• Land Use Schemes are understood to be tools used by Municipalities to guide and manage development as well as land usage in accordance with the vision, objectives and broad strategic focus of the Integrated Development Plan (IDP) and Spatial Development Framework (SDF).

• The Spatial Planning and Land Use Management Act 16 of 2013 (hereafter noted as SPLUMA) notes that as per Section 24 (1), “a Municipality must, after public consultation, adopt and approve a single land use scheme for its entire area within five years from the commencement of this Act”.

• SPLUMA came into effect on 01 July 2015, as per Government Gazette dated 27 May 2015. Specifically, this therefore implies that all 44 Local Municipalities, including the Metro, in KwaZulu-Natal are required to have single Land Use Schemes by the 01 July 2020. 3

• Since the Spatial Planning & Land Use Management Act (SPLUMA) came into effect, out of the 44 KZN Local Municipalities, 14 have developed and adopted single land use schemes,

• These municipalities include 1) uMzumbe, 2) Newcastle, 3) Dannhauser, 4) uMlalazi, 5) Nkandla, 6) KwaDukuza, 7) Umzimkhulu, 8) Okhahlamba, 9) Richmond, 10) Ubuhlebezwe, 11) Greater Kokstad, 12) Umhlabuyalingana, 13) uMshwathi and 14) uMhlathuze (New)

• Single Land Use Scheme reviews need to be conceptualised, due to Demarcation Issues, conversation of Rural Land Use Policy (SALA and Traditional Authoritie Land) substitutions into basic schemes

• The majority of municipalities in KwaZulu-Natal, 30 in total, have not yet adopted a single land use scheme for their entire area of jurisdiction, but have adopted a land use scheme for some parts of their area of jurisdiction.

• Noting the slow pace of progress, the Provincial Executive Council Lekgotla resolved in August 2018 as following (Resolution 6.12)—

– “COGTA to initiate a process to seek an extension of time for the preparation of Land Use Schemes by Municipalities in the Province from the Minister of Rural Development and Land Reform after having consulted and received proposed plan of action from each municipality”. 19

• In implementing the Provincial Executive Council Lekgotlaresolution, the KwaZulu-Natal MEC for Cooperative Governance and Traditional Affairs has forwarded to the Minister of Rural Development & Land Reform a letter of intent to apply in terms of section 55(1) of SPLUMA for exemption for some municipalities from the deadline for the adoption of a single land use scheme for their entire area of jurisdiction.

• In order for the MEC to make an appropriate application and comply with the Act and for the Minister to make an informed decision each Local Municipality and Metro was requested to confirm whether or not it will be able to comply with the 1 July 2020 deadline - MEC Circular 1 (18 January 2019).

• 22 out 44 municipalities have responded despite numerous requests.

• Of those that have responded:– 13 municipalities have confirmed they will meet the deadline, and do not require an exemption

– 9 municipalities have confirmed that they will require an exemption

– those requiring exemption have requested between 1-3 additional years to develop and adopt a single land use scheme.

• However, those that have requested exemption have not adequately addressed the requirements for application for exemption ito SPLUMA.

• A subsequent MEC Circular 2 has now been transmitted ( 27 November 2019) to the Mayors, MMs and Planning Unit/Department Officials of those 30 municipalities who have not yet adopted Single Land Use Schemes, requesting the following:

• In the event a Municipality will not be able to comply with the deadline and if so opts for KZNCOGTA to apply for exemption from SPLUMA, the municipality must:– (1) Take a Council Resolution resolving to (a) request for exemption from compliance with the

provisions of Section 24(1) of SPLUMA from the Minister of Agriculture, Land Reform and Rural Development and (b) mandating COGTA to submit the application on their behalf

– (2) Package the application for exemption in line with SPLUMA and submit the information required in terms of regulation 32(2) and 33(7) of the SPLUMA Regulations, and which should include the date by which the municipality will be able to adopt a Single Land Use Scheme for their entire area of jurisdiction.

• These applications must reach COGTA by 15 January 2019 in order for it to form part of the consolidated application from KZN to National.

• In the event a Municipality will not be able to comply with the deadline and subsequently opts to make its own application to the Minster of Agriculture, Land Reform and Rural Development, the Municipality must still package the application for exemption in line with SPLUMA and submit the information required in terms of regulation 32(2) and 33(7) of the SPLUMA Regulations, and which should include the date by which the municipality will be able to adopt a Single Land Use Scheme for their entire area of jurisdiction.

• The municipality then has a responsibility to update COGTA on the progress and status of the application for exemption from SPLUMA

• COGTA via its district Municipal Planning Reps are available to support municipalities in this process. Please contact Spatial Planning if unsure of rep.

• Information (required in terms of regulation 32(2) and 33(7) of the SPLUMA Regulations) to form part of application includes:– (a) a cadastral description of the land within each municipality for which exemption is requested;

– (b) the reasons why the municipality is unable to meet the 1 July 2020 deadline;

– (c) the degree to which the objects of the Act referred to in section 3 of the Act will be undermined per municipality;

– (d) the degree to which the development principles, norms and standards referred to in Chapter 2 of the Act will be promoted or prejudiced by the exemption;

– (e) the degree of risk or potential risk posed by the exemption;

– (f) the impact of the exemption on existing and surrounding land uses;

– (g) the reasons why a refusal by the Minister to grant the exemption would be extremely prejudicial to the interests of the community;

– (h) a programme with milestones for adopting a single land use scheme for the municipal entire area of jurisdiction; and

– (i) a new deadline for adopting a single land use scheme for the entire municipal area of jurisdiction.

• Department has convened a provincial task team (initially made up of KZNCOGTA, DRDLR, EKZN Wildlife, KZNDARD, DAFF and the OTP )to support the 41 affected municipalities in the delineation of land in terms of Subdivision of Agricultural Land Act, as part of Single Land Use Scheme Adoption.
