Hector H. Henry, II, M.D. , President of the Board of Medical Exatniners of the State ofNorth Carolina, called the meeting to order on Wednesday, November 13, 1991, at 7:30p.m. , at the Embassy Suites Hotel, Raleigh, North Carolina.

On November 14, 1991, during the Attorney's Report, Mr. Breeze addressed the issue ofhaving persons who are not members of the staff present at the Board meetings.

The Boarcl arlopted a motion made by Dr. Patterson and seconded by Dr. Daniel that asubconunittee research the issue of having the Board meetings used as a training tool. Dr.Henry is to appoint a subcointnittee of two members to research this issue.

RETIREMENT PLANS

On November 14, 1991, during the Attorney's Report, the Board adopted the followingmotion made by Dr. Stratas and seconded by Dr. Daniel:

THAT THE NORTH CAROLINA BOARD OF MEDICAL EXAMINERSRATIFY THE CERTIFICATE OF RESOLUTIONS AMENDING THENORTH CAROLINA LICENSING BOARDS RETIREMENT SAVINGSPLAN TO COMPLY WITH THE TAX REFORM ACT OF 1986 ADOPTEDBY THE BOARD THROUGH A POLL EFFECTIVE NOVEMBER 4, 1991,AND AUTHORIZED THE PRESIDENT, THE SECRETARY, AND THEEXECUTIVE SECRETARY TO EXECUTE SUCH DOCUMENTS AS MAYBE REQUIRED TO OBTAIN NECESSARY APPROVAL AND REVIEW BYTHE INTERNAL REVENUE SERVICE.

REVISION OF STATEMENT OF RIGHTS

On November 14, 1991,duxing the Attorney's Report, the Board adopted a motion made byDr. Patterson and seconded by Dr. Roufail that the Statement of Rights and the informalinterview invitation be rewritten.

PI-IEP LEGAL REPRESENTATION

On November 14, 1991, during the Attorney's Report, the Board adopted a substitutemotion made by Dr. Godwin and seconded by Dr. Nance that the Board have Mr.Weddington advise Dr. Vanderberry during this time at the Board expense. Dr. Godwin willadvise the Foundation at its meeting in December that this problem has arisen and that theBoard feels it is not its responsibility to represent PHEP legally. Dr. Godwin will ask theFoundation who is going to represent them and who is going to pay for it.

EXPUNGING RECORDS —John L. Sullivan, M.D.

On November 14, 1991,during the Attorney's Report, the Board adopted a motion made byDr. Patterson and seconded by Dr. Nance that the Board notify Dr. Sullivan's attorney thatthe Board's action stands as is.

FAILURE OF SPEX OR FLEX

On November 14, 1991, the Board adopted a motion made by Dr. Stratas and seconded byDr. Patterson that doctors who are required to take FLEX or SPEX and fail are denied forlicensure or sunuaarily suspended. Mr. Paris is authorized by the Board to ask those doctorsclose to retirement age to retire in lieu of having public action taken against their license.

EXECUTIVE SECRETARY'S REPORT

A ITORNEY'S FEE ARRANGEMENT FOR FISCAL YEAR 1992

On November 14, 1991, during the Executive Secretary's Report, Mr. Paris presented theproposed arrangement for 1992 for the attorney's fees.

On November 14, 1991, the Board adopted a motion made by Mrs. Willis and seconded byDr. Patterson that the Board accept the proposed retainer of $78,000 for 1992.

PERSONNEL POLICY

On November 14, 1991, the Board adopted a motion made by Dr. Godwin and seconded byDr. Nance that the Board will consider having each staff member sign a statement indicatingthey have read and agree to abide by the terms of the policy, after the Board receives inputfrom staff members and Mike Weddington's office.

EMS REPORT

On November 16, 1991, during the EMS Report, Dr. Nance reported that Dr. Atwater hassuggested that the Board prepare a training tape. He is requested that the Board endorse themaking of the tape. The Board supported this effort, however, will not pay for the makingof the tape.

DATA REQUEST —NC Healthcare, Winston-Salem, NC

On November 16, 1991,during the Agenda Report, the Board adopted an amended motionmade by Dr. Daniel an seconded by Dr. Roufail that the Board allow NC Healthcare topurchase a roster for $15.00. (HG opposed)

COLLAGEN INJECTION ADVERTISEMENT - Roger Bivins Russell, M.D.

On November 16, 1991, during the Agencla Report, the Board reviewed an advertisementregarding an RN injecting collagen. The Board adopted a motion made by Dr. Patterson andseconded by Dr. Daniel that the Board write the advertiser indicating that injecting collagenis a medical act and only doctors, PAs, or NPs should be allowed to do the procedure. Thestaff is to send a copy of the Board of Nursing.

MARYLAND BOARD —enemas

On November 16, 1991,during the Agencla Report, the Board reviewed a request from theBoard of Quality Assurance asking for the Board's opinion on the adniinistering of enemas.

As a result the Board adopted a motion made by Dr. Roufail and seconded by Dr. Stratasthat the Board respond to the Maryland Board that administering enemas has no scientificvalue and is not within the normal acceptable practice of medicine in the State of NorthCarolina.

NURSES' STANDING ORDERS

On November 16, 1991, during the Agenda Report, the Board reviewed information fromEast Carolina School of Medicine regarding its interest in developing standing orders fornurses allowing them to refill medications within specific guidelines.

As a result the Board adoptecl a motion made by Dr. Nance and seconded by Dr. Godwinthat the Board notify ECU that it supports Mr. Paris' response of October 8, 1991, whichindicated that the procedures described appeared to represent the practice of medicine. Thisinformation is to be shared with the Board of Nursing.

NP MEDICAID CODES

On November 16, 1991, during the Agenda Report, the Board reviewed information fromthe Department of Human Resources regarding Nurse Practitioners and Medicaid patients.

As a result the Board adopted a motion made by Dr. Stratas and seconded by Dr. Daniel thatthe staff research and determine if this is a law or regulation of the agency. If it isdetexmined that this is a regulation of the agency then the Board is to register an objectionwith its Senators and Congressmen indicating that this is not in keeping with standardmedical practice and is not in the best interest of the patient.

The newly appointed Chairman of the NP subconunittee will be responsible to bring thisinfomiation back before the Board.

PHEP COMMI'rI EE REPORT - ln

On November 13, 1991,Dr. Stratas presented the PHEP Report to the full Board. Followingdiscussion of the cases, the Board adopted a motion made by Dr. Stxatas and seconded byDr. Daniel to accept the report as information.

PHEP BOARD OF DIRECTORS MEETING - ln

On November 13, 1991, during the PHEP Committee Report, Dr. Stratas reported on theNCPHEP Board of Directors meeting on November 7, 1991 at the Grove Park inn inAsheville. The proposed change in the PHEP office space was approved and the staff willremain in the same location (Six Forks Center) for the next few years. The annual review,which has been held in in the past during the Medical Society's actual meeting inNovember, will be held in the future xluring the PHEP Board's meeting in August.

PHEP STATISTICAL SUMMARY - ln

On November 13, 1991, during the PHEP Conunittee Report, the Board reviewed thestatistical sununary for third quarter 1991 and accepted the report as infomiation.

INFORMAL (STAFF) REFERRALS TO PHEP - ln

On November 13, 1991, during the PHEP Committee Report, the Board discussed thecurrent procedure regarding staff referrals to PHEP. As part of the routine licensureapplication process, if a physician has a history of substance abuse and/or is involved inanother state's equivalent to PHEP, the Board's staff automatically refers the physician toDx. Vanderberry. (Dr. Vanderberry provides an evaluation prior to the licensure interviewand the physician is "known" to the Board rather than being in anonymous status. )

A question had also been xaised by the Board's staff regarding "informal" referrals to PHEPby the investigative staff. Following some discussion of the issue, on November 13, 1991,the Board accepted the recomtrtendation made by Dr. Patterson that when an investigatorbelieves a referral is necessary and recommends to the physician to contact Dr.Vanderbexiy, the investigator is to untnediately report the referral to a member of theBoard's PHEP Conznittee ox the President of the Board.

On November 14, 1991, the required rule hearing was conducted by Dr. Patterson, Mr.Paris, and Kathy Burke. Notice of the hearing was run in the NC Register as required by theAdministrative Procedures Act. The NC Board of Medical Examiners, pursuant to authorityvested in it by N.C. General Statutes 90-6, 90-10, 90-11, 90-13, proposed to amend rulespromulgated within those chapters. These rules as adopted would be effective January 1,1992, after proper filing procedures are followed for review by the Adininistrative RulesReview Commission.

Persons interested were instructed in the NC Register publication to present statementsrelevant to the proposed actions either at the hearing or in writing to the Board's office. Noone attended to speak. Two letters were received which were brought to the Board'sattention: one from the Legislation and Public Policy Committee of the NC Academy ofFamily Physicians and one from the American Association of Osteopathic Specialists.

On November 14, 1991, the Board unanimously adopted a motion that the following rulescontained in 21 NCAC 328 - LICENSE BY ENDORSEMENT OF CREDENTIALS beamended by the Board and filed with the proper authorities to become effective on January1, 1992. (Amen nent are underline .)

The Board instructed that Dr. Ulrickson would be allowed to take Part I of theOsteopathic National exam which was taken prior to January 1, 1990. Dr. Ulrickson's feefor application by endorsement is to be refunded.

On November 16, 1991, the Board adopted a motion made by Dr. Henry and seconded byDr. Patterson that the Board of Merlical Examiners deny Dr. Stuart's application forlicensure until the North Carolina Board receives a satisfactory explanation fron& theMissouri Board regarding alleged probjems. If the Missouri problems are ratifiedsatisfactorily, Dr. Stuart will be required to take SPEX before being approved for licensure.

MINIRTH, Frardslin Brent, M.D. - Richardson, TX

On November 16, 1991,Dr. Minirth did not appeared for his licensure interview before theBoard (Dr. Henry and Dr. Daniel).

On November 16, 1991, Dr. Baran appearerl for his licensure interview before Dr.Patterson and Dr. Roufail. Dr. Baran was invited as a result of one malpractice suit andtwo complaints filed against lan in Florida. Dr. Baran was unaware of the complaints.

The Board discussed his practice plans, his continuing medical education, his past practiceexperience anti asked some general medical questions.

The routine questions were answered to the Board's satisfaction.

On November 16, 1991, the Boarcl adopted a motion macle by Dr. Patterson and seconrledby Dr. Roufail that the Board of Medical Examiners approve Dr. Baran for licensure.

LEUNG, Joseph Wing Cheong, M.D. - Durham, NC - lw

On November 16, 1991 Dr. Leung appeared for his licensure interview before Dr. Nanceand Dr. Godwin. Dr. Leung was asked to meet with the Subcomtnittee because he wasapplying for a 5 year VIP with the requirement that he must take and pass FLEX withinthat time frame.


Dr. Godwin and Dr. Nance reviewed the documents in the file and asked Dr. Leung if heunderstood this license would be for one year only and that he must take and pass theFLEX exam in order to get a full unrestricted license. Dr. Leung said he had left HongKong on an itnmigrant visa and he platted to stay here and pursue application to take theFLEX and receive the NC Medical License.


On November 16, 1991 the Board adopted a motion made by Dr. Godwin and seconded byDr. Nance that the Board of Medical Examiners approve Dr. Leung for VIP licensure toexpire on November 16, 1992.

On November 16, 1991 Dr. Quinn appeared for his licensure interview before Dr. Godwinancl Dr. Nance. Dr. Quinn was askerl to meet with the Subcotmnittee because ofalcoholism in 1989 and states that he is currently in his own recovery program. He hasbeen advised to contact PHEP. Dr. Quito' also has one malpractice.

On November 16, 1991 the Board adopted a motion made by Dr. Nance and seconded byDr. Godwin that the full board review Dr. Quito'.

JOYCE, Peter Henry, M.D. - Vero Beach, FL - lw

On November 16, 1991 Dr. Joyce appeared for his licensure interview before Dr. Godwinand Dr. Nance. Dr. Joyce was asked to meet with the Subconznittee because twomalpractice cases.

Dr. Joyce indicated his plans were to work one month out of the year in Sylva, NC and tocontinue to practice in Florida. Dr. Joyce's explanation of the malpractice suites wassatisfactory.

The Board discussed his practice plans, his continuing medical education, his pastexperience, and asked some general medical questions.
