CALL TO ORDER

F. M. Sunmons Patterson, Jr. , M.D., President of the Board of Medical Examiners of theState of North Carolina, called the meeting to order on Wednesday, September 18, 1991, at7:30p.m. , at the North Raleigh Hilton, Raleigh, North Carolina.

Board numbers present included: Nicholas E. Stratas, M.D., Secretary; John T. Daniel, Jr. ,M.D.; Harold L. Godwin, M.D.; Walter M. Roufail, M.D.; Hector H. Henry, II, M.D.; JohnW. Nance, M.D.; and Mrs. Kathryn H. Willis.

On September 21, 1991, the budget for fiscal year November 1, 1991 through October 3l,1992 was presented during Executive Session.

ATTORNEY'S REPORT - wl

INSURANCE SEITLEMENT REPORTING

On September 19, 1991,during the Attorney's Report, Bill Breeze presented an amendmentto N.C.G.S. 90-14.13. The atnendment was presented as follows:

The admitustrative officer of any trust fund operated by a hospital authority, group, orprovider shall report to the Board within 30 days:1) any award or damages or settlement affecting or involving a physician or

corporation it insures;2) any cancellation or nonrenewal of its professional liability coverage of a

physician or corporation, if the cancellation or nonrenewal was for cause.

As a result, the Boarcl unanimously adopted a motion made by Dr. Roufail and seconded byDr. Daniel that the proposed amendment be sent to the Medical Society and request that itbe considered for their Legislative agenda.

On September 21, 1991, the May 1992 meeting of the Board was rescheduled for May20-24, 1992.

SEPTEMBER 1992MEETING

On September 21, 1991, the Septembex 1992 meeting of the Board is schedule(1 forSeptember 23 —27, 1992.

LONG-RANGE PLANNING RETREAT

On September 21, 1991, Dr. Stratas suggested that the Board continue to collect an agendafor the retxeat. An hour should be set asixle at the November 1991 meeting to discuss theretreat. A date was set for February 13-16, 1992.

Dr. Roufail suggested that the person running the agenda should not be a part of the Boarcl.Dr. Patterson requested that Mr. Paris check with the Federation to determine is there is;u&yone tluough the Federation that has experience with retreats to conxe and be the directorof the retreat. Dr. Godwin suggested Dr. Bryant Galusha might serve as director.

DATA REQUEST - North Carolina Healthcare, Winston-Salem, NC

On September 21, 1991 the Board adopted a motion made by Dr. Godwin and seconded byDr. Henry that the Board delay making a decision on this request until after the November1991 meeting. Dr. Godwin requested that Dr. Roufail send each member of the Board acopy of the publication requesting the data.

DATA REQUEST - Wesley Long Community Hospital, Greensboro, NC

On September 21, 1991, the Board adopted a motion by Dr. Patterson and seconded by Dr.Henry that the Boarcl deny Wesley Long Community Hospital's request.

ANORECTIC SURVEY

On September 21, 1991,Dr. Godwin repoxted that after much research he found no basis forextended use of anorectic agents beyond the Board's current policy.

As a xesult, the Board axlopted a motion made by Dr. Nance and seconded by Dr. Daniel thataftex xeviewing literature and consulting with recognized experts in the field the Boardaccepts this as information and stands on its present policy regarding anorectic prescribing.

HIV MEETING —SEPTEMBER 17, 1991

On September 21, 1991, Dr. Godwin asked if the Board would be willing to accept thexesponsibility of disciplining healthcare professionals who fail to follow universalprecautions in treating potential HIV+ carriers. The Boarcl will determine what Universalprecautions are after consultation.

As a result, the Board adopted a motion made by Dr. Patterson and seconded by Dr. Danielthat Dr. Godwin be allowed to take information back to the task force that the Board iswilling to accept the responsibility of disciplining healthcare professionals who fail tofollow universal precautions in treating potential HIV+ carriers. The Board will determinewhat Universal prescautions are after consultation.

DERMATOLOGIST'S QUESTION - NURSES INJECTING SALINE

On September 21, 1991, the Board adopted a motion made by Dr. Patterson and secondedby Dr. Godwin that nurses not be allowed to inject saline.

LEASE 1NFORMATION

On September 21, 1991, the Board adopted a nzotion made by Dr. Roufail and seconded byDx. Godwin that the Board approve the lease as presented.

On September 18, 1991, the Board adopted a motion to deny Mr. Hackney's theapplication for PA approval on the basis of the indictment of June 3, 1991, on two countsof obtaining a controlled substance by fraud. The Board indicated it will not consider anapplication from hun until he has satisfied all legal requirements of the Terms ofAgreement of Deferred Prosecution which runs through September 10, 1992.

A motion was adopted that the practice be monitored by an investigator regardingcountersigning and reported at the 11/91 meeting.

On September 18, 1991, the Board adopted a motion that Dr. Bloomfield's practice bemonitored by an investigator regarding primary supervision of Hair, PA; and back-upsupervision of Cross, PA and Harkness, PA at King Medical Center and reported at the11/91 meeting.

ELECTION OF OFFICERS

On Septembex 21, 1991, Dx. Daniel xeported that the nominating comnuttee comprised of Mrs.Willis, Dr. Roufail and Dr. Daniel nominated Dr. Henry as President and Dr. Nance asSecretary-Treasurer. There were no other nominations from the floor. The Board unamiouslyapproved the nominations for President and Secretary-Treasurer.

On September 20, 1991, the Board adopted a motion that it would not allow dentist to participatein PHEP at this tune.

NORTI-I CAROLINA MEDICAL FOUNDATION - wl

On September 20, 1991, the Board adopted a motion made by Dr. Patterson and seconded by Dr.Stratas that the Board endorse having a permanent member on the North Carolina MedicalFoundation. This person is to be an active member of the North Carolina Board of MedicalExaminers and is to be chosen by the Board of Medical Examiners as a representative.

FORMULARY

On September 19, 1991, the Board adopted a motion made by Dr. Patterson and seconded by Dr.Roufail that the staff prepare a pxoposal to adopt the formulary by rule to be presented at theNovember 1991 meeting of the Board.

On September 21, 1991, Dr. Nance reported that the following were certified for the period ofJuly 15, 1991 - August 26, 1991: EMT-Defibrillation, 61; EMT-Intermediate, 86; MobileIntensive Care Nurse, 42; EMT-Paramedic, 57; and EMT-Advanced Intermediate, 18.

EPINEPHRjNE CERTIFICATIONS

On September 21, 1991,Dr. Nance reported that Epinephrine Certifications totaled 374.

POST-OPERATIVE CARE BY OPTOMEI'RISTS

On September 21, 1991, the Board unamiously adopted a motion made by Dr. Daniel andseconded by Dr. Roufail that the Board adopt the proposed position statement on cataracts.

MEDICAL EDUCATION

On September 21, 1991, the Board unamiously adopted a motion made by Dr. Roufail andseconded by Dr. Henry adopted the amendment on the medical education position statementwhich changed the worrling from three years to 36 months.

POSITION STATEMENTS

On Septembex 21, 1991, the Board adopted a motion made by Dr. Henry and seconded by Dr.Nance that the Board include the position statements in the Roster and give each applicant forlicensure a copy of them at the time of his interview.

GUIDELINES FOR PHYSICAL EXAMINATIONS

On September 21, 1991, the Board adopted a motion made by Dr. Patterson and seconded by Dr.Godwin that the Boarcl change the woxding in its position of Guidelines for PhysicianExaminations to read: When appropriate, the physician should have a third party in the roomwhen he examines his patient.

RTL APPLICATION PROCESS

On September 21, 1991, the Board unanunously adopted a motion made by Dr. Stratas andseconded by Dr. Nance that the Board's staff do the following:

1. begin using the license by enrlorsement application foxtn for RTL applications;2. add verification of licensure in othex states to the RTL requirements; and3. comtnunicate with the medical schools the Board's suggestion that a personal interview

be included in the medical schools' process fox placement in training programs.

On September 21, 1991, the Board of Medical Examiners unanimously adopted a motion that theBoard accept the recomtnendation of the subcommittee that:

On September 21, 1991, the Board adopted a motion made by Dx. Godwin and seconded by Dr.Daniel that Dr. Jacobs be issued a full and unrestricted license at such time as he provides theBo ud's office with pxoof of his receipt of the PRA.

On September 21, 1991, the Board adopted a motion made by Dr. Roufail and seconded by Dr.Patterson that the Board of Metlical Examiners approve Dx. Gross for licensure. The Boardinstructed Dr. Gross that he should notify the Board in writing of his intentions and what he plansto do.

HAMILTON, James Greene, M.D. —Alexandria, LA —wl

On September 21, 1991, the Board adopted a motion made by Dr. Stratas and seconded by Dr.Roufail that the Board of Medical Examiners deny Dr. Hamilton for licensure. The basis for thedenial of Dr. Hamilton's medical license are his felony conviction, his lack of Category I CMEwhich concerned the Board regarding his professional knowledge to practice medicine with areasonable degree of skill and safety for his patients. The Board was also concerned with Dr.Hamilton's mental status as it would bear on his ability to practice medicine with reasonable skilland safety to patients as evidenced by his apparent extreme preoccupation with his personalmedical condition which he described as "needle phobia. "

PHYSICIAN EXTENDER POSITION PAPER —kb

On September 19, 1991, the Board discussed the Physician Extender Position Paper drafted byDr. Roufail. The Board coniniended Dr. Roufail on the thorougliiiess of his research and effortsand asked for a final draft for the next meeting.

Tire Board also considered iecoininendations from Kathy Burke for administrative changes toaddress some of the Board's current concerns regarding the practice of physician extenders in thestate. The following issues were discussed:

NCCPA Certification;continued NCCPA certification requiring recertification by CME and retesting;requesting additional infomiation at the time of aiinual PA/NP registration;PA/NP representation on an Advisory Committee to the Board; andpossible rule amendments.

The Board adopted a motion that Dr. Heniy, Dr. Roufail, Mr. Paris and Kathy Burke meetbefore the next Board meeting and bring to the meeting specific recoininendations.

LICENSED BY ENDORSEMENT - wl

On September 21, 1991, it was reported that 264 applicants had been licensed by endorsementof their credentials.
