WorldHealthOrganisation’sInternationalAgencyforResearchonCancer(IARC)hasdeclaredglyphosateasa2Acarcinogen(probablycarcinogenicinhumans)On20/03/2015IARCreacheditsdecisionbasedontheviewof17expertsfrom11countries,whometinLyon,France,toassessthecarcinogenicityof5organophosphatepesticides:tetrachlorvinphos,parathion,malathion,diazinon,andglyphosate.1However,theIARCMonographVolume11220/03/20152hasnolegalpowertobanglyphosate.“TheMonographsProgrammeprovidesscientificevaluationsbasedonacomprehensivereviewofthescientificliterature,butitremainstheresponsibilityofindividualgovernmentsandotherinternationalorganizationstorecommendregulations,legislation,orpublichealthintervention.”TheGermanRapporteurMemberState(BfR)recommendedre-approvalofglyphosatetotheEuropeanFoodSafetyAuthority(EFSA)ProfessorDrDrAndreasHenselPresidentoftheFederalInstituteofRiskAssessment(BfR)ataPressreleaseinMarch2014saidonbehalfofBfR:“Thesenewstudiesdonotsuggestthatglyphosatehascarcinogenicorembryo-damagingpropertiesorthatitistoxictoreproductionintestanimals.Thedatadonotwarrantanysignificantchangesinthelimitvaluesoftheactiveingredient...Worldwide,glyphosateisoneofthemostcommonactiveingredientsinpesticidesusedtopreventunwantedplantgrowthinplantcultivationortoacceleratetheripeningprocessofcrops(desiccation).Glyphosateinhibitsanenzyme(5-enolpyruvylshikimate-3-phosphatesynthase)whichisessentialforthebiosynthesisofcertainaminoacids.Thisenzymeisnotfoundinanimalsandhumans.“3ThisfinalstatementbytheGermanBfRiswrong:glyphosatepoisonshumansinthesamewayasitpoisonsplants.Humansandanimalshaveexactlythesamepathwayasinplants;mammalscanonlyabsorbnutrientsviathebacteriaintheirgut;thegutmicrobiome.Thegutmicrobiomeisthecollectivegenomeoforganismsinhabitingourbody.4Pesticidescientistsandplantscientistshavebasedtheirassessmentofherbicidesoncompleteignoranceofhumanphysiology.BfRallowedtheGlyphosateTaskForce(GTF)toexcludemanyreportsthatshowedthatglyphosatebioaccumulatesandcausesbirthdefectsandcancersEventheonesthatwereallowed,BfRmanagedtodismissthembysayingthattheydidn’tmeettheKlimischcriteria:thesecriteriaweredevisedin1997byKlimisch,aBASFscientist,andwasamethodofassessingthereliabilityoftoxicologicalstudiesforregulatorypurposes.BythismethodBfReliminatedtheworkthatMonsantofearedthemost(apartfromtheratfeedingstudiesofSéraliniandhiscolleaguesthatwerereportedbyindustrytobefraudulent5)byProfAndrèsCarrascoandhisteaminBuenos

Airesthatshowedthatglyphosatecausedmalformationsinamphibianandchickenembryos,confirmingtheeffectsonhumansintheCrop-sprayedtownsofArgentina.6HowBfRmanagedtodismissthisstudyandthosereportingreproductivetoxicityIntheRenewalAssessmentReport(RAR)forglyphosateatotalof18peer-reviewedpublicationsshowingreproductivetoxicitywereranked3–notreliable.TheRARcommentedonthestudybyPaganellietal.(i.e.theCarrascostudyfromArgentina).‘Thestudyreportedendocrinedisruptionbutwasdeemed“notreliable”.TheRARcommented:“Non-Guidelinestudythatisnotsufficientlydescribedforassessment-Inadequatepositiveandnegativecontrolexperiments.Irrelevantroutesofexposureandinappropriatelyhighdoses.Testsystemnotadequateforhumanriskassessment”.[Volume3AnnexB.6.1,p669]Furthermore,“multiplehighqualitytoxicitystudiesandexpertreviewpanelsconsistentlyagreeglyphosateisnotateratogenorreproductivetoxicant.Theauthor’sjustificationforthisresearchisflawed,providingnovalidbasis,otherthananopinion,ofanincreaseintherateofbirthdefectsinArgentina.Directinjectionoffrogembryosandthroughchickeggshellsdonotreflectrealworldexposurescenariostoeitherenvironmentalspeciesorhumans.”7InfacttherewereseveralpapersontheincreaseintherateofbirthdefectsinSouthAmericawhereGMRoundupReadycropsaregrown;buttheGTFhadexcludedallofthem.TheyalsoexcludedthelaboratorystudybyThongprakaisang,S.,etal.(2013).Glyphosateinduceshumanbreastcancercellsgrowthviaestrogenreceptors.FoodChemToxicol59:129-136.8Thestudyfoundthatbreastcancercellproliferationisacceleratedbyglyphosateinextremelylowconcentrations.“Thepresentstudyusedpureglyphosatesubstanceatlogintervalsfrom10-12to10-6M.Theseconcentrationsareinacrucialrangewhichcorrelatedtothepotentialbiologicallevelsatpartpertrillion(ppt)topartperbillion(ppb)whichhavebeenreportedinepidemiologicalstudies.”ThesewereorderofconcentrationsthatwerefoundinAugust2013and2014intapwaterandriverwaterinSwansea.RounduphasdestroyedbiodiversityandhumanhealthinSwanseaMorethan5tonnesofRounduphavebeensprayedin2015-2017oninvasiveweedsinwoodland,andmorerecently,ordinaryweedsonroadsandpavementsintheCityofSwansearegardlessofthefactthatintargeting‘publicparks,gardens,sportsandrecreationgrounds,schoolgroundsandchildren’splaygrounds,andintheclosevicinityofhealthcarefacilitieswhere(accordingtoEUDirectiveAdvice2009seepage27)therisksfromexposuretopesticidesishigh.’Thisiswithoutanymeasurementofglyphosateingroundwater.Inthewholeregionbiodiversityhasgraduallybeendestroyed.Glyphosateisachelatorofminerals,originallypatentedforcleaningboilers9Itchelates(captures)andwashesoutthefollowingminerals:boron,calcium,cobalt,copper,iron,potassium,magnesium,manganese,nickel,molybdenum,zincandsulphate.InadditionitkillsoffbeneficialgutbacteriaandallowstoxicbacteriasuchasClostridiumdifficiletoflourish.10Twokeyproblemscausedbyglyphosateinthedietarenutritionaldeficiencies,especiallymineralsandessentialaminoacids,andsystemictoxicity.

SafeguardinghumanhealthintheAnthropoceneepoch:ReportoftheRockefellerFoundation–LancetCommissiononplanetaryhealth:13nomentionofpesticidesTheRockefeller/LancetCommissiononPlanetaryHealthnevermentionedpesticides.AccordingtotheReport,thekeydriversofecosystemchangeinthelast60yearswere:“Increasesintheamountsofnitrogenandphosphorusenteringtheenvironmentthroughagriculturalfertiliserrun-offandsoilerosion.”ThisiswhatDefrasaidin2011intheSynthesisoftheUKNationalEcosystemAssessment:14“Majorincreasesinfertiliseruse,particularlynitrogenandphosphorus,haveadverselyaffectedaquaticecosystemsthroughrunoff.”Whataboutpesticides?Thescientistswhocontributedtothe56-pageRF/LancetCommissionReportfailedtomentiontheseriousthreatsofexposuretothemostwidespreadchemicalsintheglobalenvironment,glyphosate(anendocrinedisruptor)andthesystemicneonicotinoidinsecticides.Neitherofthemisroutinelymeasuredintheenvironmentbygovernmentsortheirdepartmentsofagriculture.However,thereisplentyofevidencethathumansandtheenvironmentarecompletelysaturatedwithman-madechemicals.

respecttobothexistinginternationallaw,andtoprospectivelawinordertoimproveinternationalhumanrightsandenvironmentallaw.Theadvisoryopinionisstructuredinthreeparts:I.TheintroductorysectiondetailstheconditionswithinwhichtheTribunalwasinitiated.II.ThemiddlesectionexaminesthesixquestionsposedtotheTribunal.Lookingatthebroaderpicture.III.Thefinalsectiontacklesthegrowingasymmetrybetweentherightsconcededtocorporationsandtheconstraintsimposeduponthemtoprotectlocalcommunitiesand/orfuturegenerations,wherevercorporationsoperate.Question6askedtheTribunaliftheactivitiesofMonsantocouldconstituteacrimeofecocide,understoodascausingseriousdamageordestroyingtheenvironment,soastosignificantlyanddurablyaltertheglobalcommonsorecosystemservicesuponwhichcertainhumangroupsrely.Developmentsininternationalenvironmentallawconfirmtheincreasedawarenessofhowenvironmentalharmnegativelyaffectsthefundamentalvaluesofsociety.Preservingdignityforpresentandfuturegenerationsandtheintegrityofecosystemsisanideathathasgainedtractionintheinternationalcommunity.Asevidenceofthesedevelopments,andaccordingtothePolicyPaperonCaseSelectionandPrioritisationfromSeptember2016,theProsecutoroftheInternationalCriminalCourtinTheHaguewantstogiveparticularconsiderationtoRomeStatutecrimesinvolvingtheillegaldispossessionoflandorthedestructionoftheenvironment.However,despitethedevelopmentofmanyinstrumentstoprotecttheenvironment,agapremainsbetweenlegalcommitmentsandtherealityofenvironmentalprotection…thelarge-scaleuseofdangerousagrochemicalsinindustrialagriculture;andtheengineering,production,introductionandreleaseofgeneticallyengineeredcrops.Severecontaminationofplantdiversity,soilsandwaterswouldalsofallwithinthequalificationofecocide.Finally,theintroductionofpersistentorganicpollutantssuchasPCBsintotheenvironmentcausingwidespread,long-lastingandsevereenvironmentalharmandaffectingtherightofthefuturegenerationscouldfallwithinthequalificationofecocideaswell.TheoColborn’scrucialresearchintheearly1990sintoendocrinedisruptingchemicals(EDCs)thatwerechanginghumansandtheenvironmentwasignoredThelateTheoColborn22(1927-1914)wasthefirsttoresearchandwriteaboutEDCs,man-madechemicalsthatbecamewidespreadintheenvironmentafterWWII.Inabookpublishedin1996,OurStolenFuture:HowMan-madeChemicalsareThreateningourFertility,IntelligenceandSurvival,Colborn,DumanoskiandPetersrevealedthefullhorrorofwhatwashappeningtotheworldasaresultofcontaminationwithEDCs.23Therewasemergingscientificresearchabouthowawiderangeofman-madechemicalsdisruptdelicatehormonesystemsinhumans.Thesesystemsplayacriticalroleinprocessesrangingfromhumansexualdevelopmenttobehaviour,intelligence,andthefunctioningoftheimmunesystem.Atthatstage,polychlorinatedbiphenyls(PCBs),pesticidesDDT,chlordane,lindane,aldrin,dieldrin,endrin,toxaphene,heptachlor,dioxin,atrazineanddacthalwereidentifiedasEDCs.Colbornillustratestheproblembyconstructingadiagram(page105)ofthejourneyofaPCBmoleculefromafactoryinAlabamaintoapolarbearintheArctic.Colbornsays:“Theconcentrationofpersistentchemicalscanbemagnifiedmillionsoftimesastheytraveltotheendsoftheearth…Many

GENEVA(7March2017)–TwoUnitedNationsexpertsarecallingforacomprehensivenewglobaltreatytoregulateandphaseouttheuseofdangerouspesticidesinfarming,andmovetowardssustainableagriculturalpractices.Theysay:“excessiveuseofpesticidesareverydangeroustohumanhealth,totheenvironmentanditismisleadingtoclaimtheyarevitaltoensuringfoodsecurity.”Chronicexposuretopesticideshasbeenlinkedtocancer,Alzheimer’sandParkinson’sdiseases,hormonedisruption,developmentaldisordersandsterility.Farmersandagriculturalworkers,communitieslivingnearplantations,indigenouscommunitiesandpregnantwomenandchildrenareparticularlyvulnerabletopesticideexposureandrequirespecialprotections.Theexpertswarnthatcertainpesticidescanpersistintheenvironmentfordecadesandposeathreattotheentireecologicalsystemonwhichfoodproductiondepends.Theexcessiveuseofpesticidescontaminatessoilandwatersources,causinglossofbiodiversity,destroyingthenaturalenemiesofpests,andreducingthenutritionalvalueoffood.Theimpactofsuchoverusealsoimposesstaggeringcostsonnationaleconomiesaroundtheworld.Theexpertssaytheuseofneonicotinoidpesticidesisparticularlyworryingbecausetheyareaccusedofbeingresponsibleforasystematiccollapseinthenumberofbeesaroundtheworld.Forexample,heavyuseoftheseinsecticideshasbeenblamedforthe50percentdeclineover25yearsinhoneybeepopulationsinboththeUnitedStatesandtheUnitedKingdomofGreatBritainandNorthernIreland.Suchacollapse,theysay,threatenstheverybasisofagricultureas71%ofcropspeciesarebee-pollinated.Globalcontaminationofhoneybyneonicotinoidinsecticides3205/10/2017:“Weassessedtheglobalexposureofpollinatorstoneonicotinoidsbyanalyzing198honeysamplesfromacrosstheworld.Wefoundatleastoneoffivetestedcompounds(acetamiprid,clothianidin,imidacloprid,thiacloprid,andthiamethoxam)in75%ofallsamples,45%ofsamplescontainedtwoormoreofthesecompounds,and10%containedfourorfive.Ourresultsconfirmtheexposureofbeestoneonicotinoidsintheirfoodthroughouttheworld.”ContaminationrateswerehighestinNorthAmericawith86%ofsamplescontainingoneormoreneonicotinoid,followedbyAsia(80%)andEurope(79%).ItwaslowestinSouthAmericaat57%.Almosthalfthesamplescontainedacocktailoftheinsecticides.“Thestrikingfindingisthat75%ofoursampleshadmeasurablequantities,”saidProfEdwardMitchellattheUniversityofNeuchâtel.“Thatwassurprisingtous,sinceourcoverageincludedmanyremoteareas,includingoceanicislands.”UKfiguresreleasedinOctober2017revealthatsincetheneonicotinoidshavebeenbannedoil-seedrapeharvestshavebeenthebestin4years33Oilseedrapeyieldsthisyearareattheirhighesteverlevels,onlytwicebeforehastheaverageyieldreached3.9tonnesperhectare–in2011and2015,newfiguresreleasedtodayreveal.Don’tpollutemyfuture!Theimpactoftheenvironmentonchildren’shealthAReportbytheWorldHealthOrganizationpublishedinMarch2017.Thisreportfocusedonarangeofenvironmentalrisks,thecostofapollutedenvironmentaddsuptothedeathsof1.7millionchildreneveryyear.34MonsantoIsn’tFeedingtheWorld—It’sKillingOurChildren35

moreseriousandrapidwaveofpopulationdeclinesandextinctions….Humanitywilleventuallypayaveryhighpriceforthedecimationoftheonlyassemblageoflifethatweknowofintheuniverse.”EvaggelosVallianatosonTheSwamp,theUSlabthatdidfraudulenttesting40“IthappenedinaseriesoflargefacilitiesknownasIndustrialBiotest(IBT)headquarteredinNorthbrook,Illinois.ThetimeIBTdiditsdirtyworkcoveredmostoftheyearsfromthe1950stothe1970s.ButtestingpesticidesandotherchemicalsatIBTwasprimarilyafraudulentaffair.Thelabhadtheappearanceofascientifictestingfacility.Infact,itwasaswampoffilthandcorruption.Ithadnothingtodowithscience.Theanimalswerethefront.Thescientistsweretheprops.Theanimalsatefeedpoisonedbythechemicalseekinggovernmentapproval.However,itdidnotmatterwhatthepoisonedfooddidtotheanimals.Thetechnicians-scientistsdoingthetestingsimplytrashedtheanimalsthatdevelopedtumors,cancer,orotherdisease.Thenthetechniciansspeededuptheexecutionofthestudiesbymakingupdata.That’showIBTworked.ThepathologistwhospilledthebeanswasAdrianGross.In1976,Grossmadeaninspectionanduncoveredthegiantlabwasagiantfactoryoffraud.GrossworkedfortheUSDrugandFoodAdministration.In1979,hejoinedtheUSEnvironmentalProtectionAgencywhereIalsoworked.ForseveralyearsGrossandIweregoodfriendsandcolleagues.WetalkedextensivelyaboutIBT.GrosshadnodoubtthemanagersofIBTwerecriminals.Theirsoleinterestwasinwritingfancyreportsofhowbenignthe“tested”chemicalswere.Forexample,Monsanto’sbest-sellingweedkillerglyphosatecameoutoftheIBTswamp.ThisissomethingIdidnotknowwhileservingatEPA.IlearnedaboutitfromastreamofMonsantodocumentsthatsawthelightofthedaybecausesomanypeoplehavebeensuingMonsantoforcancerfromexposuretoglyphosate.InMarch17,2015,WilliamF.Heydens,aMonsantoscientist,sentanemailtohiscolleagueJoshMonkeninwhichhesaidrounduphad“low”levelsofcarcinogenicformaldehydeandcarcinogenicN-nitrosocompounds.Inaddition,Heydenssaid,“Manytox[icological]studiesforglyphosatehadbeendoneatalab(IBT–IndustrialBiotest)thatFDA/EPAfoundtogeneratefraudulentdatabackinthe1970s.”Monsantohasbeenmakingsomuchmoneyfromglyphosatethatithasbecomeparanoidandimmoralinitsdefenseofglyphosate.Yet,luciditysometimesprevailsandthetruthcomesout.IthappenedinNovember22,2003.Inanemailtoacolleague,aMonsantotoxicologist,DonnaR.Farmer,said:“youcannotsaythatRoundupisnotacarcinogen.”Sheisright.Roundupisacarcinogen.Itincludesglyphosate,carcinogenslikeformaldehyde,andotherchemicals,someofwhichmaybemoretoxicthantheIBT-testedglyphosate.Thepesticideslawclassifiesthesetoxicmaterialsas“inerts.”Draintheswamp—now.Nomoredeception,cover-upandcollusion.Monsantoexposed:theMonsantoPaperscontinued41Over2017anincrediblenumberofsecretdocumentsfromvariousindustriesandcompaniesweremadepublic.InMarch2017,anAmericanJudgeruled – overMonsanto’sobjections – thatcertaininternaldocumentscouldbeunsealedintheframethemultidistrictlitigationglyphosatecancercase.Observerswerequicktorenamethesedocumentsthe‘MonsantoPapers’.Fourmonthslater,anewbatchofcompanyrecordswasreleased.AttorneysforBaumHedlundwhowereleadingthelawsuitagainstMonsantoforRoundupcausingcancersissuedanunprecedentedstatement.42

The27–yeardeclineofcoralcoverontheGreatBarrierReefanditscauses90Extracts:Basedontheworld’smostextensivetimeseriesdataonreefcondition(2,258surveysof214reefsover1985–2012),weshowamajordeclineincoralcoverfrom28.0%to13.8%(0.53%y-1),alossof50.7%ofinitialcoralcover.Tropicalcyclones,coralpredationbycrown-of-thornsstarfish(COTS),andcoralbleachingaccountedfor48%,42%,and10%oftherespectiveestimatedlossesamountingto3.38%y-1mortalityrate.Importantly,therelativelypristinenorthernregionshowednooveralldecline.Thus,reducingCOTSpopulations,byimprovingwaterqualityanddevelopingalternativecontrolmeasures,couldpreventfurthercoraldeclineandimprovetheoutlookfortheGreatBarrierReef.Suchstrategiescan,however,onlybesuccessfulifclimaticconditionsarestabilized,aslossesduetobleachingandcycloneswillotherwiseincrease.

SustainableUseofPesticides21October2009:DIRECTIVE2009/128/ECOFTHEEUROPEANPARLIAMENT.102EUDirectiveAdvicecomparedwithUKGovernment’sResponse2010Article9AerialSprayingEUDirectiveAdvice:Aerialsprayingofpesticideshasthepotentialtocausesignificantadverseimpactsonhumanhealthandtheenvironment,inparticularfromspraydrift.Thereforeaerialsprayingshouldgenerallybeprohibitedwithderogationspossiblewhereitrepresentsclearadvantagesintermsofreducedimpactsonhumanhealthandtheenvironmentincomparisonwithothersprayingmethods,orwheretherearenoviablealternatives,providedthatthebestavailabletechnologytoreducedriftisused.GovernmentResponse:Wedonotconsiderthatresponsibleapplicationofpesticidesbyaerialsprayingposesanunacceptablerisktohumanhealthandtheenvironment,andconsequentlywewillusethederogation.WebelievethattheexistinglegislationcontrolregimeprovidesabasisformeetingtheDirectiveandthiswillbeadaptedtoensurethecontinuationofproperlyregulatedaerialapplicationsthroughaconsent-basedapproach.Article10ProtectionofwaterEUDirectiveAdvice:Theaquaticenvironmentisespeciallysensitivetopesticides.Itisverynecessaryforparticularattentiontobepaidtoavoidingpollutionofsurfacewaterandgroundwaterbytakingappropriatemeasuressuchastheestablishmentofbufferandsafeguardzones,orplantinghedgesalongsurfacewatertoreduceexposureofwaterbodiestospraydrift,drainflowandrun-off.Thedimensionsofbufferzonesshoulddependinparticularpesticideproperties,aswellasagriculturalcharacteristicsoftheareasconcerned.GovernmentResponse:Currentstatutoryandvoluntarycontrolsrelatedtopesticidesandtheprotectionofwater,iffollowed,affordahighdegreeofprotectiontowatercoursesandcoverspecificmeasuresdetailedintheDirective.TheGovernmentwillprimarilyseektoworkwiththepesticidesindustrytoenhancevoluntarymeasures.Article11UseofpesticidesinspecificareasEUDirectiveAdvice:UseofpesticidescanbeparticularlydangerousinverysensitiveareassuchasNatura2000sitesprotectedinaccordancewithDirectives79/409/EECand92/43/EEC.Inotherplacessuchaspublicparksandgarden,sportsandrecreationgrounds,schoolgroundsandchildren’splaygrounds,andintheclosevicinityofhealthcarefacilities,therisksfromexposuretopesticidesishigh.Intheseareas,theuseofpesticidesshouldbeminimizedorprohibited.Whenpesticidesareused,appropriateriskmanagementmeasuresshouldbeestablishedandlow-riskpesticidesaswellasbiologicalcontrolmeasuresshouldbeconsideredinthefirstplace.GovernmentResponse:Wedonotconsideritnecessarytoprohibittheuseofpesticidesinpublicspacesorconservationareasortoimposenewstatutorycontrolsonpesticideuseintheseareas.WebelievethattheUKcanmeetitsobligationsundertheDirectivethroughexistingstatutoryandvoluntarycontrolsanddevelopadditionalvoluntarymeasures.InDecember2010LordHenley,theUnder-SecretaryofStateforDefra,explainedwhytheUKweren’tgoinglegislate.HesaidthattheBritishhadan“ideologicaldislikeoflegislationtherewere“dangersofover-legislating.”
