ij The appointment of Governor Dole to the Territorial Federaljudgeship and of George R. Garter as Governor of the Territory isthe highest compliment which President Roosevelt could have paidto the Territory,, in this that both gentlemen are Island men. "it is evident to this grant! jurythat the police force of Wailuku arevery slack in their duties. Therehave been conplaints made by citizens living here in regard to manyannoyances which is claimed havtbeen reported to the heads of thepolice force, but no actions seems tohave been taken in the matter.

''The police force is for the protectionof the public, and it is the dutyo? that department to see that thepeople are not insulted or annoyedby the misconduct of others, such asurinating in the public streets ormaking indecent exposure of themselves.

"There is also a matter of estraysin the public streets, whereby pri-

vate citizens have been annoyed, andtheir property destroyed, and itwould seem to this grand jury thatit is the part of the police force tosee that the streets are kept' clearfrom these wandering animals.

"The whole police force of this cir-

cuit shows a lack of dicipline."There has been a complaint made

to. this grand jury about Govern-ment officials receiving more salaryallowed by law. We have investi-gated this matter, and fiud thatthere are no grounds for complaint.

"The grand jury has spent consid-erable time in investigating the booksand accounts of the clerk of thiscourt. e have found everything ina most unsatisfactory atate, and asyour honor charged us yesterday, wewould request that the court directand order t,he Auditor of the Govern-men- t

to examine all the records andaccounts of the office under suspicionjaccording to law. We also recommend that, the clerk of the courtbe suspended from all official duties,until suen time as the books and accounts are found to be in. order.

"To the Foreman of the Grand Jury,. Second Circuit Court, October

Term."We, the undersigned members of

the grand jury, appointed as com-

mittee, have investigated the follow-

ing matter and have to report:"1st. At two points on the roads

leading to the Wailuku depot, a cor-poration by the name of the WailukuSugar Company have constructedrailroads across the above mention-ed streets or roads. At the last sit-

ting of the grand jury it was recom-mended that the said Wailuku SugarCompany should at once be instruct-ed to have flagman stationed at theseroads to notify passers-b- y should anytrains or cart be running at thotime. Said Wailuku Sugar Companyhas paid no. attention to and has apparently treated the matter in acontemptuous manner, placing theformer grand jury in the light of havlng no authority whatever. Vetherefore recommend that this mat-

ter be taken up in a strenuous manner: and, if possible, the WailukuSugar Company shall be made toanswer why it has not followed theinstructions given. We also reconi!-mend that the Wailuku Sugar Company be forced to see that the flag-

man are stationed at the abovepoints whenever trains are run,which apparently would be duringtheir grinding seasons. This is amenace to public safety, and N alsoto the interests of the WailukuSugaivCompany, as in case of accidents arising the said Wailuku SugarCompany would be held accountable.

"2d. In the rear of the WailukqSugar Company (rear of their office)is a large covered molasses tank. Thesame measures apprimately 30x30It li covered by rotten boards, andwhen full of refuse molasses thestench which issues therefrom men.aces the health of any person or persons w.ithin a radius of half, a mile.This tank especially menaces thehealth of the 6mall children who attend the school opposite the WailukiiSugar Company a premises. Thistank is on a level with the ground,and a child at any time might attempt to cross on the rotton boards,in which ease it would result nisastrously. We recominehd that thistauk be closed Immediately. ":

ers without their proper badges,shoving that they are not licensedto drive. It is entirely wrong thatthe lives of the people of this com-

munity and visitors should be placedin jeopardy by not having propermen to drive the racks, vve nnamany of the Japanese hack driverswho actually do not know oa whatside of the road to keep.

5th. The obstructing of Marketstreet in Wailukvr we ffnd an increasing evil.- The peddlers and fish mongers infest this district, blocking thestreet, and thereby menacing thepublic at large. Offensive odors alsomenace the people living in andaround Market street. We reconvmend that a suitable market be builtin some central location,--t- be usedby these fish mongers and other pad-ler- s.

Two locations have been pointred out to us, one back of AntoneBorba's store and in front of theMaui Stables. Here there is a largelot and a suitable market should bebuilt here such as already exists atHilo.
