DEMOLITIONWHEREAS, the City of Rising Sun believes that theestablishment of anOrdinance regulating demolition is in the best inter-est of the citizens of Rising Sun,Indiana.NOW, THEREFORE, BE IT ORDAINED BY THE COM-MON COUNCIL OF THECITY OF RISING SUN, INDIANA as follows:Section 1. Permit RequiredIt shall be unlawful to wreck or demolish any build-ing or structure in the city without first a permittherefore.Section 2. Application for Permit(A) An application for a permit to wreck or demolishany building or structure in the city shall be made inwriting to the Zoning Administrator. Such applica-tion shall give the location of the building or struc-ture, the date when wrecking or demolition is tocommence and the approximate time which suchwrecking or demolition shall take.(B) The Zoning Administrator shall notify other par-ties that may be affected by the proposed demoli-tion (utilities, property owners, governmental enti-ties) as he/she may deem necessary before the startof demolition.Section 3. Fees, Inspections and Evidence of Insur-anceBefore a permit is issued:(A) The applicant shall pay to the City Clerk/Treas-urer a fee as prescribed by Ordinance 2006-3 of theCity of Rising Sun Zoning Ordinances, plus a feescale for moving any utility facilities. Care shall be takento protect neighboring structures with adequateshoring and whatever else is needful to protectsuch structures. Adequate protection shall be pro-vided to prevent injury to any city or public utility orpertinence. It shall be the duty of all persons work-ing on or responsible for such wrecking or demoli-tion to see to it that children are warned away fromsuch premises and are not permitted to play in oron or frequent such structures.Section 7. Excavation and Filling(A) If excavation is necessary from wrecking or de-molishing, it is to be filled in and the material to beused for such fill should consist of clay, and/orbank run, gravel (or equivalent), and no appliances,such as stoves, refrigerators, freezers and similaritems, shall be used, no wood materials are to beused for filling, and no brick, concrete block, fromeither the demolished structure, from the demoli-tion site, or from off site , shall be used to fill the ex-cavation cavity. In the filling of such excavation theprovisions contained in Fees, Inspections and Evi-dence of Insurance shall be adhered to as it relatesto danger to sewer or water connections, or electri-cal wires or connections. Such tilling shall also pro-vide for proper and adequate drainage.
