Section - I

1.1 INVITATION FOR BIDS

Biometric based Attendance System

Secretary, Human Resource Department, Government of Bihar invites sealed bids from established,

reputed National/International IT firms with base in India for selection of Solution Provider for

Supply, Installation, Commissioning, Maintenance and Day-to-Day Operation of Biometric-based

Attendance & Monitoring System in Universities and Constituent Degree Colleges in the State.

All the hardware supplied shall be on rent basis.

Project Life – The Project life shall be for a period of Three years from the date of signing of the

contract. All the hardware has to be supplied by the Firm on Rent. The Firm will also supply software

and Manpower (as per fixed qualification and remuneration) and install and commission the project

on a turn-key basis and operate the systems for a period of three years.

The bidder shall be responsible for carrying out the following major activities under the system -

University/College Level

1. Supply and installation of Biometric devices in University/College. The devices will be on

rent basis.

2. Capturing the Fingerprints of Teaching, Non-Teaching staff and Students.

3. Authentication of captured fingerprints with the master fingerprints at local level before

transmitting the status report to the central level.

4. Number of Teaching and Non-Teaching staff shall be between 100-250. Number of

Students per College/University will be in the range of 500–1500. This range is variable.

5. Providing GPRS based communication in Universities/Colleges with unlimited data

usage and SMS usage on Rental basis (Annual Rental & 3 Years Cost). This

connectivity must be backhauled on Private network (MPLS).

6. All devices, wherever applicable, must be GPRS enabled for online connectivity.

7. Transmitting the status report with respect to attendance marking of all Teaching, Non-

teaching and Students of the respective College to the Central database using online

GPRS connectivity.

8. Preparation of various MIS reports for use by Department, University and Colleges.

These reports will be prepared at Central location and it should be downloadable as

per the requirement at college, university, individual concerned level.

9. There shall be a provision of small mini hub (backed-up by server at HRD) at the

University level to access the entire data of the concerned colleges.

10. Provision of web-portal application for monitoring and management of attendance.

11. Provide IT resources such as Application Server, Database Server, Router, Firewall, Leased

Line of 2 Mbps (Internet Connectivity), etc.

12. Location of Central Hub Server at III-Tier Architecture at Datacenter facility in HRD

Department for housing web-enabled application software, database and other

associated information. This will work as Master Station for the whole Project.

13. Different authorized users can access Web portal application for required purposes.

14. Providing service and support for the entire system during the warranty period of three

years.

1.2 BID CONDITIONS

1. Bidders are advised to study the Bid Document carefully. Submission of Bids shall be

deemed to have been done after careful study and examination of the Bid Document with

full understanding of its implications.

2. Sealed offers prepared in accordance with the procedures enumerated in Clause 1 of

Section-II should be submitted to Shri B. K. Jha, Deputy Director (Planning), Human

Resource Development Department, Govt. of Bihar, New Secretariat, Vikas Bhawan,

Bailey Road, Patna 800015 not later than the date and time laid down, at the address

given in the Schedule for Invitation to Bid under Clause 8 (Given below).

3. The Bidder must furnish Earnest Money Deposit (EMD) for Rs. 1,00,000/- (Rs. One Lakh

only) in favour of Accounts Officer, Human Resource Development Department, Bihar

payable at Patna in the envelope containing the Pre-Qualification bid failing which the bid

will be rejected.

4. Bid Document is not transferable.

5. The tenders of only those bidders, who have purchased the documents in their names will

be considered.

6. The HRD reserves the rights to reject any bid or all the bids without assigning any reasons

and revise quantity, fine-tuning specifications as per requirement of Government of Bihar

before opening the commercial bids.

7. The bidder will accept all conditions of the Bid Document unconditionally or depending

upon the decisions of the Tender Evaluation Committee.

1.3 BID EVALUATION CRITERIA

The Technical Bid of only those bidders shall be opened who meet the Pre Qualification

Criteria. The Technical Bids will be analyzed by a Technical Committee comprising of experts of NIC

and the HRD Department. The Technical Committee shall award marks out of 100 against the set

parameters which will include the Technology offered, Device specifications, Presentation /

Demonstration of Device, Financial Strength of the Company, etc.

All bidders securing 50 marks or above shall be deemed to have qualified in Technical

terms. The Financial Bids of those bidders shall be opened who qualify in the Technical Analysis.

The Financial Bids shall be evaluated on the L-1 Criteria and the bidder with lowest rentals in all

three items (namely, Biometric Device, Computers and Gensets) shall be awarded the contract. In

case no single bidder is lowest in term of all three items, the bidder offering lowest rentals in

Biometric Device shall be awarded the Contract with the condition that he will supply rest of the

two items (Computers and Gensets) at the L-1 rent offered to the Dept. by the other bidders.

1.4 SCOPE OF WORK

The bidder is required to establish a GPRS based Biometric Attendance System at the

universities and selected Colleges ON A TURN-KEY BASIS. For the purpose of this project, the

bidder shall have to supply –

a. Biometric Devices and associated Computer Hardware, Generators, etc. to be supplied on

Rent.

b. Necessary Software.

c. IT Manpower (As per Annexure B).

1.4.1 Biometric Device, Hardware and software – The Bidder shall supply the Biometric

Device, Computers/Printers, Gensets (both at College and the University) purely on

RENT. The hardware deployment shall be as under –

College Level - Biometric Devices (The number may vary between 3 to 8 depending

upon the College), Desktop Computer with UPS and Printer, Genset and 3.1 Mbps

Data Card for the Desktop.

University level - Biometric Devices (The number may vary between 5 to 10)

Desktop Computer with UPS and Printer, Genset and 3.1 Mbps Data Card for the

Desktop.

HRD Level – Server, Client, UPS, Printer, Scanner, Leased line for Web Server,

Biometric Device based secure login system, Router, Switch, etc. (All these items TO

BE PROVIDED BY HRD). Bidder does NOT have to deploy any hardware at his

expense at HRD Level.

This project shall be executed in all the Universities of the State, namely:

1. Patna University, Patna 2. Bihar University, Muzaffarpur 3. Mithila University, Darbhanga 4. Sanakrit University, Darbhanga 5. Magadh University, Gaya 6. B.N.Mandal University, Madhepura 7. Bhagalpur University, Bhagalpur 8. J.P. University, Chapra 9. Veer Kunwar Singh University, Ara

This project will also be executed in all constituent Degree Colleges in following districts of Bihar -

1. Patna 2. Muzaffarpur 3. Darbhanga 4. Gaya 5. Saran (Chhapra) 6. Madhepura 7. Munger 8. Purnea 9. Bhagalpur 10. Saharsa. 11. Ara (Bhojpur)

Note: The College List may change and some names may be added or deleted subject

to the number remaining under 100.

1.4.2 It may be noted that upon successful implementation of the project in the above

mentioned district, subsequently more colleges from other districts will be covered

phase-wise.

1.4.3 The objective of the Project -

1. To utilize the data captured at field level to generate various MIS reports such as

monitoring of attendance, leave maintenance, preparation of department wise

absentee, payroll, etc.

2. The system should be functional during working hours, which would be

approximately 8 hours daily except Sunday or Holiday with maximum uptime.

The vendor should consider providing sufficient power backup to overcome any

power failure. The vendor should provide one 2 KVA Portable Genset as power

backup.

3. Since Biometric device will be used by large number of students/employees it

should be robust and physically secured for any physical damage or tempering.

4. Exceptional cases: It has been observed that there are few such persons whose

finger-prints are not detectable by biometric device; the vendor should provide

some alternative to handle such cases through which attendance of such person

may be marked in same format as generated by all biometric devices. It means

that attendance of all concerned student/employee should be transmitted to

the datacenter in the same format.

5. The system supplied by the vendor should have the following feature :

a. The data captured by the biometric device should AUTOMITICALLY be

transferred to the CENTRAL SERVER at HRD, Patna. The original record of

attendance should be dumped (copied) in Central Server in its native format.

To meet any audit requirement, the native files generated at Biometric

devices should be kept in archive manner at the Central Server.

b. Proper electrical earthing is to be arranged by the successful bidder for the

computer, printer and the biometric devices installed at each college and

university to protect the instruments. (Neutral to Earth voltage should be in

the range of 0 to 3 volts).

c. An exclusive electrical wiring for the computer system, printer and the

biometric devices is to be arranged by the successful bidder at each location

i.e., both colleges and universities. The spread of installation area of these

equipments will be approximately 50 meters at each location.

6. Generator Back up – The vendor should provide one 2 KVA Portable Genset as

power backup at each location. Fuel for running this genset would be provided

by the respective college or university (as per the location).

1.4.4 IT Manpower –

1. AT HRD: The vendor should provide one I.T. Manager having qualification of

B.Tech. (Computer Science) or MCA with minimum 7 years of experience of

handling software project. His minimum consolidated salary will be Rs. 30,000.00

(Rupees Thirty Thousand Only) per month. He will be overall in-charge of the

project and will be responsible for all activities related to this project. He will

interact with the HRD department for day-to-day activity of the project.

2. AT HRD: The vendor should provide one Deputy I.T. Manager having

qualification of B.Tech. (Computer Science) or MCA with minimum 3 years of

experience of handling software project. His minimum consolidated salary will

be Rs. 25,000.00 (Rupees Twenty Five Thousand Only) per month. He will assist

the I.T. Manager in running of the project and will be jointly responsible for all

activities related to this project.

3. AT HRD: The vendor should provide two Programmers having qualification of

B.Tech. Computer Science or MCA with minimum 3 years of experience of

software development and they should be capable of developing or modifying

the software supplied by the vendor as per the HRD Department's need. They

will be responsible for uploading data of various colleges for web based

application and maintenance of Data centre for Bio-metric device. His minimum

consolidated salary will be Rs. 20,000.00 (Rupees Twenty Thousand Only) per

month.

4. AT EACH LOCATION: The vendor should provide per college one Graduate

“Data Assistant” having minimum qualification in one of these streams: BCA or

B.Sc. (IT) or PGDCA with 1 year course. The role of Data Assistant would be to

prepare master database of finger prints, configuring biometric devices, to enter

daily leave details of employees, generate various kind of reports as required by

concerned office, data-entry of college/university related records, etc. The minimum

consolidated salary will be Rs. 10,000.00 (Rupees Ten Thousand Only) per month.

1.4.5 Generating MIS Reports

The bidder shall, inter alia, provide following MIS Reports, on such formats to be

decided by NIC, to the College/University/Department –

a. Daily Attendance Sheet on a format to be decided by NIC.

b. Web Enabled Application on Server kept at HRD.

c. Leave Management of Employees.

d. Generation Pay Roll System for employees.

e. Preparation of Students-List eligible for appearing on exam based on

Session Attendance.

f. Any other reports that may be specified later.

1.4.6 NIC as the Technical Advisor

The Bidder shall directly work under the technical supervision/guidance of the National

Informatics Center (NIC) and shall provide such technical cooperation to them as

required. The NIC may require the bidder to change/amend/improve certain aspects of

the Software/MIS forms etc. as the project moves on.

SECTION - II

INSTRUCTIONS TO BIDDERS

A. INTRODUCTION

1. Procedure for Submission of Bids

It is proposed to have a Three-Cover System for this bid.

1. Pre-qualification documents (2 copies) in one cover.

2. Technical Bid (2 copies) in one separate cover.

3. Commercial Bid (2 copies) in another separate cover.

1.1 The Bidders must place their pre-qualification, technical and commercial bids in two

separate envelopes, super-scribed with separate Bid titles as follows:

A. PRE QUALIFICATION BID

B. TECHNICAL BID

C. COMMERCIAL BID

1.2 The Bidder shall have to qualify the pre-qualification Bid.

1.3 Pre-Qualification Bids will be opened on the prescribed date and time.

1.4 Technical Bids of only those Bidders will be opened who qualify the Pre-

Qualification round after the initial processing of pre-qualification bid on the same

day or at a date and time to be notified on the same day.

1.5 Each copy of the Pre-qualification document should be covered in a separate sealed

cover super-scribing the wording ‘Pre-qualification document’. Both copies should

be separately marked as “original copy” and “first copy” respectively. Thereafter,

both the copies should be put in a single sealed cover super-scribing the wording

“Pre-qualification document”.

1.6 Each copy of Technical Bid of the Bid should be covered in a separate sealed cover

super-scribing the wording “Technical Bid”. Both copies should be separately marked

as “original copy” and “first copy” respectively. Thereafter, both the copies should

be put in a single sealed cover super-scribing the wording ”Technical Bid”.

1.7 Please note that commercial aspects (prices, cost etc.) should not be indicated in

the Pre-qualification Bid or the Technical Bid and should be quoted only in the

Commercial Bid.

1.8 Each copy of Commercial Bid should be covered in a separate sealed cover super-

scribing the wording “Commercial Bid”. Both copies should be separately marked as

“Original copy” and “First copy” respectively. Thereafter, both the copies should be

put in a single sealed cover super-scribing the wording “Commercial Bid”.

Commercial Bid should only indicate prices in the prescribed format.

1.9 The cover thus prepared should also indicate clearly the name and address of the

Bidder to enable the Bid to be returned unopened in case it is received “Late”.

1.10 The bids received late and declared late by the Bid Evaluation committee after the last

date and time for receipt of bids prescribed in the bid document or otherwise shall be

rejected and/or returned unopened to the Bidder.

1.11 Each copy of the bid should be a complete document with Index & page numbering

and should be bound as a volume. Different copies must be bound separately.

2 Cost of Bid document

The Bidder shall bear all costs associated with the preparation and submission of its Bid,

including cost of presentation for the purposes of clarification of the bid, if so desired by

the Department and Department will in no case be responsible or liable for those costs,

regardless of the conduct or outcome of the Biding process.

3 Correctness of the Bid

The Bidder is expected to carefully examine all instructions, forms, terms and specifications

in the Bid Document. Failure to furnish all information required in the Bid Document or

submission of a bid not substantially responsive to the Bid Document in every respect will

be at the Bidder’s risk and may result in the rejection of the bid.

4 Clarification regarding Bid Document

4.1 A prospective Bidder requiring any clarification of the Bid Document may notify the

Department in writing at the Department’s mailing address indicated in Clause 8 of Section

I. The Department will respond in writing to any request for clarification of the Bid

Document, received, not later than 7 days prior to the last date for the receipt of bids

prescribed by the Department. Written copies of the Department response (including an

explanation of the query but without identifying the source of Inquiry will be sent to all

prospective Bidders who have received the Bid Documents.

5 Amendment of Bid Document.

5.1 At any time up to the last date for receipt of bids, the Department may for any reason,

whether at his own initiative or in response to a clarification requested by a prospective

Bidder, modify the Bid Document by an amendment.

5.2 The amendment will be notified in writing or by telex or fax or e-mail or at the

Department’s website to the prospective Bidders who have received the Bid Documents

and will be binding on them.

5.3 In order to afford prospective Bidders reasonable time or otherwise for any other reason, in

which to take the amendment into account in preparing their bids, the Department may, at

its discretion, extend the last date for the receipt of Bids.

B. Preparation of Bids

6 Language of Bids

6.1 The Bids prepared by the Bidder and all correspondence and documents relating to the

bids exchanged by the Bidder and the Department, shall be written in the English language.

7 Documents Comprising the Bids

7.1 Conditional bids shall not be entertained.

7.2 BID REQUIREMENTS - The Bids prepared by the Bidders shall comprise of following

components (Bid documents are to be submitted in the order of pre-qualification clauses

along index page no., otherwise bid will be disqualified):

a) Bid proposal sheet duly filled in, signed and complete in all respects.(Performa-I)

b) Qualifying data duly filled in as per relevant Performa provided in the bid proposal that

the Bidder is eligible to bid and is qualified to perform the contract, if its bid is accepted

(Performa -II)

c) The Bidder must furnish Earnest Money Deposit (EMD) of Rs.1,00,000/- (Rupees

One lacs only) which shall be in the form of Demand Draft drawn on any scheduled

bank in favor of Accounts Officer, Department of Human Resource Development

payable at Patna, failing which the bid will be rejected. This earnest money is to be

submitted along with the pre-qualification documents.

d) The Bidder must be registered/ incorporated under Indian Companies Act 1956. Bidder

should have a base in India for at least 3 years. For the purpose of tender, vendors

having experience with biometric based attendance shall only be considered;

experience on Magnetic stripe, plain Plastic card, bar coded or paper cards shall not be

considered.

e) The Bidder/Consortium should be an OEM partner for the product being quoted.

f) The Bidder/Consortium must be ISO 9001:2000 certified or above.

g) Company Financial Status: The Bidder must have an average annual turnover of

minimum Rs 1 Crore for the preceding last three financial years.

h) The Bidders must indicate the names of its GPRS service Providers in Bihar for this

assignment.

i) The Bidder/ consortium must have implemented at least 1 (one) project on turn-key

basis in the Central/ State Government/ Govt. PSUs/ Private sector valued for Rs 50 lacs

in last five financial years ending 31-Mar-10. Project should comprise of Hardware,

GPRS, Application software Integration.

j) The Bidder must possess Professional Competence and experience of the key personnel

(both technical and domain experts) to be associated with this project.

k) The Bidder/ consortium should not be under a declaration of ineligibility for corrupt

and fraudulent practices or any other reason, whatsoever, or have not been blacklisted

by the Government of India or any of its agencies, including public enterprises and/or

by any State Government or any of its agencies.

l) The Bidder must have valid PAN issued by Income Tax Authorities, India.

m) The Bidder must have valid State Sales Tax and CST Number. If no, the Bidder will give

undertaking that the Sales Tax Number shall be submitted to the Department before

the signing of the contract.

n) The Bidder shall give a certificate regarding the use of quality components for IT

Resources as per Performa IV.

7.3 Technical Bid shall consist of the following: -

(a) Technical Brochures of the product quoted and also current certifications asked for in

the detailed technical specifications should be enclosed.

(b) The bidder may be asked to make presentation of the proposed solution.

(c) The Technical specifications may be fine-tuned on the basis of discussions with various

Bidders during Technical Bid evaluation process.

7.4 Commercial Bid consisting of the following: -

(a) Bid prices for the fine-tuned Technical Specifications duly filled, signed and complete as

per the Price Schedule on the prescribed Quotation Performa (Performa-III).

(b) The commercial bid - The bidder is required to submit price bid as per Performa III.

• The prices will be valid for a period of six months from the date of signing the

contract.

• HRD, Bihar may issue order(s) for any quantity as per its requirements within

one year and the bidder shall be required to supply and install the requisite

units at the specified Colleges/locations.

SECTION - III

TERMS AND CONDITIONS OF THE BID

1.1 The Department reserves the right to carry out the capability assessment of the

Bidders and the Department’s decision shall be final in this regard.

1.2 The bidder shall not sub-contract any part of the contract without written

permission of the Department.

2 STANDARDS:

The Goods supplied under this contract shall conform to the standard mentioned in

the Fine tuned Technical Specifications, and when no applicable standards are

mentioned, to the authoritative standards. Such Standard shall be the latest issued

by the concerned institution governing that standard.

3 INSTALLATION PERIOD :

3.1 The delivery and Installation period would 6 weeks from the date of signing the

contract.

3.2 In the event of delay in the supply and /installation, specified above, the bidder shall

be liable to pay a penalty @ 2% for the TOTAL MONTHLY QUOTED CHARGE for

every week of delay subject to a maximum of 10% for that value, after which the

Department shall be at liberty to cancel the contract. For the purpose of this clause,

part of a week shall be considered to be a full week.

3.3 The delivery/ installation period should be adhered to as will be mentioned in the

Award of Contract. The supply shall actually be deemed to have been complete on

the actual date of entire installation of all components/ items.

4 DELAY IN THE BIDDER’S PERFORMANCE & PENALTY:

4.1 The bidder shall submit a performance Bank Guarantee of Rs. 20 lac in the

prescribed Performa within 4 (four) weeks of the signing of the contract and would

be valid for warranty period.

4.2 An unexcused delay by the agency in the performance of its installation obligations

shall render him liable to any or all of the following penalties:-

4.2.1 In case of non/ partial installation of the equipment within a stipulated

period, penalty @ 2% of total contract value for every week of delay subject

to a maximum of 10% of the total contract value, after which Department,

shall be at liberty to cancel the contract. For the purpose of this clause, part

of a week shall be considered to be a full week.

4.2.2 Forfeiture of earnest money/Security/Invoking the Bank Guarantee.

4.3 Hiding of facts, misrepresentation, corrupt practices by the Bidder if revealed at any

stage, would amount to forfeiture of EMD/Invocation of Bank Guarantee and

subsequently the firm may also be blacklisted.

5 USE OF CONTRACT DOCUMENTS AND INFORMATION

5.1 Agency shall not, without the Department’s prior written consent, disclose the

contract or any provision thereof, or any specification, plan, drawing, pattern,

sample or information furnished by or on behalf of Department in connection

therewith to any person other than a person employed by Agency in the

performance of the contract. Disclosure to any such employed person shall be made

in confidence and shall extend only as far as may be necessary for purposes of such

performance.

5.2 Agency shall not without the purchaser’s prior written consent, make use of any

document or information.

5.3 Any document other than the contract itself shall remain the property of the

Department and shall be returned (in all copies) to the Department on completion

of the service provider’s performance under the contract if so required by the

Department.

6 SCHEDULE OF PAYMENT:

6.1 The payment terms shall be as per follows:

For Hardware - The Payment shall be made on a monthly basis after the invoice is

raised by the bidder depending upon the operational machines. The operationally

of the machines shall have to be certified by the Principal/Registrar or any other

officer duly authorized by the HRD.

For Manpower - The Payment shall be made on a monthly basis after the invoice is

raised by the bidder depending upon the attendance of the manpower deployed.

The attendance shall have to be certified by the Principal/Registrar or any other

officer duly authorized by the HRD.

6.2 PENALTY:

For Hardware – For every biometric Device /Computer that remains in- operational

for more than 48 hours, a penalty shall be levied of Rs. 1,000/- (Rupees One

Thousand Only) per day. It is expected that the bidder shall replace/repair the

device/computer within 48 hours. In case the firm fails to maintain the 97% uptime

of the system at each location, then it will be liable for an additional penalty @ 0.5%

of the total Contract value. The penalty will be adjusted from the monthly payable

charge to the bidder.

For Manpower – For every single day of absence of the employee of the bidder, a

deduction of Rs. 500/- (Rupees Five Hundred only) shall be made.

7 WARRANTY PERIOD:

7.1 Biometric Attendance System: The firm will be responsible for a comprehensive

warranty of three years for all items.

7.2 The firm will not remove the equipment without the written permission of the

Principal of the College or Registrar of the University.

7.3 The response time for attending the faults will be six hours after reported to the

firm through Fault logging System. The firm will rectify the faults within 36 clock

hours failing which the service provider will arrange temporary replacements in next

48 clock hours. The services shall be provided Mondays to Saturdays on working

hours.

7.4 The firm will do preventive maintenance (PM) once in three months for the supplied

equipment running. Fault Logging System will have the provision of data of PM’s

record. The PM may generally be done on Non-working days/Beyond General Shift

Hours with the prior permission of the Principal.

7.5 In case of default, the Department will have the right to arrange maintenance at the

risk and cost of the firm from any other source and shall adjust the charges from the

Performance Bank Guarantee. Department decision shall be final in this regard and

will be binding on the firm.

7.6 Based on these parameters, detailed Agreement will be signed with the firm at the

time of awarding of contract.

8 TAXES AND DUTIES:

The bidder shall be entirely responsible for all taxes, levies, Cess, Octroi, Duties, License

fees, etc. incurred until delivery and operation of the contracted equipment to the

purchaser. The Department will issue no C or D forms.

9 INSURANCE:

The equipment supplied under the contract shall be fully insured throughout the contract

period of three years by the bidder against loss, theft or damage.

10 SUSPENSION:

10.1 The Department may by a written notice of suspension to the Firm, suspend all

payments to the Firm under the contract, if the Firm failed to perform any of its

obligations under this contract provided that such notice of suspension:

10.1.1 Shall specify the nature of the failure.

10.1.2 Shall request the bidder to remedy such failure within a specified period

from the date of receipt of such notice of suspension by the bidder.

11 TERMINATION FOR DEFAULT:

11.1 The Department may, without prejudice, to any other remedy for breach of contract,

by written notice of default sent to the bidder, terminate the contract in whole or in

part if:

11.1.1 The bidder fails to deliver any or all of the obligations within the time

period(s) specified in the contract, or any extension thereof granted by the

Department.

11.1.2 The bidder fails to perform any other obligation(s) under the contract.

11.1.3 The Firm shall be given maximum of two opportunities of 30 days each to

improve his service level and meet the obligations as per the contract.

12 TERMINATION FOR INSOLVENCY:

The Department may at any time terminate the contract by giving written notice to the

bidder without compensation to the bidder, if the bidder becomes bankrupt or otherwise

insolvent, provided that such termination will not prejudice or affect any right of action or

remedy which has accrued thereafter to the Department.

13 “NO CLAIM” CERTIFICATE:

The bidder shall not be entitled to make any claim, whatsoever, against the Department

under or by virtue of or arising out of this contract nor shall the Department entertain or

consider any such claim, if made by the bidder after he shall have signed a “no claim”

certificate in favour of the Department in such forms as shall be required by the

Department after the works are finally accepted.

14 DOCUMENTS PREPARED BY THE BIDDER TO BE THE PROPERTY OF THE DEPT.

All plans, software, drawings, specifications, designs and other documents prepared by the

bidder in the execution of the contract shall become and remain the property of the

Department, and before termination or expiration of this contract, the bidder shall deliver

all such documents to the Department under the contract along with the detailed inventory

thereof.

15 CONFIDENTIALITY:

The bidder and their personnel shall not, either during the term or after expiration of this

contract, disclose any proprietary or confidential information relating to the services,

contract or the Department’s business or operations without the prior written consent of

the Department.

16 FORCE MAJEURE:

16.1 Notwithstanding the provisions of the bid, the bidder shall not be liable for

forfeiture of its performance security, liquidated damages or termination for default,

if and to the extent that, its delay in performance are other failure to perform its

obligations under the contract is the result of an event of Force Majeure.

16.2 For purposes of this Clause, “Force Majeure” means an event beyond the control of

the bidder and not involving the bidder and not involving the bidder’s fault or

negligence and not foreseeable. Such events may include, but are not restricted to,

acts of the Department either in its sovereign or contractual capacity, wars or

revolutions, fires, floods, epidemics, quarantine restrictions and freight embargoes.

16.3 If a Force Majeure situation arises, the bidder shall promptly notify the Department

in writing of such conditions and the cause thereof. Unless otherwise directed by

the Department in writing, the bidder shall continue to perform its obligations

under the contract as far as reasonably practical, and shall seek all reasonable

alternative means for performance not prevented by the Force Majeure event. The

Department may terminate this contract, by giving a written notice of minimum 30

days to the bidder, if as a result of Force Majeure, the bidder being unable to

perform a material portion of the services for a period of more than 60 days.

17 GOVERNING LANGUAGE:

The contract shall be written in the language of the bid, as specified by the Department, in

the instructions to the bids.

18 OTHER CONDITIONS:

18.1.1 Risk purchase at the cost of bidder will be made on the failure of the bidder to

make supply as per Terms and Conditions. The difference of excess in cost thus

incurred will be received from the bidder in a suitable manner and even from his

pending bills, earnest money or security whichever is available.

18.1.2 All disputes shall be subject to Patna High Court Jurisdiction.

Biometric Data • All installed Biometric devices data should be preserved in its original form and provided to the Department. The data may be required for Audit or any other issue arising in future.

• Suitable Penalty may be imposed on the Bidder if there is loss of data.

Note:

1. The bidder will be required to make presentation of proposed solution for Biometric

Based Attendance System as per above-mentioned specifications during the

Technical bid. The Bidder will be required to show demonstration of the quoted

USE OF NEW, GENUINE AND QUALITY COMPONENTS FOR IT RESOURCES

This has reference to the quoted/to be supplied by your Department against the tender for

Biometric Devices.

We hereby undertake that all the components/parts/assembly/software to be used in

Biometric Based Attendance System shall be original, new, genuine and as per the said technical

specifications from respective OEM(s) of the quoted products. It is also certified that no

refurbished/duplicate/second-hand components/parts/assembly/software are being used or shall

be used.

We shall also submit a certificate from the OEM supplier in support of above undertaking at

the time of delivery. It will be our responsibility to produce such letters from our OEM supplier’s

within a reasonable time. In case we are found not complying with above indicated undertaking at

the time of delivery or during installation, we allow the Human Resource Development

Department to take appropriate action (e.g. Forfeiture of Bank Guarantee/EMD).

Annexure B

Schedule for Manpower Deployment

2 Programmers - 2 B.Tech. Computer Science or MCA with minimum 3 years of experience of software development and they should be capable of developing or modifying the software supplied by the vendor as per the HRD Department’s need.

3 Data Assistant – 1 in each College.

BCA or B.Sc. (IT) or PGDCA with 1 year Experience.

Note – The above deployment indicates that the cost on manpower deployment is fixed on a

monthly basis. The Department shall pay the above cost as per the number of manpower

employed directly to the bidder and this shall not form part of the Commercial BID. The

Department shall not pay the manpower cost directly to the personnel.

Screening Committee – There shall be a Screening Committee comprising of the experts of

NIC and officials of DHRD to shortlist the Manpower to be supplied by the Bidder. The

personnel shall have to be removed by the bidder on the directions of the DHRD. There shall

be a separate Agreement with the Bidder on the terms and conditions regulating the

supply/control of the Mnpower.
