Summary: Directs the director of the division of law enforcement of the department of fisheries, wildlife and environmental law enforcement to issue the articulated written warning relative to the dangers to pregnant and nursing women, women who may become pregnant and young children, of eating fish with elevated levels of mercury, to all persons who register a motorboat; requires posting of said warning at any boat launching facilities operated by the division of fisheries and wildlife, the department of conservation and recreation, or any

municipality; requires the issuance of said warning to all persons who receive noncommercial permits for the taking of lobster, crab or shellfish and to all persons who receive fishing licenses; requires persons in the business of providing recreations fishing tours to provide all customers with said warnings; requires all persons who sell fish for human consumption or over the counter, to post the articulated written advisory relative to the potential health dangers resulting from eating mercury contaminated fish; regulates the content, shape, size and display of said advisory.

Summary: Defines “abandoned dam” and “remove” or “removal”; amends the definition of dam to include the condition “man-made”; increases a certain fine from five hundred dollars to twenty-five thousand dollars; directs the commissioner of the department of conservation and recreation, in conjunction with the commissioner of fish and game and the division of fish and wildlife and the riverways program to complete an inventory of all dams in the Commonwealth and update it every five years; articulates information for inclusion in said inventory; directs said commissioner to ensure emergency action plans are developed for all high hazard dams and significant hazard dams, which shall be available for all dam owners and be accessible by all local and state dam safety officials in the event of potential dam failure; directs said commissioner to develop an inspection schedule and articulates details of same; requires the reviewing of the hazard classifications of all dams at least every five years or when new development is constructed near a dam; directs the secretary of the executive office of energy and environmental affairs to publish a written guidance to streamline the regulatory permitting process for dam removal; directs said secretary to ensure the availability of capital funds and a forty million dollar fund for dam assessment, repair and removal.

Summary: Amends various provisions relative to the assessment of civil administrative penalties and collection of fees by the executive office of environmental affairs; requires said office to evaluate a persons commitment to perform a supplemental environmental project, including the cost of said project and the economic benefit realized by a person for noncompliance when determining civil penalty amounts; authorizes said office to require the cost of said enforcement penalties to exceed the cost of noncompliance; increases the maximum daily penalty for said violations from two hundred fifty dollars to one thousand dollars; regulates the assignment of said supplemental environmental projects in lieu of financial penalties for said violations; directs the commissioner of the department of environmental protection to prepare a recommended schedule of annual compliance assurance fees; articulates additional reporting requirements of said department, including, but not limited to the number of on site inspections conducted, the number of such inspections conducted without notice, and the number of incidences of noncompliance by category of violation; directs said department to create and maintain an enforcement database; regulates data stored by said database, including, but not limited to the frequency and extent of any noncompliance and dates and findings of inspections; authorizes said department to require the cost of said enforcement penalties to exceed the cost of noncompliance.
