I t is absolutelyunbelievable to m e that i t takes your lone voice to expose the .revoltinggang -up in this country against IT &T for having t h ~ i t t o oppose aCommunistic dictatorship which was trying to x p ~ propertybelonging to American shareholders. The Administration's handlingof this , and the way i t has perm itted this Watergate nonsense to beblown out of all proportion and to be used as a strict political issue bythe Ervin Committee, using third-hand hearsay to ~ p e o p l eall of this is most discouraging.

    I would Wm to chat with you about New York politics whenyou get the chance. The sentence in your recent column about somethings stil l functioning in New York, as indicating that Lindsay's workis stil l not finished, real ly broke up everyone in the political world.

    The latest on the Defiance is that it out of fuel offHaiti and was towed into Kingston, Jamaica, by aJ 'ugboat, the ownersof which now asser t that they own the Defiance because i t becamesalvage when i t ran out of fuel. At the moment, I have talked them intol i t igating here in New York, so i the boat isn ' t nationalized by theJamaican Government, with the approval of the State Department becauseof m y dangerous political tendencies, we will have it avai lab l e shortlyfor our reunion.

    Since i t was recognized, inter al ia that the issue of standing to raise these issues \ t0uld be challenged, defendant also requested anevidentiary hearing prior to trial for the purpose of deteermining this andother matters. Defendant s memorandum in support of said motion, also filedon July 18, 1972, asserted that under Title 18 U.S.C. Sections 2510(11) and2518(10)(a), defendant was clearly an aggrieved per?On as to those commun-

    i c a ~ i o n s in which he himself participated but also further asserted that hewas an aggrieved person as to all of the interceptions on the ground that hewas 11 a person against whom the interception was directed 11 , and that variousof the applications for warrants were in fact subterfuges to conceal the same.After arguing this last point .at some length the memorandum continued:

    11 In addition to the foregoing, i t is respectfully submittedthat the within motions raise other substantial questions of factand law which require full hearing and determination prior totrial . . .

    Subsequently, even after the Court below, in a mistaken application of,Poeta, limited the pre-trial hearing tm solely to the issue of the timeliness

    tAo( .the amendment of the warrant App. appendi x 2 0 a - 2 6 ~ counsel for appellantsougbt unsuccessfully to . reintroduce the issue of minimization of Rattenni sown .conv.ersations over the Boggi a tap, and to distinguish Poeta on the groundthat appellant was not attempting to assert violations of another s Constituti na lrights, but of his own. Thus, counsel argued App. appendix 56a-57a):

    The only t R thing, t seems to me, t might be argued thatRattenni loses [under Poeta] insofar as conversations areconcerned is the continuation of tapping, which happens to comeup in t his case in a few minutes. But insofar as the Boggia tapis concerned, he has every standing under the statute and under2515 and 2518 to talk about conversations in which he himselfwas a party and an aggrieved person under definitiBn of thestatute, and the only thing he loses is the indiscriminatecontinuation of the R Boggia tap on matters unrelated to him.But he retains, I respectfully suemit, under all the decisions,the rights affecting the very conversations to which he \tas aparty and an aggrieved person and where there is a cl ear case ofprivity and standing.

    The Court cut this argument short by noting that t had a viewof the law different from the one just expressed.

    Clearly, the issue of minimization was fully raised below.

    involved in this case was over Boggia 1 s telephone ln: mWlmld on January 12,on January 13th.1972, and was f o l 1 0 ~ 1 e d by a series of c o n v e r s a t i o n s r t t M M M f M l l f t M t t t ~ M M ~ (Govt.to be exact,brief, p. 3-6). \'.lithin days, on January 17, 7 2 ~ the District=film Attorneyof Westchester County al then im: rbi initiated a tap on Rattenni s owntelephone (allegedly in connection with a continuing gambling i n v e s t i ~ a t i o n .At the hearing below, counsel for app ellant sought to cross-examne theAssistant District Attorney concerning this Rattenni wire tap in an attemptto show that in truth, t ~ e his office had sufficient informat ion by January17th x to apply for an amendment of the Boggia warrant. However, evenhere, the Court below improperly limited the questioning: (App. appendixpp. 69a -70a)

    we are really dealing with good faith here, insofar as t he practicabi l i ty of an amendment and good f ai th insofar as compliancewith the statute is concerned, and I think I might have a l i t t leTHE COURT : You are talking about an amendment to an order andnot a Rattenni tap. The objection is sustained.MR COHN: Your Honor, m ght there hi} be relevance i f xa basedupon certain conversations a conclusion was reached sufficient to put
