SPECIAL ARCHERY HUNT FOR DEER, TURKEY, & WATERFOWL

An experimental archery hunting season on land owned and managed by the North Dakota Department of Corrections & Rehabilitation (DOCR) is being offered to reduce population numbers. A maximum of 25 permits will be available. Applicants must first obtain an access permit from the DOCR. Participants must be at least 18 years of age to obtain an access permit from the DOCR, unless accompanied by another participant that is an adult. Deer, turkey, and waterfowl licenses will be available at the North Dakota Game & Fish Department (NDGFD) headquarters in Bismarck. This hunt will conform to the stipulations of the 2015 North Dakota Deer Hunting Proclamation, the 2015 North Dakota Wild Turkey Hunting Proclamation, and the 2015 North Dakota Waterfowl Hunting Proclamation. Licenses may be received in addition to other North Dakota hunting licenses. Application deadline is 4:00 pm CST, July 1, 2015. Only hunters selected in a random lottery will be approved for hunting. Applicants will be notified of the results via email on or before August 1, 2015. DOCR archery hunting licenses not purchased by September 4, 2015 will be void. Unsuccessful lottery applicants will have first option for unclaimed licenses. Remaining licenses may be offered to participating hunters.

Waiver of Responsibility Agreement

I fully understand and agree that the DOCR or any of the staff cannot guarantee my safety. I fully understand the risks and dangers involved in hunting on DOCR property. I realize that my life could be in danger and I could be held hostage, assaulted, verbally abused and otherwise placed in danger. I accept the fact that I have been granted permission to enter the DOCR properties only because I realize the dangers and risks involved; liability rests with myself. I will observe all rules, regulations and policies required of archery hunters. I will adhere strictly to policies and procedures required for archery hunting, security and safety of the DOCR. I hereby waive and release the State of North Dakota, its officers, employees, and agents, both in their official and individual capacities, from any and all legal liability for damages that result from the furnishing or receiving of such criminal records information.

The ARCHER hereby agrees to indemnify and hold harmless the State of North Dakota and its officers, agents, and employees, from and against all claims, damages, losses, and expenses, including reasonable attorney’s fees, (in the event it shall be necessary to file or defend and action) for bodily injury, illness, or death, or for property damage, including loss of use, arising out of or is in any way connected with the event described above, including the property owners participation in the program. This agreement shall be effective for the entire time period of the Archery Hunting Event.

Security Requirements The ARCHER shall comply with all applicable DOCR rules, regulations, and policies, including rules and regulations relating to archery hunting, safety, and security. DOCR reserves the right to deny admission on DOCR properties to the ARCHER for violation of any applicable DOCR rule, regulation, or policy. DOCR may require and complete a criminal history background check. No person convicted of a Class A misdemeanor involving violence, weapons, or controlled substances, or anyone convicted of a Felony may enter any DOCR property. The ARCHER shall be aware that DOCR properties are secure environments. When ARCHER arrives at the DOCR property, they will be subject to search at any time, and they are responsible for ensuring that all hunting gear and equipment, cell phones, cameras, and other wireless electronic devices that are allowed on the property are accounted for at all times, and their vehicle is locked and secured. The ARCHER shall report to the DOCR immediately if any hunting gear or equipment, cell phones, cameras, and other wireless electronic devices are lost, misplaced, or stolen. Tobacco products must remain in the ARCHER’S vehicle at all times. No alcohol or products containing alcohol are allowed on DOCR property. Possession, distribution or delivery of alcohol, tobacco, a controlled substance, firearm, or a dangerous weapon is a criminal offense, and will be prosecuted accordingly.

DOCR Rules for Archery Hunting on Specified Properties

1. All laws and regulations established by the State of North Dakota shall be enforced in hunting areas, except those that by their nature are not applicable.

2. A mandatory Hunter Orientation meeting will be held Aug 21st at 7:00 p.m. CST at the MRCC compound in the main building. The meeting will be to go through the hunting rules, parking areas, and other regulations.

3. All archers must apply and receive an access permit from the DOCR before participating in the special archery hunt. The access permit authorizes archers to hunt on specified DOCR properties during specific time periods. All access permits must be carried by archers while hunting. Permits must be displayed upon demand by any enforcement officers of the State of North Dakota. A valid North Dakota hunting license and archery stamp(s) are also prerequisites.

4. No firearms are allowed on property at any time including pellet or BB guns and muzzle loading weapons. 5. Access is limited to archers only, no guest(s) allowed. 6. Archers may hunt antlerless only deer from September 4, 2015 at noon through January 3, 2016. Archers may hunt

wild turkeys from October 10, 2015 through January 3, 2016. Archers may hunt waterfowl from September 26, 2015 through December 27, 2015, unless closed by the 2015 ND Waterfowl Hunting Proclamation and dependent upon harvesting of crop.

7. No hunting is allowed in or around occupied buildings or properties in any of the hunting areas. No hunting is allowed near the Missouri River Correctional Center compound.

8. Hunting from tree stands is permissible (limit 2); provided the stands are portable and that the stand or steps do not damage trees in any way. Use of any type of ground blind for hunting is permitted (limit 1) only from November 3, 2015 through January 3, 2016. Hunters must abide by regulations consistent with North Dakota’s Wildlife Management Areas. Your temporary tree stand and ground blind must include your name, address and phone number. Use of a sled or wheeled game cart for hauling tree stands and carcasses is permitted.

9. Regular arrows may be used for deer and turkey hunting. Only Flu-Flu arrows are allowed for waterfowl hunting. 10. It is unlawful for any individual to hunt big game or turkeys over bait. Deer drives are not allowed for safety reasons. 11. It is prohibited to hunt in unharvested crops, including corn and alfalfa. 12. No vehicles are allowed inside hunting areas at any time. Field dressing is allowed. 13. Only knives with a four-inch blade or smaller are acceptable for the special archery hunt. 14. Archers must park vehicles only in designated parking areas, as identified on the map, and the vehicle must be locked

and secured at all times. Archers not complying may have their permits revoked. 15. A maximum of 25 archers receiving an access permit under the program may purchase up to three antlerless only

deer licenses and up to three wild turkey licenses from the North Dakota Game and Fish Department. 16. Archers must wear hunter orange if hunting during portions of the deer gun and muzzle loader season. There are no

clothing restrictions for the remainder of the archery season. 17. Mandatory questionnaires, which can be obtained from the North Dakota Game and Fish Department, must be

completed and submitted to the North Dakota Game and Fish Department. 18. This archery program is experimental from year-to-year and can be terminated at any time. 19. Selected archers are ambassadors of the archery program. Its continuation depends on you. We ask that there be

no smoking, to report violators or suspicious activity, police your ranks, strive for compatibility with other users, think safety and enjoy yourself. Use common sense when removing your game from hunting areas.

The NDGFD receives federal financial assistance from the US Fish and Wildlife Service. In accordance with the Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, and Title IX of the Education Amendments of 1972, the NDGFD joins the US Department of the Interior and its Bureaus in prohibiting discrimination on the basis of race, color, national origin, age, disability, sex (in education programs or activities) and also religion for the NDGFD. DOCR General Rules

Contraband: Defined as any item or service not specifically authorized by security staff. No property or other items will be allowed on DOCR property other than appropriate archery gear and equipment. All items are subject to search. Searches: Any individual entering DOCR property may be subject to search at any time for contraband articles. This also applies to their personal property. Anyone refusing to submit to search will be denied admittance. If contraband is found, the DOCR may detain the individual for a reasonable amount of time. Searches are not intended to embarrass, degrade or cast aspersions on the integrity of any individual. The DOCR has found through experience that it is necessary to conduct searches for contraband to adequately provide a safe and secure environment for inmates, staff and visitors. North Dakota Century Code: SECTION 12-47-21. Alcoholic beverages and controlled substances prohibited – Physician’s orders – Use of tobacco – Weapons and Firearms – Penalty. 1. It is unlawful for any person to willfully:

a. Manufacture or possess with intent to manufacture or deliver, a controlled substance, on or within any premises under the control of the DOCR or any of its divisions.

b. Deliver a controlled substance to any inmate of the DOCR or to any other person for redelivery to an inmate of the DOCR. Any person who violates this subsection is guilty of a Class A Felony.

2. It is unlawful for a DOCR inmate to possess any controlled substance except in accordance with the prescription or orders of a licensed physician. It is unlawful for a DOCR inmate to possess alcohol or alcoholic beverages. IT is unlawful for a DOCR inmate to possess any tobacco. Any DOCR inmate who violates this subsection with respect to: a. Possession of a controlled substance is guilty of a Class B Felony. b. Possession of alcohol or alcoholic beverages is guilty of a Class A Misdemeanor. c. Possession of tobacco is guilty of a Class B Misdemeanor.

3. It is unlawful for any person to willfully deliver alcohol or alcoholic beverages to a penitentiary inmate. It is unlawful for any person to willfully delivery tobacco to an inmate. Any person who violates this subsection by: a. Delivery of alcohol or alcoholic beverages to DOCR inmates is guilty of a Class A Misdemeanor. b. Delivery of tobacco to a DOCR inmate is guilty of a Class B Misdemeanor.

4. It is unlawful for any person other than a DOCR inmate to willfully possess a controlled substance on or within any property under the control of the DOCR or any of its divisions except when the person is an authorized agent of the DOCR pharmacy or except in accordance with the orders or prescription of a licensed physician. Any person who violates this subsection is guilty of a Class B Felony.

5. It is unlawful for a DOCR inmate to willfully procure, make, or possess any object, including a shard made of any material or any weapon, firearm, ammunition, or explosive material, intended to be used for an assault on another person or to damage property. Any DOCR inmate who violates this subsection with respect to: a. A shard or weapon that is not a dangerous weapon or firearm as defined in section 62.1-01.01 is guilty of a Class

B Felony. b. Ammunition, a knife of any length, a weapon that is a dangerous weapon or firearm as defined in section 62.1-01-

01, or explosive material is guilty of a Class A Felony. 6. It is unlawful for any person to deliver or provide to a DOCR inmate any object intended to be used for an assault on

another person or to damage DOCR property. Any person who violates this subsection with respect to: a. A shard or weapon that is not a dangerous weapon or firearm as defined in section 62.1-01.01 is guilty of a Class

B Felony. b. Ammunition, a knife of any length, a weapon that is a dangerous weapon or firearm as defined in section 62.1-01-

01, or is an explosive or destructive device is guilty of a Class A Felony. 7. As used in this section, “controlled substance” is as defined in subsection 6 of section 19-03.1-01 and includes

counterfeit substances as defined in subsection 7 of section 19-03.1-01. As used in this section, “willfully” is as defined in section 12.1-02-02. As used in this section, “alcohol” and “alcoholic beverage” are as defined in section 5.01-01. As used in this section, “tobacco” means any form of tobacco, including cigarettes, cigars, snuff, or tobacco in any form in which it may be sued for smoking or chewing. As used in this section, a wireless electronic communications device includes a cellular phone, personal digital assistant, pager, mobile broadband card, internet router, digital camera, two-way radio, modem, or any other electronic device capable of wireless transmission, reception, interception, or storage of oral communications, text, electronic mail, video or photograph images, data signals, or radio communications, text electronic mail, video or photograph images, data signals, or radio communications. A wireless electronic communications device does not include a medically prescribed device or other device approved by the DOCR.

8. It is unlawful for a DOCR inmate to willfully manufacture, possess, or use a wireless electronic communications device on or within any premises under the control of the DOCR or any of its divisions except for law enforcement purposes. A violation of this section is a Class C Felony.

9. It is unlawful for any person to willfully deliver, or possess with intent to deliver, a wireless electronic communications device to a DOCR inmate or to any person for redeliver to a DOCR inmate, or to allow a DOCR inmate to possess or use a wireless electronic communications device, on or within any premises under the control of the DOCR or any of its divisions except for law enforcement purposes. A violation of this section is a Class C Felony.

SPECIAL ARCHERY HUNT MAP Located on DOCR property south of Bismarck; specifically, south of 48th Avenue and west of Washington Street.

Parking: Hunters will receive a vehicle decal parking permit. The parking permit shall be prominently exhibited in the vehicle front window while hunting. Vehicles not exhibiting a valid permit may be towed at the owner’s expense. Archers must park along the south side of 48th Avenue or along the west side of Washington Road. Please do not block gates or vehicle access routes when parking. Walk-in hunting only; upon harvesting of game, the hunter will be allowed to use a sled or wheeled game cart for hauling tree stands and carcasses, field dressing allowed. All Terrain Vehicles (ATV) are not permitted.
