Road Safety Road Rules Further Amendment Rules 2012

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Rules:

1 Objective

The objective of these Rules is to—

(a) make changes to the rules relating to speed-limits for drivers of heavy vehicles;

(b) create a new offence of entering a blocked crossing;

(c) make changes concerning the use of portable warning triangles in relation to stopped large heavy vehicles and fallen loads;

(d) make various technical amendments concerning—

(i) the minimum separation distance to be kept between long vehicles;

(ii) the use of pavement bars and markers in dividing strips;

(iii) double parking;

(iv) crossing roads at traffic lights when the traffic lights change;

(v) the approval and use of seatbelts, including the addition to the dictionary of a definition of approved seatbelt;

(vi) the use of visual display unit driver aids by motor bike riders;

(vii) the approval by VicRoads of various items for the purposes of the Rules;

(e) make other minor technical amendments to improve the operation of the Rules.

2 Authorising provision

These Rules are made under section 95D of the Road Safety Act 1986.

3 Commencement

These Rules come into operation on 30 June 2012.

4 Principal Rules

In these Rules, the Road Safety Road Rules 20091 are called the Principal Rules.

5 Speed-limits for drivers of heavy vehicles

(1) For rule 20(2) of the Principal Rules substitute—

"(2) For the purposes of this rule a heavy vehicle includes a motor vehicle (other than a bus) that has a GCM greater than 14·5 tonnes.".

(2) For note 5 at the foot of rule 20(2) of the Principal Rules substitute—"5 Bus, GCM and heavy vehicle are

defined in the Act.".

(3) For rule 21(2) of the Principal Rules substitute—

"(2) However, if the number on the speed-limit sign is over 100 the speed-limit applying to the driver for the length of road is 100 kilometres per hour if the driver is driving—

(a) a bus with a GVM over 5 tonnes; or

(b) a prime mover with a GCM over 22 tonnes; or

(c) a vehicle other than a bus with a GVM over 12 tonnes.".

(4) In note 2 at the foot of rule 21(2) of the Principal Rules, after "applying to" insert "the".

6 Substitution of last dot point in note 1 under heading to Part 7

In note 1 under the heading to Part 7 of the Principal Rules, for the last dot point substitute—

"● for pedestrians crossing the road near a stopped tram—rules 163, 164 and 164A.".

7 Keeping a minimum distance between long vehicles

In rule 127(2) of the Principal Rules—

(a) for the definition of required minimum distance substitute—

"required minimum distance means—

(a) for a road train that is behind a long vehicle—200 metres; or

(b) for a long vehicle other than a road train that is behind a long vehicle—60 metres;";

(b) in the definition of road train, for "2009;" substitute "2009.";

(c) the definition of road train area (including the note at the foot of that definition) is revoked.

8 New rule 128A inserted

After rule 128 of the Principal Rules insert—

"128A Entering blocked crossings

(1) A driver must not enter a children's crossing, marked foot crossing or pedestrian crossing if the driver cannot drive through the crossing because the crossing, or a road beyond the crossing, is blocked.

Penalty: 3 penalty units.Example

The crossing, or a road beyond the crossing, may be blocked by congested traffic, a disabled vehicle, a collision between vehicles or between a vehicle and a pedestrian, or by a fallen load on the road.

Note

Children's crossing, driver, enter, intersection, marked foot crossing and pedestrian crossing are defined in the dictionary.

(2) Despite subrule (1), a driver may enter a children's crossing or a pedestrian crossing if—

(a) the crossing is immediately before an intersection that does not have traffic lights; and

(b) the crossing is not blocked; and

(c) before entering the crossing, the driver gives way to any pedestrian on the crossing.".

9 Keeping off a dividing strip

After rule 137(2) of the Principal Rules insert—

"(2A) For the purposes of subrule (2), a dividing strip is to be treated as being at the same level as the road even if it contains one or more raised pavement bars or markers.".

10 Driving past the rear of a stopped tram at a tram stop

For rule 163(3)(a) of the Principal Rules substitute—

"(a) one or more of the doors on the side of the tram closest to the driver are open or opening; or".

11 Stopping beside a stopped tram at a tram stop

For rule 164(3)(a) of the Principal Rules substitute—

"(a) one or more of the doors on the side of the tram closest to the driver are open or opening; or".

12 Double parking

(1) For rule 189(1) of the Principal Rules (including the note at the foot of that subrule) substitute—

"(1) A driver must not stop on a road if to do so would put any part of the vehicle that he or she is driving between a vehicle that is parked on the road and the centre of the road.

Penalty: 3 penalty units.Note

One-way road and two-way road are defined in the dictionary.

(2) For the examples at the foot of rule 189(2) of the Principal Rules substitute—"Example

Vehicles parked in a parking area—not in contravention of this rule.

In the example, the angle-parked vehicles are not stopped in contravention of this rule.".

13 Making a motor vehicle secure

In rule 213(4) of the Principal Rules—

(a) for "(i)" substitute "(a)";

(b) for "(ii)" substitute "(b)".

14 Using portable warning triangles

For rules 227(2) to (5) (including the notes at the foot of subrules (2) and (5)) of the Principal Rules substitute—

'(2) If the driver stops on a road, or if some or all of any load being carried by the vehicle falls on to a road, at a place where the speed limit is 80 kilometres per hour or more and the vehicle is not visible at any time for at least 300 metres in all directions from that place,

the driver must use at least 3 portable warning triangles, placed in accordance with subrule (4), to warn other road users of the vehicle or load.

Penalty: 3 penalty units.Notes

1 Portable warning triangle is defined in the dictionary and road user is defined in rule 14.

2 See rule 220 for the requirement to operate certain lights on vehicles that are stopped.

(3) If the driver stops on a road, or if some or all of any load being carried by the vehicle falls on to a road, at a place where the speed limit is less than 80 kilometres per hour and the vehicle is not visible at any time for at least 200 metres in all directions from that place, the driver must use at least 3 portable warning triangles, placed in accordance with subrule (5), to warn other road users of the vehicle or load.

Penalty: 3 penalty units.

(4) For the purposes of subrule (2), the driver must—

(a) place 1 triangle at least 200 metres, but not over 250 metres, behind the vehicle or fallen load; and

(b) if the vehicle or fallen load is on a one-way or divided road, place 1 triangle between the triangle required by paragraph (a) and the vehicle or fallen load; and

(c) if the vehicle or fallen load is not on a one-way or divided road, place 1 triangle at least 200 metres, but not

over 250 metres, in front of the vehicle or fallen load; and

(d) place 1 triangle at the side of the vehicle or fallen load in a position that gives sufficient warning to other road users of the position of the vehicle or fallen load.

Note

One-way road is defined in the dictionary and divided road is defined in subrule (7).

(5) For the purposes of subrule (3), the driver must—

(a) place 1 triangle at least 50 metres, but not over 150 metres, behind the vehicle or fallen load; and

(b) if the vehicle or fallen load is on a one-way or divided road, place 1 triangle between the triangle required by paragraph (a) and the vehicle or fallen load; and

(c) if the vehicle or fallen load is not on a one-way or divided road, place 1 triangle at least 50 metres, but not over 150 metres, in front of the vehicle or fallen load; and

(d) place 1 triangle at the side of the vehicle or fallen load in a position that gives sufficient warning to other road users of the position of the vehicle or fallen load.

(6) A reference to "the vehicle or fallen load" in subrules (4) and (5) is to be read as a reference to "the vehicle or fallen load, as the case may be".

(7) In this rule—

divided road means any length of a two-way road that has a median strip other than a median strip that consists only of lines painted on a road related area; and

road does not include a road related area, but includes any shoulder of the road.Notes

1 Two-way road and median strip are defined in the dictionary, road related area is defined in rule 13, and shoulder is defined in rule 12.

2 Although the presence of a median strip is necessary to establish that a road is a divided road, for the purposes of this rule the median strip is not part of the road (as it is a road related area).'.

15 Crossing a road at traffic lights

(1) In rule 232(3)(b) of the Principal Rules, for "nearest" substitute "far".

(2) After rule 232(3) of the Principal Rules insert—

"(3A) Despite subrule (3), in the circumstances set out in that subrule the pedestrian may instead return to the side of the road, or to the safety area, that he or she has just left, but only if—

(a) at the time the lights change, that side or safety area is closer to him or her than the side or safety area (whichever is the closer) that he or she was heading for at that time; and

(b) he or she does not stay on the road for longer than is necessary to return to that side or safety area.".

16 Crossing a road to or from a tram

In note 2 at the foot of rule 233(5) of the Principal Rules, for "164." substitute "164A.".

17 Proceeding when bicycle crossing lights change to yellow or red

(1) In rule 262(2)(b) of the Principal Rules, for "nearest" substitute "far".

(2) After rule 262(2) of the Principal Rules insert—

"(2A) Despite subrule (2), in the circumstances set out in that subrule the rider may instead return to the side of the road, or to the safety area, that he or she has just left, but only if—

(a) at the time the lights change, that side or safety area is closer to him or her than the side or safety area (whichever is the closer) that he or she was heading for at that time; and

(b) he or she does not stay on the road for longer than is necessary to return to that side or safety area.".

18 Wearing of seatbelts by drivers

(1) In rule 264(1) of the Principal Rules, for "a seatbelt" substitute "an approved seatbelt".

(2) For the note at the foot of rule 264(1) of the Principal Rules substitute—"Note

19 Wearing of seatbelts by passengers 16 years old, or older

(1) In rule 265(2)(a) of the Principal Rules, for "a seatbelt" substitute "an approved seatbelt".

(2) At the foot of rule 265(2) of the Principal Rules, insert the following note—"Note

Approved seatbelt is defined in the dictionary.".

20 Wearing of seatbelts by passengers under 16 years old

(1) In rule 266(2B)(b) of the Principal Rules, for "a seatbelt" substitute "an approved seatbelt".

(2) For note 1 at the foot of rule 266(2B) of the Principal Rules substitute—"1 Approved child restraint and approved booster seat are

defined in subrule (7), forward facing is defined in subrule (6A) and approved seatbelt is defined in the dictionary.".

(3) For rule 266(3A) of the Principal Rules substitute—

"(3A) A passenger who is 4 years old or older, but is less than 7 years old, must not be in the front row of a motor vehicle that has 2 or more rows of seats unless in the row or rows behind the front row—

(a) all of the other seats are occupied by passengers who are also less than 7 years old; or

(b) there is no empty seating position in which the passenger can sit in accordance with this rule.

This subrule would permit a 6 year old to sit in the front row of a vehicle that has 2 rows of seats if 2 occupied approved child restraints in the back row encroached on an empty seating position between them in a way that made it impossible for another approved child restraint or booster seat to be placed in that position.".

(4) In rule 266(4)(b)(i) of the Principal Rules, for "seatbelt" substitute "approved seatbelt".

(5) For the note at the foot of rule 266(5) of the Principal Rules substitute—"Notes

1 Approved child restraint and approved booster seat are defined in subrule (7) and public minibus and taxi are defined in the dictionary.

2 Despite the exemption provided by this subrule, in order to comply with subrule (5A), the driver of a public minibus or taxi must ensure that passengers who are 1 year old or older, but less than 7 years old, wear an approved seatbelt.".

(6) For the note at the foot of rule 266(5AA) of the Principal Rules substitute—"Notes

1 Approved child restraint and approved booster seat are defined in subrule (7) and tow truck is defined in the dictionary.

2 Despite the exemption provided by this subrule, in order to comply with subrule (5A), the driver of a tow truck must ensure that passengers who are 1 year old or older, but less than 7 years old, wear an approved seatbelt.".

(7) In rule 266(5A) of the Principal Rules, for "suitable seatbelt" substitute "suitable approved seatbelt".

(8) In rule 266(6)(b) of the Principal Rules, for "seatbelt" substitute "approved seatbelt".

(9) For rule 266(7) of the Principal Rules substitute—

"(7) In this rule—

approved booster seat means a child restraint that is approved, for the purposes of these Rules, by the Corporation under rule 407(a);

approved child restraint means a child restraint that is approved, for the purposes of these Rules, by the Corporation under rule 407(b);

approved child safety harness means a child safety harness that is approved, for the purposes of these Rules, by the Corporation under rule 407(c).".

21 Exemptions from wearing seatbelts

(1) In rule 267(1)(c) of the Principal Rules, for "in a" substitute "in or on a".

(2) In rule 267(4)(a) of the Principal Rules, for "in which" substitute "in or on which".

22 Approved motor bike helmet

In rule 270(3) of the Principal Rules, for the definition of approved motor bike helmet substitute—

"approved motor bike helmet means a protective helmet for motor bike riders that is approved, for the purposes of these Rules, by the Corporation under rule 407(d);".

23 Television receivers and visual display units in motor vehicles

In rule 299(2)(aa) of the Principal Rules, for "aid;" substitute "aid, and the driver is not holding the visual display unit in his or her hand;".

24 Leading an animal while driving a vehicle

In the heading to rule 301 of the Principal Rules, for "driving" substitute "in or on".

25 Approved horse riding helmet

For rule 303A(4) of the Principal Rules substitute—

"(4) In this rule approved horse riding helmet means a helmet that is approved, for the purposes of these Rules, by the Corporation under rule 407(e).".

26 New rules 407 and 408 inserted

After rule 406 of the Principal Rules insert—

"407 Corporation may declare or approve items for the purposes of the Road Rules

The Corporation, by notice published in the Government Gazette, may declare, for the purposes of these Rules—

(a) a booster seat to be an approved booster seat;

(b) a child restraint to be an approved child restraint;

(c) a child safety harness to be an approved child safety harness;

(d) a motor bike helmet to be an approved motor bike helmet;

(e) a horse riding helmet to be an approved horse riding helmet;

(f) a bicycle helmet to be an approved bicycle helmet;

(g) items to be approved as portable warning triangles;

(h) a seatbelt to be an approved seatbelt.

408 Transitional provision—Corporation approvals

(1) The approval of a booster seat by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(a); and

(b) may be amended or revoked accordingly.

(2) The approval of a child restraint by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(b); and

(b) may be amended or revoked accordingly.

(3) The approval of a child safety harness by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(c); and

(b) may be amended or revoked accordingly.

(4) The approval of a motor bike helmet by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(d); and

(b) may be amended or revoked accordingly.

(5) The approval of a horse riding helmet by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(e); and

(b) may be amended or revoked accordingly.

(6) The approval of a bicycle helmet by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(f); and

(b) may be amended or revoked accordingly.

(7) The approval of a portable warning triangle by the Corporation under these Rules in force immediately before 30 June 2012—

(a) is taken to be an approval declared by the Corporation under rule 407(g); and

(b) may be amended or revoked accordingly.".

27 Dictionary

In the dictionary to the Principal Rules—

(a) for the definition of approved bicycle helmet substitute—

"approved bicycle helmet means a bicycle helmet of a type that is approved, for the purposes of these Rules, by the Corporation under rule 407(f);";

(b) insert the following definition—

"approved seatbelt means a seatbelt of a type that is approved, for the purposes of

these Rules, by the Corporation under rule 407(h);";

(c) for the definition of portable warning triangle substitute—

"portable warning triangle means a portable warning triangle of a type that is approved, for the purposes of these Rules, by the Corporation under rule 407(g) and that is capable of—

(a) producing a clear red warning light visible at a distance of 200 metres from the device; or

(b) showing a red reflection of light from a headlamp attached to a motor vehicle approaching the portable device between sunset and sunrise visible 200 metres from the device;";

(d) in the definition of taxi, for "Miscellaneous" substitute "Miscellaneous)".═══════════════
