PHARMACISTS’DUTYTOWARN

LawsuitsClaimingThatPharmaciesMustWarnCustomersAboutDangersAssociatedWithPrescriptionDrugs

INTRODUCTIONPatientsinjuredbyprescriptiondrugssometimesclaimthattheirpharmacistshadadutytowarnthemaboutpotentialsideeffectsandotherdangersassociatedwithprescriptiondrugs.Thismemorandumprovidescitationstocourtdecisionsfromacrossthecountrythataddresstheissueofwhetherandwhenpharmacistshaveadutytowarn.Mostcourtshaveruledthatpharmacistsdonothaveageneraldutytowarnpatientsabouttheirprescribeddrugs.Instead,thegeneralruleisthatdrugmanufacturershaveadutytoprovidegeneralwarningstophysicians,andthenphysicianshaveadutytowarntheirpatientsaboutthedrugstheyprescribe.Mostcourtsimposethisdutytowarnonphysicians,ratherthanpharmacists,becausephysiciansdecidewhichdrugstoprescribe.Physiciansknowwhichwarningsareappropriateforaparticularpatientbecausetheyhaveaccesstothepatient’scompletemedicalhistory.This“learnedintermediarydoctrine”isthetraditionalrationaleforrejectingclaimsthatpharmacistshaveadutytowarn.Afewstatecourtshaverejectedthelearnedintermediarydoctrine,andhaveinsteaddecidedthatpharmacistsdohaveageneraldutytowarnpatients.Althoughmostcourtsthathaveconsideredtheissuerejectthenotionthatstatecounselinglawscreateadutytowarn,aminorityofcourtshavepointedtocounselinglawsasevidencethatpharmacistshaveadutytowarn.Othercourtshaveheldthatpharmacistshaveadutytowarnonlyincertaincircumstances.Forexample,somecourtshaveruledthatpharmacistshaveadutytowarnaboutknowncontraindications,orclearerrorsonthefaceofaprescription(e.g.,excessivedosages).Othercourtsrejectthenotionofageneraldutytowarn,butholdthatapharmacycanvoluntarilyassumeadutytowarn.Forexample,apharmacythatadvertisesitsdrugutilizationreviewandcomputerwarningsystemsmayhaveassumedadutytowarnaboutdangeroussideeffects.ALABAMANailv.PublixSuperMarkets,Inc.,72So.3d608(AL2011)(rejectingamotiontodismissadutytowarncaseagainstapharmacybasedonthelearnedintermediarydoctrinewhereplaintiffclaimedthatthepharmacisthadadutytowarnheroftheincreaseddrugdosage(whichsheallegedcausedherinjury)versusadutytowarnofdrugsideeffects,whichmayimpactthedoctor/patientrelationship).SpringhillHosps.,Inc.v.Larrimore,5So.3d513(AL2008)(relyingonWalls,Courtconcludesthatlearnedintermediarydoctrinepreventspharmacistliabilityevenifpharmacistprovideddoctorofdeceasedpatientwithdosinginformation;doctorwasresponsibleparty;“voluntaryundertaking”exceptiondoesnotapplybetweenpharmacistanddoctor(versuspatient)).
