Minutes of the Ordinary Monthly Meeting of Lockhart Shire Council held in the Council Chambers, Green Street, Lockhart on Monday, 21 November 2016 at 6.06pm.

PRESENT Cr R. Schirmer (Mayor), Cr G. Verdon (Deputy Mayor), Cr D. Douglas, Cr M. Day, Cr I. Marston, Cr. A. Rockliff, Cr P. Sharp, Cr J. Walker. Also in attendance were the General Manager, Director of Engineering and Environmental Services and Director of Corporate and Community Services. The meeting opened with a prayer.

MAYORAL REPORT The Mayor, Cr Schirmer, verbally reported on activities during the past month as follows: Tues, 25 Oct Along with the General Manager Rod Shaw, attended the REROC

AGM in Wagga Wagga.

Along with Crs Douglas, Marston, Verdon and Walker, the GM and Directors, attended the Community Strategic Planning Public Consultation in The Rock.

Wed, 26 Oct Along with the General Manager Rod Shaw, attended the Bush Fire Management Committee meeting at the Wagga Wagga RFS.

Along with Crs Day, Douglas, Rockliff and Verdon, the GM and Directors, attended the Community Strategic Planning Public Consultation in Lockhart.

Tue, 15 Nov Along with the Director Engineering and Environmental Services

David Webb, attended the CSU Engineering dinner in Griffith.

(T26-005) MINUTES OF THE TOURISM/ECONOMIC DEVELOPMENT STEERING COMMITTEE MEETING OF LOCKHART SHIRE COUNCIL HELD AT YERONG CREEK BOWLING CLUB ON TUESDAY, 1 NOVEMBER COMMENCING AT 6.35PM. CONFIRMATION OF MINUTES The minutes of the Meeting held Tuesday, 6 September 2016, as printed and circulated, be taken as read and confirmed on the Motion of S Creek. 1. Economic Development

Members of the Tourism and Economic Development Committee (TEDSC) are invited to attend the workshop facilitated by Crowe Horwath regarding specific actions for Council to take to promote economic development and to determine how to resource the actions is proposed for Monday, 7 November commencing at 4.00pm at Lockhart Shire Council Chambers. The committee discussed a number of potential actions and all those able to attend will be at the workshop. Recommendation: That the information be noted.

2. Lockhart Shire Business Excellence Awards The Tourism & Economic Development Officer (TEDO) is continuing to work with Rotary to conduct the Lockhart Shire Business Excellence Awards, with the following details confirmed to date. The Lockhart Shire Business Excellence Awards is a joint collaboration between Lockhart Shire Council and Rotary. The primary purpose of the Awards is to provide local businesses with the opportunity to celebrate and be recognised for their achievements including outstanding results through initiatives that demonstrate leadership and commitment to service excellence. Entry to the 2017 Lockhart Shire Business Excellence Awards is open to all businesses located within Lockhart Shire, with nominations open between 1 December 2016 and 31 January. Members of the community are able to nominate based on the following categories: • Young Entrepreneur (18-35) (Sponsored by Rotary) • Employee of the Year (Sponsored by The Rock Progress Association) • Business Leader (Sponsored by Lockhart Progress Association) • Excellence in Small Business (Potential Sponsorship – Lockhart Shire Council). Finalists will be selected based on the number of nominations received in their specific category, and will be notified of their selection on 24 January 2017. Finalists will receive a Finalist Pack that includes an Invitation to the Lockhart Shire Business Excellence Awards Presentation Evening, a Certificate, the Judging Criteria including a brief questionnaire and General Information about the Awards.

Lockhart Shire Council Ordinary Meeting – 21 November 2016

NSW Business Chambers and Wagga Rotary contacts have indicated they will assist with judging. Finalists are judged based on a two stage process: • Information received by each business (Qualifying) • A 30 minute interview with judge(s) (Judging). The Presentation Evening will be a ticketed event which will include talks by Industry Leaders/Experts, an evening meal and the naming of the Lockhart Shire Business Excellence Award winners. The evening is an ideal opportunity for business owners to share the accolade of becoming a finalist with their family, friends and staff. The evening acknowledges everyone's hard work and contribution to the business' success - a shared celebration of the business' achievements. The Winner in each category will receive a Trophy and Certificate, with the runner up receiving a Highly Commended Certificate. The Winner of the overall Lockhart Shire Business Excellence Award will be selected from the four finalists and will receive a Trophy and Certificate. Key Dates: November 2016: Distribution of Entry form in newsletter. Available in towns. 1 December 2016: Entries Open 31 December 2016: Entries Closes 24 January 2017: Finalists Announced 1 February 2017: Questionnaires Returned 7 – 14 February 2017: Judging Process 22 February 2017: Presentation Evening. Rotary, Lockhart Progress Association and The Rock Progress Association have each agreed to sponsor a category, with Rotary to sponsor the overall winner. The TEDSC discussed potential sponsorship by Lockhart Shire Council and the committee agreed it would be appropriate if Lockhart Shire Council were to sponsor the Excellence in Small Business Award. The cost (approximately $50) would be covered under the Economic Development Promotion Budget. Recommendation: That Lockhart Shire Council sponsor the Excellence in Small Business Award at the inaugural Lockhart Shire Business Excellence Awards.

3. Destination Riverina Murray

Following changes by Destination NSW to Regional Tourist Offices, the TEDO has attended a number of meetings regarding the proposed changes and has received an update on proposed roles and timings for the new Riverina Murray Destination Network. The meetings have shown a strong case for the existing Riverina Regional Tourism member councils to continue to work together to ensure the continuing increase of visitors to the Riverina. The TEDSC are in support of this continued collaboration and the TEDO will compile a report for Council. Recommendation: That the information be noted.

4. Donation of Shearing Shed for Lockhart Museum Project On Saturday, 29 October approximately 20 people from across Lockhart Shire took part in a community working bee to take down an old shearing shed at Sandigo which was donated to Lockhart/Lockhart Historical Society by John Williams. The shed was donated with an aim that parts of the 100 year old shed will be used to add history and character to a potential new town project, further enhancing tourism in Lockhart and ensuring long term sustainable tourism. The theme of the potential project ties in with Greens Gunyah Museum and the Doris Golder Wool Art Gallery and the TEDO is compiling a report for Council. The shearing shed collection is being stored at the back in one of the old Billabong Motors sheds.

Lockhart Shire Council Ordinary Meeting – 21 November 2016

The day kicked off at 8am and it was incredible to see the enthusiastic teamwork and friendly camaraderie in action. By 10am everyone was looking forward to a very welcome morning tea provided by Carolyn and Rosemary Dowdle, while Rotary members cooked up a storm on their BBQ at lunch time. Colin Wiese observed the presence of all senior Council staff at the working bee, in addition to two councillors and people from across the Shire and beyond, was to be congratulated, as was the team effort. It was a long, dusty day but everyone got stuck in and achieved so much! What shone through on the day was the absolute community heart and spirit shown by everyone. It was a momentous day, not only preserving history but also potential the first step in creating a new history for Lockhart in the future. Emails of thanks have been sent to all those who assisted on the day, and a letter of thanks is to be sent to John Williams for his kind donation. Recommendation: That a letter of thanks be sent to John Williams for his donation.

5. Current TEDO projects

Spirit of the Land Festival Very successful Festival, particularly given road closures at Narrandera. Saturday was a great day. Shop front businesses reported good weekend. Visitor numbers are being calculated.

Drovers Way Touring Route Relevant councils to meet mid-November to further progress. Collingullie have confirmed interest as starting point travelling through Lockhart, Urana, Jerilderie, Conargo and Deniliquin.

Lockhart Shire Tourism Logo TEDO to meet with local artist Raeleen Pfeiffer to discuss

graphic design of logo after SOL Town Visitor Information Boards Working on town and shire maps for information sign at The

Rock. On completion of The Rock frame, TEDO will work with Lockhart Rotary to produce frame.

Billboard DA being lodged. Shop the Spirit and Win 8 week local shopping campaign in Lockhart town centre

running until Friday, 9 December. Great response to date. Australia BIG List The TEDO is working on recognition of the large Emu and

Kangaroo Sculptures, which stand approximately 8m tall, on the Australia BIG list.

The Rock Shop Local Promotion The TEDO is working on a draft postcard to promote businesses in The Rock and will liaise with The Rock Progress Association regarding the product

The Rock Heritage Trail Final proof to be sent to printers. The Rock Museum Waiting to hear back regarding grant for sound system which

will tell the story of The Rock. The Rock Progress The Progress Association are looking for funding for the

Faerie Tree project. Working on a B&S Ball for 2017. The Rock Hill Works by NPWS are ongoing. Interpretative signage is at

design stage. Lockhart Museum Continuing to work on collections, have keys to Billabong

Motors and will start moving machinery in New Year. Wall of Fame TEDO still looking for potential grant funding.

The next TEDSC meeting will be held at The Rock Bowling Club on Tuesday, 7 February 2017 at 6.30pm.

Recommendation: That the report be received and the recommendations contained therein be adopted.

Delegates’ Reports DELEGATES REPORT FOR RWCC NOVEMBER 2016 1. Cr Greg Verdon elected unopposed as Chairman for 16/17. 2. Cr Paul Funnell elected unopposed as Deputy Chair. 3. Operational Plan Performance Targets presented. Progress severely hampered by wet

weather. 4. Annual Report of Audit & Risk Committee received and noted. 5. Quarterly budget review completed. 6. Water Treatment Plant progress continues to be delayed by high-river. 7. A number of Policy reviews were completed and adopted. 8. Council resolved to undertake 1000m of main replacement in The Rock this financial year and

also investigate the site location for the proposed new reservoir. 9. Council agreed to proceed with purchase of land for new low level reservoir in Wagga. Also

agreed to purchase new backhoe and upgrade a/c at RWCC Administration Building. 10. Council accepted tender for construction of reservoir pad and access road at Dunn’s Rd for

280/16 GM Standing Orders

Council adopt the following Standing Orders for Council Meetings for the next 12 months: a) Appointment of Ordinary Meetings

THAT subject to the right of Council to vary by resolution in pressing or necessitous circumstances Ordinary meetings of the Council shall be held monthly at the Council Chambers, Green Street, Lockhart on the third Monday of each calendar month, except for January and February. For those months, a meeting will not be held in January, and in February will be on the first Monday. The commencement time of meetings to be 5.00pm.

b) Notice of Meetings THAT notice of each meeting of Council or of a Council Committee shall be delivered or posted to each councillor so as to reach that councillor not less than three (3) days before such meetings provided however, that notices of less than three (3) days may be given of an extraordinary meeting and of a Committee meeting called in an emergency and furthermore a notice of any meeting shall specify the time and place at which the date on which the meeting is to be held and the business proposed to be transacted at the meeting.

c) Notices of Motion THAT notices of motion intended for consideration at any meeting shall be delivered to or posted to the General Manager so as to reach that officer not less than seven (7) days before such meeting.

d) Order of Business THAT subject to the proviso the order of business so fixed can be altered if a motion to that effect, which can be moved without notice, is carried, the general order of business at a meeting of the Council shall be:

276/16 DEES Mayoral Minute – Request for Additional Culverts A letter to be sent to John Holland Rail requesting installation of additional culverts on The Rock Boree Creek rail line over Brookong Creek in Lockhart to assist with flood mitigation in the town.

DW Cr Verdon – Solar Power Concerned about high cost of electricity at public recreation grounds and pools within Shire and enquired if Council has considered solar power, especially for The Rock Recreation Ground?

DW has spent considerable time/gone to seminars investigating this issue and will be putting a report to Council shortly. Executive Summary Council has obtained several sheds from recently demolished properties under the Voluntary Purchase (VP) Scheme. Report Council has obtained several sheds from recently demolished properties under the Voluntary Purchase (VP) Scheme. Most the sheds were of near new construction and as such Council has taken ownership of them when demolition works were undertaken for later reuse. Two of Council s355 Committees have expressed interest in using the sheds as part of local recreational ground facilities. In addition, Council’s Parks and Garden shed at Lockhart Depot is in poor condition and is not up to modern day standards for its purpose. It is proposed to allocate the sheds as follows: (i) First property at The Rock – stables, small shed and carport – The Rock Rec Ground for use of

the Pony Club (ii) First property at Lockhart – small shed – Lockhart Rec Ground for use as storage at new netball

courts (iii) Second property at Lockhart – large shed – Lockhart Depot for use by Parks and Garden staff. Integrated Planning and Reporting Reference A1 - Build capacity, capability and partnerships to encourage sustainable community groups and clubs. Executive Summary Australia Day celebrations outline and nomination arrangements. Report Australia Day 2017 will be celebrated on Thursday, 26 January 2017. The Yerong Creek Hall Committee has nominated to host the event, which will be held at the Yerong Creek Hall/Recreation Ground. Nominations for citizenship awards are currently open and close on Friday, 2 December 2016. An Awards Committee needs to be determined and for it to meet to make recommendations to Council’s December Meeting on award recipients. This will follow ranking sheets being forwarded to Councillors after closure of nominations on 2 December 2016. Last year the Committee was Cr Yates, Cr Driscoll, Cr Day and Cr Morgan. STRATEGIC DIRECTION B: A Dynamic and Prosperous Economy 3. ECONOMIC DEVELOPMENT STRATEGY (GM/E05-020)

Executive Summary Report of economic development strategy workshop and next steps. Report A further economic development strategy (EDS) workshop was held on 7 November 2016 facilitated by the Crowe Horwath team. Attendees included some members of our Tourism and Economic Development Committee and Luke Foley from John Mooney Real Estate, as well as most Councillors. The scope for this workshop was widened to include 5 hubs to which participants added new ideas to already identified actions in small group sessions, ending with the highest priorities being identified and separated into short, medium and longer term goals. This workshop was very successful, and I believe we now have the ability to further prioritise the actions we wish to resource and take forward. The 5 Hubs which the participants centred around were: • Lockhart Industrial Park • Lockhart CBD area • The Rock CBD area • The Rock Industrial Land • General Activities. The highest priority outcomes of the meeting are presented below in table form for your perusal.

Executive Summary Establishment of the Australian Kelpie Hall of Fame in Lockhart Report The Kelpie is an icon of Australia, and the establishment of an Australian Kelpie Hall of Fame in Lockhart would be a major attraction, providing long term sustainable tourism in the town, fortifying Lockhart as a tourist destination, and neatly tying into the existing wool theme of Greens Gunyah Museum and the Doris Golder Wool Art. Tourism plays a significant role in Lockhart Shire’s economy, and the project would certainly capture a larger portion of the one million visitors that travel to and through the Riverina each year. Through strategic marketing, there is potential for the Australian Kelpie Hall of Fame to develop into one of the “must do” experiences in rural Australia.

It was once said “Australia rode on the sheep’s back” – referring to the dependency of the Australian economy on the wool industry. Without the Australian Kelpie however, the Australia wool industry may not have been quite so prosperous. The Kelpie came into being during the years of the great pastoral stations, when sheep dogs imported from Europe and the UK proved too heavily coated to cope with the severe Australian climate. Early landholders produced a new breed of dog - hardy and strong, with weather-resistant coats, intelligent enough to work unsupervised and tough enough to work sheep under the harsh conditions on vast outback properties. Stations owners recognised the importance of this new breed, and the Kelpie became the backbone of the Australian wool industry. While today Kelpies can be found throughout the world, they remain the devoted companion of the Australian “man on the land”. The Kelpie is very significant to Lockhart Shire. Not only was the breed important to the success of large stations like Brookong, Grubben, Urangeline and Mittagong, the working breed name actually originated from ‘Kings Kelpie’, owned by John King of Hanging Rock Station (now The Rock). John King’s son, Charles Beechworth King, went on to partner in the very successful King & McLeod Kelpie Stud at Condobolin in the early 1900s. In nearby Narrandera, the McMasters of Wyreema Kelpie Stud are recognised as the world’s longest established Kelpie breeders, while Mike Donelan, who wrote ‘The Australian Kelpie’, ran the well-known Bullenbong Kelpie Stud at The Rock for many years. There are also a number of well-regarded Kelpie events in the surrounding areas, with Jerilderie hosting the annual Working Dog Auction and Henty Field Days hosting the Murray Valley Dog Yarding Championships each year. Whilst Ardlethan, situated to the north of Lockhart is regarded as the ‘Home of the Kelpie’ and Casterton, situated in south west Victoria, is regarded as the ‘Birthplace of the Kelpie’, there is nowhere in the world that recognises the contribution of the Australian Kelpie in the form of an Australian Kelpie Hall of Fame. Rationale Lockhart & District Historical Society were recently assisted by Council in purchasing Billabong Motors to enlarge the museum precinct. As part of the process, Council purchased a number of blocks on the site for strategic use by Council in the future. These blocks included a large grassed area behind existing buildings and adjacent to the Caravan Park; a vacant block next to Greens Gunyah Hotel which could be used to provide access to the Caravan Park; and an old tin shed adjacent to the Billabong Motors building, which was originally built as the town stables and blacksmiths shop. Following the purchase of the blocks by Council, the interior of the historic shed was investigated to ascertain existing condition and possibilities for use. The spaces in the shed are a mix of corrugated iron and timber with high ceilings and an authentic rural feel. The shed appears in reasonably good condition, with the building’s historic interior retaining much of its character. Consultation with the Museum Advisor regarding possible use of the shed area concluded that subject to funding opportunities for fitout, the old stables and blacksmiths shop was well suited to display and commemorate the Australian Kelpie Hall of Fame in a number of informative and engaging ways, whilst suitably providing an authentic visitor experience.

By creating an interactive display of images and stories collected from all over Australia, developing 3D drone and GoPro footage and compiling historical stories including how the breed began, linking in Ardlethan and Castleton, how the Kelpie got its name, early breed champions, the breed standard and important studs of the past one hundred years, it is possible to create a very engaging and informative exhibition space. Recently members of the community took part in a working bee to preserve aspects of an old shearing 1920s shed from a local farmer. Corrugated iron, flattened out 44 gallon drums, pine posts aged with lanolin, catching pens, wool bins, shearing spindles, a wool press and the original table were all preserved by the community group for future use. These historic items would make a perfect backdrop to the Australian Kelpie Hall of Fame. The location of the Australian Kelpie Hall of Fame close to Green Street and the Caravan Park would be very beneficial to tourism, and Greens Gunyah Museum comfortably provides support functions such as restrooms and information desk. It would be quite straightforward to incorporate entry to the Australian Kelpie Hall of Fame through the existing Museum complex, which is now opening 7 days per week, although staffing may need to be considered should visitor numbers, which currently are approximately 3000 people per year, start to show a marked increase. Although this would be a long term project that requires further investigation, the establishment of the Australian Kelpie Hall of Fame in Lockhart would be a tremendous asset for the future growth of the town, would add to our growing list of cultural assets and attractions, and also be a leading tourism attraction after being set up. 5. RIVERINA REGIONAL TOURISM (GM/T25-010)

Executive Summary Future operations of Riverina Regional Tourism. Report Riverina Regional Tourism (RRT) is the peak Regional Tourism Organisation in the Riverina. Consisting of 12 member councils, the role of RRT in raising the profile of the Riverina and attracting visitor numbers is significant. In the 2015-2016 financial year alone, tourism contributed an incredible $331 million dollars in to the Riverina economy, with an impressive 20% increase in visitor numbers to our region. Despite this success, Destination NSW recently undertook a review of regional tourism in NSW, resulting in the announcement of 6 new State funded Destination Networks across NSW, changing the structure of regional tourism organisations (RTO) in NSW. Under the new structure, the Riverina region will become part of the larger Riverina Murray Destination Network. This obviously raises questions about the future of RRT, and also on Lockhart Shire maintaining its success in regional tourism. RRT has invested approximately $1.1 million between 2014-2016 to raise the profile of the Riverina with very positive results, and want to determine that all tourism stakeholders in the Riverina, including Councils and operators, continue to have a voice under the new Destination Network structure. RRT organised a meeting of RRT’s member Councils on 10th October 2016 to discuss the new Destination Networks, and to consider various options and obtain member council feedback. The result of this meeting was widespread support from member councils for the continuance of RRT as a Local Tourism Organisation, recognising its vital role in the continued growth in tourism, and to ensure local Councils have a voice under the new Destination Network structure. RRT are now seeking official confirmation from each Council requesting support of: a) RRT’s continued operations from 10 February – 30 June 2017 using existing reserve funds b) RRT’s continued operations from 01 July 2017 – 30 June 2018, with a mid-year review. In FY2016-17, Lockhart Shire Council contributed a total membership fee of $4,850 (plus GST) including a $1500 contribution to the Taste Riverina Destination Awareness project. The reviewed fees for Lockhart Shire Council in FY2017/18 will be $4,600 (plus GST) including a compulsory contribution towards the coordination and promotion of Taste Riverina, an important festival which includes regional flagship events such as the Spirit of the Land Festival. It was noted that quarantined funding will no longer be available to RRT, however ongoing contestable funding will be available providing matched funding can be obtained. Executive Summary Monthly report on Noxious Weeds. Report The majority of inspections were carried out on residential properties. These inspections were completed to assess whether control measures were applied and their effectiveness. The weeds most commonly found were Bridal Creeper (Asparagus asparagoides), Horehound (Marrumbium vulgare), and Privet (Ligustrum sp.). Other weeds found in lower frequency were Prickly Pear (Opuntia sp.), Lippia (Phyla canescens), and Sweet Briar (Rosa rubiginosa).

The majority of these properties have absentee land owners whom completed control measures between earlier inspections but have not applied any follow up control measures. Spray Program Priority for spraying has been given to the control of vegetation on the roadside shoulders within the Shire, in preparation for summer. Spot spraying has been applied to control Coolatai grass (Hyparrhenia hirta), Horehound (Marrumbium vulgare), Bridal Creeper (Asparagus asparagoides), Privet (Ligustrum sp.), Wild Radish (Raphanus raphanistrum), and St John’s Wort (Hypericum perforatum). Biological Control of Weeds On 18 October Council’s Environmental Officer attended the biological control of weeds training provided by Tocal College. The training was delivered by Paul Sullivan, who is an expert in the field, spending his entire career working with biological control and having decades of experience. The training involved the development of skills in: assessing the suitability of biological control for a particular weed infestation; selecting a suitable site to establish a breeding nursery; sourcing and acquiring a desired bioagent; transporting and storing biological cultures; maintaining and monitoring the biological control site; bioagent harvesting and release; and evaluating the effectiveness and spread of the bioagent. Mr Sullivan emphasised the extensive research that is applied to finding suitable bioagents and the stringent testing process that is required before any bioagent is considered for release into the Australian environment. The Atlas of Living Australia has provided a website for those seeking further information, as well as the location of nursery sites and release sites, and in doing so, established an avenue for the further development of biological control between individuals, weed officers, councils and other government agencies. Over the next few months Council’s Environmental Officer will endeavour to collect appropriate information suitable for Council’s website.

Weeds Action Program (WAP) Funding On 6 October 2016, Minister for Primary Industries, Niall Blair, announced nearly $10 million to help manage the worst of the State’s weeds, as part of the NSW Government’s Weeds Action Program. Of this amount, $717,978 was committed to the Riverina, with $47,450.10 granted to Lockhart Shire Council for the 2016-17 weed control program. While any funding is of great benefit, the $47,000 is $6,000 below the requested amount, based on a dollar for dollar commitment from Lockhart Shire Council over the 5-year life of the WAP. Funding granted through the WAP, including Council’s commitment, is accounted for through ISP Key Objectives and targets, which are in turn reported back to Department of Primary Industries. Council’s Noxious Weeds/Environmental Officer has noted a significant increase in pressure from DPI to capture data for reporting, including mapping of weeds and infestations, new incursions and high risk pathways, to be more accountable with spending of state funding. Integrated Planning and Reporting Reference C1.4 – Decreased occurrence, spread and impact of weeds and pests throughout the Shire. STRATEGIC DIRECTION D: Infrastructure for the Long Term Needs of the Community 7. MAJOR PROJECTS UPDATE (DEES/T10-005)

Executive Summary Update on Council’s current major projects. Report Council is currently undertaking a number of major projects and the status of each of those are as follows: a) Swimming Pools Upgrade: Staff are continuing to work on detailed design/scoping of the

project. Meetings have been held with each town Pool Steering Committee. Staff have met with Greater Hume Shire Council as they are slightly advanced on their upgrade projects and are providing design and costing information. Council was advised recently that it was unsuccessful with grant application under the National Stronger Regional Fund for each pool, creating $1M shortfall in funding model. Funding to be determined once a more robust costing is established following detailed design works. It is expected an updated report will be provide to February 2017 council meeting.

b) The Rock Sewer Extension: Staff have called for quotations for survey and design works which

will close 28 November 2016.

c) The Rock STP Tertiary Ponds Upgrade: Staff have been in discussions with NSW Water regarding a Section 60 approval for the works. Geotechnical testing has been undertaken and final design and detail works are being completed. Subject to being granted a Section 60 approval works are scheduled for early in the New Year.

d) Demolition of Voluntary Purchase Properties: The demolition of first round of homes in Lockhart

and The Rock have been completed. Second round of homes have yet to be purchased by Council. These properties will be required to be demolished by end of April 2017.

e) Flood Mitigation Construction: Council has submitted grant applications for Stage 4 construction

of flood mitigation structures in both Lockhart and The Rock for 2016/17 & 2017/18 years. Council has been successful with application for Lockhart, with The Rock placed on a reserve list pending availability of funding. It is expected the staff will call for tenders for the construction works shortly.

f) Toilet/Shower Upgrade at The Rock Rec Ground: Investigations of options are currently being

undertaken. Plan is to have works completed before next football-netball season. Integrated Planning and Reporting Reference D – Infrastructure for the long-term needs of the community. Executive Summary Monthly report on parks and gardens. Report Walter Day Park Landscaping around the new toilet block is in the planning stages; including a permanent home for ‘Going to the Dance’ and an extension of the rose garden. New footpaths and a drinking fountain have been installed. Sculpture Trail This year’s Spirit of the Land National Farm Art winner, Freedom Run by Andrew Whitehead will be placed on display at the front of the Lockhart Caravan Park. Colin Wiese sculpture ‘Peace’ will be added to the Curly Heckendorf garden at Hodgson Park. Street Cleaning The pavers in Green St were pressure washed before the Spirit of the Land Festival in Lockhart. The pavers came up quite well; now that Parks and Urban maintenance have their new pressure washer regular cleaning of the pavers in the CBD of both Lockhart and The Rock will be scheduled to keep them at their best. Pools Park and Gardens crews have been busy over the last few weeks preparing the pools for opening on 7 November. Council staff cleaned both pools, conducted regular vacuuming and water testing and attended to the amenities buildings, gardens and lawns before the facilities were handed over to the contractors, Sophie Driscoll and Tammy Lenon. Council staff will continue to assist the contractors where necessary. Parks and Gardens Routine garden maintenance is being conducted including regular weeding, spraying, pruning, mulching and redefining garden edges. Irrigation systems are being checked, maintained and set to spring watering schedules. Mowing and Slashing The spring slashing schedule has commenced with priority given to high profile areas in Lockhart and Pleasant Hills in the lead up to the Spirit of the Land Festival and Pleasant Hills Public School 125th Anniversary. The recent warm weather has helped dry out many of the areas that were previously inaccessible due to the constant heavy rainfall over winter and early spring. Due to the previous inaccessibility these areas are very long and thick and slashing is taking longer than it normally would. Most of these areas, especially highly visual areas like town entrances will require follow up mowing due to clumping and shaggy results caused by the length of the grass. Slashing is being prioritised as well as possible. Some overtime has been required to get on top of the situation; most areas have now been attended to and should be back to their usual standard before Christmas. Mowing and edging schedules for irrigated areas has been increased to fortnightly as growth rates increase. The Rock and Lockhart recreation grounds have required weekly mowing to keep them free from windrows for the cricket season and a recent Athletic Carnival. Trees A stump grinder has been organized to deal with a number of stumps throughout the shire.

Weed Control Regular weed control is being conducted on Council property including hand spraying and weeding of gardens but growth has been vigorous. Hand weeding has been necessary in many areas before the local events. Khaki and Cathead are coming into season, known problem areas will be monitored throughout the warmer months. General maintenance Regular duties include inspections of parks and public facilities to remove litter, clean BBQ’s, check for damage or vandalism, clear footpaths and empty public and roadside bins. Most areas undergo inspections twice per week, including Galore Hill, where crews also clean and check the toilet facilities. Contract cleaners attend to the public toilet facilities in Lockhart, The Rock and Yerong Creek. Playgrounds in the shire are being inspected regularly as per Australian Standards, with any maintenance being noted and completed as necessary. (a) Works Report: Construction projects have now commenced with first construction projects being MR370 Rehabilitation north of Wattles Lane & Reid Street Widening, MR543 Heavy Patching and The Rock Mangoplah Road widening and Grubben Road Upgrade. These projects will be followed then by Western Road widening, Osborne Yerong Creek Road widening and Urana Lockhart Road Causeways Upgrade. At present all three grader crews are undertaking repairs to roads where damaged by flood waters and maintenance grading in accordance with program where possible, however crews will move onto construction projects mid November 2016. There is some significant damage to some of Council’s sealed and unsealed road network from the inclement weather which will be scheduled for repairs when conditions are more suited and contractor is available. Council staff have been undertaking some repairs as resourcing permits. Unfortunately, due to wet winter delaying the construction projects and additional road repairs required, Council staff will be working through the harvest period in several places at once. This may result in small delays, Council will however try to minimise any disruptions. Updated 12-month programme will be presented at the meeting.

Concrete crew is now undertaking construction of drainage structures for the year being new works or maintenance of old pipe crossings. Only major PAMPS project this year is the sealing/completion of path from The Rock to The Rock Hill Nature Reserve.

(b) Flood Mitigation: Council has submitted grant applications for Stage 4 construction of flood mitigation structures in both Lockhart and The Rock for 2016/17 & 2017/18 years. Council has been successful with application for Lockhart, with The Rock placed on a reserve list pending availability of funding. Voluntary Purchase of flood affected properties is continuing in both Lockhart and The Rock. First properties have been demolished and second round of property purchases currently being negotiated.

(c) Road Safety Officer: First steering committee meeting with Council’s new Road Safety Officer is

scheduled for 15 November 2016.

(d) Traffic Committee: The traffic committee is currently reviewing installation of Give Way at intersection of Day and Davison Streets, The Rock.

11. DEVELOPMENT APPLICATION 45/16 – LOCKHART AGRICULTURAL, PASTORAL AND SHOW SOCIETY (MES/P25-010) Executive Summary Lockhart Agricultural, Pastoral & Show Society have lodged a development application with Council to demolish the existing poultry pavilion, and replace it with a new steel shed. The site is heritage listed in accordance with the Lockhart Local Environmental Plan 2012. Report As previously reported in the September 2016 meeting, an application has been lodged with Council to demolish the existing poultry pavilion in Lockhart, and replace it with a new steel framed, colorbond pavilion. The Lockhart Showground, located off Treasure Street at Lot 122 DP756429, is a Council-managed parcel of crown land, and is heritage listed in accordance with the Lockhart LEP. As such, any works undertaken on the site are subject to a heritage assessment. Advice provided by Council’s heritage advisor recognises the historical significance and aesthetics of the existing galvanised iron shed, which was built many decades ago from local labour and materials. It consists of pine posts and rails, a high pitched roof, with an awning added at a later date. Aside from the unoriginal awning, the shed itself is still in good condition. Unfortunately, however, it does not meet the needs of the Committee, who plan to increase exhibition space for showing and sales of poultry at the site. Grant funding has recently been approved by NSW Department of Primary Industries – Crown Lands to rebuild a new pavilion, and the committee are keen to have it built in place of the existing building. The application for demolition/construction has been assessed with respect to section 79C of the Environmental Planning and Assessment Act 1979, which requires consideration to be given to the social, environmental and economic impacts of a proposed development. The pavilion represents one of the few standing buildings in the area, with connections to local labour, materials and building practices, which is publicly available for viewing. Other similar buildings on the site have been replaced with new colorbond versions over the years, and the historical significance of the site is slowing being diminished. On this premise, and to help sustain the appeal of Lockhart as a ‘historical verandah town’, the heritage advice provided for the project is very relevant, and there remains considerable public interest to maintain the site as a heritage listed site. Following Council’s resolution to meet with stakeholders and agree on a way forward, it was of general consensus between the applicant and the Lockhart showground Management Committee that the preferred outcome remain as follows: - That the existing pavilion be demolished, and replaced with a new shed (plans attached),

painted externally in a similar fashion to the adjoining pavilion and secretary’s office. The assessing officer of the development application considers the historical nature of the shed and surrounds to be significant, and would like to see the existing shed retained, despite the preference of the applicant. Council’s considerations is therefore sought to determine the most desirable outcome for the project. Executive Summary Summary of customer requests received by Council. Report Council receives customer requests for numerous reasons such as road repairs, stormwater issues, trees, noisy dogs, new garbage bins and burials. Council has a system to collect and monitor where any request may be up to at any time, assess for trends, as well as look at response times. Customer requests are monitored weekly with most requests dealt with in a timely manner. Request numbers for the quarter are tracking up due to wet a September/October. The Council achieved a surplus in net operating result from continuing operations (including capital contributions) of $3,251k (2015: $1,330k) for the year ended 30 June 2016. The net operating surplus for the year before grants and contributions provided for capital purposes is $3,251k (2015: $1,204k). The size of Council’s operations has remained relatively consistent over the past three years with increases in rates and annual charges being attributable to the annual permissible increase (2.4% in 2015/2016) for rates and annual charges increase being a combination of CPI and operating costs. User fees and charges have decreased from prior year, with less Private Works being completed in 2016. Operating grants and contributions have increased due to an additional $1,300k of Roads to Recovery funding and new Fixing Country Roads funding of $666k. No capital grants were received in the 2016 financial year. Employee costs have increased due to the wage increase in line with the Local Government Award, plus additional resources required for the roads to recovery funded projects. Depreciation has been a focus area for the Council over the last two years, following the review of useful lives and move to BizeAsset for its road infrastructure asset management and valuation management. This has resulted in a slight increase in depreciation in 2016, which from 2015 we would observe is better aligned with industry averages. A detailed analysis of Council’s Financial Statements can be found in the Audited Financial Statements, pages 78-89. A representative of Crowe Horwath Auswild will attend Council’s November meeting to elaborate on their report and to respond to any questions.

Executive Summary A further resolution required for Special Rate Variation Report At its July 2016 Meeting, Council resolved its intent to apply for a special rate variation (SRV) to raise money to pay for community infrastructure and to increase its own source revenue in line with the action plan submitted by Council to IPART last year which resulted in Council being declared Fit For the Future and ultimately allowed to remain independent as a stand- alone rural based Council. The Improvement Action Plan now needs to proceed in order to satisfy the State Government that our Council is doing its part to stay Fit For the Future well into the future. Implementation of the SRV was a key component of the Improvement Action Plan.

Apart from the enormous amount of detail required to accompany the SRV application, its most important aspect is community engagement and awareness. Specifically, IPART will consider whether: • The application demonstrates that the community is aware of the need for, and extent of, the

rate rise • The application has demonstrated an appropriate variety of engagement methods to ensure

community awareness and input into the SRV process.

As you are aware, Council went out to the public with the FFF program and gained 80% support for the 4.6% SRV. IPART’s current expectation was that more recent data was necessary to ensure the community was still on side with the proposal. To that end, a further series of 5 community engagement sessions have been held across the shire which were completed on Thursday 27 October 2016. The resultant outcome was 72% of participants supportive of the SRV, a comprehensive majority, even though after extensive advertising, a poor turnout resulted. To my mind, this means the rest of the population are either supportive or neutral about the proposal, because in all probability if they were against it, they would have been out in force to be heard. This means those against the proposal are only the few who made up the 28% at the community meetings. Council now needs to formalise its intent to apply for the SRV by resolving to clearly state its details and the purposes to which the income derived will be put. The resolution needs to state an SRV of 4.6% per annum inclusive of rate pegging cumulative for 10 years for the purpose of increasing Council’s own source revenue and to be applied to the provision of community infrastructure including flood mitigation works, road restoration and swimming pool refurbishment. 17. COMMUNITY STRATEGIC PLAN REVIEW (GM/I13-010)

Executive Summary Next steps for Community Strategic Plan (CSP) review Report Prior to the meeting today, a workshop for the review of the CSP took place. It is anticipated that any changes arising from community feedback will have received consensus at the workshop and that the reviewed document and associated Integrated Planning and Assessment (IPR) documents will be ready to be placed on public exhibition for further public feedback prior to adoption by Council at its February Council Meeting. It is critical for our Special Rate Variation (SRV) application that the IPR documentation be adopted at the February Meeting, as we need to demonstrate that the reasons for applying for the SRV have been set out in the IPR program, especially the Delivery Program, that appropriate community consultation has taken place and community support received. If this information is not present, it is extremely unlikely that our SRV application will succeed. 329/16 RESOLVED on the motion of Crs Verdon and Douglas that Council close the meeting to the public as per section 10(A)(2)(a) of the Local Government Act 1993.

The meeting moved into Closed Session at 8.41pm.

331/16 RESOLVED on the motion of Crs Douglas and Walker that Council move into Open Council. The meeting moved into Open Session at 8.47pm.

330/16 RESOLVED on the motion of Crs Verdon and Marston that Council: a) Award the tender for the emergency road repairs for 2016/17 to Stabilco Pty Ltd for

$680,363.20 (including GST), with funding from Council Reserves, and b) Authorise the General Manager and Director of Engineering & Environmental Services to

execute Contract and Purchase Order for the Works. The meeting concluded at 8.48pm. Confirmed Chairman of the Ordinary Meeting of Lockhart Shire Council held Monday, 21 November 2016 at which meeting the signature was subscribed hereto.
