CHAPTER - 1 INTRODUCTION

1.1 The West Bengal Electricity Regulatory Commission (hereinafter referred to as the

‘Commission’) was constituted by the Government of West Bengal in the year 1999 in

terms of section 17 of the Electricity Regulatory Commissions Act, 1998, now repealed by

section 185 of the Electricity Act, 2003 (hereinafter referred to as the ‘Act’) which came

into force with effect from 10 June, 2003. The first proviso to section 82(1) of the Act

ensured continuity of the Commission – along with that of all other State Electricity

Regulatory Commissions – by laying down that the State Electricity Regulatory

Commission, established by a State Government under section 17 of the 1998 Act (and

some other enactments) and functioning as such immediately before coming into force of

the Act, shall be the State Commission for the purposes of the Act.

1.2 The functions of a State Commission are laid down in section 86 of the Act. Of its many

functions, a State Commission has to discharge the function of determination of tariff for

generation, supply, transmission and wheeling of electricity, wholesale, bulk or retail, as

the case may be, within the State. Further, section 62(1) of the Act also requires the

Appropriate Commission to determine the tariff in accordance with the provisions of the

Act for supply of electricity by a generating company to a distribution licensee, for

transmission of electricity, for wheeling of electricity as well as for retail sale of electricity.

1.3 In accordance with the provisions of Part XIII of the Act, the Government of West Bengal

reorganized West Bengal State Electricity Board (in short ‘WBSEB’), a State Electricity

Board constituted under section 5 of the Electricity (Supply) Act, 1948 (since repealed),

and replaced it by two Government companies viz. West Bengal State Electricity

Distribution Company Limited (in short ‘WBSEDCL’) and West Bengal State Electricity

Transmission Company Limited (in short ‘WBSETCL’) with effect from 1.4.2007. As

WBSEDCL is a successor entity of erstwhile WBSEB for distribution of electricity

throughout the State of West Bengal except in the areas of supply of other distribution

licensees in the State, WBSEDCL is a deemed distribution licensee in terms of the fifth

proviso to section 14 of the Act.

1.4 In terms of the provisions of the Act, therefore, the Commission is fully empowered to

determine the tariff of WBSEDCL.

1.5 The Commission had, in the past, passed tariff orders determining the tariffs of erstwhile

WBSEB for seven consecutive years starting from 2000 - 2001. The Commission also

passed tariff orders determining the tariffs of WBSEDCL for 2007 – 2008, 2008 – 2009,

2009 – 2010 and 2010-11.

1.6 A generating company or a licensee, whose tariff is needed to be determined by the

Commission as per the provisions of the Act, is required to prepare the application for

determination of tariffs for each year of a control period under the multi-year tariff

framework complying with the provisions of the regulations framed by West Bengal

Electricity Regulatory Commission on Terms and Conditions of Tariff and submit the

same to the Commission within the specified date.

1.7 Accordingly, WBSEDCL, complying with the provisions of the West Bengal Electricity

Regulatory Commission (Terms and Conditions of Tariff) Regulations,2007, as amended

(hereinafter to be referred as old Tariff Regulation), prepared the application for the

determination of its tariffs for each year of the second control period and submitted the

same to the Commission on 2 June, 2008. This tariff application was admitted by the

Commission and numbered as TP-41/08-09.

1.8 The old Tariff Regulation has now been repealed and replaced by West Bengal Electricity

Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2011(hereinafter to

be referred as New Tariff Regulations) published on 29.04.2011. The New Tariff

Regulations have come into effect from 29.04.2011 i.e. the date of publication of it in

official gazette in supersession of the old Tariff Regulation. Thus from 29.04.2011 all

matters relating to tariff determination are to be dealt under the New Tariff Regulations.

1.9 WBSEDCL was, after admission of their tariff application as at 1.7 above, directed to

publish, as required under section 64(2) of the Act, the gist of the tariff application, as

approved by the Commission, in at least four daily newspapers having wide circulation in

the area of supply of WBSEDCL, at least 1 (one) each of such newspapers being in

Bengali and English. The gist was, accordingly, published simultaneously on 16 June,

2008 in Ananda Bazar Patrika, Bartaman, Ganasakti, The Times of India and Sanmarg.

The publication invited the attention of all interested parties, stake holders and the

members of the public to the application for determination of tariffs of WBSEDCL for

each year of the second control period and requested for submission of objections,

comments etc., if any, on the tariff application to the Commission by 18 July, 2008 at the

latest. Opportunities were also afforded to all to inspect the tariff application and take

copies thereof.

1.10 By 18 July, 2008 i.e., the due date, the Commission received objections, comments, etc.

from Jayashree Textiles, Exide Industries Ltd., Hooghly Chamber of Commerce &

Industry, Eastern India Textile Mills’ Association, Manoranjan Roy Energy Education

Centre, CESC Limited, West Bengal Cold Storage Association, EPCOS India Pvt. Ltd.,

West Bengal Cold Chain & Cold Storage Owners’ Welfare Association, Indian Tea

Association, Sri Vasavi Industries Ltd., Eastern Railway, South Eastern Railway, Bharat

Chamber of Commerce, Rohit Ferro – Tech Limited. The Commission also received

objection from All Bengal Electricity Consumers’ Association and identical printed

objections, comments etc. signed by one Shri Pijush Kanti Sharma and 8490 others and

by one Shri Satyen Bhattacharyya by 18 July, 2008. As required under the Act, the

Commission duly considered the objections, comments, etc. of the persons from whom

such objections, comments, etc. were received while dealing with the case.

1.11 The Commission thereafter, in accordance with the provisions of the Act and Tariff

Regulations then in force, passed the tariff order of WBSEDCL for 2008 – 2009

determining the Aggregate Revenue Requirement (in short ‘ARR’) of WBSEDCL for each

year of the second control period, revenue recoverable through tariff by WBSEDCL

during 2008 – 2009 after carrying out negative adjustment of the refundable amount to

the consumers and other distribution licensees (hereinafter referred to as ‘other

licensees’) in the State who had purchased power from erstwhile WBSEB in 2006 – 2007

and now purchase power from WBSEDCL as determined in the Annual Performance

Review (in short ‘APR’) of erstwhile WBSEB for the year 2006 – 2007 with the determined

ARR of WBSEDCL for 2008 – 2009 and also the tariffs of WBSEDCL for 2008 – 2009.

The analyses and findings for determination of the aforesaid ARR and tariffs of

WBSEDCL were recorded in the tariff order of WBSEDCL for 2008 – 2009. The amount

recoverable through tariff during 2009 – 2010 by WBSEDCL had also been determined

subsequently in the tariff order for 2009-10 after carrying out adjustments as were found

necessary on APR relating to the year 2007 – 2008 with the amount of ARR determined

earlier for the year 2009 – 2010 and accordingly tariff for 2009-10 was amended also.

The analyses and findings in that regard were recorded by the Commission in its orders

in Cases No. APR-11/08-09 and TP-41/08-09 dated 28 May, 2009 and 28 July, 2009

respectively.

1.12 The Commission thereafter determined the revenue recoverable through tariff by

WBSEDCL during the year 2010 – 2011 carrying out the adjustment as were found

necessary on APR relating to the year 2008-09 as per order dated 26.7.2010 in Case No.

APR-16/09-10 with the amount of ARR determined earlier for the year 2010-11 in the

tariff order for 2008-09. The Commission also considered the following orders passed by

the Commission and carried out adjustments, as deemed necessary with the ARR for

2010-11 as determined earlier in the tariff order for 2008-09 and passed an order dated

29.07.2010 in Case No.TP-41/08-09 determining the revised ARR of WBSEDCL for the

year 2010-11 and amended tariff for the year 2010-11 in respect of WBSEDCL :-

i) Order dated 30.6.2010 in Case No.OA-73/09-10

ii) Order dated 16.07.2010 In Case No. OA-97/10-11

iii) Order dated 13.02.2009 in Case No.OA-53/08-09

iv) Order dated 16.07.2010 read with corrigendum dated 27.07.2010 in case No.OA-

95/10-11

v) APR order dated 28.05.2009 for 2007-08 in Case No.APR-11/08-09

1.13 The Tariff Order passed by the Commission on 29.07.2010 was challenged in an appeal

before the Hon’ble Appellate Tribunal for Electricity (hereinafter referred to as the Hon’ble

Tribunal) in Appeal No. 173 of 2010. The Hon’ble Tribunal in IA No.62 of 2011 in Appeal

No. 173 of 2010 has passed an order dated 04.04.2011. While passing order Hon’ble

Commission did not go into the merits of the matter and did not incline to express any

opinion with regard to merit of those grounds. Hon’ble Tribunal has remanded the matter

to the Commission for redetermination of tariff with the following directions :

“1) The State Commission shall direct West Bengal discom to file composite tariff in

accordance with the Tariff Regulations and to publish the same inviting objections

and suggestions from the public.

2) The State Commission shall give reasonable time to public to file their objections

and suggestions.

3) State Commission shall consider the pleadings and documents and pass a revised

tariff order for West Bengal discom within the stipulated time as prescribed under

Section 64 of the Act”.

In their order Hon’ble Tribunal also made it clear that the Commission is required to

follow the procedure contemplated under Section 64 of the Act and pass the order in

accordance with law by invoking the power conferred under Section 86 of the Act.

Hon’ble Tribunal also clarified that it is open to the DISCOM to place further particular

with reference to the subsequent developments on various claims, and in that event the

State Commission shall follow the procedure and decide the said claim in accordance

with law. The Hon’ble Tribunal also set aside the order dated 29.7.2010 passed by the

Commission.

1.14 The order of the Hon’ble Tribunal dated 4.4.2011 was received at the Commission’s

Office on 21.04.2011. Accordingly, WBSEDCL was directed under letter No. WBERC/AT-

32/0069 dated 21.04.2011 to take necessary action regarding the direction of the Hon’ble

Appellate Tribunal at (1) above as expeditiously as possible so that the Commission can

take necessary action as per direction of the Hon’ble Appellate Tribunal.

1.15 WBSEDCL submitted the application on 06.05.2011 for re-determination of tariff for 2010-

11 in pursuance of direction given by Hon’ble Tribunal. The application has been admitted

by the Commission on 12.05.2011 in Case No. TP-41/08-09.

1.16 In terms of the provisions of the New Tariff Regulations the application for re-

determination of tariff for 2010-11 is to be dealt with in terms of the provision of the New

Tariff Regulations. According to New Tariff regulations steps to be followed for disposal

of the applications for re-determination of tariff for 2010-11 are as follows :-

i) Disposal of the application dated 6.5.2011 for re-determination of tariff for 2010-11 is

to be done under the New Tariff Regulations.

ii) As per directions of the Hon’ble Tribunal while undertaking the re-determination of

tariff in accordance with the New Tariff Regulations the normative parameters, the

method of calculation and principles of calculations will remain as had been

considered in the concerned tariff order and the old Tariff Regulation.

iiii) Since the year 2010-11 for which tariff is to be re-determined is over, the

Commission in accordance with the New Tariff Regulations may ask WBSEDCL to

submit the updated expenditure on different head of uncontrollable ARR items, so

that tariff can be re-determined with better accuracy to reduce the impact of FPPCA

and APR of 2010-11 in future tariff.

1.17 After admission of the application, WBSEDCL was directed to publish the gist of the

application as approved by the Commission in Newspapers and also in their website.

Accordingly, the gist of the application was published simultaneously in Anandabazar

Patrika, Times of India, Aajkal and Sakalbela on 14.05.2011 inviting suggestion, and

objection from all interested parties and members of the public and all stake holders. A

copy of the gist was also posted in the website of WBSEDCL. They were also offered

opportunities for inspection of the application and to take certified copies of the same in

terms of the relevant provision of the West Bengal Electricity Regulatory Commission

(Conduct of Business) Regulations,2003, as amended and West Bengal Electricity

Regulatory Commission (Fees) Regulations,2003. A copy of the application was also

posted in the website of WBSEDCL.

1.18 Objections and suggestions on the aforementioned application of WBSEDCL for re-

determination of tariff for the year 2010-11 were received by the Commission from the

following persons within the stipulated time i.e. 10.06.2011:-

1) Eastern Railway

2) Hooghly Chamber of Commerce & Industries

3) All Bengal Electricity Consumer’s Association

4) West Bengal Cold Storage Association.

1.19 Objections and suggestions on the applications in question received by the Commission

within the stipulated period i.e. 10.06.2011 have been dealt with in Chapter-3.

CHAPTER – 2 THE CASE OF WBSEDCL FOR 2010-11

2.1 West Bengal State Electricity Distribution Company Ltd. (WBSEDCL) has

submitted their application for re-determination of tariff for 2010-11 as per

direction of the Commission in pursuance to the order dated 04.04.2011 of the

Hon’ble Appellate Tribunal for Electricity in IA No. 62 of 2011 in Appeal No. 173 of

2010 .

2.2 In their application, WBSEDCL has stated that their application for determination

of tariff for the 2nd control period i.e. for the years 2008-09, 2009-10, 2010-11 was

submitted on 02.06.2008 under the Multi-Year Tariff approach under old Tariff

Regulation. On the basis of such application, the Commission issued an order

dated 30.09.2008 in Case No. TP-41/08-09 (hereinafter to be referred as first year

tariff order) determining Aggregated Revenue Requirement (ARR) for 2008-09,

2009-10 and 2010-11 separately and determining the tariff for 2008-09.

2.3 In their application, WBSEDCL has also stated that the Commission had

subsequently issued Tariff Order dated 29.07.2010 for the year 2010-11 giving

effect to various interim orders viz. order dated 16.07.2010 in case no. OA-97/10-

11, order dated 16.07.2010 in Case No.OA-95/10-11 (including corrigendum

order dated 27.07.2010), order dated 30.06.2010 in case no. OA-76/09-10, order

dated 13.02.2009 in case no. OA-53/08-09 and the APR order for 2008-09 dated

26.07.2010 in case no. APR-16/09-10 for adjustment with the ARR for 2010-11

and thereby fixed the tariff of WBSEDCL for 2010-11. The Tariff Order dated

29.07.2010 was challenged in an appeal before the Appellate Tribunal for

Electricity. Hon’ble Tribunal has been pleased to remand the matter to this

Commission for re-determination of tariff for 2010-11.

2.4 In pursuance of the penultimate paragraph of the order dated 04.04.2011 of the

Hon’ble Appellate Tribunal, WBSEDCL has requested for pass through different

elements on different heads by placing further particulars with reference to the

subsequent developments on various claims in their application in addition to the

ARR already determined in the tariff order of first ensuing year of the second

control period i.e the tariff order for 2008-09. While submitting such further

particulars, as permitted by the Hon’ble Tribunal , WBSEDCL has also submitted

a certificate from a Chartered Accountant engaged by them in favour of their

claim in support of their submission. Such further particulars relate to following

additional claims:

a) In the first year tariff order i.e. the tariff order for 2008-09, the first ensuing

year of the 2nd control period, the Commission approved the Power Purchase

Cost of Rs. 556921.38 lakh against purchase of 31890.79 MU for the year

2010-11. WBSEDCL has submitted that actual power purchase cost for

2010-11 as per audited report comes to Rs. 720161.34 lakh against

purchase of 29281.64 MU. Agencywise power purchase cost has been given

by WBSEDCL along with their application. So the additional claim on account

of power purchase cost of Rs.163239.96 lakh has been made by WBSEDCL.

In this context WBSEDCL has mentioned that they have submitted an

application on 01.07.2010 for additional power purchase claim due to

imposition of clean energy cess which was considered by the Commission

vide order dated 16.07.2011 in case no. OA-97/10-11. Now in view of the

audited data WBSEDCL has prayed to consider the figure of Rs. 720161.34

lakh as reflected in the certificate of the Chartered Accountant for the

purpose of allowing this power purchase cost.

b) Beside the above claim, WBSEDCL has stated that there is an additional

expense of Rs.25201.99 lakh incurred by WBSEDCL during 2010-11 on

account of Fuel Cost Adjustment (FCA) payable to WBPDCL for the year

2008-09 as per order of the Commission dated 16.07.2010 in case no. OA-

95/10-11 and subsequent corrigendum order dated 27.02.2010. WBSEDCL

has prayed to include this amount to the ARR of 2010-11 as this amount has

already been paid to WBPDCL in ten monthly equal instalments commencing

form the month of June, 2010.

c) WBSEDCL has mentioned that in the first year tariff order charges for Central

Transmission Utility (CTU) had not been considered and in the tariff order for

2009-10 the Commission admitted Rs. 14000.00 lakh for the year 2010-11 on

account of CTU charges. WBSEDCL has stated that the actual CTU charges

paid during the year 2010-11 as per the certificate of Chartered Accountant

comes to Rs. 11621.56 lakh and prayed to consider Rs. 11621.56 lakh only.

Since no amount was considered on account of CTU charges in the ARR for

2010-11 in the first year tariff order so entire amount of Rs. 11621.56 lakh is to

be considered in the ARR for 2010-11.

d) In the first year tariff order, the Commission approved the transmission

charges payable to State Transmission Utility (STU) for 2010-11 at Rs.

62052.75 lakh. WBSEDCL has mentioned that actual STU charge paid to

WBSETCL during the year 2010-11 as per tariff order of WBSETCL for the

year 2010-11 is Rs. 65938.66 lakh after availing the timely payment rebate. A

computation in this regard has been annexed by WBSEDCL with their

application. So an additional amount of Rs. 3885.91 lakh has been claimed by

WBSEDCL on account of STU charge.

e) WBSEDCL has mentioned that in the first year tariff order the employee cost

was approved at Rs. 53195.42 lakh for the year 2010-11. Subsequently

through order dated 30.06.2010 in case no. OA-73/09-10 the Commission

allowed the employee cost for 2010-11 at Rs.79795.42 lakh on projection

basis against the application submitted by WBSEDCL on 20.03.2010.

WBSEDCL has now stated that the actual employee cost (including terminal

benefit) net of capitalization as per audited data comes to Rs. 85544.59 lakh

and prayed for considering the same in the ARR for 2010-11 alongwith a

certificate from Chartered Accountant in favour of their claim.

f) WBSEDCL has stated that in the first year tariff order, the Commission

approved the fuel cost for 2010-11 at Rs. 122.84 lakh but the actual fuel cost

for 2010-11 against which a certificate of Chartered Accountant has been

given comes to Rs. 113.87 lakh. Such reduced amount may be considered.

g) WBSEDCL has stated that in the first year tariff order, the Commission

approved the interest on loan for 2010-11 at Rs. 31348.19 lakh whereas

actual interest on loan (net of capitalization) for 2010-11 as per the certificate

of Chartered Accountant comes to Rs. 25690.71 lakh. A detailed computation

in this regard has been annexed to their application.

h) It is also stated that in the first year tariff order, the Commission approved the

finance charge for 2010-11 at Rs. 1140.00 lakh. But the actual finance charge

for 2010-11 as per the certificate of Chartered Accountant comes to Rs.

569.78 lakh which may be considered.

i) It is also stated that the actual interest on working capital for 2010-11 comes

to Rs. 2436.07 lakh. But in the first year tariff order the Commission did not

allow any interest on working capital for the year 2010-11. WBSEDCL has

claimed the actual amount of working capital of Rs. 2436.00 lakh to be

included in the ARR for 2010-11 and in support of such claim WBSEDCL have

submitted a certificate of Chartered Accountant.

j) WBSEDCL has further stated that Commission allowed interest on Consumer

Security Deposit at Rs. 5594.00 lakh. But the actual interest on Consumer

Security Deposit for 2010-11 as per the certificate of Chartered Accountant

comes to Rs. 2392.03 lakh and WBSEDCL prayed for to consider the same in

the ARR for 2010-11.

2.5 WBSEDCL in their application has claimed an additional expenditure of

Rs.229296.03 lakh over and above the gross Aggregate Revenue Requirement

(ARR) as determined for the year 2010-11 in the first year tariff order of the

second control period. As a result the revised gross ARR as claimed by

WBSEDCL for 2010-11 comes to Rs. 1073624.90 lakh which is proposed by

WBSEDCL to be recovered through tariff for 2010-11 in accordance with the

paragraph 5.3(h)(4) of National Tariff Policy published on 06.01.2006.

2.6 Regarding the revenue from sale of power to licensees and Government of

Sikkim, gain from sale to persons other than consumer and licensee and income

from Unscheduled Interchange (UI) which will be deducted from the gross ARR

to arrive at the net ARR and the revenue to be recovered through tariff,

WBSEDCL has stated the following:

a) The actual revenue earned from sale to other licensee during the year 2010-

11 is Rs. 71450.79 lakh.

b) In the tariff order for 2008-09 the Commission deducted the expenses for sale

to persons other than licensee and consumers for the year 2010-11 as Rs.

109611.53 lakh whereas the actual amount on this account has come to Rs.

59416.92 lakh.

c) The actual amount received on account of Un-scheduled Interchange (UI)

charge during the year 2010-11 is Rs. 15561.39 lakh.

d) In the tariff order 2008-09 a presumptive gain from sale to person other than

consumer and licensee during the year 2010-11 was considered as Rs.

15806.74 lakh against sale of 6270.96 MU and kept as Regulatory Asset to

maintain the tariff at a reasonable level. Now the actual amount on account of

the same comes to Rs. 9178.07 lakh, WBSEDCL has prayed for passing this

amount of share of gain to the consumer instead of creating the Regulatory

Asset in the tariff order for 2010-11.

2.7 WBSEDCL has claimed to release Rs. 12723.77 lakh or part thereof on account

of adjustment of short recovery during the year 2007-08 as per APR order dated

28.05.2009.

2.8 WBSEDCL has prayed for release of Regulatory Asset of Rs. 176383.00 lakh

created in terms of order dated 24.09.2009 in not more than five installments.

Accordingly, WBSEDCL has claimed Rs. 35276.60 lakh i.e. 1/5 of Rs. 176383.00

lakh in the ARR for 2010-11. This regulatory assets of Rs. 176383.00 lakh

consists of arrear payment of salary to the employee and accrued terminal

benefit to be deposited to the Terminal Benefit Fund by WBSEDCL due to

revision of pay and allowance of WBSEDCL as per ROPA, 2009. WBSEDCL has

mentioned that there was a cash outflow of Rs. 19450.00 lakh during 2009-10

being the 50% of arrear payment of salary during 2009-10. There was also cash

outflow of Rs. 19450.00 lakh during 2010-11 being the balance 50% of arrear

payment of salary which was not considered in the ARR for 2010-11 determined

in the first year tariff order.

2.9 The actual distribution loss experienced by WBSEDCL during 2010-11 is

25.24%. WBSEDCL has stated that excess power purchase due to higher level

of distribution loss is to be disallowed and they have deducted Rs. 54778.98 lakh

from the ARR for 2010-11 to arrive at the revenue to be recovered from own

consumer and licensee.

2.10 WBSEDCL has also prayed to release through the ARR for 2010-11 the withheld

amount of Rs. 4589.76 lakh for the year 2009-10 on account of non-submission

of Performance Guarantee Test Report of PPSP in the tariff order of 2009-10

since such report had subsequently been submitted by them. WBSEDCL has

also prayed not to withhold in the tariff order for 2010-11 the amount of Rs.

4645.71 lakh as was decided to withhold in the first year Tariff Order.

2.11 After considering all these total revenue to be recovered from their own

consumers and licensees for the year 2010-11 as claimed by WBSEDCL comes

to Rs. 957148.58 lakh and the average tariff of consumer for 2010-11 comes to

503.41 P/kWh.

2.12 WBSEDCL has prayed that the applicable average tariff for consumers at 349.48

P/kWh as per tariff order for 2009-10 along with adhoc increase of power

purchase cost @ 78 P/kWh to be considered as base tariff and amend the tariff

of 2010-11 in line with the guide line of paragraph 8.3(1), 8.3(2) and 8.3(3) of the

National Tariff Policy.

CHAPTER - 3 OBJECTIONS

Objections against the application for re-determination of tariff of WBSEDCL for

the year 2010-11 as per directions of the Hon’ble Appellate Tribunal for Electricity

in its order dated 04.04.2011 in IA 62 of 2011 in Appeal No. 173 of 2010

3.0 Paragraph 1.19 of Chapter-1 contains the list of persons from whom suggestions

and objections on the application for re-determination of tariff of WBSEDCL for

the year 2010-11 have been received within the stipulated date of 10.06.2011.

These objections and suggestions are summarized in subsequent paragraphs of

this Chapter against the respective names of such objectors along with the view

of this Commission on this aspect.

3.1 Hooghly Chamber of Commerce and Industries (HCC)

Hooghly Chamber of Commerce and Industries (hereinafter to be referred as

‘HCC’) have submitted their objections and suggestions on the application

submitted by WBSEDCL for re-determination of tariff for 2010-11. The objections

and suggestions submitted by HCC are broadly divided into two parts. While in

the first part some general issues were raised by HCC, in the second part they

submitted point wise suggestions/ objections.

3.1.1 In paragraph 3 of the objection the HCC had requested for oral hearing to assist

the Commission to adjudicate upon the matter. In this context HCC relied on

different sections of the Act to show that Sections 64 and 86(3) warrant grant of

hearing before deciding upon the objection and determining the tariff.

In this context the Commission finds that in the order of the Hon’ble Appellate

Tribunal the State Commission has been directed to direct WBSEDCL to file

composite tariff in accordance with Tariff Regulations and to publish the same

inviting objections and suggestions from the public. Even in Paragraph (2) of their

direction it is specifically mentioned that the State Commission shall give

reasonable time to public to file their objections and suggestions.

3.1.2 In this context it is also to be noted that nowhere in the order, Hon’ble Appellate

Tribunal has directed for taking any hearing. In fact the conjoint reading of

Sections 64 and 86(3) of the Act clearly establishes that hearing can only be

allowed to the applicant of the application specifically in case of rejection of any

application that is being filed under Section 64 of the Act. But in case of inviting

suggestions and objections as per Section 64 of the Act, there is no such

requirement. Section 86(3) of the Act in particular speaks of ensuring

transparency while discharging its functions but not anything on point of hearing.

3.1.3 As per regulation 2.1.13 of the New Tariff Regulations, the re-determination of

tariff shall be done under the New Tariff Regulations which clearly speaks that

such re-determination shall consider the normative parameters, method of

calculation and principles of calculation in a manner as had been considered in

the concerned tariff order and related repealed regulations to the extent it is not

affected by the order of the Court of Law. In no circumstances it has referred that

the procedural part in disposing the application for re-determination of tariff is to

be relied on the repealed regulations. Thus the procedural aspect for disposing

the application for re-determination of Tariff is to be done in accordance with New

Tariff Regulations in order to fulfill the directives of the Hon’ble Appellate Tribunal

dated 04.04.2011 where Hon’ble Appellate Tribunal directed that “The State

Commission is required to deal with the matter and decide the issues by

observing the required procedure as expeditiously as possible ” .In regulation 2.4

of the New Tariff Regulations it is clearly spelt out that suggestions and

objections shall always mean as submitted in written form only and it has also

been clearly spelt out that hearing on invitation of suggestions and objections

shall be always in a manner and at a stage which is only specifically provided in

the Act and the Regulations made thereunder. Accordingly, any application for

re-determination of tariff can be dealt with through invitation of objections and

suggestions as directed by the Hon’ble Appellate Tribunal. Thus the prayer of

HCC for hearing is not maintainable.

3.1.4 The Commission feels that natural justice has been adequately provided through

invitation of suggestions and objections in written form and consideration of

those. Even on this question of hearing we may refer to the judgment passed by

the Hon’ble Justice Pinaki Chandra Ghose on 04.10.2011 on the Writ Petition

being W.P.No. 16166 (W) of 2004 filed before the Hon’ble High Court,Calcutta in

which West Bengal Electricity Regulatory Commission was one of the

respondents. The Hon’ble Justice Pinaki Chandra Ghosh in his order dated

04.10.2004 having considered the judgment of the Hon’ble Supreme Court

reported in (2002) 8 SCC 715, inter alia held that :

“After going through the said Regulations it appears to me that hearing

was not contemplated under the said Section 64 of the said Act and the

Regulations framed thereunder. Therefore, in my opinion, not granting of

a hearing to the petitioner cannot be said to be violation of natural justice

after construing the said Act and the Regulations framed thereunder.

Therefore, in my opinion, it cannot be said that at this stage the said order

has been made arbitrarily or any violation of natural justice ….”

The aforesaid order dated 4th October,2004 of the Hon’ble Justice Pinaki

Chandra Ghosh was challenged before the Hon’ble Division Bench of the Hon’ble

High Court at Calcutta in an appeal being MAT No. 596 of 2005. The Hon’ble

Division Bench comprising of the Hon’ble Justice Aloke Chakrabarti and the

hon’ble Justice S.P.Talukdar affirmed the order of the Ld. Single Judge by an

order dated 25th February,2005 and, inter alia held that :

“…………… After due consideration of the relevant provisions of the

Act,2003 and having regard to the submission made by the Learned

Counsel for the parties, we think that what is required at the stage of

determination of tariff is consideration and not ‘hearing’…………”

3.1.5 Regarding maintainability of the application the objector HCC has raised their

objection on the ground that the application filed by WBSEDCL is not under the

procedure for filing of Tariff Application in MYT framework. On this issue

Commission feels that such application was filed in accordance with the direction

of State Commission in pursuance to order of the Hon’ble Appellate Tribunal

which is covered under regulation 2.1.13 of the New Tariff Regulations and not

as a tariff application in the first ensuing year of a control period under MYT

framework. In fact in no part of the order Hon’ble Appellate Tribunal has directed

to file any application for tariff determination. Hon’ble Appellate Tribunal has

remanded the matter for re-determination of Tariff where it directs that State

Commission shall direct DISCOM to file Composite Tariff in accordance with the

Tariff Regulations and to publish the same inviting objections and suggestions

from the public. In fact, under the New Tariff Regulations in case of

redetermination of tariff due to order of any Court of Law the relevant particular

regulation is regulation 2.1.13 only and the normal procedure of Tariff

Application filing under MYT is not required though HCC referred to regulation

2.7(ii) of Tariff Regulations. But there is no such regulation 2.7(ii) in the Tariff

Regulations as mentioned by HCC. However in the regulation 2.7.2 the same

content as referred by the objector exists which is not applicable to this case as it

falls under the case of re-determination. Moreover, Hon’ble Appellate Tribunal

remanded the matter to the State Commission for re-determination of tariff in

accordance with the Tariff Regulations. Thus, according to the New Tariff

Regulation, Commission considered the tariff application filed at the start of the

2nd control period for all the three ensuing years 2008-09, 2009-10, 2010-11 as

the tariff application.

According to the Appellate Tribunal’s order dated 4.4.2011 this Commission

directed WBSEDCL to invite suggestions and objections on their application for

re-determination of tariff for 2010-11. Accordingly, WBSEDCL published the gist

of their application approved by the Commission inviting suggestions and

objections in the newspapers and also in the website of WBSEDCL in line with

the direction of the Appellate Tribunal. The said application of WBSEDCL for re-

determination of tariff for 2010-11 provides all the information which is required

for determination of composite tariff arising out of following elements:

i) ARR determined for 2010-11 in the tariff order for 2008-09 i.e. the first

ensuing year of the 2nd control period.

ii) Adjustable amount to ARR under (i) arising out of APR of 2008-09.

iii) Other adjustable amount to ARR under Sl. No. (i) arising out of the further

particulars with reference to the subsequent developments on various

claims which has been put under the application for re-determination of

tariff for 2010-11 in line with direction in the order dated 4.4.2011 of the

Hon’ble Appellate Tribunal.

3.1.6 In paragraph 10(d) of the objection HCC has claimed that Hon’ble Appellate

Tribunal has directed to file a composite application. In fact the Commission on

scrutiny found that in the order of the Hon’ble Appellate Tribunal the Commission

is required to direct WBSEDCL to file “Composite Tariff” in accordance with the

Tariff Regulations. The conjoint reading of the direction above referred and the

penultimate paragraph of the order of the Appellate Tribunal dated 4.4.2011

make it clear that during re-determination process WBSEDCL has been required

to file composite Tariff consisting of the elements as already explained in

Paragraph 3.1.5 of this order.

3.1.7 In fact the original Tariff Application under Multi Year Tariff (MYT) for 2nd control

period and tariff order of 2008-09 are available in public domain and the objector

has access to it. Similarly the order dated 28.05.2009, 24.09.2009, 30.06.2010

and 16.07.2010 are available in public domain and the objector has also access

to it. Therefore the objector had sufficient chance to provide his objection on the

basis of original application of tariff for 2nd control period, tariff order for 2008-09

and the applications under orders dated 28.05.2009, 24.09.2009, 30.06.2010 and

16.07.2010. In this context it is to be mentioned that regulation 2.6(i), as referred

by HCC, does not exist in the New Tariff Regulations. However, regulation 2.6.1

makes it abundantly clear that the Annual Performance Review (in short ‘APR’)

shall provide related information as required for the content of the APR as per the

format of the Tariff Application. In that context the objector had not provided any

evidence by which it is established that any deviation has taken place in

submission of relevant information as per the format of the Tariff Application. The

Commission also feels that the relevant information are duly supplied in desired

format as required under Tariff Application.

In fact, on scrutiny the Commission finds that the APR application for 2008-09

has been duly placed and thus admitted. In view of the above the Commission

feels that the application is quite maintainable.

3.1.8 In paragraph 11 of the objection HCC has mentioned that in para 5(a), 5(e) and

5(g) of the application WBSEDCL has claimed additional cost towards power

purchase cost, employees cost and interest on loan. But it is observed that there

is no claim on account of interest on loan in para 5(g) of the application submitted

by WBSEDCL. Moreover, there is negative adjustment on account of refundable

amount of Rs 5657.48 lakh towards interest on loan.

The last proviso of regulation 2.1.13 of New Tariff Regulations has empowered

the Commission to ask “ the licensee or generating company to resubmit the

updated expenditures on different heads of uncontrollable ARR item, so that tariff

can be re-determined with better accuracy to reduce the impact of FPPCA and

APR of the ensuing year in future tariff” and in this instant application the

applicant WBSEDCL have claimed that they have submitted their updated

expenditures with an audited report by Chartered Accountant. The licensee in

this case has submitted their claim with a certification from a Chartered

Accountant which is mentioned as audited report. In fact the audited accounts will

be required during determination of APR for 2010-11. In view of above

submission of claim by WBSEDCL with a certification from a Chartered

Accountant, Commission feels prudent to accept such value subject to final

adjustment in the FPPCA and APR for 2010-11 on the basis of audited annual

accounts in future and in order to reduce the burden of consumer from recovery

of additional ARR requirement of 2010-11 in future years.

Moreover, it is to be noted in the same application under Para 5(c), 5(h) and 5(j)

the licensee has proposed for refund on the basis of actual expenditure as

envisaged under the last proviso of regulation 2.1.13. On those issues there is no

comment of the objectors. Thus, the above claim under paragraph 5(a), 5(c),

5(e), 5(g), 5(h) and 5(j) in the application by WBSEDCL is in accordance with the

penultimate paragraph of the order of Hon’ble Appellate Tribunal and also as per

regulation 2.1.13 of the New Tariff Regulations. Thus the application is

maintainable.

3.1.9 In point-wise objection HCC has raised their objection regarding the power

purchase cost as claimed by WBSEDCL on the ground that WBSEDCL have not

provided the station-wise power procurement details regarding quantum, price

and cost duly supported by audited accounts and there is lack of credibility in the

filing made by WBSEDCL.

In paragraph 13 of the objection HCC has also raised his objection to pass on the

excess power purchase cost of Rs. 162339 lakh over the amount as approved as

power purchase cost by the Commission in the Tariff Order for 2008-09 on the

ground that the Annexure-1 is unaudited accounts. The Commission feels that

the audited account is required for APR but not at the stage of tariff determination

or re-determination. Thus if WBSEDCL claims such expenditure with a

certification from their engaged Chartered Accountant then there is no harm.

However, Commission will make further due diligence on submission of FPPCA

application in future. Moreover, the order of the Hon’ble Appellate Tribunal has

allowed the applicant to place further particulars in regard to subsequent

development and asked the State Commission to decide on such claim following

the procedure in accordance with the law. As under regulation 2.5.3 of New Tariff

Regulations, it is permissible to change the already determined ARR for any

ensuing year due to increase in power purchase cost. Thus, the Commission

feels that the above claim by WBSEDCL is permissible in accordance with the

law and feels it prudent to accept the power purchase cost as claimed by

WBSEDCL subject to final adjustment in the FPPCA and APR for 2010-11 on the

basis of audited annual accounts in future and in order to reduce the burden of

consumer from recovery of the additional ARR requirement of 2010-11 in future

years.

3.1.10 The HCC has objected on the ground of lack of due diligence by the DISCOM as

the energy purchase by DISCOM is reduced by 8% from the figure that appeared

in the Tariff Order for 2008-09, the power purchase cost has increased by nearly

29%. In this context the Commission feels that conjoint reading of the para 35 of

the application of Annual Performance Review of 2008-09 submitted by

WBSEDCL and the supplementary application dated 24 July, 2010 to the

application of APR for 2008-09 and Para 5(a) of the application dated 06.05.2011

for re-determination of tariff of WBSEDCL for 2010-11 give all the explanation of

increase in power purchase cost as this power purchase cost is permissible

under regulation 2.5.3 of the New Tariff Regulations. Thus Commission admits

the additional power purchase cost.

3.1.11 The objector in paragraph 15 has raised their objection on the ground that the

power purchase cost should be allowed only after considering the disallowance

of the power purchase quantum on account of under-achievement of distribution

loss level in line with the Tariff Policy 2006. In this context it is to be mentioned

that WBSEDCL has already adjusted the disallowed power purchase cost due to

excess distribution loss over the normative level in the application for re-

determination of tariff for 2010-11 submitted on 06.05.2011.

3.1.12 In Paragraph 16 of their objection HCC has mentioned that DISCOM has applied

for disallowance of power purchase cost due to higher distribution loss level but

they have not applied the same principle for the transmission charges, CTU and

STU charges incurred for procuring the said additional power, thereby burdening

the consumers by additional cost. In this context it is to be mentioned that CTU

& STU charges are the fixed charges in nature in case of WBSEDCL.

WBSEDCL has to pay CTU charges for purchase of inter state power as per

allocated share irrespective of quantum of energy drawn. WBSEDCL has to pay

the entire STU charge to West Bengal State Electricity Transmission Company

Limited (in short ‘WBSETCL’), the State Transmission Utility (in short ‘STU’) as

they are the only long term user of the STU system. Therefore, the proposal for

disallowance due to higher distribution loss over normative level with respect to

the losses arising out of CTU & STU system for any disallowed portion of the

power purchase due to higher level of distribution loss cannot be accepted.

3.1.13 HCC has also proposed that the principle of Merit Order Dispatch shall be

considered for disallowance cost of excess power purchase for higher distribution

loss. In this context the Commission feels that this is not logical as this is

tantamount to saying that high cost energy only contributes towards distribution

losses. In fact, the power purchased at different rates are sourced at different

instant of time throughout the year and more or less distributed over the year

according to demand pattern and loss occurs at all instant of time under the

same law of physics. Thus it cannot be said that the power procured at the higher

cost will be considered for disallowance portion due to high distribution loss.

Thus the Commission feels it prudent that the weighted average price of the

pooled power purchase cost shall only be considered as a most reasonable and

rational approach for disallowance of excess power purchase cost for excess

distribution loss over the normative loss.

3.1.14 In Paragraph 17 of their objection HCC has mentioned that WBSEDCL’s claim of

Rs. 85544.59 lakh on account of employee cost are not as per audited report ,as

stated by the DISCOM, and hence the revenue realization against the same is

liable to be rejected. HCC in their point wise objection has also challenged the

Employees cost on the ground of absence of rationale for incidence of

employees cost and reasons of such deviation from the projected expenses. In

this context the objector has not mentioned clearly by what they mean by

projected expenses. However, the Commission feels that WBSEDCL has already

explained in their application dated 20.3.2010 in Case No.OA-73/09-10 the

reason of increase in employees cost. In the application for redetermination of

tariff for 2010-11 WBSEDCL has only claimed the final actual expenditure under

the same head which was previously considered on the projection base in the

OA-73/09-10. As the order has already been referred under the application for

redetermination of tariff for 2010-11 it was known to the objector as it is available

in this Commission for any public scrutiny. Thus the contention of the objector

could not be accepted.

As the claim under head ‘Employees Cost’ is in accordance with the direction of

the Appellate Tribunal in their order dated 4.4.2011 and also in accordance with

regulation 2.1.13, the Commission feels it prudent to admit such amount for

consideration in the ARR for 2010-11 to make the tariff more realistic and to

reduce the impact of APR in future years. Moreover audited accounts are only

necessary during APR.

HCC has also raised their objection regarding the employee cost claimed by

WBSEDCL on the ground that WBSEDCL has not furnished any accounting

statement for 2010-11 in absence of which no prudence check may be possible.

HCC has also questioned that though WBSEDCL has booked significant liability

under Employees cost and has claimed such expenses in tariff but there has

been no matching cash outflow on account of the employees cost.

In this context it is mentioned that audited accounts is required in case of APR of

any year. The tariff to be re-determined in this order for 2010-11 is subject to

truing up through APR of 2010-11 based on audited accounts. Regarding liability

on staff related matter, it may be mentioned that the employees cost includes the

liability on account of terminal benefit fund also. A large portion of such

employees cost is on account of accrual valuation due to revision of pay and

allowances of the employees under ROPA 2009 for which no cash flow has

taken place. This amount is payable to terminal benefit fund subject to release of

Regulatory asset created in the order dated 24.09.2009. As such amount is not

yet released from regulatory asset, the cash flow statement cannot reflect it

3.1.15 In relation to the objection raised in paragraphs 18 and 19 of the objections, the

objector has not given any reference to which portion of the Tariff Application it is

related. On scrutiny, it seems to the Commission that such objection is related to

Para 8 of the application for redetermination of tariff. In this context it is to be

noted that referred regulatory asset of Rs.1763.83 crore as per order dated

24.09.2009 is net of capitalization. The Commission in its order dated 24.09.2009

admitted the expenditure of Rs.1763.83 crore after due prudence and kept the

amount as regulatory asset. In the application of tariff re-determination,

WBSEDCL has claimed to release a part of the regulatory asset. While claiming

such amount WBSEDCL has also mentioned the fact of cash outflow of

Rs.194.50 crore during 2010-11 on account of arrear payment which is a part of

the said regulatory asset of Rs. 1763.83 crore. In fact there is no additional claim

over and above the regulatory asset of Rs. 1763.83 crore.

3.1.16 In paragraph 20 of their objection HCC has submitted that DISCOM is seeking

true-up of power purchase cost from West Bengal Power Development

Corporation Limited (in short ‘WBPDCL’) in turn whose true-up for the

corresponding period has not been conducted. In this context it is to be noted

that impact of truing up under APR for any Generating Company or licensee from

where WBSEDCL is purchasing power is always considered in the APR or in

Tariff order of any future year in which payment due to such impact is given.

Moreover, power purchase cost from WBPDCL as claimed by WBSEDCL is in

accordance with Regulation 2.5.3 (vi) of the New Tariff Regulations.

3.1.17 Transmission charge to CTU.

Regarding Transmission Charge payable to CTU, HCC has raised their objection

on the ground that the claim of WBSEDCL is not backed by audited accounts

statement, financial statement as purported by the Tariff Regulation. In this

context it is mentioned that Audited Accounts is required in case of APR as per

provision of the New Tariff Regulations. Tariff for any year is being determined on

the basis of projected cost only. Thus, the CTU charges as claimed by

WBSEDCL is admitted by the Commission.

3.1.18 Interest on Working Capital

HCC has raised their objection on the ground that the claim of WBSEDCL on

account of interest on Working Capital is not backed by audited accounting

statement and has submitted that claim towards interest on Working Capital can

be allowed after completion of audit of accounting statement of WBSEDCL for

2010-11. Commission admits the same as it is always passed through APR of

the relevant year.

3.1.19 Interest on Consumer Security Deposit

HCC has submitted that WBSEDCL has not provided the figure of actual

consumer security deposit for FY 2010-11 on which interest has been claimed.

Commission agreed with the views of HCC.

3.1.20 Other issues

Other issues as raised by HCC in respect of fuel cost adjustment payable to

WBPDCL for 2008-09, amount payable as per APR 2007-08, release of withheld

amount due to non-submission of P.G.Test report of Purulia Pumped Storage

Project, presumptive gain from sale of electricity to persons other than licensee

and consumers and release of regulatory asset are dealt with in Chapter 4.

3.2 All Bengal Electricity Consumers’ Association (ABECA)

All Bengal Electricity Consumers’ Association (ABECA) has submitted their

objection and suggestions on the application submitted by WBSEDCL for re-

determination of tariff for 2010-11. The objection and suggestion submitted by

ABECA are broadly divided into two parts while in the first part some general

issues have been raised by ABECA, in the second part they have submitted point

wise suggestions/ objections.

3.2.1 In the general discussion the objector ABECA have raised their objection without

any specific reasons regarding the Aggregate Revenue Requirement (ARR)

claimed by WBSEDCL for the year 2010-11 amounting to Rs. 957148.58 lakhs

which is in excess of Rs. 9203.61 lakh over the ARR determined by the

Commission in the impugned order dated 29.07.2010 and they opposed the

same.

In this context it may mentioned that WBSEDCL has claimed expenditure under

different heads for determination of ARR on the basis of actual expenditure

incurred under some heads during the year 2010-11 in line with the direction

given by the Hon’ble Appellate Tribunal in the penultimate paragraph of their

order dated 04.04.2011. Thus the objection is not accepted.

3.2.2 In paragraph 3 of their objection, ABECA have raised their objection regarding

adjustment of 1/5 of the Regulatory Assets of Rs. 176383.00 lakh as claimed by

WBSEDCL and the existing adhoc increase of Power Purchase Cost of 78

p/kWh. In this context it is to be mentioned that additional burden of Rs.

176383.00 lakh on account of additional Employee Cost due to revision of pay

under “ROPA-2009” of WBSEDCL has been approved by the Commission vide

its order dated 24.09.2009 against the application submitted by WBSEDCL in

case no. OA-63/09-10. In absence of any appropriate reasoning from ABECA for

not allowing of such claim, the objection is not accepted by the Commission.

3.2.3 In paragraph 4 of their objection, ABECA have mentioned that WBSEDCL has

tried to justify their claim of ARR for 2010-11 and enhanced average cost of

supply at 503.41 p/kWh supported with audited report. It is stated by ABECA that

audited report is not infallible and the audited report may be accepted subject to

prudence check and the Commission in its earlier regulation mandated that

audited report of the licensee needs to have a prudence check before accepting

it. They have suggested to follow this principle in this case also. They have also

mentioned that as per the Auditor Certificate the Power Purchase Cost has been

booked by WBSEDCL for the period April 2010 to March 2011 and the same has

not been checked by the auditor with the records as available at the Corporate

Office. It is also mentioned by ABECA that WBSEDCL has purchased lesser

quantum of power than the quantum as allowed in the impugned tariff order for

2010-11 while the power purchase cost is more than what was allowed in the

impugned tariff order. ABECA has suggested to allow the power purchase cost

as allowed in the impugned tariff order for 2010-11. In this context it is to be

mentioned that WBSEDCL has claimed the expenses on account of Power

Purchase Cost on the basis of actual quantum of Power Purchase and Cost

thereof during the year 2010-11 with the certification from a Chartered

Accountant engaged by them. The Commission feels that as actual power

purchase cost is now available, thus it is prudent to pass the expenditure on

actual basis to reflect more realistic ARR subject to final scrutiny at the stage of

FPPCA on the basis of audited annual accounts.

3.2.4 ABECA have also raised their objection regarding additional expenditure of Rs.

25201.99 lakh during 2010-11 on account of FCA payable to West Bengal Power

Development Corporation Limited (in short “WBPDCL”) for the year 2008-09 as

per Commission’s order in case no. OA-95/10-11 as according to ABECA this

claim is contrary to the Act and the terms and conditions of the Tariff

Regulations. They have also mentioned that this contradicts the provisions in

section 61(4) of the Act which says that the tariff will be fixed once in a year and

if the cost of fuel and power purchase cost changes in the mid year of the tariff

fixation then that may be considered on the basis of actual in accordance with

supporting document in the next year tariff fixation. They have also stated that

this increase is for the year 2008-09 and should be considered in the tariff

determination of 2009-10. They have suggested for not taking into account this

expenditure in the tariff determination for the year 2010-11. In this regard it is

mentioned that there is no such section 61(4) in the Act as mentioned by

ABECA. However, the FCA for the year 2008-09 in respect of the power stations

of WBPDCL has been determined by the Commission vide its order dated

01.06.2010 on the basis of application submitted by WBPDCL as per their

audited accounts as per provision made, in the Tariff Regulations then in force, in

accordance with the provision of section 62(4) of the Act, 2003. The Commission

in its order dated 16.07.2010 read with corrigendum dated 27.07.2010 in case

no. OA-95/10-11 has admitted this amount of Rs. 25201.99 lakh on account of

FCA of WBPDCL of 2008-09 and payable by WBSEDCL during the year 2010-11

as an additional expenditure of WBSEDCL during the year 2010-11 and decided

to include this amount in the ARR of WBSEDCL for the year 2010-11. WBSEDCL

have also claimed this amount in line with the direction given by the Hon’ble

Appellate Tribunal in the penultimate paragraph of the order dated 04.04.2011.

3.2.5 In paragraph 3 of point wise suggestion and objection, ABECA have mentioned

that in the Tariff Order for 2009-10 the Commission admitted Rs. 14000.00 lakh

for the year 2010-11 on account of transmission charge payable to CTU but as

per the audited report this comes to Rs. 11621.56 lakh and accordingly

WBSEDCL has claimed Rs. 11621.56 lakh under the head of CTU charge.

ABECA has mentioned that the projection made by WBSEDCL of Rs. 14000.00

lakh was not proper and they suggested to consider the charges paid to CTU on

the basis of production of payment documents after proper verification of such

documents. In this context it is mentioned that determination of tariff for any year

has been done on the basis of projection of expenditure given by the licensee

under different heads. There is a provision in the New Tariff Regulations for

truing up of the expenditure through APR of the concerned year on the basis of

the audited accounts. So any difference in projection and actual expenditure

under this head will be adjusted in the APR for the concerned year. If the CTU

charges are allowed on the basis of submission of payment documents by

WBSEDCL and not any amount is allowed at this stage at all then WBSEDCL

may have to take loan to make the payment in time and the interest on this score

is to be borne by the consumer which will be extra burden to the consumer. Thus

the claim of WBSEDCL on actual CTU charges is admitted by the Commission

which is less than their projected amount in the tariff application for first ensuing

year of the control period.

3.2.6 In paragraph 4 of the point wise suggestion and objection ABECA have opposed

without any appropriate reason the additional claim of Rs. 3885.91 lakh on

account of STU charges. In this context it may be mentioned that the

Commission has allowed the STU charges of Rs. 65938.66 lakh to be recovered

by WBSETCL in the tariff order of WBSETCL for 2010-11. The expenditure on

account of STU charge as allowed in the ARR of WBSEDCL for the year 2010-11

in the tariff order for 2008-09 was Rs. 62052.75 lakh. So WBSEDCL had to pay

Rs. 3885.91 lakh (Rs.65938.66 lakh - Rs. 62052.75 lakh) extra during the year

2010-11 and WBSEDCL has claimed the same. In this regard WBSEDCL has

also submitted a statement with a certificate from a Chartered Accountant

engaged by them. However, such claim will be subject to truing up during APR of

2010-11.

3.2.7 At paragraph 5 of their point wise suggestion and objection on employee cost

ABECA has mentioned that WBSEDCL in their petition made additional claim of

Rs. 32349.17 lakh on account of employee cost on the plea stated in the

application. ABECA have stated that it is revealed from the impugned order of

WBERC in respect of WBSEDCL for the year 2010-11 that WBEDCL had made

an application dated 20.03.2010 registered in case no OA-73/09-10 stating

therein that WBSEDCL had revised the pay and allowances of the employees

including retired employees with effect from 1st January, 2006 and the

Commission felt it necessary to revise the employee cost in said impugned order

to Rs. 79795.42 lakh from 53195.42 lakh as admitted earlier. Now WBSEDL has

claimed additional employee cost of Rs. 32349.17 lakh in the application dated

06.05.2011 for re-determination of tariff of WBSEDCL for 2010-11. ABECA has

also objected that no paper notification was made for that application. ABECA

has also raised their objection wanting to know how many times WBSEDCL

would enhance their employee cost in a financial year. In this context it is to be

mentioned that WBSEDCL had made their application on 20.03.2010 for

enhanced employee cost on the basis of projection. Now WBSEDCL in their

application dated 06.05.2011 for re-determination of tariff for 2010-11 have

claimed the actual employee cost with a certificate from a Chartered Accountant

engaged by them for the purpose. They have also mentioned in the said

application not to consider the employee cost of Rs. 79795.42 lakh claimed

earlier in their application dated 21.03.2010 and admitted in the order dated

30.06.2010 in case no OA-73/09-10 which was on projection basis. The objection

raised by ABECA has not been considered as WBSEDCL has already mentioned

in their application not to consider the amount of employee cost as admitted in

the order in case no OA-73/09-10.

3.2.8 At paragraph 6 of their point wise suggestion and objection ABECA have raised

their objection on the interest on working capital for the year 2010-11 as claimed

by WBSEDCL. The Commission has accepted it at this stage and will consider

the same in the APR for 2010-11 as per provision of the New Tariff Regulations.

3.2.9 In paragraph 8 of their point wise suggestion and objection ABECA have

mentioned that the revenue from sale of power to licensee and Government of

Sikkim during the year 2010-11 for an amount of Rs. 71450.79 lakh as projected

and claimed by WBSEDCL in their application are as per audited report which is

to be considered in the ARR of WBSEDCL for 2010-11 instead of the amount of

Rs.58963.30 lakh as considered earlier in the ARR of WBSEDCL for 2010-11 in

the Tariff Order for 2008-09. The Commission considers the same.

3.2.10 In paragraph 9 of their point wise suggestion and objection ABECA have raised

their objection on the issues regarding the expenses for sale to persons other

than licensee and consumers during the year 2010-11 and have suggested to

consider the same for an amount of Rs, 109611.53 lakh as considered earlier in

determination of ARR for 2010-11 in the Tariff Order for 2008-09. WBSEDCL has

submitted their claim under this head for an amount of Rs. 59416.92 lakh on the

basis of actual sale to persons other than licensee and consumers as per audited

data. The Commission considers the same computed as per claims supported by

certificate of Chartered Accountant.

3.2.11 In paragraph 10 of their point wise suggestion and objection ABECA have raised

their objection on the issues regarding the revenue from sale of power to persons

other than licensee and consumers during the year 2010-11 and the benefit to be

passed on to the consumers on this account. They have suggested to consider

the gain from sale as Rs. 15806.74 lakh as considered earlier for 2010-11 in the

Tariff Order for 2008-09 whereas WBSEDCL has submitted to consider the gain

of Rs. 9178.00 lakh on the basis of actual sale to persons other than licensee

and consumers supported with certificate of Chartered Accountant. The

Commission considers such gain computed as per such data.

3.2.12 ABECA has also opposed the positive adjustment of entire amount of Rs.

12723.77 lakh with the ARR for the year 2010-11 as this is related to APR for

2007-08 and to be adjusted in the tariff order for 2009-10. In the tariff order for

2009-10 the amount was not considered by the Commission and kept as

Regulatory Assets to contain the tariff at a reasonable level and the same is to be

passed on to the tariff in future year as per provision of the Tariff Regulations. So

this Regulatory Asset is required to be released in the tariff order for 2010-11.

ABECA has also opposed that the APR order for 2007-08 was issued without

publishing notice and without public hearing. The APR order for 2007-08 was

issued on 28.05.2009 as per provision of the then prevailing regulation of the

Commission without any challenge at any stage.

3.2.13 In paragraph 12 of their point wise suggestion and objection ABECA have raised

their objection regarding the claim of WBSEDCL for release of 1/5th of the

regulatory asset of Rs.176383.00 lakh created in the order dated 24.09.2009 in

case No OA-63/09-10 and suggested for resubmission of copies of all relevant

documents by WBSEDCL with the APR application for 2008-09. In this regard it

is to be mentioned that a copy of the APR application of WBSEDCL for 2008-09

along with the copy of the petition for approval of additional amount in employee

cost due to revision of pay of the employees of WBSEDCL as per ROPA, 2009

along with the relevant documents as suggested by ABECA was annexed with

the instant application for re-determination of tariff for 2010-11 submitted by

WBSEDCL. Thus they have already had access to it. In view of such the

objections of ABECA could not be accepted.

3.2.14 ABECA has also raised their objection regarding actual distribution loss of

25.24% as stated by WBSEDCL and suggested to consider the power purchase

cost on the basis of 10% distribution loss. The year wise normative distribution

loss has been specified in the old Tariff Regulation and New Tariff Regulations.

Commission will consider the normative distribution loss as per those regulations

while determining the allowable power purchase cost of WBSEDCL for the year

2010-11 in the subsequent chapter.

3.2.15 ABECA has also raised their objection on the expenditure claimed by WBSEDCL

on other heads like bad debts, reserve for unforeseen exigencies, special

allocation , cost of outsourcing and interest on loan. The Commission will decide

those as per provisions of the relevant regulation while determining the expenses

under different heads in subsequent chapter.

3.2.16 ABECA has also raised their objection regarding adhoc power purchase cost of

78 paise per kwh which is not a subject matter of this petition.

3.3 West Bengal Cold Storage Association

West Bengal Cold Storage Association has made their objections and

suggestions regarding the tariff for cold storage. They have mentioned that uses

of electricity in Cold Storages are varying in nature in different parts of the year.

They have suggested to give seasonal effect in their tariff. Such seasonal

variation is already protected by :

I) Energy charge on drawal basis

II) Opportunity of contract demand reduction once in a year

The Association also raised their objections on the high distribution loss

experienced by WBSEDCL and suggested for examination of the same while

fixing tariff in respect of the consumers of WBSEDCL. The Association has also

suggested to consider the issue of giving Load Factor rebate and Power Factor

rebate for Cold Storages. The Association also suggested giving effect of the re-

determined tariff from a prospective date. It is to be noted that excess power

purchase cost on account of distribution loss over and above the normative

distribution loss have not been considered for ARR re-determination. As it is re-

determination of tariff for the year 2010-11 and that to when the year 2010-11 is

over giving effect from prospective date for the year is not possible.

3.4 Eastern Railways

Eastern Railways has submitted their suggestions and objection mainly on the

rise in their tariff for Traction purpose. They have suggested not to increase the

tariff for traction purpose. They have also suggested for waiver of demand

charges for traction purpose. In this context, the Commission will consider the

provisions of National Tariff Policy while fixing the tariff for different classes of

consumers in subsequent chapter. The Commission also feels that if there is

increase in input cost of distribution licensee, then retail tariff at consumer end is

bound to increase.

3.5 While dealing with all the above observations of different stake-holders, the

Commission has kept in mind that revision of tariff appropriately is required in the

interest of improving the financial health and long term viability of electricity

sector in general and distribution utilities in particular, as has been observed by

the Hon’ble Appellate Tribunal for Electricity in their order dated 11.11.2011 in

OP No 1 of 2011.

In the context of above background the Commission has noted that already a

considerable amount of expenditure incurred by WBSEDCL has yet not been

passed through tariff for which some expenditure has already been admitted in

the Tariff Order and some expenditure is under scrutiny against different

applications. The amount of such expenditure as claimed stands as under:

a) Annual Performance Review for the year 2009-10 where the recoverable

amount of fixed charge, as claimed by WBSEDCL is Rs. 40765.89 lakh,

order on which is under process. Besides, the additional recoverable

amount on account of Fuel and Power Purchase Cost Adjustment

(FPPCA) for 2009-10 as per FPPCA order for 2009-10 as claimed by

WBSEDCL is Rs 39419.18 lakh.

b) Annual Performance Review for the year 2007-08 where the admitted net

recoverable amount is Rs. 12723.77 lakh.

c) The enhanced cost of power purchase and other expenditure on above

as claimed in the application for re-determination of tariff.

If those amounts are not released, as may be determined against the above

claim, by the Commission, it will adversely affect the health of WBSEDCL and in

turn it will affect the interest of the consumers.

CHAPTER – 4 SUMMARISED STATEMENT OF AGGREGATE REVENUE

REQUIREMENT & REVENUE RECOVERABLE THROUGH TARIFF FOR THE YEAR 2010 – 2011

4.1 As stated in the preceding chapters, the Commission determined the ARR of

WBSEDCL separately for each of the three years of the second control period

covering the years 2008 – 2009, 2009 – 2010 and 2010 – 2011 in the tariff order

for 2008 – 2009 based on the analyses and findings recorded in that order. Such

summarized statement of ARR for 2010 – 2011 is given in Annexure-4A.

4.2 Revision of the ARR for the year 2010 – 2011:

4.2.1 In terms of regulation 2.1.13 and 2.5.3 of the New Tariff Regulations, the

amounts of ARR of WBSEDCL, as were determined and shown for the ensuing

year 2010 – 2011 on Annexure-4A in the tariff order of 2008-09 under Multi Year

Tariff approach require to be re-determined on the basis of the application and

submitted claim of WBSEDCL in pursuance of the order dated 04.04.2011 of the

Hon’ble Appellate Tribunal to the extent it is found acceptable to the Commission

after taking into consideration the objections and suggestions as submitted by

different stake holders against the tariff re-determination application submitted

by WBSEDCL in terms of the Hon’ble Appellate Tribunal’s order dated

04.04.2011.

4.2.1.1 Fuel cost

In the tariff order of WBSEDCL for 2008 – 2009 Commission allowed an amount

of Rs. 122.84 lakh as fuel cost for the year 2010-11 for its Diesel generating

stations at Rudranagar. WBSEDCL has now submitted that actual fuel cost

during the year 2010-11 is Rs. 113.87 lakh. Commission considers the same in

terms of regulation 2.5.3 of the New Tariff Regulations.

4.2.1.2 Power purchase cost :

The regulation 2.1.13 of the New Tariff Regulations provides that, in case re-

determination of tariff due to order of Court of Law is to be undertaken by the

Commission and the concerned ensuing year for which tariff is to be re-

determined is already passed over, then the Commission may ask the licensee

or generating company to resubmit the updated expenditures on different heads

of uncontrollable ARR item, so that tariff can be re-determined with better

accuracy to reduce the impact of FPPCA and APR of the ensuing year in future

tariff.

The regulation 2.5.3 of the New Tariff Regulations also provides that in case fuel

price or power purchase cost considered during ARR determination differs

significantly from the prevailing fuel price during the determination of tariff of any

ensuing year, the Commission may change the ARR accordingly as deemed fit

on that account of fuel price and its consequential impact on power purchase

cost as was considered while determining ARR for the ensuing years concerned.

The Commission allowed Rs. 556921.38 lakhs against purchase of 31890.79 MU

of energy for the year 2010-11 in the tariff order for 2008-09 i.e the tariff order for

the first year of the second control period. In their application for re-determination

of tariff for 2010-11 WBSEDCL has stated that the actual power purchase cost

during the year 2010-11 is Rs. 720161.34 lakh against purchase of 29281.64 MU

of energy. This means per unit power purchase cost may increase substantially

from 174.63 Paise/Unit to 245.94 Paise/Unit, i.e., 40.83%. WBSEDCL has

submitted a certificate from a Chartered Accountant engaged by them showing

the agency wise power purchased during the year 2010-11 and the cost thereof.

The power purchase cost as mentioned by WBSEDCL includes the cost of power

drawn through unscheduled interchange (UI). Out of such energy purchased

during the year 2010-11, total 26171.07 MU were sourced from the agencies

generating power from coal. The prices of different grades of coal increased

considerably after the determination of ARR for WBSEDCL for the year 2010 –

2011 in the tariff order for 2008-09 i.e the tariff order for the first year of the

second control period and WBSEDCL had to pay the additional cost due to

increased fuel cost to those agencies during the year through fuel cost

adjustment by those agencies as per the fuel surcharge formula applicable for

the respective generating stations. The Commission thus admits the power

purchase cost submitted by WBSEDCL for the year 2010-11 for re-determination

of the ARR for 2010-11 vide regulation 2.5.3.(vi) and regulation 2.1.13 of the New

Tariff Regulations against the claim in the application for re-determination of

tariff. However, this power purchase cost will be reconciled with the data to be

submitted by WBSEDCL supported by audited annual accounts in their FPPCA

application for 2010-11.

4.2.1.3 Transmission Charges paid to CTU

The fixed charges totaling to an amount of Rs. 11621.56 lakh was paid by

WBSEDCL to Power Grid Corporation of India Limited (in short ‘PGCIL’), which

is the Central Transmission Utility (in short “CTU”) for the year 2010-11.

WBSEDCL has claimed this amount in their application for re-determination of

tariff for the year 2010-11.

In their application for determination of tariff for the second control period,

WBSEDCL had projected that it would have to pay to CTU Rs. 12000.00 lakh,

Rs. 13000.00 lakh and Rs. 14000.00 lakh in the years 2008-09, 2009-10 and

2010-11 respectively towards transmission charges to receive the allocated

share of power from the Central Sector Power Utilities during those years. It has

however, come to the notice of the Commission that during determination of ARR

of WBSEDCL for the years 2008-09, 2009-10 and 2010-11 inadvertently the

aforesaid charges were not considered by the Commission and therefore not

included in the ARR of WBSEDCL for those years. The Commission considers

the entire amount of Rs. 11621.56 lakh paid by WBSEDCL to CTU during the

year 2010-11, as claimed by WBSEDCL in their application, in the ARR for 2010-

11 in terms of regulation 2.5.3(v) and 2.1.13 of the New Tariff Regulations.

4.2.1.4 Transmission charges paid to STU

The Commission considered an amount of Rs. 62052.75 lakh under the head

transmission charge to STU (State Transmission Utility ) in the ARR for 2010-11

in the tariff order for 2008-09. The transmission charge to STU for the year was

considered in accordance with the tariff order of West Bengal State Transmission

Company Limited (in short “WBSETCL”) functioning as State Transmission Utility

(STU). In the tariff order of WBSETCL for the year 2010-11, the Commission

revised the transmission charge to be recovered by WBSETCL during the year

2010-11 at Rs. 67284.35 lakh and WBSEDCL paid the transmission charges to

WBSETCL during the year 2010-11 accordingly. WBSEDCL paid Rs. 65938.66

lakh (net of rebate allowed for timely payment) to WBSETCL, the STU during the

year 2010-11. In support of their claim WBSEDCL has submitted a certificate

from the Chartered Account engaged by them. The Commission considers this

amount of Rs. 65938.66 lakh under the head transmission charge to STU, an

uncontrollable item, in the ARR of WBSEDCL for the year 2010-11 in terms of

regulation 2.1.13 of the New Tariff Regulations.

4.2.1.5 Employee Cost :

4.2.1.5.1 In the tariff order for 2008-09 i.e the tariff order for the first year of the second

control period the Commission considered the employee cost at Rs. 53195.42

laks in the ARR for the year 2010-11. Now WBSEDCL has submitted in their

application for re-determination of tariff for 2010-11 that the employee cost for the

year 2010-11 is Rs. 85544.59 lakh which includes terminal benefit expenses after

net of capitalization. In support of their claim WBSEDCL has submitted a

certificate from a Chartered Account engaged by them for this purpose.

4.2.1.5.2 WBSEDCL in their application dated 09.09.2009 registered in case no OA-63/09-

10 has submitted that the pay allowances including Gratuity and LTA of all the

employees including retired employees of WBSEDCL are revised as per West

Bengal State Electricity Distribution Company Limited “ Revision of Pay and

Allowances Rules, 2009” ( in short ‘ROPA 2009’) notified on 16.02.2009. The

increase in employees cost during the year 2010-11 over what was admitted in

the ARR for 2010-11 in the tariff order for 2008-09 is due to revision of pay and

allowances of the employees of WBSEDCL including the retired employees as

per ROPA 2009.

4.2.1.5.3 The Commission considers the amount of Rs. 85544.59 lakh as claimed by

WBSEDCL under the head of employee cost in determination of ARR for 2010-

11 in terms of regulation 2.5.3 (x) and 2.1.13 of the New Tariff Regulations.

4.2.1.5.4 WBSEDCL has not submitted the segregation of the employee cost for

generation and distribution activity. The admitted employee cost has been

allocated for generation and distribution in the same proportion as admitted in

the ARR for 2010-11 determined in the tariff order for 2008-09.

4.2.1.6 Interest on loan

The Commission admitted Rs. 31348.19 lakh (net of capitalization) under the

head ‘Interest on loan‘ for borrowed capital for the year 2010-11 in the tariff order

for 2008-09. WBSEDCL has now claimed that the actual interest on loan for

borrowed capital during the year 2010-11 comes down to Rs. 25690.71 lakh after

capitalization. In support of their claim WBSEDCL has submitted a certificate

from a Chartered Account engaged by them for this purpose. The Commission

consider the amount of Rs. 25690.71 lakh as claimed by WBSEDCL under the

head ‘Interest on loan‘, which is a uncontrollable item, in the ARR for 2010-11 in

terms of regulation 2.1.13 of the New Tariff Regulations.

4.2.1.7 Other Finance Charges :

The Commission admitted Rs. 1140.00 lakh under the head ‘Other Finance

Charges‘ in the ARR for 2010-11 in the tariff order for 2008-09. WBSEDCL has

now claimed that the actual expenditure under this head during the year 2010-11

comes down to Rs. 569.78 lakhs. In support of their claim WBSEDCL has

submitted a certificate from a Chartered Account engaged by them for this

purpose. The Commission considers the amount of Rs. 569.78 lakh as claimed

by WBSEDCL under the head ‘Other Finance Charges‘, which is a uncontrollable

item, in the ARR for 2010-11 in terms of regulation 2.1.13 of the New Tariff

Regulations.

4.2.1.8 Interest on consumer Security Deposit :

The Commission admitted Rs.5594.00 lakh under the head ‘Interest on

consumer Security Deposit’ in the ARR for 2010-11 in the tariff order for 2008-09.

WBSEDCL has now claimed that the actual expenditure under this head during

the year 2010-11 comes down to Rs. 2392.03 lakhs. In support of their claim

WBSEDCL has submitted a certificate from a Chartered Account engaged by

them for this purpose. The Commission consider the amount of Rs. 2392.03 lakh

as claimed by WBSEDCL under the head ‘Interest on consumer Security

Deposit‘, which is a uncontrollable item, in the ARR for 2010-11 in terms of

regulation 2.1.13 of the New Tariff Regulations.

4.2.1.9 Interest on consumer Security Deposit :

In the tariff order for 2008-09, the Commission did not considered any

expenditure for the year 2010-11 under the head ‘ Interest on working capital’

since there was no expenditure under that head during the previous years.

WBSEDCL has now claimed an expenditure of Rs. 2436.07 lakh under this head

during the year 2010-11. In support of their claim WBSEDCL has submitted a

certificate from a Chartered Account engaged by them for this purpose. Since no

amount was admitted under this head in the ARR for 2010-11 in the tariff order

for 2008-09, the Commission does not consider any amount under the head

‘Interest on working capital’ in this order in determination of ARR for the year

2010-11. However, WBSEDCL may claim the actual expenditure incurred by

them under this head with audited accounts data in their APR application for the

year 2010-11.

4.2.1.10 Expenditure on other heads

The Commission considers the expenditures on other heads as admitted in the

ARR for 2010-11 in the tariff order for 2008-09.

4.2.1.11 Income from investment and income from non-tariff income :

Income from investment and income from non-tariff income have been

considered as admitted in the ARR for 2010-11 in the first year tariff order for

2008-09 and the same are deducted from the Gross ARR to arrive at the Net

ARR.

4.2.1.12 Receipt from UI charges :

In the ARR for 2010-11 in the first year tariff order for 2008-09 no amount was

considered to be receivable from Unscheduled Interchange (UI). No projection

can be made for UI receivables as it occurs depending on the real time

operation. It is submitted by WBSEDCL in their application that an amount of Rs.

15561.39 lakh has been received by them against UI receivable during the year

2010-11. The Commission considers the entire amount to be passed on to the

consumers and the same is to be deducted from the Gross ARR to arrive at the

Net ARR in accordance with the regulation 2.1.13 of the New Tariff Regulations.

4.2.1.13 Adjustments relating to expenses for sale to persons other than

Consumers and Licensees:

As per the energy balance for the year 2010–11 as admitted in the tariff order for

2008-09, vide paragraph 5.3 of the Commission’s Order dated 30 September,

2008 in Case No. TP-41/08-09, WBSEDCL is to sell 6270.96 MU of power to

persons other than consumers and licensees. The expenses for such sale were

deducted from the gross ARR of WBSEDCL. WBSEDCL has submitted a

statement of technical particulars certified by a Chartered Account engaged by

them which shows that 1207.329 MU has been sold to persons other than

consumers and licensees during the year 2010-11. Since cost of power

purchase and the quantum of energy sold to persons other than consumers and

licensees has been changed, expenses for sale to persons other than

consumers and licensees to be deducted from gross ARR is also revised and

works out at Rs. 59416.92 lakh. Commission considers the same for adjustment

under the head ‘Expenses for sale to persons other than Consumers and

Licensees’ in pursuance to regulation 2.1.13 of the New Tariff Regulations.

4.2.1.14 Sharing of Benefits from sale to persons other than own consumers and

licensees of the Commission

In the first year tariff order for 2008-09, the Commission considered the amount

of share of presumptive gain from sale to person other than consumer and

licensee during the year 2010-11 at Rs. 15806.74 lakh against 6270.96 MU of

energy sold to such persons and kept as Regulatory Asset to maintain the tariff

at a reasonable level. The Commission also mentioned that liability of sharing

such gain with the consumers on the basis of actuals as per audited data would

be taken up at the time of APR for the concerned year. WBSEDCL has

submitted with a computation sheet showing the actual share of gain from sale

to persons other than consumer and licensee during the year 2010-11.

WBSEDCL has also submitted a certificate from a Chartered Account engaged

by them regarding the quantum of sale to persons other than consumer and

licensee and revenue earned therefrom. The share of gain to be passed on to

the consumers from such sale is computed below :

The amount of share of gain comes to Rs. 9178.07 lakh. The Commission

decides to consider for adjustment of this amount as share of gain to the

consumer instead of creating the Regulatory Asset in the ARR for 2010-11. This

is done in accordance with regulation 2.1.13 of the New Tariff Regulations.

4.2.1.15 Payments towards FPPCA to be made to WBPDCL:

An amount of Rs. 25201.99 lakh was found payable by WBSEDCL to WBPDCL

towards Fuel and Power Purchase Cost Adjustment (in short “FPPCA”) for the

year 2008 – 2009 in terms of Commission’s order dated 1 June, 2010 in Case

No. FPPCA-42/09-10. As this amount requires to be paid to WBPDCL in

installments during 2010 – 2011, the amount has been included in the ARR of

WBSEDCL for 2010-11 in terms of order dated 16 July, 2010 of the Commission

read with the Corrigendum dated 27 July, 2010 in Case No. OA-95/10-11.

4.2.1.16 Release of Amount withheld for Non-Submission of P.G. Test Reports:

The amount of Rs. 4392.85 lakh, Rs. 4589.76 lakh and Rs. 4645.71 lakh were

withheld from the ARRs for the year 2008 – 2009, 2009 – 2010 and 2010 – 2011

respectively for non-submission of Performance Guarantee Test Reports (P.G.

Test Reports) in regard to Purulia Pumped Storage Project. Since such reports

were subsequently submitted, amount of Rs. 4392.85 lakh withheld in the ARR

for 2008-09 was released through APR for the year 2008 – 2009. Hence no

amount on this score is being withheld in the ARR for 2010-11. The amount of

Rs. 4589.76 lakh pertaining to the year 2009 – 2010 is also being released in the

ARR for the year 2010 – 2011 in terms of regulation 2.5.3(iv) of the New Tariff

Regulations.

4.2.1.17 The actual distribution loss experienced by WBSEDCL during 2010-11 is

25.24%. WBSEDCL has stated that excess power purchase due to higher level

of distribution loss is to be disallowed and they have deducted Rs. 54778.98 lakh

from the Gross ARR for 2010-11 to arrive at the revenue to be recovered from

own consumer and licensee.

4.2.1.18 WBSEDCL utilized Rs. 3498.00 lakh from the Power Purchaser Fund to meet a

portion of its increased cost of power purchase due to increase in power

purchase price. The amount of Rs. 3498.00 lakh is being deducted from the

gross ARR of WBSEDCL as that amount was available from the Power

Purchaser Fund. WBSEDCL is directed to submit the account of Power

Purchaser Fund duly audited along with the APR application for 2010-11.

4.2.1.19 The withheld amount of Rs. 100.00 lakh on account of non compliance of safety

audit and interest credit of Rs. 1824.00 lakh as considered and deducted from

the gross ARR for 2010-11 in the tariff order for 2008-09 are also considered to

be deducted from the gross ARR of 2010-11 in this order.

4.3 A revised statement of ARR for 2010-11 after giving effect of the adjustment as

stated in paragraph 4.2 is given in Annexure – 4B.

4.4 In terms of the New Tariff Regulations, the Commission is to ascertain the amount

of revenue recoverable through tariff by WBSEDCL for the year 2010 – 2011 after

carrying out, at its discretion, any positive or negative adjustment of the

recoverable or refundable amount determined in APR for the year 2008 – 2009

taking into consideration the admissible variable costs determined in FPPCA,

admissible fixed costs determined in APR and the revenue realized by WBSEDCL

by selling electricity to its consumers and other licensees during that year with the

ARR of WBSEDCL for 2010 - 2011. The Commission in its order dated 26 July,

2010 in Case No. APR-16/09-10 has determined in the APR of WBSEDCL for

2008 – 2009 the net amount of Rs. 164403.86 lakh recoverable by WBSEDCL

from its consumers and other licensees for 2008 – 2009 after taking into

consideration the admissible variable costs (determined in FPPCA vide

Commission’s Order dated 30 June, 2010 in Case No. FPPCA-38/09-10), the

admissible fixed costs (determined in APR vide Commission’s Order dated 26

July, 2010 in Case No. APR-16/09-10) and the revenue realized by WBSEDCL by

selling electricity to its consumers and other licensees during that year. It is

revealed from the annual accounts for the year 2009-10 submitted by WBSEDCL

in the APR for 2009-10 that WBSEDCL has incurred only Rs. 18800.00 lakh

during the year 2009-10 on account of 50% of Arrear pay. The Commission

decides to make positive adjustment of Rs.18800.00 lakh from the net

recoverable amount of Rs. 164403.86 lakh, determined in APR for 2008 – 2009,

with the revised ARR of WBSEDCL for 2010 – 2011 to determine the revenue

recoverable through tariff by WBSEDCL for the year 2010 – 2011 and to keep the

balance amount of Rs. 145603.86 lakh as regulatory asset to contain abnormal

tariff hike. WBSEDCL is directed to submit the actual amount paid by them on

account of arrear pay during the years 2009-10 and 2010-11 with audited

accounts data. The Commission will re-assess the actual receivables on such

head of arrear pay on receipt of such information. Accordingly, balance regulatory

asset so assessed will be released in subsequent year / years in instalments or

otherwise as may be decided by the Commission.

4.5 An amount of Rs. 12723.77 lakh was found recoverable by WBSEDCL from its

own consumers and other licensees in APR for the year 2007 – 2008 in terms of

Commission’s order dated 28 May, 2009 in Case No. APR-11/08-09. The said

amount of Rs. 12723.77 lakh was kept as regulatory asset by the Commission in

the Tariff Order for 2009-10 of WBSEDCL and was not passed on to WBSEDCL

for recovery during the year 2009-10. The Commission now decides to release

that amount in full and to consider the same to arrive at the amount to be

recovered through tariff for the year 2010-11, since the Commission has decided

to make a fresh regulatory asset of Rs. 145603.86 lakh this year as mentioned in

paragraph 4.4 above to contain the abnormal tariff hike.

4.6 Accordingly, the revenue recoverable through tariff, capacity charge and fixed

charge of WBSEDCL for the year 2010 – 2011 work out as under:-

4.7 The Commission has also worked out the average tariff for the consumers of

WBSEDCL for 2010 – 2011 and the same is shown in the table below:

CHAPTER – 5 TARIFF ORDER

5.1 In the previous chapter, the Commission has determined for WBSEDCL the revenue

recoverable through tariff during 2010 – 2011 and the average tariff for the consumers

of WBSEDCL for 2010 – 2011 as well. The Commission now proceeds to determine

the tariff schedule applicable to the consumers of WBSEDCL and also the associated

conditions of tariff of WBSEDCL for 2010 – 2011. The Commission is passing other

orders also as mentioned in subsequent paragraphs.

5.2 The tariff schedule as applicable to the consumers of WBSEDCL in the year 2010 –

2011 is given at Annexure – 5A1 for LV and MV consumers under quarterly billing

cycle, at Annexure – 5A2 for LV and MV consumers under monthly billing cycle and at

Annexure – 5A3 for HV and EHV consumers. Details of different tariff schemes of

different classes of consumers and various associated terms and conditions are

specified in various regulations and in Annexure – C1 and Annexure – C2 of the New

Tariff Regulations. Other associated conditions of tariff of WBSEDCL for 2010 – 2011

shall be as follows:

5.2.1 Load Factor Rebate/ Surcharge:

5.2.1.1 In order to reduce the overall system T&D loss and to flatten the load curve by

improving the existing system load factor of WBSEDCL, the voltage-wise graded load

factor rebate applicable for the EHV and HV industrial consumers and L&MV industrial

consumer under rate (B-ID) will be as per the following table:

5.2.1.2 The above load factor rebate shall be applicable on total quantum of energy

consumed in the billing period. (For example a 33 kV industrial consumer at 85% load

factor shall be eligible for a rebate @ 35 paise / kWh on the total quantum of energy

consumed in the billing period).

5.2.1.3 Load factor surcharge shall continue at the prevailing rate for those categories of

consumers to whom these are applicable at present. In addition, load factor surcharge

shall be applicable to the industrial consumers under Rate B-ID at the same rates.

5.2.1.4 Load factor rebate and load factor surcharge shall be computed in accordance with

the formula and associated principles given in regulations 3.9.2, 3.9.3 and 3.9.4 of the

New Tariff Regulations and at the rates mentioned in paragraphs 5.2.1.1 and 5.2.1.3

above.

5.2.2 Fixed / Demand Charge:

5.2.2.1 The fixed charge shall be applicable to those categories of consumers as specified in

regulation 4.2.1 of the New Tariff Regulations at the rates as shown in Annexure 5A1

and Annexure 5A2 of this tariff order subject to the conditions as specified in the New

Tariff Regulations including regulation 4.2.4 ibid.

5.2.2.2 The demand charge shall be applicable to those categories of consumers as

specified in regulation 4.3.1 of the New Tariff Regulation as per rates as shown in

Annexure – 5A1, Annexure – 5A2 and Annexure - 5A3 of this order on the basis of

recorded demand as specified in regulation 4.3.3 ibid subject to the conditions as

specified in the New Tariff Regulations. Such demand charge shall be levied as per

relevant provisions of regulations 4.3.5, 4.3.6, 4.4, 4.5, 4.6.1, 4.7, 4.7.1, 4.7.2, 4.7.3,

4.8, 4.9, 4.10 and 4.11 of the New Tariff Regulations.

5.2.3 Subject to the condition as specified in regulation 4.13 of the New Tariff Regulations,

the minimum charge shall continue at the existing level for all consumers

5.2.4 The rate of energy charge applicable for temporary supply related to events, festivals,

marriage ceremony, etc. shall be at the highest rate of supply under non-TOD tariff

scheme applicable to that particular category of consumers to which the applicant

seeking such supply belongs. For such temporary supply, the fixed / demand charge

shall be the fixed / demand charge under non-TOD tariff applicable to that particular

category of consumers to which the applicant seeking such supply belongs. Such

temporary supply shall not have any load factor rebate and power factor rebate and

shall not be entitled to TOD tariff. However, other charges for such temporary supply

shall be the same as are applicable to that particular category of consumers to which

the applicant seeking such temporary supply belongs. If there is no appropriate rate

given in the tariff schedule for such temporary supply, the rate for such temporary

supply shall be @ Rs.6.00/kWh. For such temporary supply, the applicant shall apply

to the licensee at least 10 days in advance.

5.2.5 Rebate for Cold Storage or dairy with chilling plant shall be 3% of the energy charge

provided the payment is made within the due date.

5.2.6 For street lighting and public water works, a rebate of 15 paise/KWh on energy

charge will be given if the payment is made within the due date in case of normal or

normal-TOD meter only. It will not apply to such supply having pre-paid meter.

5.2.7 For all consumers, excluding those covered by paragraphs 5.2.5 and 5.2.6 above

or consumers having pre-paid meters, rebate shall be given @ 2% of the amount of

the bill excluding meter rent, taxes, duties, levies and arrears (not being the arrears

due to revision of tariff) if the payment is made within the due date.

5.2.8 For industrial supply, rebate for 33 KV and 66 KV supply shall be 1% of the energy

charge and the rebate for 132 KV supply shall be 4% of the energy charge. This

rebate will be given before giving effect to rebate mentioned in paragraph 5.2.7.

5.2.9 Additional rebate of 15 paise per kWh on energy charge shall be allowed to an EHV

industrial consumer whose contract demand is 25 MVA or above and whose load

factor is not less than 75% in the billing period and whose recorded maximum

demand during the billing period is not less than 80% of the contract demand subject

to the condition that the payment is made within the due date. This rebate is in

addition to the rebates under paragraphs 5.2.1, 5.2.7 and 5.2.8. This rebate will be

given effect after giving effect to rebates mentioned in paragraphs 5.2.7 and 5.2.8.

5.2.10 Additional rebate of 5 paise per unit on energy charge shall be given to domestic and

commercial consumers under LV and MV categories covered by quarterly billing

cycle under normal or normal-TOD tariff scheme if the payment is made for the

quarter at a time within the due date stipulated for the first month of the quarter. This

rebate shall be in addition to rebate under paragraph 5.2.7 for normal meter or

normal TOD meter and will be given effect after giving effect to rebate under

paragraph 5.2.7.

5.2.11 Un-metered agricultural / irrigation consumers may make monthly payment for which

they shall be entitled to 2% rebate for timely payment within the due date in line with

the consumers of other categories as mentioned in paragraph 5.2.7. In case,

however, such agricultural/ irrigation consumers opt for advance payment of the full

annual amount, the consumers shall be allowed a rebate of 5% in addition to 2%

rebate mentioned in paragraph 5.2.7 and this additional rebate of 5% shall be given

effect after giving effect to rebate under paragraph 5.2.7.

5.2.12 Power Factor Rebate/ Surcharge:

5.2.12.1 The power factor rebate and surcharge shall continue for those categories of

consumers to whom these are applicable at present. In addition, power factor rebate

and surcharge shall be applicable to the industrial consumers under Rate-B-ID. The

rate of rebate and surcharge and the methods of calculation of such rebate and

surcharge are given below:

5.2.12.2 The rebate and surcharge against different time periods shall be reflected in the bill

separately and shall be treated separately.

5.2.12.3 The power factor computation for different periods of the day shall be done subject to

regulation 3.12.5 of the New Tariff Regulations.

5.2.12.4 The above rate of power factor rebate and surcharge for different time periods under

TOD or non-TOD tariff shall be applicable from the consumption month of

September, 2010. Prior to the consumption month of September, 2010, the rate and

method of calculation of power factor rebate and surcharge shall continue for the

consumers under TOD or non-TOD tariff, as the case may be, in accordance with the

tariff order for WBSEDCL for 2009 – 2010.

5.2.13 For short term supply, emergency supply and for supply of construction power, there

shall be no rebate or surcharge for load factor and power factor.

5.2.14 For pre-paid tariff scheme with pre-paid meter no rebate on energy charge is allowed

with effect from 01.08.2010 except for public water works. For public water-works, a

special discount of 16 paisa/KWh on energy charge is to be given in case the supply

is under pre-paid tariff scheme through prepaid meter.

5.2.15 Delayed payment surcharge shall be applicable as per regulation 4.14 of the New

Tariff Regulations.

5.2.16 For irrigation tariff under Rate-C(b), North Bengal stands for the districts of

Coochbehar, Jalpaiguri, Darjeeling, North Dinajpur, South Dinajpur and Malda.

5.2.17 All existing charges relating to meter rent, meter testing, meter replacement,

disconnection and reconnection etc. shall continue. For LT consumers, the meter

rents shall be as follows:

5.2.17.1 Meter Rent for LT consumer:

a) All types of LT single phase meter including single phase prepaid meter for domestic consumers

- Rs. 10/- per month

b) All types of LT single phase meter including single phase prepaid meter for commercial consumers

- Rs. 15/- per month

c) All types of LT single phase meter including single phase prepaid meter for irrigation consumers

- Rs. 10/- per month

d) LT single phase prepaid meter for all categories of consumers other than domestic, commercial and irrigation consumers

5.2.17.2 No meter rent shall be applicable for a consumer if the cost of the meter is paid by

the consumer to WBSEDCL.

5.2.17.3 A consumer opting for pre-paid meter shall not be required to make any security

deposit for the energy charge.

5.2.18 All statutory levies like Electricity Duty or any other taxes, duties etc. imposed by the

State Govt. / Central Govt. or any other competent authority shall be extra and shall

not be a part of the tariff as determined under this tariff order.

5.2.19 All the rates and conditions of tariff are effective from 1 April, 2010. However, for all

categories of consumers the tariff as per this order are applicable from the first meter

reading date on or after 1 April, 2010 and will continue till issue of further tariff order.

Adjustments, if any, for over recovery / under recovery from the energy recipients

shall be made in 6 (six) equal monthly instalments through subsequent energy bills

5.2.20 The Commission passed an order dated 25.11.2009 in Case No. FPPCA-37/09-10

allowing WBSEDCL to recover ad-hoc fuel and power purchase cost at the rate of

78.00 paise/ kWh from the consumers and other licensees from the billing month of /

pertaining to November, 2009 till determination of tariff of WBSEDCL for 2010-11.

Now tariffs of WBSEDCL for the year 2010-11 have been determined and the same

are applicable from the first meter reading date on or after 1 April, 2010 and onwards.

The ad-hoc fuel and power purchase cost mentioned above shall not be applicable to

an energy recipient with effect from the date on which the tariff for 2010-11 comes

into effect in respect of that energy recipient.

5.2.21 In addition to the tariff determined under this tariff order, WBSEDCL would be further

entitled to additional sums towards enhanced cost of fuel and power purchase, if any,

after the date from which this tariff order takes effect. The fuel and power purchase

cost shall be subject to adjustment in accordance with the New Tariff Regulations.

5.2.22 Optional TOD tariff scheme for LT Commercial, LT Industrial and LT Public Water

Works categories of consumers having minimum contract demand of 30 KVA, which

was directed to be introduced in the Tariff Order for 2007-2008, shall continue and

energy charge under such scheme shall be computed according to regulation 4.12 of

the New Tariff Regulations, wherever applicable, if no tariff rates for such consumers

are mentioned in the tariff schedule.

5.2.23 For any pre-paid and TOD tariff scheme, other charges shall be the charges

applicable to the consumers under respective category of non-TOD tariff.

5.2.24 An applicant for short term supplies through pre-paid meter shall have to comply with

all necessary formalities for obtaining supply including payment in accordance with

the Regulations made by the Commission. The same will be subject to the following

conditions:

a) provision of space for installing weather-proof, safe and secure terminal services apparatus to protect sophisticated meter; and

b) availability of prepaid-meter of appropriate capacity

5.2.25 A new rate namely Rate – D(2) for street lighting with metered supply and illuminated

with LED has been introduced. To avail of this rate for street lighting the supply

should be metered and all the street lights under the same meter shall be illuminated

with LED. For mixed type of street lights under one meter the Rate-D(1) shall be

applicable. The rebate for timely payment under such new Rate-D(2) shall be the

same as for street lighting as mentioned in paragraph 5.2.6.

5.2.26 A new rate namely Rate-B-ID has been introduced in Annexure 5A2. The Rate-B-ID

shall be applicable to all existing and new low and medium voltage industrial or

commercial consumers having contract demand of 50 KVA and above but not

exceeding 125 KVA. The Rate-B-ID is applicable from 1st October, 2010. Prior to

October, 2010 the tariff for these consumers shall be as per this tariff order.

5.2.27 For LT Domestic consumers with prepaid meters the tariff at uniform rate shall be

applicable from 01.08.2010. For a consumer with prepaid meter who has purchased

voucher prior to 01.08.2010, the existing voucher will continue till such voucher is

exhausted.

5.2.28 The tariffs determined under this order for different categories of consumers are the

maximum ceilings for supply of electricity at any agreed price to the consumers of

WBSEDCL only for those areas of supply of WBSEDCL where multiple licensees

exist. However, if supply is effected to a consumer at a price lesser than the upper

ceiling, and as a result the licensee incurs loss, such loss shall not be allowed to be

passed on to any other consumers or any other distribution licensees under purview

of the Commission.

5.2.29 The purchase price of electricity by WBSEDCL from other licensees shall be as per

Annexure-5A4.

5.2.30 Where the billing cycle is quarterly, for determination of Life Line Domestic Consumer

the energy consumption of three months shall not exceed the three times of the

ceiling of monthly consumption as specified for a Life Line Domestic Consumer in the

New Tariff Regulations.

5.2.31 An un-metered Lokdeep / Kutirjyoti consumer shall be treated as a Life Line

Domestic Consumer as soon as he is provided with metered supply if his monthly

consumption and contract demand are such as specified in the New Tariff

Regulations for a Life Line Domestic Consumer. A metered Lokdeep / Kutirjyoti

consumer, who does not have the specified requirements to be considered as a Life

Line Domestic Consumer, shall be treated as a Domestic Consumer (Urban) or

Domestic Consumer (Rural), as the case may be. WBSEDCL is expected to bring all

un-metered Lokdeep / Kutirjyoti consumers under metered supply through installation

of meters within 31.03.2011 and thereafter treat those metered Lokdeep / Kutirjyoti

consumers as Life Line Domestic Consumers or Domestic Consumers under any

other category depending upon their consumptions and contract demands. The

Commission now directs WBSEDCL to inform the present status of the programme of

completion of conversion of the un-metered supply through installation of meters by

31.01.2012. However, such change of Lokdeep / Kutirjyoti consumers to any

category of the domestic consumers mentioned above shall be effective

prospectively from the first day of the next billing cycle applicable to those consumers

after such change.

5.2.32 All new consumers taking supply for the purpose of irrigation should be treated under

tariff rate of C(t) i.e. under class of consumers of “Irrigation pumping for Agriculture

(Metered).” The Commission directed WBSEDCL to shift all the existing consumers

under the category C(a) namely “Irrigation pumping for Agriculture (Metered supply

from mixed HV feeder)” to category C(t) in phases within 31.03.2011 and to keep the

Commission informed through quarterly progress report regarding such shifting. The

Commission now directs WBSEDCL to inform the present status of the programme of

completion of this conversion by 31.01.2012.

5.2.33 The Commission directed WBSEDCL to complete the program of conversion of all

un-metered supply through installtion of metering within 31.03.2011. The

Commission now directs WBSEDCL to inform the present status of the programme of

completion of conversion of the un-metered supply through installation of meters by

31.01.2012.

5.2.34 HT domestic Rate may be applicable to private hospitals with facilities for research;

and to avail of this tariff, those hospitals are required to furnish to WBSEDCL

appropriate certificate on research undertaken by them along with other

data/information as may be required by WBSEDCL. WBSEDCL shall satisfy itself

about the veracity of the claim of such consumers and submit its report and

comments in this regard to the Commission along with its next application for APR.

After due consideration of the report and comments of WBSEDCL, the Commission

may modify the rate of such consumers in subsequent tariff order, if considered

necessary. Such consumers shall furnish every year an undertaking to WBSEDCL

stating that the power supply to their premises shall be used/ shall continue to be

used exclusively for the purpose for which the supply has been taken.

5.2.35 HT Public Utility Rate may be applicable to all non profit-making educational and

research institutions aided by the State/Central Government, charitable hospitals and

social welfare establishments owned and run by any charitable organization either

public or private; and to avail of this tariff, such consumers are to satisfy the following

conditions.

i) educational and research institutions aided by the State/Central Government

shall furnish necessary documents to indicate that they have been receiving

from the State/Central Government such aid, which must be at least 50% of

their total annual income for the last three years consecutively;

ii) educational and research institutions aided by the State/Central Government

and the charitable hospitals and social welfare establishments owned and run

by charitable organizations either public or private shall be required to submit

their audited accounts of the last three years; and

iii) such consumers shall be required to furnish an undertaking stating that the

power supply to their institutions/ organizations shall be used and shall continue

to be used exclusively for the purpose for which the supply has been taken.

Such consumers shall apply to WBSEDCL along with the above documents and

WBSEDCL shall verify the same and shall give effect to such tariff to such

consumers, if the claim is found to be satisfactory, prospectively but not later than

three months from the date of receipt of the application with the required documents.

5.2.36 Any matter, which has not been explicitly mentioned in this order, shall be guided by

regulations 2.9.8 and 2.9.9 of the New Tariff Regulations.

5.3 It is directed that where there is any difference between the amounts appearing in the

audited annual accounts and the amounts appearing in the application for

determination of tariff or in the application for APR or in the application for FPPCA

under any head, due to adjustments, for any reason whatsoever, a reconciliation

statement is to be furnished along with such application for determination of tariff or

APR or FPPCA, as the case may be, in respect of each of such heads.

5.4 For merit order dispatch, SLDC / ALDC shall consider the energy charge of the

generating stations as determined in the prevailing tariff orders for the respective

generating companies / licensees.

Monthly Fuel Cost Adjustment (MFCA) or Monthly Variable Cost Adjustment (MVCA)

as may be applicable shall be added to the above energy charge for merit order

dispatch as notified by WBPDCL for their respective generating stations and DPL for

the concerned month.

For power stations of NTPC or DVC, WBSEDCL shall provide on monthly basis to

SLDC / ALDC of WBSEDCL the average value of fuel related cost on the basis of last

three months which are available to WBSEDCL in order to consider such cost for

merit order dispatch. Such information shall be given to SLDC on each month for

each power station within three working days of receiving the power purchase bill for

that power station on the basis of the amount mentioned in the bill. For this purpose

for NTPC the summated amount of base energy charge and fuel price adjustment

(FPA) shall be considered as effective energy charge. Similarly for DVC the

summation of energy charge and fuel cost surcharge (FCS) shall be considered as

effective energy charge. Such effective energy charge shall then be considered by

SLDC / ALDC of WBSEDCL for merit order dispatch purpose only. In case of single

part tariff where fixed charge recovery through target availability is not done, the tariff

itself will be considered as energy charge for merit order dispatch.

5.5 The State Government has issued a letter dated 24.12.2011 citing their intention to

give subsidy to the consumers whose tariff is increased as per the modality stated in

their letter. It is mentioned in their letter that the State Government has decided to

provide subsidy to such class of consumers, for whom the re-determined tariff

structure in terms of energy charge and fixed charge/ demand charge only is higher

than the rate out of the following two rates of the following orders :

(a) tariff as per order of the Commission vide dated 29.07.2010 which was

remanded by the Appellate Tribunal for Electricity vide order dated

04.04.2011.

(b) tariff of 2009-10 vide Commission’s order dated 28.07.2009 plus 78

paise/unit as adhoc power purchase cost vide order dated 25.11.2009.

The subsidy amount applicable for any class of consumer under any slab will

be limited to the lowest difference between the re-determined tariff rate at that

slab and any of the corresponding rate of that slab as was found as per rate in

the order as referred above under (a) and (b). The subsidy already paid by the

Sate Government in 2010-11 shall be included as already paid in the proposed

subsidy against such slab. In case if any class of consumer has already

received higher amount of subsidy in 2010-11 in accordance to the order No.

189-Power/II/1B-28/2009(Pt-II) dated 06.08.2010 than what is being now

mentioned in this letter then that extra amount shall not be recovered from

consumer and will be considered a subsidy for the year 2010-11 only. However,

the above subsidy will not be applicable to any consumer/ person who are

drawing part or full of its power requirement through open access for its power

related to backup or stand by power.

State Government has also decided that resultant shortfall in revenue

realization by WBSEDCL due to above decision under the new tariff structure

as per re-determination of tariff for 2010-11 shall be compensated by the State

Government through subsidy that is to be given by the State Govt. in the

following mechanism in order of merit.

i) Adjustment against Electricity Duty (E.D.) collected as first charge.

ii) Adjustment against interest due on State Government Loan to

WBSEDCL for the year concerned as second charge.

iii) Adjustment against principal due on State Government Loan to

WBSEDCL for the year concerned as third charge.

iv) Payment in terms of regulation framed against section 65 of Electricity

Act, 2003 in case if all the above mechanisms do not permit to provide

the whole subsidy.

The above subsidy will be effective from 01.04.2010 till further order on the

tariff rate as per re-determination order on tariff of 2010-11. It is also

mentioned that at present Electricity duty to be collected at the present tariff

level will be around Rs. 385.00 Cr in 2011 – 12 and for principal loan

repayment due and interest payment due will be around Rs. 104.45 Cr and

Rs. 166.64 Cr respectively. According to the above principle, the Commission

may issue relevant orders.

Accordingly the Commission decides that :-

The subsidy will be effective from the date of effect of the tariff of 2010-11 under this

order of re-determined tariff and will be continued till further order by the State

Government. However, the subsidy mentioned above will not be applicable to any

consumer / person who are drawing part or full of its power requirement through open

access for its power related to back up or stand by power. The subsidy as proposed

by the State Government will be recovered by WBSEDCL through the mechanism as

stated in the letter of the State Government in order of merit.

WBSEDCL shall ensure the availability of fund from the State Government as per

proposed mechanism before giving subsidy to any class of consumers as per

provision of the Act and regulations made thereunder.

The tariff schedule as applicable to the consumers of WBSEDCL after giving the

subsidy as stated by the State Government are given at Annexure – 5B1 for LV and

MV consumers under quarterly billing cycle, at Annexure – 5B2 for LV and MV

consumers under monthly billing cycle and at Annexure – 5B3 for HV and EHV

consumers.

WBSEDCL shall clearly indicate in the consumer/consumer’s bill (a) the amount

payable in terms of the tariff determined by the Commission (b) the amount of the

state government subsidy and (c) the net amount payable as per provisions of the

New Tariff Regulations.

5.6 In the tariff order of WBSEDCL for 2008 – 2009, issued on 30.09.2008, the

Commission had given certain directives to WBSEDCL. WBSEDCL submitted the

compliance report from time to time. Since the year 2010-11 is already over, the

Commission is not giving any further directive on those issues in this order. However,

the Commission will review those matters and will give further directives, if

necessary, in the tariff order for the third control period.

5.7 The Commission has also noticed that the Judgment order dated 11.11.2011 in OP

No 1 of 2011 of Hon’ble Appellate Tribunal for Electricity has elaborated that the fuel

and power purchase cost is uncontrollable and it has to be allowed as quickly as

possible according to the Tariff Policy. Hon’ble Appellate Tribunal has also given

directions that all the State Commissions has to ensure that Annual Performance

Review (APR) and Annual Revenue requirement and Tariff determination is

conducted year to year basis as per the time schedule specified in the Regulations.

5.8 The Commission has noticed that the Annual Accounts of WBSEDCL for the year

2010-11 has been completed and has duly been audited by the statutory auditor and

C&AG also. WBSEDCL is directed to submit their application for Fuel and Power

Purchase Cost adjustment (FPPCA) and Annual Performance Review (APR) for the

year 2010-11 immediately since the stipulated time period for submission of the

FPPCA and APR application for 2010-11 are over. WBSEDCL is also directed to

submit their application for determination of tariff for the third control period

comprising of the years 2011-12, 2012-13 and 2013-14 which is already due.

5.9 In case WBSEDCL finds any discrepancy or faces any dispute regarding the amount

of subsidy for any particular category of consumers as at Annexure 5B1, 5B2 and

5B3, they may submit specific proposal through the State Government for approval of

the Commission.

5.10 WBSEDCL shall submit to the Commission a gist of this order along with the names

of at least four leading daily newspapers (at least one of which will be in English and

one in Bengali) within three working days from the date of receipt of this order for

approval of the Commission and on receipt of the approval, shall publish the

approved gist in those newspapers within four working days from the date of receipt

of the approval of the Commission.
