of funds will be subject to capital gains tax, which we discuss in the next paragraph.

DOES A NON-RESIDENT HAVE TO PAYINCOME TAX?Income Tax- Whilst South Africans are taxed on their worldwide income, non-residents are liable for income tax only on income accruing from a South African source and may then utilize the

double tax treaty benefit (if applicable) to avoid double taxation. For example, if a non-resident rents his property out, he will be obliged to declare such rental for primary taxation in his country of residence but will still be obliged to declare such income in South Africa as well. Thus, non-residents are also obliged to register for income tax purposes in South Africa.

Capital Gains Tax (CGT)- The non-resident is liable for payment of tax on the gain made on selling the property (capital gains tax).

Withholding Tax- Because some foreign buyers in the past avoided paying CGT when they sold their property, new legislation was passed which obliges any buyer of a property sold by a non-resident for R2 million or more, to retain a percent-age of the purchase price and pay it to the South African Revenue Services within a maximum of 28 days of the transfer.

Cape Town Opera’s African Angels returns to Artscape after it’s sold out performance last season, and fresh from touring to over 34 cities in Holland and Germany over the past year.

In 2013, African Angels was created as a new South African-themed musical show that showcases the energetic and soulful sound and exuberant performances of our country’s choral singers.

ORPHEUS IN AFRICA

ORPHEUS IN AFRICA, David Kramer`s new musical will premiere at the Fugard Theatre in January 2015. It tells the little known story of the McAdoo Virginia Jubilee Singers` visit to South Africa during the last decade of the 19th century. Many of the well known jubilee spirituals, such as - Roll Jordan Roll, Swing Low Sweet Chariot & The Gospel Train, will be featured, as well as a number of new compositions by Kramer. The leading

It is one of the first romantic ballets ever written, with an exceptional score by Herman Lǿvenskjold (written in 1836) and choreography by August Bournonville. La Sylphide is a two act ballet set in the Scottish Highlands, that tells the tale of a young Scottish farmer named James, who falls in love with a magical and beautiful woodland spirit, known as a Sylph. Madge, an old witch, appears before him, predicting that he will betray his fiancée, Effie. Indeed, James abandons the wedding, and follows the Sylph into the woods, with tragic consequences, leaving James heartbroken and alone, as he watches Effie marry his rival, Gurn.

In this season the role of the Sylph is taken by Laura Bosenberg, Angela Hansford and Frieda Mennen. James will be danced by Thomas Thorne, Daniel Szybkowski and Conrad Nusser. Madge, the witch, will be performed by Mervyn Williams alternating with

SA’S BIGGEST FOOD AND MUSIC FESTIVAL CAME TOTHE MOTHER CITY FOR THE FIRST TIME IN DECEMBER

The DStv Delicious International Food & Music Festival, presented by Nedbank was a mjaor victory. Cape Tonians and holiday goers worlwide indulged in the perfect day out. It was a beautiful, susnhine filled day with the majestic mountain landscape enveloping the festival.

Imma talking food tucs, artisan bakers, craft beers, cocktails and pizzas that were all foodgasmic. Chef Garth Stroebel’s pop-up restaurant offered a three course tasting menu and was a hit- if you were lucky enough to get a seat. MasterChef SA judge Pete Goffe-Wood’s legendary pork belly sandwich was award-worthy. Boer-e-licious’s traditional South African boerewors was succulent and tasty and one of our favorites was the Coconut Africa store which stocked all things coconut. And we are still day dreaming about Moro Gelato- fresh, creamy, velvety and oh so divine.

World-class entertainment rocked us into the festivitites from a line-up that included UK acid jazz and funk pioneers Brand New Heavies and British club favourites Soul II Soul. Freshly Ground, MiCasa and The Soil along with Cape Town’s modern folk artist Jeremy Loops joined in the celebrations with stellar performances.

It’s quite simple really: good food, good music and sunshine filled days with a craft beer in hand will always be a great success.

Cinema transformed to offer the most immersive cinematic experience

The 250-strong crowd cheered and clapped as The IMAX Experience® returned to Cape Town on Wednesday night, 10 December. Ster-Kinekor opened its third IMAX theatre at its cinema complex at CapeGate Mall in Brackenfell.

Exuberant radio and TV personality Leigh-Anne Williams, the MC for the evening, welcomed the guests and got proceedings underway. Following speeches by Doug Place, Marketing Executive of Ster-Kinekor Theatres, and IMAX’s spokesperson, Giovanni Dolci, VP: Theatre Development EMEA for IMAX Europe, invited guests enjoyed one of the first screenings of the final film in The Hobbit trilogy, in the world’s most immersive cinematic experience.

This follows the success of The IMAX Experience® at two other Ster-Kinekor sites – Gateway in Durban, which opened in November 2013, and The Grove Mall in Pretoria, trading since June 2014, as the country’s leading cinema chain continues to bring ‘Great Moments at their Greatest’ to its audiences. To provide audiences with maximum immersion, the cinema has been transformed to include a floor-to-ceiling and wall-to-wall IMAX screen, superior acoustical treatment and IMAX’s projection and sound technology.

CAPE FUR SEAL

Situated only 8 nautical miles (about 16km) from Simon’s Town, Seal Island is home to 75,000 Cape Fur Seals, 24 different bird species and the hunting ground of the Great White Shark. All year round we often encounter Dolphins, Humpback whales and Brydes whales. From July to November the Southern Right whales are plentiful in the bay and you can be assured of a sighting.

During the winter months the Great White Sharks are extremely active around the island and we enjoy many sightings and often witness natural predations. The main breeding season for the Cape Fur Seal is November and December when almost 20 000 pups are born.

The majority of the seals on Duiker Island, out of Hout Bay Harbour, are males waiting out their time until they reach the right breeding age, which is between the ages of 8 to 12 years depending on their size. Duiker Island is not a breeding colony as the sea can get very rough and the pups get swept off. The island is most densely populated from January through March due to the seals moulting. During this period they do not go off in search of food but rely on fats they have stored in their blubber.

BIG 5 SAFARI

The phrase Big Five game was coined by white hunters and refers to the five most difficult animals in Africa to hunt on foot. The col-lection consists of the lion, African elephant, Cape buffalo, leopard, and rhinoceros.

SHARK CAGE DIVING

Great white sharks are the apex predators of our oceans and Cape Town is one of the shark cage diving capitals of the world. Sharks are iconic and magnificent creatures. It is considered the most dangerous of the Big Five, reportedly causing the most hunter deaths, with wounded animals reported to ambush and attack pursuers.

Lion (Pantheraleo): The lion is a large carnivorous feline of Africa and northwest India, having a short, tawny coat, a tufted tail, and, in the male, a heavy mane around the neck and shoulders. A lion may attack without provocation, and is considered by many to be the best of the Big Five.

Lions habituate the savanna where tall grasses, shrubs and bushes obscure and provide them cover and camouflage. This thick undergrowth is commonly referred to as jess. As lions are ambush hunters, they use this natural cover to stalk close as possible before making a final charge to catch their prey. Lions do not generally avoid confrontation, but will usually face the challenger. Lions are unpredictable and may charge when suf-ficiently annoyed or confronted by danger.

Leopard (Pantherapardus): The leopard is a large, carnivorous feline having either tawny fur with dark rosette-like markings or black fur. They are wary of humans and will take flight in the face of danger. The leopard is solitary by nature, and is most active between sunset and sunrise, although it may hunt during the day in some areas. Leopards can be found in

the savanna grasslands, brush land and forested areas in Africa. The male leopard is less than half the size of a male lion. The leopard is the smallest of the big cats, and rarely exceeds 200 lb (91 kg).

A visit to a South African reserve will, most likely, allow seeing not only the big 5 but other habitants of the African bush. Although the stock will be different between various reserves you’ll be able to watch: Giraffes, Elands, Springbok, Hippopotamus and Zebras.

CAPE PENINSULA BABOONS

The Baboon Matters Trust comprises a handful of dedicated volunteers who are at the forefront of baboon conservation in South Africa. The goals of the trust include raising awareness for the plight of baboons as well as education and training so that sustainable solutions can be found for areas of conflict between man and baboon. On a practical level the trust makes provision for the rescue and care of injured or sick baboons, and aims to support rehabilitation centres that focus their attention on baboons.

Cape Species: The Chacma Baboon (Papioursinus), also known as the Cape Baboon, is, like all other baboons, from the Old World monkey family. With a body length of up to 115 cm and a weight from 15 to 31 kg, it is among the largest and heaviest baboon species. The Chacma is generally dark brown to gray in color, with a patch of rough hair on the nape of its neck.

Unlike the northern baboon species (the Guinea, Hamadryas, and Olive Baboons), Chacma males do not have a mane. Perhaps the most distinctive feature of this baboon is its long, downward sloping face. Males can have canine teeth as long as 2 inches (longer than a lion’s canine teeth). Baboons are sexually dimorphic, males being considerably larger than females. The Chacma Baboon is found in southern Africa, ranging from South Africa north to Angola, Zambia, and Mozambique. Size and color vary within that range.

Chacmas usually live in social groups composed of multiple adult males, adult females, and their offspring. Occasionally, however, very small groups form that include only a single adult male and several adult females. Chacma troops are characterized by a dominance hierarchy. Female ranking within the troop is inherited through the mother and remains quite fixed, while male ranking is tenuous and changes often. Chacmas are unusual among baboons in that neither males nor females form strong relationships with members of the same sex. Instead, the strongest social bonds are often between unrelated adult males and females. (Wikipedia)

BOULDERS BEACH PENGUINS

A visit to the famous Boulders Beach penguins should be part of every Cape Town itinerary. The penguins from this growing colony allow for close encounters with these famous sea birds - and most tourists fall helplessly in love with them. The story of the African penguins at Boulders Beach is one of remarkable urban colonization, but the species as a whole faces many threats and these aquatic flightless birds are listed as endangered.

The story of the penguin colony in Cape Town started in 1983 when a pair was spotted on Foxy Beach at Boulders. Since then the colony has grown rapidly and now totals about 3 000 Boulders Beach penguins. The birds came to False Bay from Dyer Island after the reduction in commercial pelagic trawling, which has increased the supply of pilchards and anchovy - part of the penguins’ diet. Southern Africa is often considered the “gemstone capital of the world” as almost half of the world’s gemstones are found in this part of the world. While some may only think of gemstones as the fabulous and expensive varieties like Diamonds and Tanzanite, there are also many other beautiful and unusual gemstones that are associated with Southern Africa – like Tiger’s Eye, Rose Quartz, Amethyst, Pietersite, Malachite, Verdite, Blue lace Agate, Sodalite, and many more.

One of the most popular and convenient places to experience the amazing beauty and variety of gemstones that are found and crafted locally is right here in the V&A Waterfront at the popular Scratch Patch and Mineral World in Dock Road next to the parking garage, and just down from the Two Oceans Aquarium.

OSTRICH LEATHER & MOHAIR

Ostrich leather is the result of tanning skins taken from African ostriches farmed for their feathers, skin and meat. The leather is distinctive for its pattern of bumps or vacant quill follicles, ranged across a smooth field in varying densities. It requires an intricate, specialised and expensive

production process making it costly as well as beautiful.

Although the first commercial farming began in South Africa in 1850, the industry collapsed after World War I and the drop in demand for the feathers for fashionable hats and military uniforms. Other products were marketed, with each success battered by world events and droughts until now, when ostrich skin is globally available and seen as a luxury item in high-end demand. Leather came late in the story of ostrich farming but after a tannery was set up onsite, it went on to make an impact in European haute couture and in the U.S. for cowboy boots. Availability was artificially limited when ostrich leather was subject to a cartel monopoly through trade sanctions, and single export and distribution channels until the end of apartheid in 1993.

After that and other factors, the South African government began to export stock allowing other countries to have their own ranches. Although wider production resulted in competition and lower prices, Klein Karoo Group remains the leading global producer. Today the industry is driven mostly by the leather and the meat, which is exported to all parts of the world.

South Africa produces over 60% of the world’s ostriches and also has a distinct quality edge in the leather tanning process. Eleven years ago, Charles and Melony Biggs were farming ostrich, sheep and goats in the Graaff Reinet area in the Karoo. At first they exported skins to people he had met in the USA, where he had previously farmed ostrich for 4 years. They learned a lot in that time abroad, one thing being what we in South Africa had to offer and show off to the world in terms of leadership in Ostrich and Mohair.

They started to seek for local manufacturers and work together with designers to present a classic collection that also presents a freshness and elegancy. In 2000, Karoo Classics opened its doors in Stellenbosch: “We had 30 handbags and six belts in stock, but 100% faith in the fantastic natural products made from ostrich leather and mohair”, says Charles. From the very beginning a policy of Proudly South Africa was adopted.

They spent months looking for and visiting factories all over South Africa. The criteria were: simply, high quality at a reasonable price. Today they have a wonderful group of suppliers, from big factories to family businesses and individuals. In 2003, Karoo Classics opened in Cape Town and five years later in Franschhoek. Today they have the world’s largest selection of ostrich leather goods, carrying over 1000 handbags alone. Ostrich leather and Mohair products can be found at Karoo Classics. The five-minute ascent to the top of Table Mountain offers a 360° view of Cape Town, the ocean and the neighbouring peaks. the two lighthouses that adorn the point – one still functional, informative interpretive signage that traces the cultural andnatural history of the Point. The lighthouse is accessible by foot or you can catch the Flying Dutchman funicular to the top.

BOULDERS BEACH

After you have fallen in love with the penguins head to the secluded Boulders Beach and take a swim in the comparatively warm waters of the False Bay. This beach is ideal for kids as immense boulders shelter the cove from currents, wind and large waves - but please always take care. Also, don’t touch or feed the penguins. They might look cute and cuddly but their beaks are as sharp as razors and if they feel threatened they have no qualms about nipping the odd finger or nose.

ROBBEN ISLAND

From the 17th to the 20th centuries, Robben Island served as a place of banishment, isolation and imprisonment. Today it is a World Heritage Site and museum, a poignant reminder to the newly democratic South Africa of the price paid for freedom.

The three and a half hour tour includes a return trip across Table Bay, a visit to the Maximum Security Prison, interaction with an ex-political prisoner and a 45 minute bus tour with a guide providing commentary.

STELLENBOSCH WINE ROUTES

The Stellenbosch Wine Route is the first and the largest in South Africa and all the estates along the route are within a 12km radius of the town. It is arguably the country´s most famous, and includes more than 200 wine and grape producers within the boundaries of the Stellenbosch Wine of Origin classification. The Wine Route is divided into five sub-routes for a convenient exploration but you are welcome to be creative and target the wineries by any classification or taste. WELLINGTON WINE ROUTE

Halfway between the bright lights of Cape Town and the statuesque

mountains of the Western Cape, lies the hidden valley

You might’ve seen it elsewhere. London. New York. Melbourne. Singapore. And hopefully you’ve tasted it too. But this is it: the motherland.
