    ThePyidaungsuHluttawherebyenactsthislaw.

    Chapter1

    Titleanddefinition

    1. ThislawshallbecalledtheMyanmarEngineeringCouncilLaw.

    2. Theexpressionscontainedinthislawshallhavethemeaningsgivenhereunder:

    (a) EngineeringSubjectmeansasubjectdealingwiththedesign,constructionandmaintenance

    of buildings, equipment, vehicles,machineries, apparatus, energy andmaterials andwith

    production processes based on knowledge and technical knowhow gained by studying,

    learningandpracticingmathematics,science,commerceandsociologywhicharebeneficial

    to mankind with the least impact on the environment, natural resources and human

    resources;

    (b) Specialized engineering subject means a major subject in engineering such as civil

    engineering,mechanicalengineering,electricalengineering,etc;

    (c) Technologymeansengineeringtechnology, i.e.methodsused inpractice,waysandmeans,

    proceduresandprocessesofproductionandrelatedtechnology;

    (d) MainministrymeansanyUnionministryspecifiedby theUniongovernment to implement

    thedutiescontainedinthislaw;

    (e) CouncilmeanstheMyanmarEngineeringCouncilorganizedbythislaw;

    (f) CouncilmembermeansanymemberoftheMyanmarEngineeringCouncil;

    (g) ExecutiveCommitteemeansthecommitteeorganizedbythislawfromamongstthecouncil

    members;

    (h) Technicianmeans a personwho obtained a technical diploma recognized by the council

    accordingtothislaw;

    (i) Graduatetechnologistmeansapersonwhoreceivedatechnologydegreerecognizedbythe

    councilaccordingtothislaw;

    (j) Engineermeans a personwho received an engineering degree recognized by the council

    accordingtothislaw;

    (k) Registration certificate means a "registered technician certificate", "registered graduate

    technologistcertificate"ora"registeredengineercertificate"issuedbythecouncilaccording

    tothislaw;

    (l) Registeredengineercertificatemeansa"registeredengineercertificate","registeredsenior

    engineer certificate", "registered professional engineer certificate", "registered limited

    engineercertificate"or "registered limitedprofessionalengineer certificate", issuedby the

    councilaccordingtothislaw;

    (m) Registered engineer certificatemeans a registration certificate issued by the council to a

    personwhohasspecificqualificationevidencedbyacertificateissuedbyanydepartmentor

    organizationrelatingtoanengineeringsubjectrecognizedbythecouncil,ortoapersonwho

    has specific qualifications evidenced by his registration with the council as an engineer

    accordingtothislaw;

    (n) Registeredseniorengineercertificatemeansaregistrationcertificate issuedbythecouncil

    toanengineerwhohasthequalificationsforanseniorengineerasevidencedbyhishaving

    passedanexaminationheldbythecouncilinanengineeringsubjectafterhishavingreceived

    (another)registrationcertificateunderthislaw;

    (o) Registered professional engineer certificatemeans a registration certificate issued by the

    council to an engineerwho has specific qualifications andwho has received a registered

    seniorengineercertificateunderthislaw;

    (p) Registeredlimitedengineercertificatemeansaregistrationcertificateissuedbythecouncil

    accordingtothestipulationstoaforeignengineerwhoconformstothespecificationsunder

    thislaw.

    (q) Registered limitedprofessionalengineer certificatemeansa registration certificate issued

    bythecouncilunderthis lawtoaforeignregisteredprofessionalengineerwhoconformsto

    thestipulationsaccordingtoanASEANmutualrecognitionarrangement.

    Chapter2

    Objectives

    3. TheObjectivesofthislawareasfollows:

    (a) todevelopthedignity,ethicalprinciplesandabilityofMyanmarcitizenengineers,graduate

    technologistsandtechnicianswhoareworkingintheengineeringservicessector;

    (b) toexplorebeneficial,usefulandgoodmethodstoresearchanddeveloptheStatesnatural

    resources andhuman resourceswith the least environmental impactby a combinationof

    engineeringtechnologyandinformationtechnology;

    (c) toguide,control,maintainandtakenecessaryactionwithregardtospecifiedstandardsand

    norms relating to specified subjects, systematicmethods, safetyandethicalprinciplesand

    dutiesinteachingengineeringsubjectsandintechnologicalresearchandservices;

    (d) toperformengineering and technological activitiesof the State and tasks assignedby the

    relevantministryororganizationfromtimetotime;

    Chapter3

    FormationoftheMyanmarEngineeringCouncil

    4. The main ministry shall form the selection committee of the Myanmar Engineering Council

    consistingofnotmorethansevenpersons,composedofpersonnelfromministries,government

    organizations and nongovernment organizations concerned with engineering and of suitably

    experiencedengineersselectedwiththeconsentoftheUniongovernment.

    5. Theselectioncommitteeshallformthecouncilconsistingof60membersinaccordancewiththe

    stipulationsasfollows:

    (a) Personnelfromthemainministryandministriesconcernedwithengineeringsubjects

    15persons

    (b) Personnelfromdepartmentsconcernedwiththeteachingofengineeringand

    technology,scholarsofengineeringatuniversities,collegesandinstitutes 15persons

    (c) Experiencedengineersfromnongovernmentalorganizations

    concernedwithengineeringsubjects 15persons

    (d) Wellknown,experiencedengineersfromoutside 15persons

    6. Theselectioncommitteecouncilshallselectandassignachairman,avicechairmananda joint

    secretary. The councilmembers shall select a vicechairman, a secretary, a joint secretary, a

    treasurerand8executivemembersfromamongsttheminaccordancewiththestipulations.

    7. Fifteenmembersofthecouncilshallformanexecutivecommitteetoperformthefunctionsand

    dutiesof the council; theexecutive committee shall consistof the chairmanof the council as

    executive committee chairman, the vicechairpersons of the council as vicechairpersons, the

    council's secretary as secretary, the council's joint secretary as joint secretary, the council's

    treasurerastreasurer,andthecouncil'sexecutivemembersasmembers.

    8. Thetermofthecouncilandofthecouncilmembersshallbeasfollows:

    (a) thetermofthecouncilis4yearsstartingfromtheformationday;

    (b) thetermofthecouncilmembersisthesameasthetermofthecouncil;

    (c) thechairmanofthecouncilisallowedtoholdtheofficeforoneterm;

    (d) acouncilmemberisallowedtoholdtheofficecontinuouslyfortwoterms;

    (e) avacantpostforacouncilmembershallbesubstitutedpursuanttoaselectionaccordingto

    therules.Thetermofthesubstitutedcouncilmembershallbetheremainderofthetermof

    thepreviouscouncilmember;

    (f) theselectioncommitteeofthecouncilshallformanewcouncilwithin60daysfromtheday

    ofterminationoftheexistingcouncilandshallhandovertheduty.

    Chapter4

    DutiesandPowersoftheCouncil

    9. Thedutiesofthecouncilareasfollows:

    (a) Announcing, from time to time, which engineering degrees, technology degrees and

    technologydiplomasarerecognizedbythecouncil;

    (b) recognizing, or refusing to recognize, the degrees and diplomas conferred by any

    technologicaluniversity,engineeringuniversity,anytechnologicalcollegeor institute inthe

    countryorabroad,andtheregistrationcertificatesissuedunderthislawbyanyorganization

    ordepartmentconcernedwithanengineeringsubject;

    (c) specifyingworkrelatedqualificationsofthedegreeanddiplomaholderswhicharerequired

    foranykindofregistrationcertificatetobeissuedunderthislaw;

    (d) specifying the ethical principles to be followed by engineers, graduate technologists and

    technicians,controllingwhethertheethicalprinciplesarefollowed,andtakingactionincase

    ofnoncompliance;

    (e) studying and scrutinizingmatters in order to develop and upgrade the qualifications and

    standards of engineers, graduate technologists and technicians; coordinating with

    governmentdepartmentsandorganizationsandNGOs;

    (f) issuing, after having scrutinized the application, registration certificates; compiling and

    maintainingalistofregistrationcertificatesandpublishingitoccasionally;

    (g) advising, supporting, and cooperatingwith themainministry, other relevant government

    ministriesandotherorganizationsrelatingtorequirednormsandthecompilationofethical

    principlesinengineeringtodevelopandupgradethequalityandstandardofallengineering

    subjectsandtechnologicalworks;

    (h) advising, supporting, and cooperating with the main ministry and other relevant Union

    ministries upon studying methods developed internationally in engineering subjects and

    technologicalteachingwithaviewtocreatequalifiedengineers,graduatetechnologistsand

    technicianscapableofdevelopingengineeringsubjectsandtechnologicalteaching;

    (i) advisingand,asnecessary,supportingthemainministry,otherrelevantUnionministriesand

    otherorganizationstosecurecontinuousteachingforengineers,graduatetechnologistsand

    technicians according to their engineering subject and technological work requirements.

    Holding theoretical and practical classes, workshops and seminars for continuous

    development.Arrangingparticipationininternationalandregionalmeetingsandconferences

    asrepresentativeoftheState;

    (j) advising and supporting the main ministry, other relevant Union ministries and other

    organizations on research and development so as to develop and upgrade engineering

    subjectsandtechnologicalstandards;

    (k) scrutinizing,inaccordancewiththeapprovalortheinstructionofthemainministry,whether

    thespecifiedprocedures,standards,normsandrulesforquantityanalysisare inconformity

    withtherequirementsofconsultingengineersandengineeringandtechnologicalcompanies

    and organizations, contractors and contracting companieswithin the country and abroad;

    conveyingthecouncil'sopinionandremarkstotherelevantUnionministryandGovernment

    organizations;

    (l) thecouncilshallformtheofficeofthechiefregistrarwiththeapprovalofthemainministry

    tocarryoutthedutiesofthecouncilandtheexecutivecommitteeunderthislaw;

    (m) performing the duties assigned to it from time to time by the main ministry so as to

    successfullyachievetheobjectivesofthecouncil.

    10. Thepowersofthecouncilareasfollows:

    (a) Formation of the followingwork committees and specifying the duties of the respective

    committees

    (1) workcommitteeforscrutinizingregistrationcertificates;

    (2) workcommitteeforthemaintenanceofethicalprinciples;

    (3) workcommitteeforthemaintenanceofdiscipline;

    (4) workcommitteeforthecompilationofnorms,rulesforquantityanalysisandengineering

    procedures;

    (5) workcommitteeforcontinuouslearningofengineeringsubjects;

    (6) workcommitteeforcompaniesandorganizationsrelatingtothescrutinyandrecognition

    ofengineeringsubjects;

    (7) workcommitteeforthescrutinyandrecognitionofthequalityofspecializedengineering

    subjects;

    (8) otherworkcommitteestobeformedasrequired;

    (b) specifyingthetermofregistrationcertificates,extendingthetermandrefusingtoextendthe

    term;

    (c) issuingregistrationcertificates,refusingtheirissuance,suspendingandcancellingthem;

    (d) specifyingregistrationfees,registrationfeesforextensions,defaultoverduefeesforoverdue

    applicationstoextendthetermofregistration;

    (e) coordinating and collaborating, within the country and abroad, with engineers and

    techniciansinaninternationalandregionalcontexttofurthertheinterestsoftheState;

    (f) formationoftherelevantworkinggroupsforspecializedengineeringsubjects;

    (g) separatelyspecifyingexemptionsand requiredrulesandregulationsregardingthe issuance

    ofregistrationcertificates.

    11. The council may hand over and assign duties and powers to the executive committee to

    implementtheobjectsofthislaweffectively.

    12. Thecouncilmayformanoffice ledbythechiefregistrarandassigndutiesofthecouncilandof

    theexecutivecommitteeto itasnecessary. Branchofficesofthecouncil ledbyaregistrarmay

    beformedandopenedintheregionsandstatesanddutiesmaybeassignedtothem.

    Chapter5

    TerminationofCouncilMembership

    13. The council shall terminate the membership of a council member at the suggestion of the

    executivecommitteeintheeventofanyofthefollowinghavingoccurred:

    (a) resignation;

    (b) havingbeenabsentthreetimesinarowfrommeetingswithoutpermissionofthecouncil;

    (c) havingbeenoutof reachof the council for6monthsor longerwithoutpermissionof the

    council;

    (d) suspensionorcancellationoftheregistrationcertificate;

    (e) punishment with imprisonment for having committed an offence related to "the moral

    character";

    (f) havingbeenfound,uponexaminationbythecouncil,tobeaperson"withoutmorals";

    (g) incapability to perform the councils duty due to anymental disease, unsoundmind or

    disabilityoranyotherreason.

    (h) death.

    Chapter6

    ConvocationofMeetings

    14. Meetingsofthecouncilshallbeconvenedinaccordancewiththefollowingstipulations

    (a) Regularmeetingsofthecouncilshallbeheldeverythreemonthsandspecialmeetingsshall

    beheldwhennecessary;

    (b) Regularmeetings of the executive committee shall be held once in amonth and special

    meetingsshallbeheldwhennecessary;

    (c) Aspecialmeetingshallbecalledifaminimumofonefourth(25%)ofthecouncilmembersso

    demandbyofficialletter;

    15. The nearest meeting shall review whether to approve the performance of the executive

    committee.

    16. TheCouncilshallreportitsperformancetothemainministryfromtimetotime.

    Chapter7

    Finance

    17. Thecouncilshallsetupafundcomposedofthefollowingmoniestoimplementthestipulations

    underthislaw

    (a) registrationfees,annualfees,overduefeeandothermoniestowhichthecouncilisentitled;

    (b) donatedmoneyandaidmoneyfromorganizationsanddonorswithinthecountryorabroad;

    (c) moneybywhichthefundisofficiallyincreased.

    18. Thecouncil

    (a) shallstrivetomeetitsexpensesonlyfromthefund;

    (b) shall submit a request, through the main ministry, to use funds of the Union with the

    approvaloftheUniongovernmentifthefundisnotsufficienttomeetitsexpenses.

    19. The council shall systematically perform financial functions in accordance with the existing

    financialrules,regulationsanddirectives.

    Chapter8

    Applicationfor,andIssuanceof,RegistrationCertificatesforGraduateTechnologists

    andTechnicians

    20. If theholderofa technologicaldegreeor technologicaldiploma,conferredbyanyengineering

    university,any technologicaluniversity,any technologicalcollegeorany technological institute

    withinthecountryorabroad,wishestoobtainaregisteredgraduatetechnologistcertificateora

    registeredtechniciancertificate,heshallapplytothecouncilinaccordancewiththestipulations.

    21. (a) The executive committee, on behalf of the council, shall scrutinize the application under

    section20 inaccordancewith thestipulationsand if itapprovestheapplication, itshall fixthe

    termsand conditionsof the registrationand issue,uponpaymentof the specified registration

    fee,theregisteredgraduatetechnologistcertificateortheregisteredtechniciancertificate. If it

    refusestheapplication,itshallrefusetoissuetheregisteredgraduatetechnologistcertificateor

    theregisteredtechniciancertificate.
