DEMOLITIONWHEREAS, the City of Rising Sun believes that theestablishment of anOrdinance regulating demolition is in the best inter-est of the citizens of Rising Sun,Indiana.NOW, THEREFORE, BE IT ORDAINED BY THE COM-MON COUNCIL OF THECITY OF RISING SUN, INDIANA as follows:Section 1. Permit RequiredIt shall be unlawful to wreck or demolish any build-ing or structure in the city without first a permittherefore.Section 2. Application for Permit(A) An application for a permit to wreck or demolishany building or structure in the city shall be made inwriting to the Zoning Administrator. Such applica-tion shall give the location of the building or struc-ture, the date when wrecking or demolition is tocommence and the approximate time which suchwrecking or demolition shall take.(B) The Zoning Administrator shall notify other par-ties that may be affected by the proposed demoli-tion (utilities, property owners, governmental enti-ties) as he/she may deem necessary before the startof demolition.Section 3. Supervision by Authorized Representa-tive of the City of Rising SunAn authorized representative of the City of RisingSun shall supervise such wrecking or demolition orfilling and shall inspect such premises as neces -sary during such wrecking or demolition and fillingand the required capping of taps, or abandonedsewer or water lines.Section 9. Enforcement(A) Upon completion of demolition, the City shall in-spect the property to ensure compliance with therequirements of the Chapter. If the demolition workis properly completed, the City shall issue a "Com-pletion Certificate" to the property owner. This cer-tificate shall allow the Owner to redevelop the prop-erty according the requirements of the City of Ris-ing Sun Zoning Ordinance and other applicableregulations, or to use the property as a yard.(B) If the inspection performed by the City deter -mines that the applicant is not in full compliancewith the requirements of the demolition permit andthis Chapter, the Zoning Administrator shall advisethe applicant in writing of the terms of non-compli-ance. The applicant shall have thirty (30) days fromthe date of the notice to comply and, if full compli-ance is made, the City shall issue a completion cer-tificate.(C) In the event that the applicant fails to complywithin thirty (30) days of the notice given pursuantto (B) above, the applicant shall be in violation ofthis ordinance which violation shall be treated as anuisance subject to abatement and enforcement asall other nuisance violations.Section 10. Supervision by Authorized Representa-tive of the City of Rising SunAn authorized representative of the City of RisingSun shall supervise such wrecking or demolition orfilling and shall inspect such premises as neces -sary during such wrecking or demolition and fillingand the required capping of taps, or abandonedsewer or water lines.Section 9. Enforcement(A) Upon completion of demolition, the City shall in-spect the property to ensure compliance with therequirements of the Chapter. If the demolition workis properly completed, the City shall issue a "Com-pletion Certificate" to the property owner. This cer-tificate shall allow the Owner to redevelop the prop-erty according the requirements of the City of Ris-ing Sun Zoning Ordinance and other applicableregulations, or to use the property as a yard.(B) If the inspection performed by the City deter -mines that the applicant is not in full compliancewith the requirements of the demolition permit andthis Chapter, the Zoning Administrator shall advisethe applicant in writing of the terms of non-compli-ance. The applicant shall have thirty (30) days fromthe date of the notice to comply and, if full compli-ance is made, the City shall issue a completion cer-tificate.(C) In the event that the applicant fails to complywithin thirty (30) days of the notice given pursuantto (B) above, the applicant shall be in violation ofthis ordinance which violation shall be treated as anuisance subject to abatement and enforcement asall other nuisance violations.Section 10. PenaltyAny person or firm or corporation violating any pro-visions of Section 1 through 9 above shall be finednot less than $100.00 nor more than $500.00 foreach offense, plus court costs and other expensesincurred in the enforcement of the said sections,and a separate offense shall be deemed committedon each day during or on which a violation occursor continues.This penalty is in addition to any penalties providedfor in Section 9(C).ADOPTED AND PASSED BY THE BY THE COMMONCOUNCIL OF THE CITY OFRISING SUN, INDIANA THIS 7TH DAY OF JUNE,2012."AYE"
