Legal and Ethical Issues

in Today’s Healthcare

TARGET AUDIENCE This program is designed for registered nurses and other healthcare providers who deliver patient care in various practice settings.

LEARNING OUTCOME To increase the participants’ knowledge base regarding updated information on legal and ethical issues that nurses and other healthcare providers face.

PROGRAM OBJECTIVES At the conclusion of this program the participant will be able to:

1. Define various foundational ethical principles and theories which serve as a guide when healthcare workers are faced with ethical dilemmas.

2. Define the term “bioethics” and explore a number of the significant questions and issues which the field encompasses.

3. Describe the provisions of the 2015 ANA (American Nurses Association) Code of Ethics for Nurses.

4. Examine a variety of ethical issues that nurses face in today’s healthcare realm.

5. Explore legal standards for nursing documentation and strategies for avoiding documentation mistakes.

6. Describe the purpose of the Patient Compensation Fund and its relevance to nursing liability.

7. Explore laws which provide guidelines for health-care providers when caring for the mentally ill.

8. Identify EMTALA’s provisions as well as other compliance issues and review their application to patient care and nursing practice.

COURSE DESCRIPTION We are extremely pleased and honored to have national and international expert on healthcare ethics, Fr. Kevin Wildes. Fr. Wildes is the President of Loyola University New Orleans and holds advanced degrees in theology and philosophy. He has published numerous works, authored a book, lectured internationally, and testified before Congress about bioethics making him a leading expert in the field. Fr. Wildes will cover important ethical issues in healthcare and nursing and will offer various perspectives and information to help you make the best decisions for yourself and your patients. Nurse attorneys, Chad Sullivan, Cynthia Schwartz, and Holly McKay Descant, as well as, hospital compliance expert, Elizabeth Champion, will also be joining us to address numerous legal and ethical topics in healthcare such as EMTALA, nurse liability, Patient Compensation Fund, documentation do’s and don’ts, social media issues, media disclosures, and mental health laws, just to name a few. Join us to get updated information on the legal and ethical issues that challenge nurses in today’s healthcare field.

FACULTY Kevin Wm. Wildes, S.J., Ph.D. The Rev. Kevin Wm. Wildes is the President of Loyola University New Orleans. He entered the Society of Jesus in 1976 after graduating from St. Joseph’s University in Philadelphia. He holds advanced degrees in theology and in philosophy, receiving his Ph.D. from Rice University in 1993. His professional work is in the field of bioethics. He serves as associate editor to and is on the editorial board of a number of ethics and medicine journals and book series and he is a founding editor of the Journal of Christian Bioethics. He was a member of the Department of Philosophy and a Senior Research Scholar in the Kennedy Institute of Ethics at Georgetown University where he also held an appointment at the Georgetown University School of Medicine. He is a member of the Department of Philosophy at Loyola and teaches undergraduate and law students each year. Wildes authored Moral Acquaintances: Methodology in Bioethics and is the editor or co-editor of four books. He has lectured internationally on medicine, ethics, and healthcare. He is developing a new book on organizational ethics in healthcare.

Chad A. Sullivan, RN, BSN, JD Mr. Sullivan is a trial lawyer and a registered nurse with years of practical experience representing clients in Louisiana’s state and federal courts and before administrative panels. These include the State Board of Nursing and Louisiana Patient’s Compensation Fund. He regularly handles difficult cases involving insurance defense, malpractice, defective products, impaired professionals, and licensure claims involving healthcare practitioners. His medical background and responsiveness are factors in his frequently being chosen as “Attorney Chairman” in medical malpractice cases, a role chosen by both sides to facilitate the medical review panel process.

Holly McKay Descant, JD, RN Ms. Descant is a registered nurse and is licensed to practice law in Louisiana and Mississippi. She attended Louisiana State University Health Sciences Center School of Nursing, obtaining a B.S. in Nursing. After working as a registered nurse in various areas, she attended law school and graduated from Mississippi College School of Law in 2008. She served as a judicial law clerk in the 4th Judicial District Court in Ouachita Parish, Louisiana, then worked in the oil and gas industry. She joined Gachassin Law Firm in 2015 with a focus in the area of professional liability defense.

Cynthia Schwartz, JD, RN Ms.Schwartz was raised in Shreveport, Louisiana and obtained her B.S. in Nursing from Northwestern State University. As a nurse, she has over 20 years of experience in intensive care, hemodialysis, and research. She graduated Cum Laude from Southern University Law Center in 2013 where she received CALI awards in Legal Writing I, Contracts, and Commercial Paper. She joined the Gachassin Law Firm in 2016 after being admitted to the bar in 2013. Ms. Schwartz practices in the areas of medical malpractice and professional liability defense.

Elizabeth Champion, CHC, RHIA Ms. Champion began serving as Chief Compliance Officer for the Franciscan Missionaries of Our Lady Health System (FMOLHS) in 2011. In addition to this position, she has held her previous post as the Compliance Officer for Our Lady of Lourdes (OLOL) since 2004. Ms. Champion holds a Bachelor of Science in Health Information Management from University of Louisiana at Lafayette. She is certified in Healthcare Compliance (CHC) and is a Registered Health Information Administrator (RHIA) and served as a member of the Malcolm Baldrige National Quality Award Board of Examiners under the Department of Commerce in 2009.
