Merry Christmas and welcome to our 2017 Christmas newsletter.

A risk assessment must be submitted before an open sleigh is considered safe for members of the public to travel on. The risk assessment must also consider whether it is appropriate to use only one horse for such a venture, particularly if passengers are of larger proportions. Goggles, hard hats and face masks are mandatory due to the danger of flying ice from the horse’s hooves. Please note that permission must be gained from landowners before entering their fields. To avoid offending those not participating in yuletide celebrations, we would suggest that laughter is moderate only and not loud enough to be considered a noise nuisance.

The Union of Shepherd’s has complained that it breaches Health and Safety regulations to insist that shepherds watch their flocks without appropriate seating arrangements being provided, therefore benches, stools and orthopaedic chairs are now available. Shepherds have also requested that due to the inclement weather conditions at this time of year that they should watch their flocks via CCTV cameras from centrally heated shepherd observation huts.

Please note that the Angel of the Lord is reminded that before shining his/her glory all around he/she must ascertain that all shepherds have been issued with glasses capable of filtering out the harmful effects of UVA, UVB and Glory.

The RSPCA have issued strict guidelines with regard to how heavy a load a donkey of small stature is permitted to carry, also included in the guidelines is guidance regarding how often to feed the donkey and how many rest breaks are required over a four hour plodding period.

Please note that due to the increased risk of pollution from the dusty road, Mary and Joseph are required to wear face masks to prevent inhalation of any airborne particles, and goggles to avoid risk of eye injury from kicked up stones etc. The donkey has also expressed his discomfort at being labelled ‘little’ and would prefer just to be simply referred to as Mr Donkey. To comment upon his height or lack thereof may be considered an infringement of his equine rights.

Basic HR Support Can Increase Workplace Productivity

In the media we have recently heard about the UK’s poor productivity at work in relation to other developed economies. The Chartered Institute of Personnel and Development completed their “People Skills” research and released information regarding the importance of HR support to small businesses in what they feel is a key factor in unlocking this productivity puzzle. They are also calling on the Government to invest £13m in to the delivery of HR support sessions, ‘revolutionising the quality of business support for small firms’.

‘People Skills’, a CIPD led advice hub, supported by JP Morgan, provided two days’ worth of free HR guidance to SME’s. The subsequent evaluation report revealed important themes and the ones that particularly caught our attention were:

• ThemoststraightforwardHRsupportsuchassimplyestablishing and tightening job descriptions provides a platform for improving workplace productivity.

• Afterusingthesupporthub,managersreportedfeeling their organisation was better or much better than similar firms in their sector on measures of workplace relations, labour productivity and financial performance.

• HRinterventions,iftheyaretobeappliedappropriately and implemented effectively, require specialist knowledge.

• Thecontinuallygrowingbodyofevidencetosuggestthat improved HR practice in SMEs is also associated with enhanced business performance.

Ben Willmott, CIPD Head of Public Policy, said: “People Skills shows the potential benefits of targeted investment to improve small firms’ capability around the management of people through co-ordinated high-quality, locally-delivered business support via channels such as Local Enterprise Partnerships, chambers of commerce and local authorities.”

Hang Ho, EMEA Head of the JPMorgan Chase Foundation, said: ‘’This report shines a light on the importance of basic HR practices to the success of small businesses, whether that is improving productivity, boosting the effectiveness of the management team or handling crises’’.

If you are a business owner, it is worth noting, that throughout the report the most commonly expressed barrier by businesses to using effective HR process was time, which was closely associated to the lack of understanding in the value of HR.

What Is The GDPR?

HR

The EU General Data Protection Regulation or

“GDPR” is the most important change to data

protection and privacy law in two decades.

It was approved by the EU Parliament in April 2016 and comes into force in the UK on 25th May 2018. The GDPR will replace the Data Protection Act 1998 and, while it is similar to the current regime under the 1998 Act in many ways, it is a great deal more modern, taking into account major advances in science and technology. Most importantly for businesses it is more demanding.

Why is the GDPR Necessary?

The GDPR is designed both to harmonise data protection law throughout Europe and to modernise it. A great deal has changed in the last two decades, not least the ways in which personal data is collected and processed by organisations. In particular, the growth of the internet and the significant increase in the amount of personal data being transferred, stored, and processed online means that legislation that worked 20 years ago is, in many respects, no longer up to the task.

Will the GDPR Affect My Business?

Simply put, if you handle personal data of any kind and you are already subject to the Data Protection Act 1998, yes, it will. The GDPR will apply to all organisations operating within the EU and to organisations outside of the EU that deal with individuals within the EU. The good news is that if you are already complying with the Data Protection Act, you’re off to a strong start. Nonetheless, it is very important to be aware of, and to understand, yourobligations(existingandnew)undertheGDPR.

What does Brexit Mean for the GDPR?

The UK government has made it clear that the provisions of the GDPR will still apply after Brexit.

In September 2017, the Government published a new Data Protection Bill, the main purpose of which is to

bring the provisions of the GDPR onto the UK statute book after we leave the EU. There are already some differences between the GDPR and the Data Protection Bill, but it is likely that from the perspective of most businesses, the steps necessary for compliance will be the same.

What are the Key Changes?

Compared to the current data protection framework under the Data Protection Act 1998, the GDPR will bring a number of important changes and enhancements including:

• Increasedaccountabilityandgreaterresponsibilitieswithin organisations to ensure that personal data is protected and processed within the bounds of the law;

• Awiderrangeofdatawillnowbeclassedas“personal data”;

• Dataprocessors(e.g.contractorsandserviceproviders)willnowalsoberegulated;

• Thepenaltiesforfailuretocomplywillbemuchstronger(upto€20mor4%oftotalworldwideturnover,whicheverishigher);

• Newproceduresrequiringdatacontrollerstonotifythe ICO of data breaches within 72 hours of the breach;

• Enhancedindividualrightsincludinggreatertransparency and “the right to be forgotten”;

• Therequirementformanyorganisationstoappointa Data Protection Officer where personal data processing is significant; and

• Stricterrulesonconsentgivenbydatasubjectstothe collection and processing of their personal data.
