    'Spirits or distilled spirits' is the substance known as ethyl alcohol, ethanol or spirits of wine, including all dilutions,

    purifications and mixtures thereof, from whatever source, by whatever process produced, and shall include whisky, brandy,

    rum, gin and vodka, and other similar products or mixtures

    AN ACT INCREASING THE EXCISE TAX RATES IMPOSED ON ALCOHOL AND TOBACCO PRODUCTS, AMENDING FOR THE

    PURPOSE SECTIONS 131,141, 142, 143, 144, 145 AND 288 OF THE NATIONAL INTERNALREVENUE CODE OF 1997, AS

    AMENDED

    SECTION 1. Section 141 of the National Internal Revenue Code of 1997, as amended, is hereby further amended to read as

    follows:

    "SEC. 141. Distilled Spirits. - On distilled spirits, there shall be collected, subject to the provisions of Section 133 of this Code,

    excise tax ; as follows:

    "(a) If produced from the sap of nipa, coconut, cassava, camote, or buri palm or from the juice, syrup or sugar of the cane,

    provided such materials are produced commercially in the country where they are processed into distilled spirits, per proof

    liter, Eleven pesos and sixty-five centavos (P11.65);

    "(b) If produced from raw materials other than those enumerated in the preceding paragraph, 'the tax shall be in accordance

    with the net-retail price (the price at which the distilled spirits is sold on retail in at least (10) major supermarkets in Metro

    Manila per bottle of 750 ml. or 5 major supermarkets outside Metro Manila) per bottle of 750 ml.

    "(1) Less than (P250.00) - ('126.00), per proof liter;

    "(2) (P250.00) up to (P675.00) - ('252.00), per proof liter;

    "(3) More than (P675.00) - ('504.00), per proof liter.

    Under the current rates, spirits meeting the raw materials requirement are taxed at 13.59 pesos/proof litre. Distilled spirits

    which do not meet the raw materials requirement are taxed at between 146.97 and 587.87 pesos/proof litre dependent on the

    retail price

    GATT Article III:2

    "1. The [Members] recognize that internal taxes and other internal charges, and laws, regulations andrequirements affecting the internal sale, offering for sale, purchase, transportation, distribution or useof products, and internal quantitative regulations requiring the mixture, processing or use of products

    in specified amounts or proportions, should not be applied to imported or domestic products so as toafford protection to domestic production.

    "2. The products of the territory of any [Member] imported into the territory of any other [Member]shall not be subject, directly or indirectly, to internal taxes or other internal charges of any kind inexcess of those applied, directly or indirectly, to like domestic products. Moreover, no [Member] shallotherwise apply internal taxes or other internal charges to imported or domestic products in a mannercontrary to the principles set forth in paragraph 1"

    Furthermore, the Interpretative Note adArticle III reads in part as follows:

    "A tax conforming to the requirements of the first sentence of paragraph 2 would be considered to beinconsistent with the provisions of the second sentence only in cases where competition was involvedbetween, on the one hand, the taxed product and, on the other hand, a directly competitive orsubstitutable product which was not similarly taxed".
