OVERVIEW OF STATE LAWMAKING

• State legislatures are charged with the day-to-day governing of the country. State legislatures pass about 80 state bills for every 1 Federal bill Congress enacts.

• State legislatures are responsible for raising enormous amounts of money through state tax revenue and finding solutions to manage complex public problems.

• 49 States have Bicameral (2 house chambers); usually a Senate/Assembly (Nebraska)

• In New York State more than 14,000 bills are introduced each year with about 2000 or <15% being acted on and less than 6% become law

Bills: Start with an idea!

• Legislation deals with birth and death, and everything in-between

• Ideas for bills come from lawmakers, constituents, state officials, organizations, and every day citizens.

• Once an idea has been settled on – it must be put into bill form.

• Actual drafting of legislation requires special skills/training – usually by staff or attorneys

• Our friends are frequently involved in crafting specific legislation

Bills: The Introduction Stage• Bills are introduced by Assembly/Senate members in

their houses or committees, or by the Governor

• Once the bill has been “introduced”, it is examined, corrected and given an number

• Then it goes to the appropriate standing committee for review and is assigned a date and printed

• FUN FACT: “First reading”, “second reading”, and “third reading” are holdovers from the days when each bill was read aloud in public sessions three times before final action could be taken

Bills: Committee Stage

• Standing Committees, controlled by the majority party, review bills and determine if they should be amended or if and when the bill is ready to report out (Chairpersons)

• The past few years FOR-NY & LIRA have worked closely by contacting committee members and chairs in an effort to move bills out of committee and to a full vote on the floor

• Relationships with allies on committees can help influence chairs to move bills or report them out.

• Bypass strategies, committee choices, rules

• Bills are placed in order on the daily calendar as they report out of committee

Bill Movement: The Calendar Stage

• When Bills are reported out of committee they are placed in order on the daily calendar

• After 3rd reading they’re ready for a vote

• If a majority of members vote in the Senate or Assembly in favor of the bill, it passes and is sent to the other house

• Identical bills are “same as” – and only those are signed by Governor

• Similar can be referred to conference (5 Senators/5 Assembly) to reconcile differences

Bills: Executive Stage

• Bills that pass both houses are sent to the Governor with 10 days to sign or veto

• If no action occurs – bill automatically becomes law

• Signed bills become law – vetoed bills are returned to house that first passed with written reason

• A vetoed bill can become law with 2/3 majority in favor in each house through “override” – not common

Schedule meetings well in advance (call the Albany office number and ask for the scheduler 4-6 weeks out if possible)

• The legislator May Not be available for the meeting; be prepared to meet with a staffer/legislative aide which can be equally effective

• Research/Homework: Be knowledgeable about your legislators track record on your issues: what is their position on current issue: Supporter/Defender-Inert Opponent-Neutral Observer-Staunch Opponent-Oblivious (NASW NYS)

• Identify a Team Leader who will open the discussion. Each person in your group should know their role in advance i.e., (sharing statistics, a personal or family story, bill history, be an observer only etc.,)

• Bring Materials for the legislator/staffer (Leave Behind )

Preparing for your meeting

• Be on Time – no more than 5 minutes before the meeting. Inform staff if you’re going to be late in case another meeting time must be arranged

• Be Flexible – prepare to meet with either Legislator or staff; treat both with same respect

• Stay on Topic – raise only the issue you schedule to discuss and keep meeting focused

• Keep Politics Out of It – don’t discuss elections or campaign support in your meeting

• Leave Behind Brief Informational – 1-2 page briefing with data points on issue discussed with Legislator/Staff

How to organize meeting with the Legislative Staffer• Identify: When possible have all introduce self and identify group

affiliation• Be a Master of your subject matter: Know what effect passing

the pending legislation or lack thereof will have and articulate that position.

• Share: Your personal story to lead into the ask. i.e. I am person in long term recovery/a family member and I (or my spouse, son or daughter) was able to recover because I (they) had access to 30 days of inpatient treatment etc. I am a parent who lost a child I am here because I do not want to see another family suffer.

• Share specific data to support your position i.e. overdose facts in your county, lack of treatment beds, recovery statistics etc.

• Stay on point: A legislative visit is typically 15-20 minutes. Make your points clear; articulate your ask: Co-sponsorship of legislation, movement on a bill; ask chamber leader to allow a vote, encourage increase in funding etc.

Meeting strategies

• Know your Legislator; If they support your position thank them; stress importance of continued support

• Sprinkle Honey: If the legislator is not supportive ask what information they need to consider a change in position. This creates an opening to stay connected as well; there may a future opportunities on other issues.

• Be Courteous and leave on good terms. Thank the legislator or staff member at the conclusion of your visit; request clarity on next steps; Shall we call you?

• Follow-up with thank you note/e-mail. Include resources if promised; restate commitments received.

• Offer to be a resource on alcohol, drug related matters
