    Majority Chairman Metcalfe Gavels In to ProtectLife, Liberty, Property and Family-Sustaining JobsDear Friends,

    Our state and nation face manychallenges, not the least of which is thecontinued growth of all levels of ourgovernment. The expansion of government,from the multi-million dollar budgets oflocal governments, such as CranberryTownship, to the multi-billion dollar budgetsof Pennsylvania, to the multi-trillion dollarbudgets of our federal government, createsthe same result: individual citizens have lessof their own money and lose more of theirindividual rights.

    As we entered the 2011-2012 legislativesession, I received the appointment ofMajority Chairman to lead the PennsylvaniaHouse of Representatives State GovernmentCommittee. The responsibilities of mycommittee include issues of interactionbetween the state and federal government.During the rst half of this year, I heldhearings on a wide range of issues facingPennsylvanians, including: performance-basedbudgeting; requiring voters to present photoID every time they vote; the health, privacyand liberty issues related to the TSA bodyscanners and pat downs; Congressionalredistricting; and increasing governmenttransparency.

    I am currently planning summer and fallhearings on issues including: addressing the$1.4 billion per year illegal alien problem inPennsylvania; protecting marriage betweenone man and one woman; the economicsavings of adopting English as our of ciallanguage; state pension issues; and the size ofthe legislature. It is important to note thatreducing welfare by only 10% would savetaxpayers more than three times the savingsof eliminating our entire state legislature.

    My main objective as a Chairman is toadvance policies that protect our individualliberties by holding our governmentaccountable to perform the limitedConstitutional responsibilities we haveassigned it, while restricting its reach intoour lives and our pockets. I will continue mywork to protect taxpayers.

    Representative Daryl Metcalfe has been appointed to serve asMajority Chairman of the highly activePennsylvania HouseState Government Committee .

    Every legislative initiative referred to this committee will beconsidered based on one overriding governing principle: whether ornot it protects, af rms or advances our God-given, not government-given individual liberties, said Metcalfe. Representative Metcalfe hasbeen recognized by the Pittsburgh Post-Gazette as the PennsylvaniaGeneral Assemblys No. 1 Conservative and a multiple timehighest-ranking lawmaker on the Pennsylvania Liberty Index .

    The State Government Committee and each of itssubcommittees maintains legislative jurisdiction over issues involvingproposed amendments to the Pennsylvania Constitution; landconveyances; statewide initiatives and referendum; election codereform; lobbyist disclosure; ethics and nancial disclosure requirementsfor public of cials and employees; sunshine laws to ensure open publicmeetings; and this years Congressional redistricting.

    Whether its advancing legislation to permanently protect thetraditional de nition of marriage between one man and one womanor defending the lives, jobs and property of Pennsylvania taxpayersfrom the illegal alien invasion, this committee has an unprecedentedopportunity to restore the proper role of state government to a fullyaccountable public servant that upholds our personal liberties, ratherthan eroding them, said Metcalfe.

    Metcalfes Moment

    Legislative committee hearings are oftenexercises in self-indulgence by lawmakers, whoseem more interested in hearing their ownvoices than what witnesses have to say.

    Metcalfe Keeps Job-Creating Legislation Moving Forward

    Representative Metcalfe addresses gun owners from across the Commonwealthat his Annual Pennsylvania Right to Keep and Bear Arms Rally.

    Just how dif cult is it for an individual member of thePennsylvania House of Representatives to sponsor and advancelegislation that ultimately becomes law?

    Considering the following statistics, the answer is clearlyagainst all odds:

    Out of the approximately11,560 bills introduced inboth chambers of the Pennsylvania General Assemblyduring the2007-08 and 2009-10 legislative sessions,only525 or less than 5 percent were signed intolaw by the governor.

    Of those525 , approximately 362 , or 69 percent , were introduced by members of House and Senate

    leadership or committee chairman .

    Conversely, only163 , or 31 percent , weresponsored by rank-and- le members of the

    Pennsylvania General Assembly.

    FAIR SHARE ACT NOW LAW

    Senate Bill 1131 (Fair Share Act ) is aimed at protectingtaxpayers, job creators and the medical community againstfrivolous lawsuits.

    The Fair Share Act reforms the states joint and severalliability law by ensuring that defendants found negligent or liablefor an injury are responsible for only their share of the damages.Senate Bill 1131 was adopted by the House and signed intolaw on June 28.

    CASTLE DOCTRINE NOW LAW

    House Bill 40 makes Pennsylvania the24 th state to adoptthe Castle Doctrine to restore the legal ability of law-abidingCommonwealth residents to stand their ground and use lethalforce to defend themselves against violent criminals.

    The Castle Doctrine , which passed in the House by a marginof 164 to 37, was signed into law by Governor Tom Corbett on June 28.

    SPRINKLER MANDATE REPEALED

    House Bill 377 repeals the Universal ConstructionCode mandate requiring sprinkler systems to be installed in allnewly constructed residential housing. Individual homeownersshould have the freedom to choose, rather than being forcedthrough a state government mandate, to invest the additional$5,000 to $15,000 to install a sprinkler system.

    House Bill 377 was the rst bill sent to and signed intolaw by Governor Tom Corbett.

    INCREASING GOVERNMENT TRANSPARENCY

    Since Representative Metcalfes appointment as MajorityChairman, the House State Government Committeehas advanced several pieces of reform legislation to increasegovernment transparency, accountability and integrity. All vebills have passed the House unanimously.

    Signed into law on June 30,House Bill 15 establishesthe PennWatch online database to allow state taxpayers toconveniently monitor government spending and other statisticalinformation to hold elected of cials scally responsible andaccountable.

    House Bill 103 increases penalties for lobbyists engaging in

    prohibited activities.House Bill 107 prohibits an individual who has been

    employed within the last two years by a company offering acompetitively sealed bid for a state contract from participatingin the evaluation of such proposals. Similarly,House Bill 108makes the Right-to-Know Law applicable to public procurementcontracts and provides for public inspection of non-competitivecontracts prior to the execution of the agreement.

    Finally, House Bill 109 prohibits members of the GeneralAssembly from creating or maintaining legislative nonpro torganizations.

    Representative Metcalfe was joined by State House members, leaders frorganizations across the Commonwealth and individuals committed to enthe practice of compulsory unionism to of cially reintroduce thePennsylvaniaOpen Workforce Initiative (House Bills 50-53).

    Sponsored and advanced by House State Government CommitteeMajority Chairman Representative Metcalfe, the Pennsylvania Voter Protection Act (House Bill 934) was passed by the House on June23.

    Pennsylvania has a long and ongoing history of documented voterfraud pre-dating even the frequently-forged signature of MickeyMouse during the 1918 election to the deeply-rooted and widespreadin uence of A.C.O.R.N. during the past several election cycles,said Metcalfe. Currently in Pennsylvania, it is impossible to board acommercial airplane, cash a paycheck, operate a motor vehicle or evenpurchase season passes to an amusement park without displaying validphoto ID. Guaranteeing the integrity of our states election processdeserves no less than equal protection under the law.

    Modeled after Indianas photo identi cation law, which was upheldas Constitutional by the U.S. Supreme Court in 2008, Metcalfeslegislation would amend the state election code to require votersto present valid photo ID before voting. Current Pennsylvania lawrequires identi cation for voters who appear to vote in an election

    district for the rst time.Expert testimony presented to the House State Government

    Committee earlier this spring con rmed that requiring valid photoID at the polls, as provided for byHouse Bill 934 , can preventthe four most widely documented types of voter fraud, including:impersonation at the polls, ctitious registrations, double voting andvoting by illegal aliens.

    Even more recently, in a June 7KQV Radio/Tribune Review poll,86 percent of respondents said that voters should be required toshow photo ID.

    House Bill 934 is a commonsense safeguard that will onlydisenfranchise integrity-de cient individuals seeking to perpetuatefraud and corruption at the polls, said Metcalfe. Any elected of cialwho opposes requiring valid photo ID at the polls needs to be asked ifallowing for cheating at the ballot box is necessary for them in order towin.

    Metcalfe Photo ID Legislation to Stamp Out Voter Fraud and CorruptionWins House Approval

    Metcalfe Calls 2011-12 State Budget First Step toFiscal Responsibility and Family-Sustaining Jobs

    For the rst time in nine years, Pennsylvania taxpayers nally have a balanced, on-time, state budget containing no taxincreases and that cuts more than$1 billion in excessive government spending compared to last years budget.

    This is the rst budget that I have supported in 13 years because it takes the rst step in reversing the scallyirresponsible spending decisions of the past and provides an excellent framework to get state government off taxpayersbacks and out of our pockets, said Representative Metcalfe. The multi-billion dollar Rendell budget de cit was closedwith no tax increases, and this years budget also includes a reduction in the job-killing Capital Stock and Franchise Tax.

    Additionally, the 2011-12 state budget eliminates or consolidates nearly100 wasteful, non-essential or duplicative lineitems and government programs.

    Again, this years budget is only the rst step on the path to scally responsible state government and much more

    needs to be done, especially in reducing taxpayer-funded expenditures for the Pennsylvania Department of PublicWelfare (DPW) whose funding ballooned by more than$4 billion per year under the Rendell administration, saidMetcalfe. Due to legislative pressure initiated by House Republicans, Governor Corbett agreed to reduce his proposedwelfare spending by$404 million . Next year, after the governor has served a full year in of ce and has had time tofully examine DPWs operations, we will expect him to bring a meat cleaver, rather than a butter knife, to cut even morewasteful and excessive welfare spending.

    Metcalfe commended the nal 2011-12 state budget for forcing state government to start to live within its means.

    As we came to a close on this scal year, state revenues exceeded expectations by hundreds of millions of dollars, said Metcalfe. Throughout the budget debate, House Democrats led a misinformation campaign in an attempt to stoplong overdue spending reductions by claiming that the state has a surplus due to the new revenue numbers. Even withthe elimination of the multi-billion dollar Rendell budget de cit, Pennsylvania still has$50 billion in current and futureliabilities. Simple math reveals that even revenue exceeding expectations by hundreds of millions of dollars still does nequal a surplus, but a de cit. I will continue my work to protect Pennsylvania taxpayers.

    Home package for the 2011-12 legislative session at the stateCapitol and participating as one of ve specially selected panelistson the nationally televisedPeter Jennings Project debate at theNational Constitution Center in Philadelphia, during the sameweek in early March...

    Returning to Washington , D.C. , in April to once again ignitethe national talk radio airwaves at the2011 Hold Their Feet tothe Fire event and continuing to address Tea Party groups acrossthe Commonwealth....

    These are just some of the ways State Legislators for Legal Immigration founder , Representative Metcalfe, isstepping up the ght to combat Pennsylvanias estimated 140,000illegal alien invasion .

    Pennsylvanians must be made aware of the personal liberties lost, the more than$1.4 billion in tax dollars wasted annually andlives destroyed due to the continued presence of illegal aliens, said Metcalfe. It is my hope that putting a human face on those who havebeen victimized by illegal aliens through violent crimes, stolen jobs and illegally-accessed bene ts will bring about the immediate and necessaryreforms contained in the National Security Begins at Home package.

    Representative Metcalfe was among the distinguished panelists invited to participatein the nationally televised debate, Putting The 14th Amendment To The Test at theNational Constitution Center.

    With approximately 42 public school districts at risk for animmediate teachers strike due to expired contracts and an additional120 districts facing the possibility of a strike before the end of 2011,Representative Metcalfe participated in a state Capitol press conferencein early June to of cially unveil theSTRIKE-FREE Education Pact(House Bills 1369 & 1640) to outlaw teacher strikes and other public

    school lockouts in Pennsylvania.

    In addition to short-changing students by completelyshort-circuiting the education process, teacher strikes are ultimatelythe hammer that drives property taxes through the roof as taxpayersare left footing the bill for union-driven salary increases and lengthyarbitrations, said Metcalfe, who also referenced that Butler County hasbeen negatively impacted by three-public-school-closing teacher strikes(Seneca Valley [1] and South Butler [2] school districts) during thepast several school years. Passage of theSTRIKE-FREE EducationPact will nally expel the self-serving greed of public sector unions thathas no legitimate place in the public service arena or in Pennsylvania.

    Article 3, Section 14, of the Pennsylvania Constitution currently

    states: The General Assembly shall provide for the maintenance andsupport of a thorough and ef cient system of public education to servethe needs of the Commonwealth.

    If approved in two consecutive sessions of the General Assemblyand by voter referendum, Metcalfes legislation (House Bill 1640)would amend, expand and clarify Article 3, Section 14 , with the followingplain English provision:

    And shall not provide for any lawful strike or lockout of employees of public education .

    Also supported by Representative Metcalfe, House Bill 1369would immediately outlaw teacher strikes and lockouts at the statutory

    level and includes a$5,000 individual ne per incident for incitinga strike , and teachers losing two days of pay for every illegalstrike day .

    Due to circumstances absolutely beyond their control, strike-impacted parents and guardians have no choice but to nd child careduring a strike, in order to keep earning their paychecks, said Metcalfe.Strike-impacted students and their families are also harmed in manyother ways, not the least of which includes lost vacation time and beingrobbed of countless other extracurricular opportunities that cannot bemeasured in terms of dollars and cents. However, striking teacher unionmembers suffer no economic loss because they will be retroactivelypaid for the 180 days of instruction as mandated by state law.

    Currently, 37 states , including neighboring New York and New Jersey, prohibit teacher strikes. Within the past decade, the majorityof teacher strikes nationwide occurred in three states: Pennsylvania(94) , Illinois (29) and Ohio (28). During this time, more than247,000 Pennsylvania students have had their learning experiencesinterrupted and adversely impacted by teacher strikes.
